MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
MARCH 5. 1991
The regular meeting of the City Council of the City of National
City was called to order at 4:02 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Van Deventer, Zarate,
Waters.
Administrative officials present: Bolint, Eiser, McCabe, Myers.
Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City
Manager, Tom G. McCabe, followed by the invocation by Councilman
Dalla.
APPROVAL OF MINUTES
Motion by Van Deventer, seconded by Dalla, the minutes of the
regular meeting of February 19, 1991 be approved. Carried by
unanimous vote.
MAYOR'S APPOINTMENTS
BOARDS AND COMMISSIONS
SUBJECT: Clean Water Program Governance Advisory Group
RECOMMENDATION: It is the intention of the Mayor to
appoint Rosalie Zarate as an alternate to the Clean Water
Program Governance Advisory Group.
ACTION: Motion by Van Deventer. seconded by Dalla. in
favor. Carried by unanimous vote.
Item No. 27 was heard at this time.
TEMPORARY USE PERMIT
27. SUBJECT: The Martinez Family Community Fund Raiser.
RECOMMENDATION: Staff recommends the Council approve use
of facility and sale of alcohol in Park area. Waiver of
fees at Council discretion.
ACTION: Motion by Van Deventer, seconded by Inzunza,
in favor. Carried by unanimous vote.

TEMPORARY USE PERMIT (Continued)
TESTIMONY: Fred Pruitt, 2414 E. 19th Street. National
City noted that the service of alcoholic beverages was
not noted on the application, however he had provided
the Risk Manager with the proper Insurance coverage.
Kassia Kossyta. Risk manager, noted that Mr. Pruitt had
provided the appropriate insurance for the event
including liquor liability so the fee waiver instead of
reading $495.34 should be $269.96.
ACTION: Motion by Inzunza, seconded by Zarate, to
include the liguor. Carried by unanimous vote.
PROCLAMATIONS
Moved by Van Deventer, seconded by Dalla, they be accepted by
title only. Carried by unanimous vote.
The Proclamation proclaiming March 10-16, 1991 to be: "EMPLOY THE
OLDER WORKER WEEK," was read aloud in full by Mayor Waters who
gave it to the City Manager to send to the appropriate people.
The Proclamation proclaiming April 1 through April 7. 1991 to be:
"NATIONAL COMMUNITY DEVELOPMENT WEEK" was read aloud in full by
Mayor Waters who presented it to Arnold Peterson„ Executive
Director of the National City Community Development Commission.

CONSENT RESOLUTIONS (Resolution Nos. 91-24 through 91-36).
Councilman Van Deventer requested that Item No. 7 (Resolution No.
91-30) be pulled. Motion by Van Deventer, seconded by Dalla, in
favor (except Resolution No. 91-30). Carried by unanimous vote.

CASSIDY AND FRIERSON TO PROVIDE CONSULTING.
REPRESENTATIONAL. AND LEGAL SERVICES PERTAINING TO

PARKING ADMINISTRATION 1991
7. Resolution No. 91-30. "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE INSTALLATION
OF RED CURB ON TRANSPORTATION AVENUE SOUTH OF 28TH
STREET."
TESTIMONY: Edgar Monroy, Traffic Engineer, answered
Councils' questions.
ACTION: Motion by Van Deventer, seconded by Inzunza,
in favor of Resolution No. 91-30. Carried by unanimous
vote.
NON -CONSENT RESOLUTIONS
Motion by Dalla. seconded by Van Deventer. they be_acceeted_by
title only. Carried by unanimous vote.
PARKING ADMINISTRATION 1991
14(a) Resolution No. 91-37. "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE INSTALLATION
OF RED CURB ON TRANSPORTATION AVENUE BETWEEN 24TH STREET
AND 25TH STREET."
RECOMMENDATION: Staff recommends approving the lease
agreement for 112 W. 24th Street and adopt the
resolutions.

CONTRACT
14(b) Resolution No. 91-38. "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO
EXECUTE A LEASE WITH SOUTHPORT OFFICE PARK FOR A POLICE
DEPARTMENT ANNEX."
RECOMMENDATION: See above, Resolution No. 91-38.
TESTIMONY: Police Chief Knee and Assistant Police
Chief Fowler explained the events which lead to these
Agenda items, inclusive of cost comparison charts.
Robert Thomas, 1625 Sweetwater Road, National City,
stated he had prepared a new lease agreement to match
the Southport Office Park lease.
Robert Zolezzi, a representative of Collins Development
Co., Southport Office Park. 212 W. 24th Street.
National City, spoke to the issue and answered
Councils' questions.
ACTION: Motion by Inzunza, seconded by Van Deventer.
to lay this item over to Friday, March 8, 1991 at 3:00
p_m. Sealed bid packages are to be turned in to the
City Manager and the City Attorney by 10:00 a.m.
Thursday, March 7, 1991. Carried by the following
vote, to -wit: Ayes: Inzunza, Van Deventer, Zarate,
Waters. Nays: Dalla.
ORDINANCES FOR ADOPTION
Motion by Inzunza, seconded by Dalla, the Ordinance be read by
title only. Carried by unanimous vote.
ZONING 1991
15. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL
CITY AMENDING TITLE 18 (ZONING) OF THE NATIONAL CITY
MUNICIPAL CODE REGARDING THE RETAIL SALE OF SEAFOOD."
RECOMMENDATION: Staff recommends adopting the Ordinance.
ACTION: Motion by Van Deventer, seconded by Zarate,
for adoption. Carried by unanimous vote.
NEW BUSINESS
WARRANT REGISTERS 1990
16. SUBJECT: Warrant Register No. 34. Ratification of
Demands in the amount of $367.948.66 (Warrant Nos. 114912
through 115021 inclusive excepting none), and
Certification of Payroll in the amount of $458,591.84.
RECOMMENDATION: Staff recommends the warrants be ratified
and the payroll certified.
ACTION: Motion by Van Deventer, seconded by Inzunza,
in favor. Warrants carried by the following vote, to -
wit: Ayes: Dalla, Inzunza, Van Deventer, Zarate,
Waters. Nays: None.

17. SUBJECT: Warrant Register No. 35. Ratification of
Demands in the amount of $665,924.61 (Warrant Nos. 115023
through 115104 inclusive excepting none).
RECOMMENDATION: Staff recommends the warrants be
ratified.
ACTION: Motion by Van Deventer. seconded by Inzunza,
for approval. Warrants carried by the following vote,
to -wit: Ayes: Dalla, Inzunza, Van Deventer. Zarate,
Waters. Nays: None.
CLAIM(S) FOR DAMAGES AGAINST THE CITY
18. SUBJECT: Claim for Damages: McMillin Development, Inc.
RECOMMENDATION: Staff recommends denying and referring to
the City Attorney.
ACTION: Motion by Van Deventer. seconded by Della, to
deny and refer to the City Attorney. Carried by
unanimous vote.
19. SUBJECT: Claim for Damages: Vonnie L. McMillin and Macey
L. McMillin.
RECOMMENDATION: Staff recommends denying and referring to
the City Attorney.
ACTION: Motion by Van Deventer, seconded by Inzunza,
to deny and refer to the City Attorney.. Carried by
unanimous vote.
LIQUOR LICENSE APPLICATIONS
ALCOHOLIC BEVERAGE LICENSE
20. SUBJECT: Type 20 - Original License - 2240 East Plaza
Boulevard, Suite H. Type 20 Liquor License is an off -sale
beer and wine license which authorizes the sale of beer
and wine for consumption off the premises where sold.
RECOMMENDATION: Police. Planning and Building Departments
state no objections.
ACTION: Moved by Van Deventer, seconded by Della. for
denial. ---
Second by Della withdrawn. Motion died for lack of
second.
ACTION: Motion by Waters, seconded by Dalla, for
approval. Carried by the following vote. to -wit:
Ayes: Dalla, Inzunza, Zarate, Waters. Nays: Van
Deventer.
ALCOHOLIC BEVERAGE LICENSE
21. SUBJECT: Type 20 - Original License - 303 Highland
Avenue. Type 20 Liquor License is an off -sale beer and
wine license which authorizes the sale of beer and wine
for consumption off the premises where sold.

ALCOHOLIC BEVERAGE LICENSE (Continued)
RECOMMENDATION: Building Department states no objections.
Planning Department sent a protest letter to ABC. Police
Department protests the issuance of an Alcoholic Beverage
Control License until such time the applicant obtains a
valid Conditional Use Permit from the City of National
City Planning Department.
ACTION: Moved by Dalla, seconded by Van Deventer, to
protest the license. Carried by unanimous vote.
ALCOHOLIC BEVERAGE LICENSE
22. SUBJECT: Type 41 - Annual Renewal - 2414 Hoover Avenue.
Type 41 Liquor License is an on -sale beer and wine license
which authorizes the sale of beer and wine for consumption
on a bona fide public eating place type premises plus the
sale of beer and wine for consumption off the premises
where sold.
RECOMMENDATION: Police, Planning and Building Departments
state no objections.
ACTION: Moved by Dalla, seconded by Inzunza, this item
be filed. No objection as filed.
ALCOHOLIC BEVERAGE LICENSE
23. SUBJECT: Type 41 - Stock Transfer - 1430 E. Plaza
Boulevard, Suite 10 & 11. Type 41 Liquor License is an
on -sale beer and wine license which authorizes the sale of
beer and wine for consumption on a bona fide public eating
place type premises plus the sale of beer and wine for
consumption off the premises where sold.
RECOMMENDATION: Police, Planning and Building Departments
state no objections.
ACTION: Moved by Dalla, seconded by Inzunza, this item
be filed. No objection as filed.
WRITTEN COMMUNICATIONS
LAW ENFORCEMENT
24. SUBJECT: Letter from Roberto L. Martinez„ Director of the
American Friends Service Committee.
RECOMMENDATION: None.
TESTIMONY: Roberto L. Martinez, 1245 Highland Avenue,
San Diego, addressed his concerns with the Police
Department.

OTHER BUSINESS
PARKING ADMINISTRATION 1991
25. SUBJECT: Appeal of the Traffic Safety Committee's
decision to not take any action on Price Club Industries
request for red curb.
RECOMMENDATION: Staff recommends posting "No Truck
Parking" signs as shown on the diagram.
ACTION: Motion by Dalla, seconded by Van Deventer, in
favor of the "No Truck Parking" signs as recommended by
Staff. Carried by unanimous vote.
NATIONAL CITY TRANSIT IMPROVEMENT PROGRAM
26. SUBJECT: Report on the installation of bus shelters in
National City by the Metropolitan Transit Development
Board.
RECOMMENDATION: Staff recommends receive and file the
report.
ACTION: Motion by Van Deventer, seconded by Dalla, to
receive and file. No objection as filed.
This Item was heard at an earlier time. after Mayor's
Appointments.

MAYOR -
Mayor Waters read into the record a letter from Maria Guadagnino
thanking the Mayor. Council and Engineering Department for their
assistance in helping her obtain a Handicapped parking space for
her husband. Copy on file in the Office of the City Clerk.
Mayor Waters gave an update on the Port District Meeting.
National City Bayfront Item. which was laid over for
consideration of the Port District Staff study, to let the City
of National City use the 20 acre Bayfront property for 15-20
years.

PUBLIC ORAL COMMUNICATIONS -
Fred Creveling, Manager of Inter -City Manor, 2101 'L' Street.
National City. low income HUD Housing Project spoke regarding the
National City Newsletter water article and his dilemma in dealing
with the County Water Authority. Sweetwater Authority. and the
State for reimbursement on installation of low water toilets and
requested the Councils' assistance.

Motion by Van Deventer, seconded by Dalla, the meeting_be
adjourned to the Adjourned Meeting - March 8. 1991 - 3:00 p.m.
Council Chambers. Civic Center. Carried by unanimous vote.
The next regular City Council Meeting with be held Tuesday, March
12, 1991 - 7:00 p.m.
The meeting closed at 6:26 p.m.
