HomeMy WebLinkAbout1997 03-25 CC MINBook 79/Page 113 03/25/97 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA MARCH 25,1997 The Regular Meeting of the City Council of the City of National City was called to order at 6:00 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Waters. Absent: Zarate. Administrative officials present: Dalla, DiCerchio, Eiser, McAvoy, Morse, Post. Mayor Waters announced that Councilwoman Zarate was absent do to other City business. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager McCabe, followed by the invocation by Vice Mayor Beauchamp. APPROVAL OF MINUTES Motion by Morrison, seconded by Inzunza, the Minutes of the Regular Meeting of March 18, 1997 be approved. Carried by unanimous vote. Absent: Zarate. BOARDS & COMMISSIONS INTERVIEWS & APPOINTMENTS CIVIL SERVICE COMMISSION (101-9-1) Mayor Waters turned control of the meeting over to Vice Mayor Beauchamp, who introduced Georgia Guarano, 410 Harbison Avenue, National City. Ms. Guarano explained her interest in serving on the Civil Service Commission, and answered questions from the City Council. Book 79/Page 114 03/25/97 INTERVIEWS & APPOINTMENTS (continued) STREET TREE & PARKWAY COMMITTEE (101-2-1) Vice Mayor Beauchamp introduced William Morales, Sr., 1420 E. 5th Street, National City, who explained his interest in serving on the Street Tree & Parkway Committee. Mr. Morales then answered questions from the City Council. PARKS & RECREATION ADVISORY BOARD (101-5-1) Vice Mayor Beauchamp stated that Mayor Waters had recommended that Gloria Jean Thompson be re -appointed to the Parks & Recreation Advisory Board for a term ending on March 31, 2001. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the Mayor's recommendation. Carried by unanimous vote. Absent: Zarate. PLANNING COMMISSION (101-6-1) Vice Mayor Beauchamp stated that Mayor Waters had recommended that Mr. Ted Godshalk be re -appointed to the Planning Commission for a term ending on March 31, 2001. ACTION: Motion by Inzunza, seconded by Morrison, in favor of the Mayor's recommendation to re -appoint Mr. Godshalk to the Planning Commission for a term ending March 31, 2001. Carried by unanimous vote. Absent: Zarate. City Clerk Dalla administered the oath of office to Ms. Thompson and Mr. Godshalk. Vice Mayor Beauchamp returned control of the meeting to Mayor Waters. MAYOR'S PRESENTATIONS Mayor Waters recognized members of Boy Scout Troop 32 who were in the audience and Peter Lusher, their Scout Master. Mayor Waters presented the scouts with the City flag and introduced them to the City Council and Staff. Anne Campbell, representing the Troop Committee, thanked the Council for their continued support. Book 79/Page 115 03/25/97 PUBLIC HEARINGS CONDITIONAL USE PERMITS (403-5-7) 1. SUBJECT: Public Hearing - Appeal of Planning Commission denial of a modification of Conditional Use Permit-1990-5 to add the sale of distilled spirits to the existing sale of beer and wine within an existing supermarket. Case File No.: M 1-CUP-1990-5 . Applicant: Fortune Commercial Corporation. NOTE: Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. RECOMMENDATION: Staff concurred with the decision of the Planning Commission to deny the application and recommended that the appeal be denied. TESTIMONY: Attorney Evan Stone, 11975 El Camino Real, Suite 201, San Diego, representing the applicant, Seafood City, spoke in favor of the appeal. He explained to the Council that due to a mix-up on their part, they did not present their case at the Planning Commission hearing. Carlos Go, 1420 E. Plaza Blvd., who is the applicant, spoke in favor of the appeal and answered questions from the Council. Ronald Detzer, 1129 Mary Lane, a member of the Planning Commission, explained the reasons the Planning Commission voted to deny the application and urged the City Council to uphold that action. ACTION: Mayor Waters declared the Public Hearing closed. Motion by Morrison, seconded by Inzunza, to uphold the appeal and approve the application with the findings for approval and all the Conditions recommended by staff. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Waters. Nays: Beauchamp. Abstaining: None. Absent: Zarate. Book 79/Page 116 03/25/97 NON CONSENT RESOLUTIONS SAN DIEGO GAS & ELECTRIC CO FRANCHISE ADMIN (205-1-1) 2. Resolution No. 97-34. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY REQUESTING THAT SAN DIEGO COUNTY'S SOUTH BAY CITIES SHARE IN THE BENEFITS OF ENVIRONMENTAL MITIGATION PROGRAMS ARISING FROM THE OPERATION OF THE SAN ONOFRE POWER PLANT." (City Attorney) RECOMMENDATION: Staff recommended that the resolution be approved. TESTIMONY: Nick Inzunza, 3037 Cagle Street, representative for County Supervisor Greg Cox, applauded the efforts of the Council to keep mitigation money in the South Bay. JoAnne Reel, 2013 North Shores Drive, Chula Vista, representative for San Diego Gas and Electric, provided information and answered questions from the Council. Mr. Ted Godshalk, 2143 Cleveland Avenue, spoke in favor. ACTION: Vice Mayor Beauchamp announced that he would be abstaining because he has done business with SDG&E in the past. Motion by Inzunza, seconded by Morrison, in favor of Resolution No. 97-34. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Waters. Nays: None. Abstaining: Beauchamp. Absent: Zarate. CONTRACT (C97-9) 3. Resolution No. 97-35. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE CITY OF SAN DIEGO, A PRINCIPAL PERMITTEE, TO PAY THE CITY'S SHARE FOR THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) EDUCATION EFFORT." (Engineering) Book 79/Page 117 03/25/97 CONTRACT (continued) RECOMMENDATION: Staff recommended the adoption of the resolution authorizing the Mayor to enter into an agreement with the City of San Diego, as Principal Permittee, for the funding of the newspaper bag advertisements and associated display ads with the San Diego Tribune and the North County Times as part of the City's NPDES education effort. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Waters, in favor of Resolution No. 97-3 5 . Carried by unanimous vote. Absent: Zarate. ORDINANCES FOR INTRODUCTION Motion by Morrison, seconded by Inzunza, the Ordinances be introduced by title only. Carried by unanimous vote. MUNICIPAL CODE 1997 (506-2-12) 4. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 10.38 TO THE NATIONAL CITY MUNICIPAL CODE, ESTABLISHING A PILOT PROGRAM FOR VEHICLES USED IN THE COMMISSION OF AN ACT OF PROSTITUTION TO BE DECLARED A PUBLIC NUISANCE." (Police) MUNICIPAL CODE 1997 (506-2-12) 5. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 10.40 TO THE NATIONAL CITY MUNICIPAL CODE RELATING TO THE REGISTRATION OF TRANSIENTS AT HOTELS AND MOTELS." (Police) NEW BUSINESS WARRANT REGISTERS (202-1-11) 6. Warrant Register #37. Ratification of Demands in the amount of $13 8,3 59.05 (Warrant Nos. 142780 through 142869 inclusive excepting none) and Certification of Payroll in the amount of $456,564.99. (Finance) Book 79/Page 118 03/25/97 WARRANT REGISTERS (continued) RECOMMENDATION: Staff recommended ratification of these warrants. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Inzunza, in favor of the Ratification of Demands and Certification of Payroll. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Waters. Nays: None. Abstaining: None. Absent: Zarate. CITY MANAGER - No Report. CITY ATTORNEY POLITICAL SUPPORT (102-4-1) 7. SUBJECT: Consider joining an Amicus Curiae Brief in support of the City of Carlsbad in West Coast General Corporation v. City of Carlsbad. TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by Morrison, in favor of the City Attorney's recommendation. Carried by unanimous vote. Absent: Zarate. OTHER STAFF - No Report. MAYOR Mayor Waters announced that Knights & Carver, with his help, had just secured the unanimous support of the Port Commission for a 20-year lease extension on their property. They will be the only yacht building company on the West Coast. CITY COUNCIL Vice Mayor Beauchamp reported that, at the behest of the Mayor, he has been attending the Coastal Zone Meetings being held in San Diego. Vice Mayor Beauchamp introduced his daughter, Vanessa Beauchamp, who attends UC Irvine, and is a Phi Beta Cappa. Book 79/Page 119 03/25/97 PUBLIC ORAL COMMUNICATIONS Pat Large, 820 Mary Court, National City, suggested the Mayor inform the public that they can speak on any issue before the City Council. CLOSED SESSIONS Conference with Legal Counsel - Existing Litigation - Government Code Section 54956.9(a) Rattray v. City of National City. ACTION: Motion by Beauchamp, seconded by Inzunza, in favor of holding the Closed Session under Government Code Section 54956.9(a). Carried by unanimous vote. Absent: Zarate. Council Members left the Council Chambers at 7:26 p.m. Council Members returned to the Council Chambers at 7:31 p.m. It was noted for the record, that with the exception of Councilwoman Zarate who was absent, all members were present. ADJOURNMENT Motion by Morrison, seconded by Inzunza, to adjourn to the next Regular City Council Meeting - April 1, 1997 - 3:00 p.m. - Council Chambers, Civic Center. Carried by unanimous vote. Absent: Zarate.
