HomeMy WebLinkAbout1993 02-02 CC MINBook 75/Page 23 02/02/93 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA FEBRUARY 2, 1993 The Regular Meeting of the City Council of the City of National City was called to order at 4:03 p.m. by Mayor Waters. ROLL CALL Council members present: Inzunza, Morrison, Zarate, Waters. Absent: Della. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager, Tom G. McCabe followed by the invocation by Assistant City Manager Bolint. APPROVAL OF MINUTES Motion by Zarate, seconded by Inzunza, the Minutes of the Regular Meeting of January 26, 1993 be, approved. Carried by unanimous vote. Absent: Della. Vice Mayor Della arrived in the Council Chambers at 4:05 p.m. Mayor Waters introduced the new Police Chief, Kent Reesor, who introduced his wife Karen. Mayor Waters reminded the public of the grand opening of the new Police Department facility, Wednesday, February 3, 1993 at 4 p.m. and invited everyone to attend. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 93-12 through 93- 15 and Item No. 5-Street Tree Removals and Replacements.) NOTE: Councilman Inzunza requested that Item Nos. 1 and 4 (Resolution Nos. 93-12 and 93-15) be pulled; Mayor Waters requested that Item No. 2 (Resolution No. 93-13) be pulled; Council members Inzunza and Zarate stated that they would be voting in opposition to Item No. 3 (Resolution No. 93-14). Motion by Della, seconded by Inzunza, for approval. Carried by unanimous vote. CONDITIONAL USE PERMIT DENIAL 3. Resolution No. 93-14. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, DENYING A CONDITIONAL USE PERMIT APPLICATION FOR THE SALE OF BEER AND WINE WITHIN A CONVENIENCE GROCERY STORE AT 2401 HIGHLAND AVENUE, SUITE 101. APPLICANT: MARIA AND NATIVIDAD BARRAZA, LUPITA'S MEAT MARKET AND GROCERIES. CASE FILE NO. CUP-1992-12." ACTION: Carried by the following vote, to -wit: Ayes: Della, Morrison, Waters. Nays: Inzunza, Zarate. Book 75/Page 24 02/02/93 CONSENT CALENDAR (continued) STREET TREE REMOVALS 1993 5. SUBJECT: Street Tree Removals and Replacement. RECOMMENDATION: Staff recommended approval of the following: J. Rogelio Ochoa, 123 W. 11th Street, National City, request removal of tree; approved removal of three trees due to curb and plumbing damage. Two replacements required. Staff to contact Community Development Commission for tree replacements. Ball Oldsmobile Property, George Quinn, Gen. Mgr., 2034 & 2038 "A" Avenue, National City, request removal of trees; approved in accordance with Street Tree Policy due to underground water leaks. One replacement required on 22nd Street. Property owner to pay full costs. ACTION: Adopted. See above. CONTRACT 1. Resolution No. 93-12. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH THE MAYTIME BAND REVIEW CORPORATION." TESTIMONY: Edith Hughes, Director, National City Chamber of Commerce, stated that the date for the Maytime Band Review has been set for May 1, 1993. ACTION: Motion by Inzunza, seconded by Dalla, in favor of Resolution No. 93-12. Carried by unanimous vote. CIVIL SERVICE RULES -AMENDMENTS 2. Resolution No. 93-13. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE AMENDMENT TO CIVIL SERVICE RULE III, SECTION 318--MEDICAL EXAMINATION." ACTION: Motion by Waters, seconded by Inzunza, in favor of Resolution No. 93-13. Carried by unanimous vote. GRANT TDA & PROPOSITION A 4. Resolution No. 93-15. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY ENGINEER TO APPLY FOR TRANSPORTATION DEVELOPMENT ACT AND PROPOSITION A FUNDS FOR CONSTRUCTION OF THE EASTERLY PORTION OF THE SWEETWATER RIVER BICYCLE PATH." TESTIMONY: Dino Serafini, City Engineering Department, answered questions of the Council. Alfonso Hernandez, 2132 Euclid Avenue, National City, made inquiry of the Council. ACTION: Motion by Inzunza, seconded by Dalla, in favor of Resolution No. 93-15 Carried by unanimous vote. Book 75/Page 25 02/02/93 NON CONSENT RESOLUTIONS Motion by Dalla, seconded by Morrison, the Resolution be introduced by title only. Carried by unanimous vote. CONTRACT 6. Resolution No. 93-16. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY REQUESTING AN EXTENSION OF THE FUNDING PERIOD APPLICABLE TO THE P.E.R.S. RETIREMENT PLAN." RECOMMENDATION: Staff recommended approval of the Resolution. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Morrison, for approval of Resolution No. 93-16. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1992 7. SUBJECT: Warrant Register No. 30. Ratification of Demands in the amount of $158,534.61 (Warrant Nos. 124769 through 124881 inclusive excepting 124772 and 124826) and Certification of Payroll in the amount of $425,042.48. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Dalla, seconded by Zarate, the demands be ratified and the payroll confirmed. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Morrison, Zarate, Waters. Nays: None. GENERAL PLAN 8. SUBJECT: Report on General Plan Update Program. RECOMMENDATION: Staff recommended that the report be accepted and filed. ACTION: Motion by Waters, seconded by Morrison, to receive and file the report. No objection as filed. AUDIT/FINANCIAL REPORT 1991-92 9. SUBJECT: Fiscal Year 1991-92 Audit Reports. RECOMMENDATION: Staff recommended that the reports be accepted and filed. ACTION: Motion by Dalla, seconded by Inzunza, to accept and file the reports. No objection as filed. TRAFFIC SAFETY COMMITTEE 1992-93 10. SUBJECT: Report of the Traffic Safety Committee Meetings of November 11 and December 9, 1992. RECOMMENDATION: Staff recommended that the reports be received and filed. ACTION: Motion by Dalla, seconded by Inzunza, to accept and file the reports. No objection as filed. Book 75/Page 26 02/02/93 NEW BUSINESS (continued) FIRE DEPARTMENT ADMIN 11. SUBJECT: Special Utilization of Fire Apparatus. RECOMMENDATION: Staff recommended the approval of the proposal as presented. TESTIMONY: Izzy Maggay, 240 W. 30th Street, National City, owner of Ramfan, made a presentation of a $1500. 00 fan to the National City Fire Department and commended Chief Kimble and his fire fighters for their assistance in developing the blower right here in National City. ACTION: Motion by Dalla, seconded by Morrison, for approval. Carried by unanimous vote. POLITICAL SUPPORT 12. SUBJECT: Consider joining Amicus Curiae Brief in Freedom Newspapers v. board of Directors of the Orange County Employees' Retirement System. RECOMMENDATION: Staff recommended authorizing the City Attorney to join Amicus Curiae Brief. TESTIMONY: Councilman Morrison requested that on future similar items brought onto the Agenda by the City Attorney, an example be presented of how this would apply to National City. ACTION: Motion by Dalla, seconded by Inzunza, for approval of joinina the Amicus Curiae Brief in any way the City Attorney feels is appropriate. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR - Mayor Waters recognized City Clerk Lori Anne Peoples, who was recently honored by the National City Chamber of Commerce as the Citizen of the Year; and Matthew Rinder, owner of Archives America of San Diego, 200 E. 26th Street, National City, who was honored as Businessman of the Year. Mayor Waters read into the record a letter from Diane Helm to the National City Historical Society (copy on file in the Office of the City Clerk), which reported that long- time National City resident Helen Lamb passed away on November 26, 1992 and that a Memorial Service would be held on Tuesday, February 27, 1993, at 7:00 p.m., at the K of P Hall. The Mayor also read a letter (copy on file in the Office of the City Clerk) from Janis Strangman, commending Purchasing Agent Brenda Hodges for her assistance in securing a special wheel chair for her terminally ill niece. Book 75/Page 27 02/02/93 CITY COUNCIL Councilwoman Zarate gave a brief report on the SANDAG retreat that she had recently attended. Councilman Morrison made inquiry of Police Chief Reesor as to the Community Conference Room at the new Police Department Building. Vice Mayor Dalla commented on the drainage problems that have been corrected over the last few years at Olive Avenue, Harbison Avenue, Civic Center Drive, Hoover Avenue, B Avenue, and Edgemere Drive. He commended Council and Staff for seeing the projects through. Councilwoman Zarate requested Community Development Commission Director Paul Desrochers provide information to the Mayor of Imperial Beach regarding our tree - planting program. PUBLIC ORAL COMMUNICATIONS Louise Martin, 1527 E. 15th Street, National City, stated that the opening of the Friends of the Library Bookstore would be this Saturday at 11:00 a.m. and invited everyone to attend the ribbon cutting. Alfonso Hernandez, 2132 Euclid Avenue, National City, made inquiry of the Council regarding the flooding of Roosevelt Avenue to Hoover Avenue during high tide. Public Works Director Curt Williams answered Mr. Hernandez' questions. Lanny Roark, President of the National City Police Officer Association, 1200 A Avenue, National City, welcomed Chief Reesor as the new Police Chief and spoke regarding the contract negotiations of the Police Officers. CLOSED SESSION CLOSED SESSION FOR PENDING LITIGATION UNDER GOVERNMENT CODE SECTION 54956.9(A) (CARRILLO V. CITY OF NATIONAL CITY) ACTION: Motion by Inzunza, seconded by Zarate, in favor of holding the Closed Session under Government Code Section 54956.9(A). Carried by unanimous vote. Council members left the Council Chambers at 5:07 p.m. Council members returned to the Council Chambers at 5:35 p.m. ROLL CALL Council members present: Dalla, Inzunza, Morrison, Zarate, Waters.
