HomeMy WebLinkAboutCC MIN OCT26 1999Book 81/Page 273 10/26/99 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA OCTOBER 26, 1999 The Regular Meeting of the City Council of the City of National City was called to order at 6:02 p.m. by Mayor Waters. ROLL CALL Councilmembers present: Beauchamp, Inzunza, Morrison, Soto, Waters. Administrative officials present: Dalla, DiCerchio, Eiser, Kimble, McCabe, Morse, Myers, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led City Manager Tom G. McCabe, followed by the invocation by Councilman Beauchamp. APPROVAL OF MINUTES Motion by Morrison, seconded by Inzunza, the Minutes of the Regular Meeting of October 12, 1999, be approved. Carried by unanimous vote. PROCLAMATIONS (102-2-1) Motion by Morrison, seconded by Inzunza, the Proclamation be read in its entirety, provided there is someone present to accept it. Carried by unanimous vote. The Proclamation proclaiming the month of November, 1999, to be: "HIV / AIDS AWARENESS MONTH" and December 1, 1999, as "WORLD AIDS DAY," was read in its entirety by Mayor Waters. Book 81/Page 274 10/26/99 INTERVIEWS AND APPOINTMENTS STREET TREE AND PARKWAY COMM ADMIN (101-2-1) Mayor Waters turned control of the meeting over to Vice Mayor Morrison. Vice Mayor Morrison announced that Mayor Waters had recommended that Roy Cesena be reappointed to serve on the Street Tree and Parkway Committee, for a term ending April 30, 2003. ACTION: Motion by Inzunza, seconded by Beauchamp, in favor of Mayor's recommendation. Carried by unanimous vote. Vice Mayor Morrison returned control of the meeting to Mayor Waters. CONSENT CALENDAR ADOPTION OF' CONSENT CALENDAR. Item Nos. 1 through 3 (Resolution Nos. 99-169, 99-170, 99-171), Item No. 4 (Ratification of Public Fireworks Display), and Item Nos. 5 and 6 (Warrant Register Nos. 15 and 16). Motion by Inzunza, seconded by Beauchamp, the Consent Calendar be approved. Carried by unanimous vote. SIDEWALK / CURB / GUTTER ADMIN (903-7-8) 1. Resolution No. 99-169. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY ENGINEER TO ESTABLISH A GREEN CURB VISITOR PARKING ZONE AT 1701 "D" AVENUE. (NATIONAL CITY MIDDLE SCHOOL, TSC ITEM NO. 99-25)" (Engineering) ACTION: Adopted. See above. CONTRACT (C99-32) 2. Resolution No. 99-170. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AWARDING A CONTRACT TO MJC CONSTRUCTION COMPANY FOR THE REPAIR OF 30`'' STREET BETWEEN NATIONAL CITY BOULEVARD AND "B" AVENUE. (SPECIFICATION NO. 99-5)" (Engineering) ACTION: Adopted. See above. Book 81/Page 275 10/26/99 SUBDIVISION (SE CORNER 9"' ST / PARADISE DR) (415-31-1) 3. Resolution No. 99-171. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING A TENTATIVE SUBDIVISION MAP FOR DIVISION OF ONE LOT INTO ELEVEN SINGLE-FAMILY PARCELS AT THE SOUTHEAST CORNER OF 9th STREET AND PARADISE DRIVE. APPLICANT: PARADISE KNOLL PARTNERSHIP / WILIFRIDO C. NAVAL. CASE FILE NOS. S-1999-1/IS-1999-1." (Planning) ACTION: Adopted. See above. SCHOOL ADM IN (704-1-1) 4. SUBJECT: Ratification of public fireworks display conducted by Sweetwater Union High School on October 15, 1999. (Fire) ACTION: Approved. See above. WARRANT REGISTER (202-1-14) 5. Warrant Register #15. Ratification of Demands in the amount of $890,626.24. (Finance) ACTION: Approved. See above. WARRANT REGISTER (202-1-14) 6. Warrant Register #16. Ratification of Demands in the amount of $537,389.58. (Finance) ACTION: Approved. See above. ORDINANCES FOR ADOPTION Motion by Morrison, seconded by Beauchamp, the Ordinances be adopted by title only. Carried by unanimous vote. MUNICIPAL CODE (506-2-14) 7. Ordinance No. 99-2168. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING THE NATIONAL CITY MUNICIPAL CODE BY AMENDING TITLE 6 BY REPEALING CHAPTERS 6.46, 6.48 AND 6.56 REGARDING BUSINESS LICENSES AND REGULATIONS; AMENDING TITLE Book 81/Page 276 10/26/99 MUNICIPAL CODE (cont.) 7, CHAPTERS 7.20 AND 7.28 REGARDING PROPERTY CONSERVATION AND COMMUNITY APPEARANCE; AMENDING TITLE 9, CHAPTER 9.06 REGARDING FOOD VENDING VEHICLES; AMENDING TITLE 10, CHAPTER 10.22 REGARDING PUBLIC PEACE, MORALS AND SAFETY; AND TITLE 11, CI-IAPTER 11.32 REGARDING VEHICLES AND TRAFFIC." (City Attorney) RECOMMENDATION: Staff recommended approval. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, to adopt Ordinance No. 99-2168. Carried by unanimous vote. MUNICIPAL CODE (506-2-14) 8. Ordinance No. 99-2169. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING TITLE 7, CHAPTER 7.10, CHAPTER 7.20 AND CHAPTER 7.32 OF THE NATIONAL CITY MUNICIPAL CODE, REGULATING GARBAGE AND RUBBISH CONTAINERS, OUTDOOR ACTIVITIES AND ENFORCEMENT." (Planning) RECOMMENDATION: Staff recommended approval. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, to adopt Ordinance No. 99-2169. Carried by unanimous vote. NEW BUSINESS NATIONAL CITY COMMUNITY CENTER (1101-5-1) 9. SUBJECT: Use of the Community Center on December 18, 1999, by a non-profit local chapter of Alcoholic Anonymous for an informational meeting. Waiver of fees is requested." (Public Works) RECOMMENDATION: Staff recommended approval (conditional upon receipt of appropriate insurance binder), and partial waiver of fees. r Book 81/Page 277 10/26/99 NATIONAL CITY COMMUNITY CENTER (cont.) TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Waters, to approve the request, subject to compliance with conditions of approval, and deny the waiver of custodial fees. Carried by unanimous vote. CONDITIONAL USE PERMITS 1999 (403-14-1) 10. SUBJECT: Notice of Decision — Conditional Use Permit for a martial arts studio at 26 N. Euclid Avenue. Case File No. CUP-1999-7. Applicant: Troy Rawls. (Planning) RECOMMENDATION: Staff concurred with the Planning Commission, and recommended that the Notice of Decision be filed. TESTIMONY: None. ACTION: Filed. CONDITIONAL USE PERMITS 1999 (403-14-1) 11. SUBJECT: Notice of Decision - Conditional Use Permit for a wireless communications facility on a vacant lot east of 1840 E. 12th Street, and west of the 1-805 freeway. Case File No. CUP-1999-4. Applicant: Nextel. (Planning) RECOMMENDATION: Staff concurred with the Planning Commission, and recommended that the Notice of Decision be filed. TESTIMONY: None. ACTION: Filed. CITY MANAGER. (Councilman Inzunza) Councilman Inzunza reported that the item would appear on the Agenda of the November 9th meeting. Book 81/Page 279 10/26/99 CLOSED SESSIONS Public Employee Discipline / Dismissal / Release Government Code Section 54957 ACTION: Motion by Morrison, seconded by Inzunza, to go into Closed Session. Carried by unanimous vote. Councilmembers left the Council Chambers at 7:00 p.m. Councilmembers returned at 7:14 p.m. All members were present. Mayor Waters announced that the City Council had reviewed the material, and unanimously voted to deny the appeal. ADJOURNMENT Motion by Inzunza, seconded by Morrison, the meeting be adjourned to the Adjourned Regular City Council Meeting, October 28, 1999, at 3:00 p.m.. Large Conference Room, Civic Center. Carried by unanimous vote. The Next Regular City Council Meeting will be held on November 2, 1999, at 3:00 p.m., Council Chambers, Civic Center.
