MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
APRIL 1, 1997
The Regular Meeting of the City Council of the City of National City was
called to order at 3:02 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Dalla, DiCerchio, Eiser, Kimble, McCabe,
McAvoy, Morse, Post, Williams.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager
McCabe, followed by the invocation by Vice Mayor Beauchamp.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Regular
Meeting of March 25, 1997 be approved. Carried by the following vote, to -
wit: Ayes: Beauchamp, Inzunza, Morrison, Waters. Nays: None.
Abstaining: Zarate.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Beauchamp, the Proclamations be read in
their entirety. Carried by unanimous vote
The Proclamation proclaiming April 4, 1997 to be: "USS CALHOUN (DD-
801) DAY" was read aloud in its entirety by Mayor Waters.

PROCLAMATIONS (continued)
The Proclamation proclaiming April 6 - April 12, 1997 to be: "BOYS &
GIRLS CLUBS WEEK" was read by Mayor Waters who then introduced
Greg Beatie from the Boys & Girls Club. Mr. Beatie introduced three
members of the club, Tristen Donet, Nick Fuller and Michelle Fisher who
accepted the proclamation and presented a gift to the Mayor and Council
members.
The Proclamation proclaiming the month of April, 1997 to be: "PUBLIC
SCHOOLS OBSERVATION MONTH" was read by Mayor Waters.
The Proclamation proclaiming the month of April, 1997 to be:
"WALKAMERICA FOR HEALTHIER BABIES MONTH" was read by
Mayor Waters.
NON CONSENT RESOLUTIONS
CONTRACT (C97-10)
1. Resolution No. 97-36. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
EXECUTION OF A MEMORANDUM OF UNDERSTANDING
WITH BURLINGTON NORTHERN SANTA FE RAILROAD FOR
AN INTERIM APPROVAL AND CONSTRUCTION PERMIT FOR
TWO NEW STREET CROSSINGS ON TIDELANDS AVENUE
AND 24TH STREET." (Engineering)
RECOMMENDATION: Staff sought Council direction on whether
to issue a temporary construction permit with conditions, as per the
M.O.U.; and authorize the Mayor and the City Manager to execute
the M.O.U.
TESTIMONY: Robert Brendza, Director of Industrial
Relations for Burlington Northern Santa Fe, explained the
importance of the Resolution and answered questions from the
Council.

CONTRACT (continued)
ACTION: Mayor Waters read into the record a letter he
received from Burlington Northern Santa Fe urging favorable
consideration of their request. Vice Mayor Beauchamp read
into the record a document outlining his views and concerns on
railroad issues. (Both are on file in the, Office of the City
Clerk) Following lengthy discussion, there was a Motion by
Inzunza, seconded by Morrison, to hold this item over for one
week. Carried by the following vote, to -wit: Ayes:
Beauchamp, Inzunza, Morrison, Waters. Nays: Zarate.
CONDITIONAL USE PERMITS (403-5-7)
2. Resolution No. 97-37. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING A
CONDITIONAL USE PERMIT APPLICATION FOR
MODIFICATION OF CONDITIONAL USE PERMIT 1990-5 TO
ADD THE SALE OF DISTILLED SPIRITS TO THE EXISTING
SALE OF BEER AND WINE WITHIN A SUPERMARKET AT
1420 E. PLAZA BOULEVARD, SUITE C. APPLICANT:
FORTUNE COMMERCIAL CORPORATION. CASE FILE NO.:
M 1-CUP-1990-5 ." (Planning)
RECOMMENDATION: Staff recommended the adoption of the
resolution.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Morrison, in favor
of Resolution No. 97-37. Carried by the following vote, to -wit:
Ayes: Inzunza, Morrison, Waters, Zarate. Nays: Beauchamp.
CONTRACT (C96-29)
3. Resolution No. 97-38. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING
WORK AND AUTHORIZING THE FILING OF THE NOTICE OF
COMPLETION FOR THE INSTALLATION OF THE DILUTION
TYPE EXHAUST VENTILATION SYSTEM. (FIRE STATION
SPECIFICATION NO. FP-96-1)." (Public Works)

RECOMMENDATION: Staff recommended that Council adopt the
Resolution authorizing the acceptance of the work and the filing of
the Notice of Completion.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Resolution No. 97-38. Carried by unanimous vote.
BUDGET TRANSFERS (206-2-12)/GRANT/TDA FUNDS (206-4-9)
4. Resolution No. 97-39. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE TRANSFER OF FUNDS FROM SANDAG TDA REVENUES
TO AN ACCOUNT FOR CONTRACT SERVICES." (National City
Transit)
RECOMMENDATION: Staff recommended that Council approve
the Resolution.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of Resolution No. 97-39. Carried by unanimous vote.
ORDINANCES FOR ADOPTION
Motion by Zarate, seconded by Beauchamp, the Ordinances be adopted by
title only. Carried by unanimous vote.
MUNICIPAL CODE 1997 (506-2-12)
5. Ordinance No. 97-2131. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ADDING
CHAPTER 10.38 TO THE NATIONAL CITY MUNICIPAL CODE,
ESTABLISHING A PILOT PROGRAM FOR VEHICLES USED IN
THE COMMISSION OF AN ACT OF PROSTITUTION TO BE
DECLARED A PUBLIC NUISANCE." (Police)
RECOMMENDATION: Staff recommended that Council adopt the
Ordinance.
TESTIMONY: Police Chief DiCerchio answered questions
from Council members.
ACTION: Motion by Zarate, seconded by Morrison in favor
of Ordinance No. 97-2131. Carried by unanimous vote.

MUNICIPAL CODE 1997 (506-2-12)
6. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY ADDING CHAPTER 10.40 TO THE
NATIONAL CITY MUNICIPAL CODE RELATING TO THE
REGISTRATION OF TRANSIENTS AT HOTELS AND MOTELS."
(Police)
RECOMMENDATION: Staff recommended that Council adopt the
Ordinance.
TESTIMONY: Police Chief DiCerchio, Sergeant Roarke and
Assistant City Attorney Hradecky provided additional
information and answered questions from Council members.
ACTION: Motion by Morrison, seconded by Inzunza, to hold
this item over for two weeks. Carried by unanimous vote.
NEW BUSINESS
WARRANT REGISTERS (202-1-11)
7. Warrant Register #39. Ratification of Demands in the amount of
$903,174.31 (Warrant Nos. 142871 through 142956 inclusive
excepting none). (Finance)
RECOMMENDATION: Staff recommended ratification of these
warrants.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of the Ratification of Demands. Carried by the following vote,
to -wit: Ayes: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Nays: None. Abstaining: None. Absent: None.

CITY COUNCIL
Vice Mayor Beauchamp thanked the Mayor and Council for their support of
his efforts to be appointed to the Border Environmental Cooperation
Commission and announced that he had just received an endorsement letter
from the United States Ambassador to Mexico.
PUBLIC ORAL COMMUNICATIONS
Everett Dickson, 2745 E. 14th Street, National City, told the Council that
Tidelands Avenue is an obstacle course for private vehicles and inquired
about the opening date for the Train Depot.
Alfonso Hernandez, 2113 Euclid Avenue, National City, gave the Council a
status report on the St. Anthony's Church rebuilding project.
ADJOURNMENT
Motion by Beauchamp, seconded by Zarate, to adjourn to the next Regular
City Council Meeting - April 8, 1997 - 6:00 p.m. - Council Chambers, Civic
Center. Carried by unanimous vote.
The meeting closed at 5:11 p.m.
