MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
OCTOBER 21,1997
The Regular Meeting of the City Council of the City of National City was
called to order at 3:01 p.m. by Mayor Waters.
ROLL CALL
Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Bouse, Dalla, Desrochers, DiCerchio,
Eiser, Hodges, Kimble, Kossyta, Matienzo, McCabe, Morse, Myers, Post,
Ruiz.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by Assistant City
Manager Park Morse, followed by the invocation by Reverend Mike Regan,
First Christian Church.
APPROVAL OF MINUTES
Motion by Inzunza, seconded by Morrison, the Minutes of the Regular
Meeting of October 7, 1997 be approved. Carried by unanimous vote.
MAYOR'S PRESENTATIONS (102-14-2)
Presentation by Assemblywoman Denise Ducheny. Assemblywoman
Ducheny gave a status report on legislative activity in Sacramento. She
highlighted progress and programs of benefit to National City including the
approval of $75,000 for El Toyon Park.
Assemblywoman Ducheny then introduced a Memorial Resolution adopted
by the California Assembly recognizing the lifetime accomplishments and
contributions of Mr. Ernie Azhocar. Ms. Ducheny presented the Resolution
to Mrs. Connie Azhocar who accepted it on behalf of her late husband and
his family.

through 97-137, and Item Nos. 6 and 7 (Warrant Register Nos. 15 & 16).
NOTE: Item # 1 was pulled by Vice Mayor Beauchamp. Motion by
Inzunza, seconded by Morrison, the Consent Calendar (Except Item # 1,
Resolution No. 97-133) be adopted by title only. Carried by unanimous
vote.

TEMPORARY USE PERMITS (203-1-13)
1. Resolution No. 97-133. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AMENDING
CITY COUNCIL POLICY NO. 704 PERTAINING TO
TEMPORARY USE PERMITS." (Building & Safety)
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of Resolution No. 97-133. Carried by the following vote, to -
wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays:
Beauchamp. Absent: None. Abstaining: None.

2. Resolution No. 97-134. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY DECLARING
COURTESY CHEVROLET THE LOWEST RESPONSIVE,
RESPONSIBLE BIDDER AND AUTHORIZING THE
PURCHASING AGENT TO EXECUTE AN AGREEMENT FOR
THE PURCHASE OF ONE SUBURBAN SPORT UTILITY

TO STATE -LOCAL TRANSPORTATION PARTNERSHIP
PROGRAM AGREEMENT NO. SLTPP-5066 WITH CALTRANS
FOR THEIR PARTICIPATION IN THE STREET RESURFACING

CITY BOULEVARD TO CREATE A NEW BUS STOP."

ENCROACHMENT AGREEMENT ADMIN (903-14-1)
8. Resolution No. 97-138. A "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF
NATIONAL CITY AND SWEETWATER AUTHORITY FOR
FACILITIES WITHIN THE RIGHT-OF-WAY IN PLAZA BONITA
ROAD." (Engineering)
RECOMMENDATION: Staff recommended that Council approve
the Resolution and authorize the Mayor to sign the Encroachment
Agreement.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, in favor
of Resolution No. 97-138. Carried by unanimous vote.
WRITTEN COMMUNICATIONS
COUNCIL MEETINGS REGS/SCH ADMIN (102-7-1)
9. SUBJECT: Master Calendar - November 1997.
ACTION: The calendar was accepted and filed.
NEW BUSINESS
CAMPAIGN STATEMENTS REGULATIONS/ADMIN (502-10-1)
10. SUBJECT: Voluntary campaign expenditure limits under
Proposition 208. (City Attorney)
RECOMMENDATION: Staff requested Council direction
concerning possible preparation of ordinance.
ACTION: Consensus of the Council was to continue this item
to a Workshop Session to be held the first week in December.

EMERGENCY/DISASTER PLANNING ADMIN (301-1-1)
11. SUBJECT: Staff report on El Nino, Winter Season 1997-98. (Fire)
RECOMMENDATION: Staff recommended that the report be
received and filed.
ACTION: Motion by Beauchamp, seconded by Inzunza, the
report be received and filed. No objection as filed.
TEMPORARY USE PERMITS 1997 (203-1-13)
12. SUBJECT: Temporary Use Permit - National City Fire Fighters
Association. (Building & Safety)
RECOMMENDATION: Staff recommended that Council approve
the Temporary Use Permit application subject to compliance with all
conditions of approval; approve the static display of the Seagraves
fire truck and the attendance of one engine company crew on paid
status at the Senior Center on December 19; approve the waiver of the
$117.00 Temporary Use Permit processing fee, and deny the request
for waiver of the insurance requirements.
TESTIMONY: Roberto Medina, representing the National
City Fire Fighters Association spoke in favor of the request and
answered questions.
ACTION: Motion by Morrison, seconded by Inzunza, for the
City to be a Co -Sponsor and for approval of the Temporary
Use Permit with a waiver of all fees. Carried by unanimous
vote.
TEMPORARY USE PERMITS 1997 (203-1-13)
13. SUBJECT: Temporary Use Permit - Butler Family Reunion.
(Building & Safety)
RECOMMENDATION: Staff recommended that Council approve
the application for a Temporary Use Permit subject to compliance
with all conditions of approval and deny the request for a waiver of
the Temporary Use Permit processing fee.
TESTIMONY: Shelly Sagiao, 1636 Capistrano Avenue,
Spring Valley, spoke in favor of the request and answered
questions.

TEMPORARY USE PERMITS 1997 (continued)
ACTION: Motion by Morrison, seconded by Inzunza, in favor
of the TUP subject to all conditions of staff with the added
condition that the music must stop at midnight. Carried by
unanimous vote.
CITY MANAGER - No report.
CITY ATTORNEY- No report.
OTHER STAFF- No report.
MAYOR- No report.
CITY COUNCIL
Vice Mayor Beauchamp advised that the underground parking across the
street from City Hall was no longer available for city employees. The
property owners have installed a gate.
Councilwoman Zarate gave a brief report on the League of California Cities
Conference in San Francisco.
Councilman Morrison also reported on the League Conference.
PUBLIC ORAL COMMUNICATIONS
Michael Burns, 1317 D Avenue, National City, spoke about the problems of
noise, red curbs, and boom boxes.
PARADISE CREEK EDUCATION PARK (702-10-1)
Ted Godshalk, advised that there was an item removed from the agenda that
involved Paradise Creek. According to Mr. Godshalk, the matter was time
sensitive and he requested that it be taken up and added to the agenda for
Council consideration.
ACTION: Motion by Zarate, seconded by Morrison, to bring
the item onto the Agenda, as the need to take action arose after
the posting of the Agenda. Carried by unanimous vote.

PARADISE CREEK EDUCATION PARK (continued)
SUBJECT: Report on the Status of the Paradise Creek Education
Park and Observation Station.
RECOMMENDATION: Staff requested Council input and
direction.
TESTIMONY: Ted Godshalk, provided detailed information
on the specific items requiring Council approval and answered
questions.
ACTION: Motion by Morrison, seconded by Zarate, to
approve the installation of the bench and fence per Engineer's
drawing; and the installation of red curb in front of the bench, a
"two hour parking" sign on Hoover Avenue and "No Parking"
sign as approved by the Traffic Safety Committee. Carried by
unanimous vote.
CLOSED SESSIONS
CONFERENCE WITH LEGAL COUNSEL - EXISTING
LITIGATION - Government Code Section 54956.9(a). Herb Fox, et.
al. v. County of San Diego, et. al; County of San Diego v. City of
National City and Community Development Commission of the City
of National City; City of National City, Community Development
Commission of the City of National City v. State Water Resources
Control Board, et al.
ACTION: Motion by Morrison, seconded by Zarate, in favor
of holding the Closed Session under Government Code Section
54956.9(a). Carried by unanimous vote.
Council Members left the Council Chambers at 4:54 p.m.
Council Members returned to the Council Chambers at 5:44 p.m.
All Members were present.

ADJOURNMENT
Motion by Inzunza, seconded by Morrison, the meeting be adjourned to
Next Regular City Council Meeting - October 28, 1997 - 6:00 p.m. -
Council Chambers, Civic Center. Carried by unanimous vote.
The meeting closed at 5:44 p.m.
