HomeMy WebLinkAbout1997 10-28 CC MINBook 79/Page 331 10/28/97 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA OCTOBER 28, 1997 The Regular Meeting of the City Council of the City of National City was called to order at 6:02 p.m. by Mayor Waters. ROLL CALL Council members present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Bouse, Dalla, Desrochers, DiCerchio, Eiser, McAvoy, McCabe, Morse, Myers, Ray. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom McCabe, followed by the invocation by Reverend Adiel De Pano, First United Methodist Church. APPROVAL OF MINUTES Motion by Inzunza, seconded by Zarate, the Minutes of the Regular Meeting of October 21, 1997 be approved. Carried by unanimous vote. Mayor Waters informed the City Council that there was an off -agenda item for the 'Mile of Cars' that needed to be brought onto the Agenda. The item required action and could not wait until the next meeting. The Mayor requested that the Temporary Use Permit application for a car sale at Plaza Bonita be brought on the Agenda as Item No. 13, under New Business. ACTION: Motion by Inzunza, seconded by Morrison, to bring this item on the Agenda as Item No. 13, as the need to take action arose after the posting of the Agenda. Carried by unanimous vote. Book 79/Page 332 10/28/97 MAYOR'S PRESENTATIONS (102-14-2) Mayor Waters said he wanted to recognize volunteers from the First United Methodist Church of National City for participation in the Adopt -a - Highway Program. Church volunteers regularly clean a three-mile section of State Highway 54 bordering National City. Vice Mayor Beauchamp introduced members of the church: Craig Woempner, Cody Woempner, Christian Woempner, Paul Vogel, Martin Balke, John Martin, Bill Evans, Jack Hadfield, Otis Camber, Hermogenes Bautista, Alicia Bautista, Alex Pangilinan, Adiel De Pano, Dennis Vernon, Fely Vernon, Fred Borja, Donald Faas. The Mayor and Council presented the members with City flags and pins. PROCLAMATIONS (102-2-1) Motion by Morrison, seconded by Zarate, the Proclamation be read in its entirety provided there is someone present to accept it. Carried by unanimous vote. The Proclamation proclaiming October 28, 1997 to be: "DOLORES FINCHER DAY" was read in its entirety by Mayor Waters and presented to Ms. Fincher. PUBLIC HEARINGS MUNICIPAL CODE (506-2-12) 1. SUBJECT: Public Hearing - Amendment to Title 18 (Zoning) of the National City Municipal Code regarding regulations pertaining to service stations, sale of gasoline and alcohol, and mini -markets (City initiated). Case File No.: A-1997-4. (Planning) RECOMMENDATION: Staff concurred with the recommendation of the Planning Commission for approval. TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by Morrison, la approve. Carried by unanimous vote. Book 79/Page 333 10/28/97 CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR Resolution Nos. 97-139 through 97-142; Item No. 6 (Warrant Register No. 17); and Item Nos. 7 through 10 (Claims for Damages). Motion by Inzunza, seconded by Morrison, to approve Item Nos. 2 through 6, and deny all Claims for Damages (Item Nos. 7 through 10). Carried by unanimous vote. CONTRACT (C97-16) 2. Resolution No. 97-139. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION FOR THE MISCELLANEOUS CURB, GUTTER, SIDEWALK, CROSS -GUTTER, PAVEMENT, AND PEDESTRIAN RAMP IMPROVEMENTS AT VARIOUS LOCATIONS IN THE CITY. (ENGINEERING SPEC. NO. 97-1)." (Engineering) ACTION: Adopted. See above. CONTRACT (C97-34) 3. Resolution No. 97-140. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE CITY OF SAN DIEGO FOR THE FUNDING OF THE FEDERALLY MANDATED STORM WATER PERMIT AND TOXIC CLEAN-UP PROGRAM FEES (1997-98)." (Engineering) ACTION: Adopted. See above. CONTRACT (C97-35) 4. Resolution No. 97-141. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE CITY OF SAN DIEGO FOR FUNDING OF THE FEDERALLY MANDATED STORM WATER MONITORING PROGRAM (1997- 98)." (Engineering) ACTION: Adopted. See above. Book 79/Page 334 10/28/97 CONTRACT (C97-36) 5. Resolution No. 97-142. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE CITY OF SAN DIEGO, A PRINCIPAL PERMITTEE, TO PAY THE CITY'S SHARE FOR THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) EDUCATION EFFORT. (Engineering) ACTION: Adopted. See above. WARRANT REGISTERS (202-1-12) 6. Warrant Register #17. Ratification of Demands in the amount of $181,584.01 (Warrant Nos. 145864 through 145948 inclusive excepting none /103248 through 103317 inclusive). (Finance) ACTION: Adopted. See above. CLAIM (501-1-138) 7. SUBJECT: Claim for Damages: Evelyn N. Woodsum. (City Clerk) ACTION: Denied. See above. CLAIM (501-1-138) 8. SUBJECT: Claim for Damages: Ashley and Elizabeth Balough. (City Clerk) ACTION: Denied. See above. CLAIM (501-1-138) 9. SUBJECT: Claim for Damages: Robert Hightower and Margie Kirk. (City Clerk) ACTION: Denied. See above. CLAIM (501-1-138) 10. SUBJECT: Claim for Damages: Nationwide Insurance for Ann and James Arnold. (City Clerk) ACTION: Denied. See above. Book 79/Page 335 10/28/97 NEW BUSINESS CITY OWNED LAND ADMIN (1001-1-4) 11. SUBJECT: Report on the City -owned real property on the east side of Clairmont Avenue, between Melrose and First Streets, A.P.N. 554- 242-17. (Engineering) RECOMMENDATION: Staff requested direction from the City Council on whether to hold this piece of property or to authorize the City Engineer to sell the property in accordance with City Council Policy No. 901. TESTIMONY: James Craze, 2738 Melrose St., spoke in favor of building owner occupied housing and against putting in a park. ACTION: Motion by Beauchamp, seconded by Morrison, to offer the property to the Community Development Commission for the First Time Home Buyer Program. Carried by unanimous vote. NATIONAL CITY COMMUNITY CENTER (1101-5-1) 12. SUBJECT: Use of Community Building by Sweetwater High's Marine Corps Junior Reserve Officers Training Corps (MCJROTC) for an award ceremony on December 12, 1998, and waiver of fees. (Public Works) RECOMMENDATION: Staff requested Council decision on waiver of fees. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Beauchamp, to approve including the waiver of fees. Carried by unanimous vote. TEMPORARY USE PERMITS 1997 (203-1-13) 13. SUBJECT: Temporary Use Permit - McCune Motors and Ron Baker Chevrolet. (Building & Safety) RECOMMENDATION: Staff recommended approval subject to compliance with all conditions of approval. Book 79/Page 336 10/28/97 TEMPORARY USE PERMITS 1997 (continued) TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Morrison, t approve the Temporary Use Permit for car sales with all conditions of Staff. Carried by unanimous vote. CITY MANAGER - No report.. CITY ATTORNEY- No report. OTHER STAFF- No report. MAYOR Mayor Waters introduced Steve South, President of the Chamber of Commerce. Mr. South then introduced Patricia (Trish) De La Rosa, the new Executive Director of the National City Chamber of Commerce. CITY COUNCIL Vice Mayor Beauchamp: A) reported that consideration had been given to an alternate bike -way along the railroad tracks through the wildlife refuge. The route was promising but it was determined to not be practical given pre- existing approvals for a different route; B) reported on events impacting the prospects of an eastern railroad connection, particularly the bid by a Mexican Railroad group for a segment of the line through Mexico; C) invited the Council to participate in VIP tours in conjunction with testing of the new Mission Valley Trolley connection; and D) informed the Council of a railroad trip along the eastern segment of the railroad sponsored by Supervisors Cox and Jacobs and encouraged the Council to support the bus promotion for National City Transit that will be held at Plaza Bonita. City of National City and Community Development Commission of the City of National City; City of National City, Community Development Commission of the City of National City v. State Water Resources Control Board, et al. ACTION: Motion by Inzunza, seconded by Morrison, in favor of holding the Closed Session under Government Code Section 54956.9(a). Carried by unanimous vote. Council Members left the Council Chambers at 7:02 p.m. ADJOURNMENT Motion by Morrison, seconded by Zarate, the meeting be adjourned to the Next Regular City Council Meeting - November 4, 1997 - 3:00 p.m. - Council Chambers, Civic Center. Carried by unanimous vote.
