MINUTES OF THE SPECIAL MEETING
OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA
NOVEMBER 12, 1996
The Special Meeting of the City Council of the City of National City was
called to order at 4:31 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison (arrived at 4:32
p.m.), Zarate, Waters.
Administrative officials present: Desrochers, Eiser, Morse, Myers, Peoples,
Post, Ruiz, Williams.
PARADISE CREEK
1. SUBJECT: Paradise Creek.
Mayor Waters introduced Ted Godshalk, 2143 Cleveland Avenue, National
City, who made a brief verbal and slide presentation on the proposed Paradise
Creek Educational Park and responded to questions of the Council. Mr.
Godshalk also provided handouts (copies on file in the Office of the City
Clerk) as follows:
1. State and Federal Agencies and their required permits.
2. Letter to Planning Commissioner Godshalk from United States
Department of the Interior, National Park Service, stating that they had
selected his project from a large number of requests for assistance in fiscal
year 1997.
3. RTCA - Rivers, Trails and Conservation Assistance Program
packet.

4. Application prepared, submitted and accepted by Mr. Godshalk.
5. Summary of Paradise Creek Educational Park Slides (1-17).
6. Color print of possible Hoover Avenue Park entrance.
7. Grant List 1 - Local Foundations.
8. Grant List 2 - National and International Foundations.
9. Conceptual Master Plan - Paradise Creek Educational Park.
Vice Mayor Zarate made inquiry on safety precautions and liability issued.
Mayor Waters made inquiry on protection of the Public Works yard and
whether the grant received was a straight or matching funds grant. (Straight).
Mr. Godshalk explained that the estimated total project cost was $750,000
and could be broken down into phases. Phase 1 would be the existing mini -
park area and would cost approximately $200,000.
Councilman Morrison expressed concerns with police access difficulty and
liability of a "public park."
City Attorney Eiser stated that for liability purposes, the proposed
improvements could be considered as similar to other City parks, and that
there was generally no liability unless the City caused a dangerous condition,
such as by creating a "trap." Additionally, statutory immunities apply if
police protection is not provided because it is allocated to other areas for
policy reasons.

Mr. Godshalk requested the Council take action to set aside the property for
the park, have Planning access the ownership of the adjoining parcels, the
City agree to provide matching funds if grants become available, the Council
advise the CIP Committee to consider the park in their budget, CDBG funds
be considered, include increases in the Parks and Recreation Budget in the
future for the maintenance of the proposed park.
Public Works Director Williams provided details on the current use of what
was being referred to as Public Works vacant land - storage space for EDCO
Equipment that if eliminated would cost the City $40-$45,000 per year; Fire
training area for lifting heavy objects and vehicle practice (jaws of life);
Police Department - evidence lockers; wood from Parks & Recreation to be
sold as revenue generator for the City; Public Works material storage area
(gravel, sand etc.); sweeper sweepings 40 cubic yard bins and area around
them for the sweepers and equipment trucks to operate; City-wide trash pick
up bins and area around them for loaders to access; storage space for sewage
man -hole covers; storage area for drying out of drainage clean out materials;
street light and signal pole and cabinet bone yard; concrete pipe storage;
equipment operator training area, bus company fuel and underground storage;
shopping cart storage etc.
Councilman Morrison expressed concerns with the soil contamination.
ACTION: Motion by Morrison, seconded by Beauchamp, to
refer this back to staff to look into the liability issues and bring a
report back to staff. Carried by unanimous vote.
PUBLIC ORAL COMMUNICATIONS - None.
Councilman Beauchamp inquired of the City Engineer as to whether the
Channel could be used as mitigation for the 35th Street bridge project.
Godshalk stated that his next step would be to pursue grants.

City Attorney Eiser stated that the letter to Mr. Godshalk from the National
Park Service was addressed to Planning Commissioner Godshalk, and
recommended that this title not be used in future correspondence.
Consensus of the Council was for City Attorney Eiser to discuss the proper
handling of grant applications and funds with Mr. Godshalk.
ADJOURNMENT
Motion by Morrison, seconded by Zarate, to adjourn to the next Regular City
Council Meeting - November 12, 1996 - 6:00 p.m. - Council Chambers, Civic
Center. Carried by unanimous vote.
The meeting closed at 5:35 p.m.
