HomeMy WebLinkAbout1993 08-31 CC MINBook 75/Page 213 08/31/93 MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA AUGUST 31, 1993 The Adjourned Regular Meeting of the City Council of the City of National City was called to order at 3:05 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Bolint, Daniels, Eiser, McCabe, Post. SALUTE TO THE FLAG The meeting was opened with the salute to the flag led by City Manager, Tom G. McCabe. CIVIL SERVICE COMMISSION APPEALS Motion by Dalla, seconded by Morrison, the Resolution be approved by title only. Carried by unanimous vote. 1. Resolution No. 93-125. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DETERMINING THE APPEAL OF RICHARD MALLARD, PLUMBER." ACTION: Motion by Inzunza, seconded by Dalla, in favor of Resolution No. 93-125. Carried by unanimous vote. LABOR RELATIONS/POLICE OFFICERS' ASSOCIATION ADMIN 2. SUBJECT: Impasse Determination - National City Police Officers' Association. The business to be transacted at said meeting consists of the following: Impasse Resolution; Consideration of 1993-1994 Police Department Budget Issues, Including Wages and Benefits, Staffing Levels, and Layoffs, and Consideration of Adoption of Resolutions and Other Appropriate Actions. TESTIMONY: Everett Bobbitt, San Diego, attorney representing the National City Police Officers' Association, stated that the Association felt that the negotiation process had not been completed and that they were prepared to proceed. He then introduced Carey Sullivan. Book 75/Page 214 08/31/93 LABOR RELATIONS/POLICE OFFICERS' ASSOCIATION ADMIN TESTIMONY: (continued) Carey Sullivan, National City Police Officers' Association member, Post Office Box 63, National City, presented the Council and the Press with a handout (copy on file in the Office of the City Clerk) which summarized the negotiations between the Police Officers' Association and the City to date. He then made a verbal and poster -board presentation of the Summary, stating that the call to Impasse was premature and ill-advised and asked the Council to go back to the table and to take action to restore the laid -off officers. Mr. Bobbitt then stated that the Association was willing to take cuts and to work with the City to put the officers back to work. Personnel Director DeFratis stated that it is the City's team position that the POA failed to respond to the City's proposals for a 93/94 contract or present a counter proposal after 12 meetings and over three months at the table. These delays were unacceptable given the reduction in service to the public in the area of police protection, and impasse was the only real alternative for timely resolution of the matter. He stated that the Council had a copy of the City's final offer, which he believes to be fair under the circumstance, and this proposal is similar to the agreements with other groups. Antoinette Mendoza, 2218 E. 20th Street, National City, spoke neither for nor against the item, stating her concerns regarding the no/slow response by the Police Department to calls for assistance. Diane Salinas, 3703 Peach Blossom, National City, expressed her fear of going out after dark, and called for a quick resolution of the problem. Kathy Smith, 3028 E. 11th Street, National City, representing Citizens for Safety, expressed her concern that the citizens had become pawns between the City and the Police Department, and that National City has lost good officers. Russell Pinney, 2132 E. 1st Street, National City, spoke regarding his concerns about problems across from the park, slow/nor response from the Police Department, and stated that he was going to quit the Neighborhood Watch group because it doesn't do any good. In response to questions from Council, Personnel Director DeFratis stated that letters had been mailed to the ten officers who were laid off, and that every one was available to come back and would do so. City Manager Tom McCabe recommended that the Council act to bring back the officers and implement the agreement and continue bargaining issues from both the Police Officers' Association and the City and move forward. General Discussion ensued. Lanny Roark, President of the National City Police Officers' Association, 1200 National City Blvd., National City, urged the Council to bring back the officers and re-enter negotiations. Book 75/Page 215 08/31/93 LABOR RELATIONS/POLICE OFFICERS' ASSN ADMIN (continued) Mr. Bobbitt stated that it is illegal to impose the impasse and then bargain. City Attorney Eiser stated that bargaining could continue if the POA were willing, but since the POA was not willing, it would not be possible. ACTION: Motion by Dalla, seconded by Inzunza, to implement the City's last best offer regarding wages and benefits, and restore the officers. Councilman Morrison requested that the maker and second include in the motion to restore the rank of demoted officers. Amended motion carried by unanimous vote. Mayor Waters declared a recess. Council members left the Council Chambers at 4:32 p.m. Council members returned to the Council Chambers at 5:14 p.m. ROLL CALL Council members present: Dalla, Inzunza, Morrison, Zarate, Waters. LABOR RELATIONS/POLICE OFFICERS ASSN. ADMIN (continued) Motion by Morrison, seconded by Zarate, to approve Resolution No. 93-126 by title only. Carried by unanimous vote. Resolution No. 93-126. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING AND IMPLEMENTING THE LAST, BEST OFFER OF THE CITY OF NATIONAL CITY TO THE NATIONAL CITY POLICE OFFICERS' ASSOCIATION, AMENDING THE PRELIMINARY BUDGET OF THE POLICE DEPARTMENT, RECALLING ALL POLICE OFFICERS WHO WERE LAID OFF, AND RESTORING THE RANK OF- OFFICERS WHO WERE PREVIOUSLY DOWNGRADED." ACTION: Motion by Zarate, seconded by Dalla, for approval of Resolution No. 93-126. Carried by unanimous vote. PUBLIC ORAL COMMUNICATIONS Katie Filzenger, 1503 Law Street, San Diego, CA 92109, declined to speak at this time. Mayor Waters heard Public Oral Communications under Agenda Item No. 2. Book 75/Page 216 08/31/93 ADJOURNMENT Motion by Morrison, seconded by Zarate, to adjourn to the next Regular City Council Meeting - September 7. 1993 - 4:00 p.m. - Council Chambers. Civic Center.
