HomeMy WebLinkAbout1997 05-20 CC MINBook 79/Page 179 05/20/97 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA MAY 20,1997 The Regular Meeting of the City Council of the City of National City was called to order at 3:00 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Zarate, Waters. Absent: Morrison. Administrative officials present: Dalla, DiCerchio, Eiser, Matienzo, McCabe, Morse, Myers, Post, Williams. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager McCabe, followed by the invocation by Vice Mayor Beauchamp. APPROVAL OF MINUTES Motion by Inzunza, seconded by Beauchamp, the Minutes of the Regular Meetings of May 6, 1997 and May 13, 1997 be approved. Carried by unanimous vote. Absent: Morrison. PRESENTATIONS PERS/NEW EMPLOYEE INTRODUCTION PROGRAM (604-2-2) Mayor Waters requested that: City Attorney George Eiser introduce his new employee Virginia Orcutt/Secretary to the City Attorney; Planning Director Roger Post introduce his new employee Harold Phelps/Assistant Planner; and Police Chief DiCerchio introduce his new employee, Timothy Dow/Police Officer. The new employees stood and were recognized by those present. Book 79/Page 180 05/20/97 Councilman Morrison arrived at 3:05 p.m. BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS BOARDS & COMMISSIONS ADMIN (101-1-1) Mayor Waters turned control of the meeting over to Vice Mayor Beauchamp, who introduced Ms. Dorothy Winner, 2310 Ridgeway Drive, National City. Ms. Winner explained her interest in serving on a board or commission, and answered questions from the Council Vice Mayor Beauchamp returned control of the meeting to Mayor Waters. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution No. 97-60 through 97-63). Motion by Inzunza, seconded by Morrison, Consent Resolution No. 97-60 and Resolution No. 97-61 be adopted. Carried by unanimous vote. CONTRACT (C89-23) 1. Resolution No. 97-60. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXTEND AN AGREEMENT FOR AUDIT SERVICES WITH CALDERON, JAHAM & OSBORN." (Finance) ACTION: Adopted. See above. CONTRACT (C94-27) 2. Resolution No. 97-61. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A PROGRAM SUPPLEMENT AGREEMENT NO. 018-R1 TO LOCAL AGENCY -STATE AGREEMENT NO. 11-5066 FOR PRELIMINARY ENGINEERING, RIGHT-OF-WAY, CONSTRUCTION ENGINEERING AND CONSTRUCTION FOR THE SANTA FE RAILROAD DEPOT RESTORATION. PROJECT NO. 9547." (Community Development Commission) ACTION: Adopted. See above. Book 79/Page 181 05/20/97 NON CONSENT RESOLUTIONS CONTRACT (C97-17) 3. Resolution No. 97-62. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH M[JNICIPAL RESOURCE CONSULTANTS TO PERFORM AN INDEPENDENT AUDIT OF THE PERS SURPLUS ACCOUNT." (Finance) ACTION: Motion by Inzunza, seconded by Zarate, Resolution No. 97-62 be adopted. Carried by unanimous vote. CONTRACT (C97-18) 4. Resolution No. 97-63. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY WAIVING THE BIDDING PROCEDURE AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH TECHNOLOGY INTEGRATION GROUP FOR THE PURCHASE OF AN AUTOMATED FIELD REPORTING SYSTEM FOR THE POLICE DEPARTMENT." (Police) RECOMMENDATION: Staff recommended that Council adopt the resolution. TESTIMONY: Lt. Mike Iglesias of the Police Department stated that an important requirement of a Field Reporting System is the ability to interface with the County ARJIS computer system and that Technology Integration Group is the only vender that provides the software that will automatically download into ARJIS. ACTION: Motion by Inzunza, seconded by Zarate, Resolution No. 97-63 be adopted. Carried by unanimous vote. POLITICAL SUPPORT (102-4-1) 5. Resolution No. 97-64. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING AB 488, THE HANDGUN SAFETY STANDARDS ACT." (City Attorney) Book 79/Page 182 05/20/97 POLITICAL SUPPORT (continued) RECOMMENDATION: Staff recommended that Council adopt the resolution. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Zarate, in favor of Resolution No. 97-64. Councilman Morrison stated that it has been his policy to not take a position on items that are not City issues or do not relate to the City. For that reason he would be abstaining on both Resolution No. 97-64 and Resolution No. 97-65. Mayor Waters stated that his name appears with Mrs. Boxer on a flyer against handguns and for that specific reason he would abstain since this issue will not be settled on the State level but has to be settled on the Federal level. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Zarate. Nays: None. Abstaining: Morrison, Waters. Absent: None. POLITICAL SUPPORT (102-4-1) 6. Resolution No. 97-65. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING AB 532, THE ONE -HANDGUN -PER -MONTH ANTI -GUN RUNNING BILL." (City Attorney) RECOMMENDATION: Staff recommended that Council adopt the resolution. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Inzunza, in favor of Resolution No. 97-65. Councilman Morrison restated his belief that he does not feel that this is a City Council issue but an Assembly issue and for that reason he would be abstaining. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Zarate. Nays: None. Abstaining: Morrison, Waters. Absent: None. Book 79/Page 183 05/20/97 ORDINANCES FOR ADOPTION Motion by Inzunza, seconded by Morrison, the Ordinances be adopted by title only. Carried by unanimous vote. MUNICIPAL CODE 1997 (506-2-12) 7. Ordinance No. 97-2132. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 10.40 TO THE NATIONAL CITY MUNICIPAL CODE RELATING TO THE REGISTRATION OF TRANSIENTS AT HOTELS AND MOTELS." (Police) RECOMMENDATION: Staff recommended that Council adopt the proposed ordinance. TESTIMONY: None. ACTION: Motion by Zarate, seconded by Morrison, in favor of Ordinance No. 97-2132. Carried by unanimous vote. LOCAL COASTAL PROGRAM ADMIN (405-5-1) 8. Ordinance No. 97-2133. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING MODIFICATIONS TO THE LOCAL COASTAL PROGRAM - IMPLEMENTATION PURSUANT TO THE CALIFORNIA COASTAL ACT OF 1976, AS SUGGESTED BY THE CALIFORNIA COASTAL COMMISSION. APPLICANT: CITY OF NATIONAL CITY. CASE FILE NO. LCP-1996-2." (Planning) RECOMMENDATION: Staff recommended that Council adopt the ordinance. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Beauchamp, in favor of Ordinance No. 97-2133. Carried by unanimous vote. CITY MANAGER - No Report. CITY ATTORNEY - No Report. OTHER STAFF - No Report. Book 79/Page 184 05/20/97 MAYOR PUBLIC REQUEST/COMPLAINT (102-1-1) 9. SUBJECT: Request from St. Anthony of Padua Catholic Church for placement of banners. TESTIMONY: Monica Valencia, representing St. Anthony's Parish Council, 2402 E. 32nd Street, spoke in favor of the request and answered questions. Alfonso Hernandez, 2132 Euclid Avenue, said the Church could not afford to pay the installation cost for the banner. ACTION: No vote was taken. It was suggested that the Church work with the Chamber of Commerce to have their event advertised on the electronic bulletin boards run by the Chamber. CITY COUNCIL Councilwoman Zarate requested that the City Council consider adopting a Resolution previously approved by SANDAG, supporting `National Homeowner Week'. Councilwoman Zarate reported that SANDAG had taken a position against the `Triple -Trailer Bill' that would permit triple trailer trucks on some highways. Vice Mayor Beauchamp commented on a letter that was sent on a Personnel matter and the need to maintain respect in written correspondence. Vice Mayor Beauchamp stated it was his understanding that the photo -radar would only be used in tandem with the trailer that advises people of their speed, and asked for clarification from staff. Police Chief DiCerchio reported that the trailer is inoperable at the present time. He stated that both pieces of equipment would frequently be used together, but it is not intended that they be used together at all the times. Councilman Morrison said he would be opposed to using the photo radar and the trailer together at all times. Councilman Morrison reported that he and Councilwoman Zarate had attended the Police Officers Memorial Service and inquired why every city except National City had a proclamation for the event. Police Chief DiCerchio explained that National City did have a Proclamation, but is was inadvertently omitted when the list was read. Book 79/Page 185 05/20/97 PUBLIC ORAL COMMUNICATIONS Ivan Bodge, 2210 E. 22nd Street, told the Council that there is a crime problem in his neighborhood, he read crime statistics and spoke in favor of closing the Las Palmas Bridge at night. Alfonso Hernandez, 2132 Euclid Avenue, reported that a furniture store on National City Blvd., overhangs the sidewalk, inquired about the time -line on the CUP improvement of the old Westerner parking lot and suggested that the shrubbery in the drainage channel near the Boys and Girls Club be cleaned out. CLOSED SESSIONS Conference with Labor Negotiator - Government Code Section 54957.6. Agency negotiator: Roger DeFratis Employee organization: Municipal Employees' Association ACTION: Motion by Inzunza, seconded by Morrison, in favor of holding the Closed Session under Government Code Section 54957.6 Carried by unanimous vote. Council Members left the Council Chambers at 4:47 p.m. Council Members returned to the Council Chambers at 5:39 p.m. ROLL CALL Council members present: Beauchamp, Zarate, Waters. Absent: Inzunza, Morrison. ADJOURNMENT Motion by Zarate, seconded by Beauchamp, to adjourn to the next Regular City Council Meeting - May 27, 1997 - 6:00 p.m. - Council Chambers, Civic Center.
