HomeMy WebLinkAbout1996 10-22 CC MINBook 78/Page 380 10/22/96 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA OCTOBER 22,1996 The Regular Meeting of the City Council of the City of National City was called to order at 6:00 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Eiser, McCabe, Myers, Peoples, Ray. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe followed by the invocation by First United Methodist Church Pastor Adiel DePano. APPROVAL OF MINUTES Motion by Zarate, seconded by Inzunza, the Minutes of Regular Meeting of October 15, 1996 be approved. Carried by unanimous vote. MAYOR'S PRESENTATION (102-14-2) Catherine Wilson of Paradise Valley Hospital, Alicia R. Pruitt of the National City Task Force, Oscar Navarro Tolaro, Program Specialist with County Health Services/Alcon Drug Services, Dr. Louise Phipps of Sweetwater Union High School/National City Chamber of Commerce/National City Task Force provided a verbal and posterboard presentation on the activities of "Partners for Prevention" and responded to questions of the Council. Book 78/Page 381 10/22/96 PROCLAMATIONS (102-2-1) Motion by Morrison, seconded by Inzunza, the Proclamations be read in their entirety. Carried by unanimous vote. The Proclamation proclaiming October 23-31, 1996 as "RED RIBBON WEEK" was read aloud in its entirety by Mayor Waters, who then presented it to Cecilia Kirk, representing the Committee to Reclaim Our Neighborhoods on behalf of Partners for Prevention. The Proclamation proclaiming October 27 - November 2, 1996 to be: "WORLD POPULATION AWARENESS WEEK" was read aloud in its entirety by Mayor Waters, who then gave it to the City Manager to forward to the proper people. NON CONSENT RESOLUTIONS Motion by Morrison, seconded by Zarate, the Non Consent Resolutions be adopted by title only. Carried by unanimous vote. PARKING ADMIN 1996 (801-2-16) 1. Resolution No. 96-154. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE REMOVAL OF "TRUCK PARKING ONLY" SIGNS FROM THE WEST SIDE OF ROOSEVELT AVENUE BETWEEN NATIONAL CITY BOULEVARD AND 4TH STREET." (Engineering) RECOMMENDATION: Staff recommended that Council approve the resolution. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, in favor of Resolution No. 96-154. Carried by unanimous vote. Book 78/Page 382 10/22/96 GRANT/LAW ENFORCEMENT (302-1-2) 2. Resolution No. 96-155. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO SUBMIT A COPS MORE GRANT APPLICATION TO THE UNITED STATES DEPARTMENT OF JUSTICE COPS OFFICE, AND TO EXECUTE A GRANT AWARD AGREEMENT AND ALL RELATED DOCUMENTS." (Police) RECOMMENDATION: Staff recommended that Council approve the resolution. TESTIMONY: National City Police Lt. Iglesias provided a brief verbal and viewgraph presentation and responded to questions of the Council. ACTION: Motion by Beauchamp, seconded by Inzunza, in favor of Resolution No. 96-155. Carried by unanimous vote. WRITTEN COMMUNICATIONS CONDITIONAL USE PERMIT (403-9-10) 3. SUBJECT: Letter from E. R. Campiani and Juan Torres requesting clarification of condition No. 7 in Resolution 96-143 of the recently approved conditional use permit regarding modification of church hours. TESTIMONY: Edward R. Campiani representing the Universal Church, 330 National City Blvd., made inquiry of the Council and responded to their questions. ACTION: Motion by Inzunza, seconded by Zarate, to approve the request for an additional 60 days to comply with condition No. 7, and to concur that this requires the Church to reseal, patch and stripe (make semi -permanent with two-inch a.c. paving, as described in the Staff Memorandum) the parking facility. The applicant also stated that the Church would be installing wheel stops and lighting and would be willing to sign a maintenance agreement with the City covering the improvements. Carried by unanimous vote. Book 78/Page 383 10/22/96 NEW BUSINESS WARRANT REGISTER #16 (202-1-11) 4. Warrant Register #16. Ratification of Demands in the amount of $193,653.92 (Warrant Nos. 140747 through 140804 inclusive excepting none) and Certification of Payroll in the amount of $421,109.17. (Finance) RECOMMENDATION: Staff recommended ratification of these warrants. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the Ratification of Demands and Certification of Payroll. Warrants carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. STREET RIGHT OF WAY (903-3-4) 5. SUBJECT: Request from Burlington Northern Santa Fe Railroad to obtain approval from the City council for two new street crossings on Tidelands Avenue and 24th Street - Second Request. (Engineering) RECOMMENDATION: Staff requested Council direction on whether to approve the two railroad/street crossings. TESTIMONY: Bob Brendza, representing the Burlington Northern & Santa Fe responded to questions of the Council and stated a willingness to discuss the potential for a turn around at the north end of the Depot as well as look into the movement of the chain link fence on the north west corner to allow for the reintroduction of the historic platform. ACTION: Motion by Beauchamp, seconded by Inzunza, in favor of the request. Carried by unanimous vote. COMMUNITY PROMOTION (102-1-3) TEMPORARY USE PERMIT (203-1-12) 6. SUBJECT: Request by the National City Firefighters' Association for use of Fire Station #10 and 1926 Seagraves fire truck. (Fire) RECOMMENDATION: Staff recommended that the request be approved as submitted. Book 78/Page 384 10/22/96 COMMUNITY PROMOTION/TEMP USE PERMIT (continued) TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the request with staff recommendations. Carried by unanimous vote. TEMPORARY USE PERMIT (203-1-12) 7. SUBJECT: Temporary Use Permit - National City Police Department and the San Diego Low Rider Association Toys to Tots/Car show. (Building & Safety) RECOMMENDATION: Staff recommended that Council approve the application for a Temporary Use Permit subject to compliance with all conditions of approval and approve the request for a waiver of the Temporary Use Permit processing fee. TESTIMONY: National City Police Capt. Tricker responded to questions of the Council and requested an amendment to the TUP request to include the display of the 1925 Seagraves fire truck. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the request including the inclusion of the fire truck. Carried by unanimous vote. TEMPORARY USE PERMIT (203-1-12) 8. SUBJECT: Temporary Use Permit Seafood City Supermarket. (Building & Safety) RECOMMENDATION: Staff recommended that Council approve the application for a Temporary Use Permit subject to compliance with all conditions of approval. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Zarate, in favor of the request subject to the conditions of staff. Carried by unanimous vote. Book 78/Page 385 10/22/96 CLAIM (501-1-126) 9. SUBJECT: Claim for Damages: Stanley G. Parra. (City Clerk) RECOMMENDATION: Staff recommended that Council deny the claim and refer to the City Attorney. TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by Morrison, to deny the claim and refer it to the City Attorney. Carried by unanimous vote. CITY MANAGER COUNCIL MEETINGS REGS/SCH ADMIN (102-7-1) 10. SUBJECT: Establishing a City Council Retreat Follow -Up Schedule. (City Manager) RECOMMENDATION: Staff requested Council direction. TESTIMONY: None. ACTION: Consensus of the Council was to schedule the follow-up retreat for Wednesday, January 22, 1997. City Manager McCabe then stated that the County would be refunding to the City, the amount of $3,389.00 plus interest for a total of $5,334.00 for the overpayment from 1987/88 to 1994/95 of election costs. CITY ATTORNEY - No report. OTHER STAFF City Clerk Peoples invited all present to attend the Election Central to be held on November 5, 1996 from 8:00 p.m. (the close of the polls) until the end results are in at the National City Community Center. Book 78/Page 386 10/22/96 MAYOR Mayor Waters acknowledged the Ball Oldsmobile employees who donated funds for neighborhood watch signs for the "A" Avenue Neighborhood Watch group. Councilman Inzunza noted that the General Manager of Ball Oldsmobile attends and participates in the Neighborhood Watch meetings. Councilman Beauchamp acknowledged that Mr. Ball had donated $500. to the SUHI soccer team. The Mayor then read into the record a retraction printed in the San Diego Union Tribune about inaccuracies printed in an article comparing National City to Poway. He also read a letter from County Assessor Gregory Smith thanking Community Development Director Paul Desrochers for speaking to his class of students at San Diego State University on redevelopment. CITY COUNCIL Vice Mayor Zarate requested Police Chief DiCerchio look into complaints of speeding vehicles on "N" Avenue between 24th and 18th Street. PUBLIC ORAL COMMUNICATIONS - None. CLOSED SESSIONS City Attorney Eiser stated that Closed Session No. 2 would be withdrawn at this time. Conference with Legal Counsel -Anticipated Litigation - Significant exposure to litigation pursuant to Government Code Section 54956.9(b). (One potential case.) Conference with Legal Counsel - Pending Litigation - Government Code Section 54956.9(a). Dispute with City of San Diego over Metro Sewer Agreement. (WITHDRAWN) ACTION: Motion by Zarate, seconded by Inzunza, in favor of holding the Closed Session under Government Code Section 54956.9(b). Carried by unanimous vote. Book 78/Page 387 10/22/96 CLOSED SESSIONS (continued) Council Members left the Council Chambers at 7:36 p.m. Council Members returned to the Council Chambers at 8:47 p.m. ROLL CALL Council Members present: Inzunza, Morrison, Zarate, Waters. Absent: Beauchamp. ADJOURNMENT Motion by Inzunza, seconded by Morrison, to adjourn to the next Regular City Council Meeting - November 12, 1996 - 6:00 P.M. - Council Chambers. Civic Center.
