MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
MAY 25, 1993
The Regular Meeting of the City Council of the City of National City was called to order
at 7:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Morrison, Zarate, Waters.
Administrative dfficials present: Bolint, Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager, Tom G.
McCabe followed by the invocation by Vice Mayor Dalla.
APPROVAL OF MINUTES
Motion by Inzunza, seconded by Zarate, the Minutes of the Regular Meeting of May 18.
1993 and the Adjourned Workshop Meeting of May 19. 1993 be approved. Carried by
unanimous vote.
PROCLAMATIONS
Motion by Morrison, seconded by Dalla, the Proclamation be read in its entirety.
Carried by unanimous vote.
The Proclamation proclaiming May 28, 1993 as: YOUNG AUTHORS OF
NATIONAL CITY MIDDLE SCHOOL DAY" was read aloud in full by Mayor
Waters who will present it personally.

INTERVIEWS/APPOINTMENTS
TRAFFIC SAFETY COMMITTEE
Mayor Waters turned the meeting over to Vice Mayor Dalla.
Vice Mayor Dalla introduced applicant Mary L. Martin, 1527 E. 15th Street, National
City, who explained her interest in being appointed to the Traffic Safety Committee
and answered questions of the Council.

COMMITTEE FOR COMMUNITY HOUSING AND DEVELOPMENT
ACTION: Motion by Inzunza, seconded by Morrison, in favor of the
appointment of Aileane Roberts to the Committee for Housing & Community
Development. Carried by unanimous vote.
Motion by Inzunza, seconded by Zarate, in favor of the appointment of Daniel S.
Murphy to the Committee for Housing & Community Development. Carried by
unanimous vote.
Vice Mayor Dalla then requested that Aileane Roberts and Daniel S. Murphy come
forward to be sworn in as members of the Committee for Community Housing and
Development. Mr. Murphy was not present. The Oath of Office was administered and
a Certificate of Appointment presented to Aileane Roberts by City Clerk Lori Anne
Peoples.
Vice Mayor Dalla requested that when recommendations are made for appointment,
the letter state when the applicants were first appointed or how many terms they have
served as this will assist Council.
Vice Mayor Dalla then turned the meeting back over to Mayor Waters.
PUBLIC HEARING -
CONDITIONAL USE PERMITS 1993
1. SUBJECT: Public Hearing - Modification of Conditional Use Permit No. 1991-
13 to remove the limit on the number of live stage shows in a theater at 330
National City Boulevard. (Applicant: Juan Torres, Bay Theater) (Case File No.
CUP-1993-3).
NOTE: Notice of Public Hearing and Proof of Publication are on file in the
Office of the City Clerk.
RECOMMENDATION: Staff recommended City Council approve the
application based on the findings attached to the agenda.
TESTIMONY: Al Garcia, 22 E. 8th Street, National City, representing
the Chamber of Commerce; Applicant Juan J. Torres, 330 National City
Blvd., National City; Jesus Garcia, 11255 Del Diablo Street, San Diego;
Luis M. Torner, 8633 Lemon Ave., #1, La Mesa; Ruben Padilla, 1399
Valencia Loop, Chula Vista, representing the Mexican American
Insurance Agency; Pola Allen, 2487 Calle Quebrada, San Diego,
representing Puro Teatro Co. of San Diego; Lucy Roberts, 36 Date
Street, Chula Vista; Brian Plowman, 1132 Cloudwalk Canyon Drive,
Chula Vista; and Alfonso Hernandez, 2132 Euclid Avenue, National City,
all spoke in support of the Item.
Mike Keough, 340 National City Blvd., National City, representing
McMahan's Furniture, spoke in opposition -to the item, stating that a
middle ground was needed.
Cecilia Kirk, 311 E. 2nd Street, National City, spoke neither for nor
against the item, but expressed concern with lack of parking and
suggested the use of Roosevelt Avenue, and also the lack of crosswalks
in the area.

Mayor Waters declared the Public Hearing closed.
ACTION: Motion by Dalla, seconded by Inzunza, to approve the
application for modification of Conditional Use Permit with the
recommended conditions of approval 1 through 11 attached to the
Agenda. Carried by unanimous vote.
CONSENT CALENDAR
ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 93-61 through 93-
62). Motion by Dalla, seconded by Zarate, the Resolutions be adopted by title only.
Carried by unanimous vote.
CONTRACT
2. Resolution No. 93-61. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY DECLARING U-LINER WEST, INC. TO BE THE LOWEST
RESPONSIVE BIDDER AND AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT WITH U-LINER WEST, INC. FOR THE FY 1992-1993 SEWER
REHABILITATION AND REPAIR PROJECT. (ENGINEERING SPEC. NO. 93-
10)."
ACTION: Adopted. See above.

3. Resolution No. 93-62. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY AUTHORIZING THE INSTALLATION OF A RED CURB AT
THE NORTHWEST CORNER OF PALM AVENUE AND SIXTH STREET ON
PALM AVENUE."
ACTION: Adopted. See above.
NON CONSENT RESOLUTIONS
Motion by Dalla, seconded by Inzunza, the Non Consent Resolutions be introduced
by title only. Carried by unanimous vote.
CONTRACT
4. Resolution No. 93-63. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN
AMENDMENT TO AGREEMENT FOR COLLECTION OF RUBBISH AND TRASH
IN THE CITY OF NATIONAL CITY WITH EDCO DISPOSAL CORPORATION."
RECOMMENDATION: Staff recommended Council adopt the resolution.
NOTE: Mayor Waters noted for the record that he had received four letters in
opposition to the Resolution from: A. J. Moore, General Manager of Bay Cities
Services, Inc.; Jorge Holland, President of Pacific Disposal, Inc.; Gregg J. King
of Debris Box; and Dominick Di Vello, President of U.S. Refuse Services, Inc.
(copies on file in the Office of the City Clerk). He then read into the record the
letter from the president of U. S. Refuse Services, Inc.

TESTIMONY: Jack Moore, 1300 Wilson Avenue, National City,
representing Bay Cities Services, Inc.; Al Garcia, 22 E. 8th Street,
National City, representing the Chamber of Commerce; Tom Allott, 9974
Scripps Ranch Blvd., #227, San Diego, representing U.S. Refuse
Service, Inc.; Alfonso Hernandez, 2132 Euclid Avenue, National City;
George Lazaruk, 19912 Mace Street, Chula Vista, representing Pacific
Disposal; George Holland, 3030 Shelby Drive, National City,
representing Pacific Disposal; and Greg King, 1845 Logan Avenue, San
Diego, representing Debris Box, all spoke in opposition to the
Resolution.
Vice Mayor Dalla left the Council Chambers at 8:35 p.m.
ACTION: Motion by Morrison, seconded by Zarate, to hold action on
Agenda Item Nos. 4 and 7 and to have Staff bring back a report to
Council on June 22. 1993 regarding licensing requirements for all
haulers concerning roll -offs and construction debris. Carried by
unanimous vote. Absent: Dalla.
CONTRACT
5. Resolution No. 93-64. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT WITH THE COUNTY OF SAN DIEGO, PERTAINING TO
ESTABLISHMENT OF AN INTERIM SOLID WASTE COMMISSION, AND
PROVIDING FOR THE DISPOSAL OF SOLID WASTE ("INTERIM
AGREEMENT")."
RECOMMENDATION: Staff recommended Council adopt the resolution
authorizing the Mayor to sign Interim Agreement with County committing all
National City acceptable waste to County.
TESTIMONY: Jack Moore, 1300 Wilson Avenue, National City,
representing Bay Cities Services, Inc.; George Lazaruk, 19912 Mace
Street, Chula Vista, representing Pacific Disposal; George Holland, 3030
Shelby Drive, National City, representing Pacific Disposal; and Alfonso
Hernandez, 2132 Euclid Avenue, all spoke in opposition to the
Resolution.
ACTION: Motion by Morrison, seconded by Inzunza, for approval of the
agreement assigning 100% to the County. Carried by unanimous vote.
Absent: Dalla.

CITY MUNICIPAL CODE RELATING TO GARBAGE AND RUBBISH
DISPOSAL."
RECOMMENDATION: Staff recommended that the Ordinance be enacted.

public services.
TESTIMONY: Paul Rinks, 331 E. 29th Street, National City; Dolores

16th Street, National City; Jon Alva, 17 So. Kenton Street, National City;
Alfonso Hernandez, 2132 Euclid Avenue, National City; Emma Castillo,

National City, all spoke in opposition to cuts in public services.
ACTION: Motion by Morrison, seconded by Zarate, the item be filed.

NEW BUSINESS
WARRANT REGISTERS 1992
9. SUBJECT: Warrant Register No. 46. Ratification of Demands in the amount
of $176,935.48 (Warrant Nos. 126157 through 126245 inclusive excepting
none) and Certification of Payroll in the amount of $427,088.18.
RECOMMENDATION: Staff recommended ratification of these warrants.
ACTION: Motion by Zarate, seconded by Morrison, the demands be
ratified and the payroll certified. Warrants carried by the following vote,
to -wit: Ayes: Inzunza, Morrison, Zarate, Waters. Nays: None. Absent:
Dalla.
ZONE VARIANCE 1993
10. SUBJECT: Notice of Decision - Planning Commission Resolution No. 7-93
approving a zone variance to reduce the required exterior side yard setback
from 10 feet to 5 feet for an addition to a single-family residence at 1605 Orange
Street. (Applicant: Ramona Rodriguez) (Case File No. Z-1993-2).
RECOMMENDATION: Staff concurred with the Planning Commission
approval of the application and recommended that the Notice of Decision be
filed.
TESTIMONY: Elias Rodriguez, 1440 I Avenue, National City, spoke in
opposition to Conditions 1f and 7.
ACTION: Motion by Inzunza, seconded by Zarate to set a Public
Hearing for June 22. 1993. at 7:00 p.m. Carried by unanimous vote.
Absent: Dalla.
COUNCIL MEETINGS REGS/SCH ADMIN
11. SUBJECT: Post -Budget City Council Recess.
RECOMMENDATION: Staff recommended establishing a post -budget City
Council recess on the two Tuesdays falling on June 29 and July 6th, 1993.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Zarate, for approval of the
proposed recess. Carried by unanimous vote. Absent: Dalla.

CITY COUNCIL
Councilman Inzunza noted that the Hazardous Waste Hearing at Kimball School was
not properly noticed and requested that Councilman Morrison provide a brief verbal
status report, which he did.
Councilwoman Zarate announced that there was a meeting scheduled tomorrow
evening at the Multi Cultural Community Center from 6:30 to 9 p.m. by the Committee
to Reclaim Our Neighborhoods in National City and inquired as to who would be
attending.
PUBLIC ORAL COMMUNICATIONS
Everett Dickson, 2745 E. 14th Street, National City, made inquiry of the Neighborhood
Watch Program and how to establish a new one for his neighborhood.
Alfonso Hernandez, 2132 Euclid Avenue, National City, suggested the Kimball School
student winner of the Pollution Speech contest be invited to present his speech to the
City Council. Mr. Hernandez also stated that a city -owned lot on Rachael Avenue is
being used as a dumping ground again.
Mary Louise Martin, 1527 E. 15th Street, National City, expressed concerns with
potential cuts in public safety.
Cecilia Kirk, 311 E. 2nd Street, National City, made inquiry of who would be in
attendance at 6:30 p.m. at the Multi -cultural Community Center. Councilwoman Zarate
stated she would and Councilman Morrison said he would try.

Motion by Morrison, seconded by Zarate, to adjourn to the next Regular City Council
Meeting - June 8. 1993 - 7:00 P.M. - Council Chambers. Civic Center. Carried by
unanimous vote. Absent: Dalla.
