MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
FEBRUARY 9, 1993
The Regular Meeting of the City Council of the City of National City was called to order
at 7:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Della, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager, Tom G.
McCabe followed by the invocation by Vice Mayor Della.
APPROVAL OF MINUTES
Motion by Della, seconded by Morrison, the Minutes of the Regular Meeting of
February 2, 1993 be approved. Carried by unanimous vote.
BOARDS AND COMMISSIONS
INTERVIEWS/APPOINTMENTS
TRAFFIC SAFETY COMMITTEE
PARKS & RECREATION ADVISORY COMMITTEE
RECOMMENDATION: Mayor Waters recommended the re -appointment of
Mr. Roy Fierro to the Traffic Safety Committee and Mr. James Grier, Jr. to the
Parks & Recreation Advisory Committee for additional two-year terms.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of the
Mayor's recommendation for re -appointments. Carried by unanimous
vote.
City Clerk Peoples issued the Oaths of Office and presented Certificates of
Appointment to Mr. Fierro and Mr. Grier.
PUBLIC HEARING
MUNICIPAL CODE 1993
1. SUBJECT: Public Hearing - Consideration of Adoption of Various Model
Building Codes by Reference and amending Chapters 14.06, 14.08, and 14.16
of the National City Municipal Code.
NOTE: Notice of Public Hearing and Proof of Publication are on file in the
Office of the City Clerk.
RECOMMENDATION: Staff recommended adoption of the Ordinances at
the conclusion of the public hearing.
TESTIMONY: None.
Mayor Waters declared the Public Hearing closed.

Motion by Zarate, seconded by Morrison, in favor of adoption by title only. Carried by
unanimous vote.
MUNICIPAL CODE 1993
2. SUBJECT: Adoption of Ordinances pertaining to adoption of various Uniform
Codes by Reference and amending Chapters 14.06, 14.08, and 14.16 of the
National City Municipal Code.
(a) Ordinance No. 93-2046. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY, ADOPTING THE
UNIFORM BUILDING CODE, 1991 EDITION, AMENDING
CERTAIN SECTIONS AND ADOPTING APPENDIX CHAPTERS
32, 35, 38 AND 49, ADOPTING THE UNIFORM BUILDING CODE
STANDARDS 1991 EDITION; PROVIDING PENALTIES FOR
VIOLATION THEREOF AND AMENDING ORDINANCE NOS.
1975, 1915 AND CHAPTER 15.08 OF THE NATIONAL CITY
MUNICIPAL CODE."
(b) Ordinance No. 93-2047. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE
UNIFORM PLUMBING CODE, 1991 EDITION, ESTABLISHING
REGULATIONS FOR THE INSTALLATION, MAINTENANCE AND
ALTERATION OF PLUMBING SYSTEMS, AMENDING CERTAIN
SECTIONS, AMENDING ORDINANCE NO. 1976 AND SECTION
15.20 OF THE NATIONAL CITY MUNICIPAL CODE."
(c) Ordinance No. 93-2048. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE
UNIFORM MECHANICAL CODE, 1991 EDITION, ADOPTING
APPENDIX A, B AND C OF SAID CODE, AMENDING AND
DELETING CERTAIN SECTIONS OF ORDINANCE NO. 1979 AND
AMENDING CHAPTER 15.14 OF THE NATIONAL CITY
MUNICIPAL CODE."
(d) Ordinance No. 93-2049. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY, ADOPTING THE
UNIFORM HOUSING CODE, 1991 EDITION, AMENDING
CERTAIN SECTIONS, AND AMENDING ORDINANCE NO. 1978
AND CHAPTER 15.16 OF THE NATIONAL CITY MUNICIPAL
CODE."
(e) Ordinance No. 93-2050. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE
UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS
BUILDINGS, 1991 EDITION, AND AMENDING ORDINANCE NO.
1979 AND CHAPTER 15.10 OF THE NATIONAL CITY MUNICIPAL
CODE."

ESTABLISHING REQUIREMENTS, RULES AND STANDARDS

AND THE UNIFORM FIRE CODE STANDARDS, PRESCRIBING
REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO
LIFE AND PROPERTY FROM FIRE, HAZARDOUS MATERIALS
OR EXPLOSION, PROVIDING FOR THE ISSUANCE OF PERMITS
FOR HAZARDOUS USES OR OPERATIONS; AND
ESTABLISHING A BUREAU OF FIRE PREVENTION AND
PROVIDING OFFICERS THEREFOR AND DEFINING THEIR
POWERS AND DUTIES, REPEALING ORDINANCE NO. 1980
AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES
IN CONFLICT THEREWITH, AND AMENDING CHAPTER 15.28

Ordinance No. 93-2054. "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY, ADDING CHAPTER
15.70, TO TITLE 15 OF THE NATIONAL CITY MUNICIPAL CODE,
REGULATING GRADING, EXCAVATIONS, FILLS, WATER
COURSES, CONSTRUCTION OF RETAINING WALLS;
REPEALING ORDINANCE NOS. 1052, 1280 AND 1416;
AMENDING SECTION 15.08.070 OF THE NATIONAL CITY
MUNICIPAL CODE; AND ADOPTING CHAPTER 70 OF THE 1991
UNIFORM BUILDING CODE, AS AMENDED HEREIN."
ACTION: Motion by Zarate, seconded by Dalla, in favor. Carried by
unanimous vote.

OLD BUSINESS
REVENUE & TAXATION ADMIN
3. SUBJECT: Report on Transient Occupancy Tax (TOT).
RECOMMENDATION: Staff recommended that this item be held over to
February 23, 1993.
ACTION: Motion by Inzunza, seconded by Morrison, in favor of Staff's
recommendation to lay this item over to February 23. 1993. Carried by
unanimous vote.
NEW BUSINESS
WARRANT REGISTERS 1992
4. SUBJECT: Warrant Register No. 31. Ratification of Demands in the amount
of $147,500.87 (Warrant Nos. 124883 through 124950 inclusive excepting
none).
RECOMMENDATION: Staff recommended ratification of these warrants.
ACTION: Motion by Dalla, seconded by Morrison, the demands be
ratified. Warrants carried by the following vote, to -wit: Ayes: Dalla,
Inzunza, Morrison, Zarate, Waters. Nays: None.
PLANNED DEVELOPMENT PERMIT
5. SUBJECT: Notice of Decision - Planning Commission Resolution No. 1-93
approving a Planned Development Permit for a 76-unit senior citizen housing
project south of 14th Street, north of 15th Street, between "F" and Highland
Avenues. (Applicant: Kristin Morrish, Telacu Housing -National City, Inc.).
(Case File No. PD-1992-7).
RECOMMENDATION: Staff concurred with the Planning Commission
decision and recommends the Notice of Decision be filed.
NOTE: Mayor Waters stated that he would be abstaining on voting on this item
due to the close proximity of his properly.
TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue, National City,
made inquiry of the Council.
ACTION: Motion by Inzunza, seconded by Zarate, to file. Carried by
the following vote: Ayes: Dalla, Inzunza, Morrison, Zarate. Nays: None.
Abstaining: Waters.
POLITICAL SUPPORT
6. SUBJECT: Consider joining Amicus Curiae Briefs in Oden v. PERS and City
of San Diego v. Neumann..
RECOMMENDATION: Staff recommended that the City Attorney be
authorized to join Amicus Curiae Briefs.
ACTION: Motion by Dalla, seconded by Morrison, for approval.
Carried by unanimous vote.

CITY ATTORNEY
City Attorney Eiser spoke regarding the Carrillo litigation, which authorized the
purchase of the Carrillo residence at 2031 Euclid Avenue by the City. That transaction
has been completed with the Carrillos; the Community Development Commission will
purchase the residence from the City for use in their First-time Home Buyer Program.
In order to close the Escrow by Thursday, February 11, 1993, Mr. Eiser stated that it is
necessary for the City Council to authorize acceptance of the deed from the Carrillos
and recommended that Resolution No. 93-17 be brought onto the Agenda.
ACTION: Motion by Dalla, seconded by Morrison, to bring Resolution No. 93-
17 onto the Agenda. as the need to take action arose after the Agenda was
posted. Carried by unanimous vote.
DEEDS & EASEMENTS
Resolution No. 93-17. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY ACCEPTING CONVEYANCE OF THE REAL PROPERTY
AT 2031 EUCLID AVENUE FROM BERNARD H. CARRILLO AND ISABEL M.
CARRILLO."
ACTION: Motion by Dalla, seconded by Inzunza, for approval of
Resolution No. 93-17. Carried by unanimous vote.
OTHER STAFF - No report.
MAYOR - No report.
CITY COUNCIL
Councilwoman Zarate invited the Council to the rededication of Olivewood School on
February 17, 1993 at 1:15 p.m.
PUBLIC ORAL COMMUNICATIONS
Troy Fulks, 2118 "N" Avenue, National City, expressed his opinion on the Telacu
project.
Rita Heiss, 2121 E. 4th Street, National City, made inquiry regarding the plaque on the
new Police Department facility.
Alfonso Hernandez, 2132 Euclid Avenue, National City, spoke regarding the new
Police Department facility and items that he noted were not completed.
Louise Martin, 1527 E. 15th Street, National City, expressed her pleasure with the new
Police Department facility and made inquiry of the Council.

Motion by Morrison, seconded by Zarate, to adjourn to the City Council Workshop of
February 10. 1993 at 4:00 P.M. - Large Conference Room. Civic Center. Carried by
unanimous vote.
