HomeMy WebLinkAbout1997 01-03 CC MINBook 79/Page 1 01/03/97 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA JANUARY 3,1997 The Special Meeting of the City Council of the City of National City was called to order at 6:00 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Waters. Absent: Zarate. Administrative officials present: Dalla, Eiser, McCabe, Post. City Attorney Eiser advised the City Council that after the agenda was prepared he received communications from the attorney representing the Thrifty Oil Company that raised some issues the Council should consider before determining how they would like to proceed. The City Attorney recommended that the City Council consider going into closed session. ACTION: Motion by Morrison, seconded by Inzunza, to bring the question of a closed session onto the agenda, as the need to take action arose after the posting of the Agenda. Motion carried by unanimous vote. Absent: Zarate. Vice Mayor Zarate arrived at 6:02 p.m. ACTION: Motion by Morrison, seconded by Inzunza, to go into closed session. Carried by unanimous vote. Council Members left the Council Chambers at 6:03 p.m. Council Members returned to the Council Chambers at 6:47 p.m. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. MUNICIPAL CODE (506-2-11) 1. SUBJECT: Public Hearing to Consider Extension of Moratorium on the Commencement of Small Business Establishments Engaged in the Sale of Alcoholic Beverages for Off -Premises Consumption. NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: City Attorney Eiser informed the City Council that after the agenda was prepared he had discussions with Planning Director Post. Following a review they both concluded that the existing Conditional Use Permit Process (CUP), provides adequate protection for the City. In addition, the Supreme Court denied the City's appeal of the Thrifty Oil case. Therefore, the need to maintain the status quo with the ordinance no longer exists. For those reasons, it was the City Attorney's recommendation to not extend the moratorium. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Beauchamp, to not extend the moratorium. Carried by unanimous vote. MUNICIPAL CODE (506-2-11) 2. SUBJECT: Consideration of an Interim Ordinance of the City Council of the City of National City Adopted Pursuant to Government Code Section 65858 as an Urgency Measure Extending a Moratorium on Small Business Establishments Engaged in the Sale of Alcoholic Beverages for Off -Premises Consumption; and Related Issues. Book 79/Page 3 01/03/97 MUNICIPAL CODE (continued) TESTIMONY: None. ACTION: Motion by Morrison, that the matter be filed. Hearing no objections, Mayor Waters declared the item filed. PUBLIC ORAL COMMUNICATIONS - None ADJOURNMENT Motion by Zarate, seconded by Inzunza, to adjourn to the next Regular City Council Meeting - January 14, 1997 - 6:00 p.m. - Council Chambers, Civic Center.
