HomeMy WebLinkAbout1996 12-03 CC MINBook 78/Page 421 12/03/96 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA DECEMBER 3,1996 The Regular Meeting of the City Council of the City of National City was called to order at 6:00 by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: DiCerchio, Eiser, Kimble, McCabe, Morse, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom McCabe, followed by the invocation by Vice Mayor Zarate. BUSINESS RELATING TO GENERAL MUNICIPAL ELECTION, NOVEMBER 5, 1996 ELECTION/11-05-96 (505-10-2) 1. Resolution No 96-167. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 5, 1996, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW." (City Clerk) ACTION: Motion by Zarate, seconded by Inzunza, In favor of' Resolution #96-167. Carried by unanimous vote. Book 78/Page 422 12/03/96 City Clerk Lori Peoples administered the Oath of Office and presented Certificates of Election to re-elected Council Members Ron Morrison and Ralph Inzunza, re-elected City Treasurer George Hood and newly elected City Clerk Michael Dalla. Mayor Waters presented a plaque to outgoing City Clerk Lori Peoples and expressed appreciation for her hard work on behalf of the city. City Council members Morrison, Beauchamp, Inzunza and Zarate all expressed their appreciation to Lori Peoples for the fine job she did during her 8 years as City Clerk, for her professionalism and the many contributions she made to the city. Outgoing City Clerk Lori Peoples thanked the Mayor, Council and the community. She expressed pride in the progress and accomplishments that took place in Clerk's office and the City during her term of office. ACTION: Motion by Inzunza, seconded by Zarate, to recess the council meeting. Carried by unanimous vote. Mayor Waters reconvened the City Council meeting at 6:15 with the newly sworn members present. ROLL CALL OF THE NEW CITY COUNCIL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Re-elected Council Members Morrison and Inzunza addressed the Council, Staff and citizens. City Clerk Michael Dalla and City Treasurer George Hood addressed the Council, Staff and citizens. Mayor Waters called a recess. Council members left the Council Chambers at 6:30 p.m. Council members returned to the Council Chambers at 7:01 p.m. Book 78/Page 423 12/03/96 ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. NON CONSENT RESOLUTION Motion by Morrison, seconded by Zarate, the resolution be read by title only. Carried by unanimous vote. CONTRACT (C96-38) 2. Resolution No. 96-168. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF NATIONAL CITY AND SAN DIEGO GAS AND ELECTRIC COMPANY." (Engineering) RECOMMENDATION: Staff recommended that Council adopt the Resolution. ACTION: Motion by Inzunza, seconded by Morrison, in favor of Resolution # 96-168. Carried by the following vote, to -wit: Ayes: Morrison, Inzunza, Zarate, Waters. Nays: None. Abstaining: Beauchamp. Absent: None. ORDINANCES FOR INTRODUCTION Motion by Inzunza, seconded by Zarate, the Ordinance be introduced by title only. Carried by unanimous vote. MUNICIPAL CODE 1996 (506-2-11) 3. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ESTABLISHING THE SALARIES OF THE MAYOR, THE CITY COUNCIL, AND THE CHAIRMAN AND MEMBERS OF THE COMMUNITY DEVELOPMENT COMMISSION." (City Attorney) Book 78/Page 424 12/03/96 NEW BUSINESS WARRANT REGISTER (202-1-11) 4. Warrant Register #22. Ratification of Demands in the amount of $361,248.62 (Warrant Nos. 141352 through 141420 inclusive excepting none) and Certification of Payroll in the amount of $466,473.83. (Finance) RECOMMENDATION: Staff recommended ratification of these warrants. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the Ratification of Demands and Certification of Payroll. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None. Absent: None. COUNCIL MEETINGS REGS/SCH ADMIN (102-7-1) 5. SUBJECT: Holiday Season City Council Recess. (City Manager) RECOMMENDATION: Staff recommended that the City Council establish the holiday season Council meeting recess as Tuesday, December 24, 1996 and Tuesday, January 7, 1997. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the City Manager's Recommendation. Carried by unanimous vote. PUBLIC REQUEST (102-1-1) 6. SUBJECT: Request for display of City flags at half staff on December 7, 1996 (Saturday). (Public Works) RECOMMENDATION: Staff recommended Council discretion. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, in favor of Alternative A (Authorize and request Fire Department to fly Fire Department flag, Police Department flag and Civic Center flag at half staff using available personnel). Carried by unanimous vote. Book 78/Page 425 12/03/96 NATIONAL CITY COMMUNITY CENTER (1101-5-1) 7. SUBJECT: Use of the Community Center by Sweetwater High School for a football banquet, and waiver of fees. (Public Works) RECOMMENDATION: Staff recommended Council discretion on use of the Hall and waiver of fees. Acceptance Insurance to be provided. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Beauchamp, in favor of the request. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate. Nays: Waters. NOTE: Mayor Waters stated for the record that he was only opposed to the -waiver of the custodial fees because that is something out-of-pocket that we have always charged. CITY MANAGER - No Report. CITY ATTORNEY MUNICIPAL CODE 1996 (506-2-11) 8. SUBJECT: Report concerning Regulation of Pushcarts. TESTIMONY: None ACTION: None OTHER STAFF- No Report. MAYOR Mayor Waters reported that there will soon be fishing at the Loveland Lake. The opening will be sometime in January and he would inform the council. Mayor Waters also provided an update on the status of the law dealing with vending machines. Book 78/Page426 12/03/96 CITY COUNCIL Vice Mayor Zarate asked questions about the flower vendors that appear on holidays such as Mothers' Day and stated that enforcement seems to be a problem. City Manager McCabe indicated that in the past, efforts have been coordinated through Planning and the Police Department. PUBLIC ORAL COMMUNICATIONS - None. CLOSED SESSIONS Conference with Legal Counsel - Pending Litigation - Government Code Section 54956.9(a). Rattray v. Ci y of National City. ACTION: Motion by Morrison, seconded by Beauchamp, in favor of holding the Closed Session under Government Code Section 54956.9(a). Carried by unanimous vote. The Council left the chambers at 7:35 p.m. Council Members returned to the Council Chambers at 7:59 p.m. ROLL CALL Council members present: Beauchamp, Morrison, Zarate, Waters. Absent: Inzunza. ADJOURNMENT Motion by Morrison, seconded by Zarate, to adjourn to the next Regular City Council Meeting - December 10, 1996 - 6:00 P.M. - Council Chambers, Civic Center. Carried by unanimous vote. Absent: Inzunza.
