HomeMy WebLinkAbout1999 01-26 CC MINBook 81/Page 18 1/26/99 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA JANUARY 26, 1999 The Regular Meeting of the City Council of the City of National City was called to order at 6:02 p.m. by Mayor Waters. ROLL CALL Councilmembers present: Beauchamp, Inzunza, Morrison, Soto, Waters. Administrative officials present: Dalla, DiCerchio, Eiser, McCabe, Morse, Myers, Post, Williams. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Councilman Beauchamp. APPROVAL OF MINUTES Motion by Morrison, seconded by Beauchamp, the Minutes of the Regular Meeting of January 19. 1999. be approved. Carried by unanimous vote. Mayor Waters turned control of the meeting over to Vice Mayor Morrison. INTERVIEWS AND APPOINTMENTS PARKS & RECREATION ADVISORY BD ADMIN (101-5-1) Vice Mayor Morrison announced that Mayor Waters recommended that Ms. Damianna Lepley be appointed to serve on the Parks & Recreation Advisory Board for a term expiring on March 31, 2002. ACTION: Motion by lnzunza, seconded by Beauchamp, in favor of the Mayor's recommendation. Carried by unanimous vote. City Clerk Dalla administered the oath of office to Ms. Lepley. Book 81/Page 19 1/26/99 INTERVIEWS AND APPOINTMENTS (continued) Mayor Waters announced that he owns property within the proposed utility district and asked Vice Mayor Morrison to retain control of the meeting during consideration of Item No. 1 to avoid a possible conflict of interest. PUBLIC HEARING UNDERGROUND UTILITY DISTRICT 21 ADMIN (904-1-7) 1. Public Hearing: Establishing Underground Utility District No. 21 (Phase II) on Highland Avenue from 8th to 16th Streets. (Engineering) (Refer to Item No. 7) NOTE: Notice of Public Hearing and Proof of Publication are on tile in the Office of the City Clerk. RECOMMENDATION: Staff recommended to hold the public hearing. TESTIMONY: None. ACTION: There being no speakers, the hearing was closed. Vice Mayor Morrison returned control of the meeting to Mayor Waters. CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR --Item No. 2 (Resolution No. 99-10), Item No. 3 (Warrant Register No. 29), and Item Nos. 4 and 5 (Claim for Damages). Motion by Inzunza, seconded by Morrison, the Consent Calendar be approved, and the Claims for Damages be denied. Carried by unanimous vote. GRANT/AB939 RECYCLING HAZARDOUS/HOUSEHOLD (206-4-3) SOLID WASTE/HAZARDOUS (911-1-7) 2. Resolution No. 99-10. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY OF CHULA VISTA TO MAKE APPLICATION FOR A HOUSEHOLD HAZARDOUS WASTE GRANT ON BEHALF OF THE CITY OF NATIONAL CITY." (Public Works) ACTION: Adopted. See above. Book 81/Page 20 1/26/99 WARRANT REGISTER (202-1-13) 3. Warrant Register #29. Ratification of Demands in the amount of $365,692.98 (Warrant Nos. 153149 through 153290 inclusive excepting none / 1735--1766 inclusive) and Certification of Payroll in the amount of $507,956.72. (Finance) ACTION: Adopted. See above. CLAIMS (501-1-142) 4. SUBJECT: Claim for Damages: Sophia Elliott. (City Clerk) ACTION: Denied. See above. CLAIMS (501-1-142) 5. SUBJECT: Claim for Damages: Jeffrey Sears, Sr. (City Clerk) ACTION: Denied. See above. NON CONSENT RESOLUTIONS SAN DIEGO COUNTY GRAND JURY REPORTS (303-1-5) 6. Resolution No. 99-11. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE MAYOR AND CITY COUNCIL'S RESPONSE TO THE REPORT OF THE SAN DIEGO COUNTY GRAND JURY." (City Manager) RECOMMENDATION: Staff recommended that Council adopt the Resolution. TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by Morrison, to adopt Resolution No. 99-11, and include language that the council shares the concerns of the Grand Jury. endorses Section 90-50 with stipulations. and opposes Section 90-51, Carried by unanimous vote. UNDERGROUND UTILITY DISTRICT 21 ADMIN (904-1-7) 7. Resolution No. 99-12. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 21 (PHASE 11) ON HIGHLAND AVENUE FROM EIGHTH TO SIXTEENTH STREETS." (Engineering) (Refer to Item No. 1) Book 81/Page 21 1/26/99 UNDERGROUND UTILITY DISTRICT 21 ADMIN (continued) RECOMMENDATION: Staff recommended that Council adopt the Resolution. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Soto, to adopt Resolution No. 99-12. Carried by the following vote, to -wit: Ayes: Morrison, Inzunza, Soto. Nays: None. Abstaining: Beauchamp, Waters. Note: Mayor Waters disclosed that he abstained because he owns property within the proposed utility district. Councilman Beauchamp disclosed that he abstained because he has an on - call contract with SDG&E through his company. OLD BUSINESS MUNICIPAL CODE 1999 (506-2-14) 8. SUBJECT: Supplemental report on Planning Commission recommendation to initiate an amendment to the Noise Ordinance. (Planning) RECOMMENDATION: Staff recommended that Council proceed with the amendment. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Beauchamp, to approve the amendment. Carried by unanimous vote. NEW BUSINESS CITY MANAGER --No Report CITY ATTORNEY --No Report OTHER STAFF --No Report MAYOR --No Report Book 81/Page 22 1/26/99 CITY COUNCIL Vice Mayor Morrison reported on an article he read about the Port District Maintenance Facility, and also announced that the Friends of the Library planned a precinct walk in favor of Proposition L. Interested participants should meet at Las Palmas Park on Saturday at 9 a.m. PUBLIC ORAL COMMUNICATIONS Michael Burns, 1415 'D' Avenue, discussed various Port District issues, and expressed his views on handicapped parking enforcement. Ted Godshalk, 2143 Cleveland Ave., presented each Councilmember a copy of the 1999 Paradise Creek Educational Park Calendar. Alda West, 315 E. 3rd Street, expressed her strong objections to the 'Q' Avenue Rehabilitation Project. ADJOURNMENT Motion by lnzunza, seconded by Morrison, the meeting be adjourned to the Next Regular City Council Meeting --February 2, 1999--at 3:00 p.m. -- Council Chambers, Civic Center.
