MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
DECEMBER 14, 1993
The Regular Meeting of the City Council of the City of National City was called to order
at 7:02 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Bolint, Daniels, Eiser, McCabe, Myers, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager Tom G.
McCabe, followed by the invocation by Vice Mayor Dalla.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Inzunza, the Minutes of the Regular Meeting of
December 7. 1993 be approved. Carried by unanimous vote.
NON CONSENT RESOLUTIONS
PARKING ADMIN 1993
1. Resolution No. 93-192. A "RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY AUTHORIZING THE INSTALLATION OF NO
PARKING TOW -AWAY SIGNS ON CITY -OWNED PROPERTY AT THE
NORTHEAST CORNER OF 20TH STREET AND "C" AVENUE."
TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue, National City,
made inquiry as to whether the decomposed granite that is on the
property will be removed.
ACTION: Motion by Inzunza, seconded by Dalla, for approval by title
only. Carried by unanimous vote.
ORDINANCES FOR INTRODUCTION
Motion by Morrison, seconded by Dalla, the Ordinances be introduced by title only.
Carried by unanimous vote.
MUNICIPAL CODE 1993
2. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY
AMENDING PORTIONS OF TITLE 3 OF THE NATIONAL CITY MUNICIPAL
CODE PERTAINING TO PERSONNEL, AMENDING ORDINANCE NOS. 916
AND 1441, AND AMENDING PORTIONS OF ORDINANCE NOS. 1023, 1076
AND 1943."

3. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY
ADDING SECTION 7.20.075 TO THE NATIONAL CITY MUNICIPAL CODE,
PERTAINING TO THE OUTDOOR DISPLAY OF GOODS OR MERCHANDISE."
ORDINANCES FOR ADOPTION
Motion by Dalla, seconded by Morrison, the Ordinance be adopted by title only.
Carried by unanimous vote.
MUNICIPAL CODE 1993
4. Ordinance No. 93-2070. "AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY AMENDING ORDINANCE NO. 1812 AND SECTION
7.18.100 OF THE NATIONAL CITY MUNICIPAL CODE, PERTAINING TO
SOLICITATION OF THE OCCUPANTS OF VEHICLES."
RECOMMENDATION: Staff recommend that Council enact the Ordinance.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, for adoption of
Ordinance No. 93-2070. Carried by unanimous vote.
WRITTEN COMMUNICATIONS
POLITICAL SUPPORT
5. SUBJECT: Letter from Joseph E. Leary asking the Council to request that a
study be done on the feasibility of FLOATPORT as an option for San Diego's
new airport.
TESTIMONY: Howard Blood, representing Float, Inc., 1660 Hotel
Circle North, San Diego, CA 92108, spoke in support of the request,
provided a hand-out to the Council (copy on file in the Office of the City
Clerk), and answered questions of the Council.
ACTION: No action taken.
NEW BUSINESS
WARRANT REGISTERS 1993
6. SUBJECT: Warrant Register No. 23. Ratification of Demands in the amount
of $277,665.98 (Warrant Nos. 128406 through 128487 inclusive excepting
none).
RECOMMENDATION: Staff recommended ratification of these warrants.
ACTION: Motion by Zarate, seconded by Morrison, for ratification of
demands. Warrants carried by the following vote, to -wit: Ayes: Dalla,
Inzunza, Morrison, Zarate, Waters. Nays: None. Abstaining: None.
CONDITIONAL USE PERMIT DENIALS 1993
7. SUBJECT: Notice of Decision - Planning Commission Resolution No. 17-93
denying a Conditional Use Permit application for an amusement arcade at 925
E. Plaza Boulevard, Suite D. Applicant: McKee Enterprises, Inc., D.B.A. Electric
Castle's Wunderland. Case File No. CUP-1993-9.

RECOMMENDATION: Staff concurred with the decision of the Planning
Commission to deny the application and recommended that the Notice of
Decision be filed.
TESTIMONY: None.
ACTION: Motion by Della, seconded by Inzunza, the Notice of Decision
be filed. No objection as filed.
CONDITIONAL USE PERMIT DENIALS 1993
8. SUBJECT: Notice of Decision - Planning Commission Resolution No. 16-93
denying Conditional Use Permit and Coastal Development Permit applications
for a cellular communications facility with a 60 foot monopole at 2150 McKinley
Avenue. Applicant: Pactel Cellular. Case File Nos. CUP-1993-8/CDP-1993-2.
RECOMMENDATION: Staff concurred with the decision of the Planning
Commission to deny the application and recommended that the Notice of
Decision be filed.
TESTIMONY: None.
ACTION: Motion by Dalla, seconded by Morrison, the Notice of
Decision be filed. No objection as filed.
ZONING
9. SUBJECT: Notice of Decision - Planning Commission Resolution No. 18-93
approving a request for exception to flood proofing requirements for property
located at the southwest corner of Highland Avenue and State Route 54.
Applicant: Stuart Engineering for Nu -Western Development Co.
RECOMMENDATION: Staff concurred with the decision of the Planning
Commission to approve the request and recommended that the Notice of
Decision be filed.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison the Notice of
Decision be filed. No objection as filed.
STREET MAINTENANCE ADMIN
10. SUBJECT: Report regarding Development Plan and required street
improvements for Thelma Way property -- Mr. Cuevas.
RECOMMENDATION: Staff recommended that Council require all standard
Engineering requirements.
TESTIMONY: Miguel Cuevas, 24 S. Drexel Avenue, National City,
requested clarification of the report. He was provided publicly with a
copy of all the reports and Council Agenda Statements on the plan to
date, and City Engineer Myers gave a brief verbal explanation of the
Thelma Way Development Plan.
ACTION: Consensus of the Council was to bring this item back to the
Council next week to allow Mr. Cuevas time to review the reports.

OTHER STAFF - No report.
MAYOR
Mayor Waters introduced the Port Commissioner from National City, Jess Van
Deventer, 1706 Prospect Avenue, National City, who gave a brief verbal summary of
the progress on the National City Marina, the agreement between the Port District and
the City for Fire and Police Services, the paving of Berth 24-2 & 3, the funding of major
CIP projects, preliminary plans for signing for Port properties, landscaping, and the
Energy Plant on 14th and Tidelands. He stated that the new board on the Port
Commission is very positive and that a lot of projects are planned in the future for the
South Bay. Councilwoman Zarate made inquiry regarding the progress of the USIAA
project. Mr. Van Deventer stated that all the papers have been signed and delivered
to the Port.
CITY COUNCIL
Vice Mayor Dalla stated that the sign on northbound Highway 5 directs motorists to
exit on Civic Center Drive for the San Diego Convention Center, but that at the bottom
of the off -ramp there is no further direction to the Convention Center. He also referred
to Staff that Division Street, East from Highway 805 to North "U" Avenue is very dark at
night, and with the empty lot on the south side, there is a need for lighting.
Councilwoman Zarate reminded everyone that there is a Committee to Reclaim Our
Neighborhoods meeting at the National City Community Center tomorrow night,
December 15, 1993, at 7 p.m. which will include a program by San Diego City
School's Chief of Police Alex Rascon, Jr. on Zero Tolerance.
PUBLIC ORAL.. COMMUNICATIONS
Alfonso Hernandez, 2132 Euclid Avenue, National City, commented on the San Diego
Union -Tribune article regarding the National City Graffiti Program, and also reported
that the storm drain at Civic Center Drive and Cleveland Avenue is clogged.
John Kirk, 311 E. 2nd Street, National City, declined to speak at this time.
Cecilia Kirk, 311 E. 2nd Street, National City, declined to speak at this time.
Luis Molina, 908 Melrose Avenue, Chula Vista, contractor for Mr. Miguel Cuevas,
made inquiry of the Council regarding the Thelma Way Development Plan, and was
invited to return to next week's Council meeting, when this item will be on the Agenda
again.
CLOSED SESSIONS
CLOSED SESSION FOR PENDING LITIGATION UNDER GOVERNMENT
CODE SECTION 54956.9(a) - CITY OF NATIONAL CITY, ET AL v.
COUNTY OF SAN DIEGO (BOOKING FEES LITIGATION)
Motion by Zarate, seconded by Morrison, in favor of holding the Closed Session
under Government Code Section 54956.9(a). Carried by unanimous vote.
Council Members left.the Council Chambers at 8:07 p.m.
Council Members returned to the Council Chambers at 8:27 p.m.

Motion by Inzunza, seconded by Dalla, to dispense with the next Regular City Council
Meeting - December 21. 1993 - 4:00 p.m. and adjourn to the Adjourned Meeting -
December 21. 1993 - 2 p.m. - Council Chambers. Civic Center. Carried by
unanimous vote.
The meeting closed at 8:35 p.m.
