CALIFORNIA APRIL 9. 1991 The regular meeting of the City Council of the City of National City was called to order at 7:00 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. Administrative officials present: Berkuti, Eiser, McCabe, Peoples. Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager, Tom G. McCabe. followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Dalla, seconded by Inzunza, the minutes of the regular meeting of April 2. 1991 be approved. Carried by the following vote to -wit: Ayes: Dalla, Inzunza, Zarate, Waters. Nays: None. Abstaining: Van Deventer. Motion by Dalla, seconded by Inzunza, for reconsideration/correction of previously approved minutes of the regular meeting of March 26. 1991. Carried by unanimous vote. MAYORS PRESENTATIONS National School District Presentation to Mayor and Council. Mayor Waters introduced Larry Tagle, President of the National School District Governing Board and recognized Board Members, Rosie Alvarado, Frank Perez and Charlotte Webster who were present in the audience. Larry commended the Mayor and the City Council for their continual support of the School District and presented them with appreciation plaques. One was also presented to CDC Director Arnold Peterson. Book 73/Page 90 4/9/91 INTERVIEWS/APPOINTMENTS BOARDS AND COMMISSIONS BUILDING ADVISORY AND APPEALS BOARD Mayor Waters turned the meeting over to Vice Mayor Inzunza who stated there were two vacancies and the Mayor had recommended that Raymond Duke and Roy Fierro be re -appointed. ACTION: Motion by Van Deventer. seconded by Dalla, in favor of the Mayor's recommendation. Carried by unanimous vote. PARK AND RECREATION ADVISORY BOARD Vice Mayor Inzunza stated that there is a vacancy for a partial term ending March 31, 1992, and the Mayor had recommended Howard Schwitkis be appointed. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor of the Mayor's recommendation. Carried by unanimous vote. PLANNING COMMISSION Vice Mayor Inzunza stated that there were a number of applicants for the opening of Planning Commissioner. He then distributed ballots to the Mayor and Council. Votes were cast and the ballots passed to the City Clerk who read the results: Chuck Howery - 2 votes, Elizabeth Toy - 1 vote, Don Sauter - 1 vote, Peter Flores - 1 vote. No one met the 3 required votes for a majority and a second set of ballots were distributed to the Mayor and Council. The second vote results were: George Baca. - 4 votes, Elizabeth Toy - 1 vote. Vice Mayor Inzunza declared that George Baca was the Planning Commissioner and turned the meeting back over to Mayor Waters. PUBLIC HEARINGS STREET VACATION 1. SUBJECT: Public Hearing - Vacation of an unimproved portion of "N" Avenue north of 28th Street. (Applicant: City of National City) (Case File No. SC-1-90) Affidavit of Mailing and Proof of Publication and Posting are on file in the Office of the City Clerk. RECOMMENDATION: Staff concurs with the recommendation of the Planning Commission that the area be vacated based on the attached findings and condition for approval. TESTIMONY: Jerry Oliver, 2805 "N" Avenue spoke in favor of the proposed vacation. ACTION: Mayor Waters declared the Public Hearing Closed. Motion by Van Deventer. seconded by Inzunza, in favor of Staffs recommendation and the Planning Commission for approval. Carried by unanimous vote. Book 73/Page 91 4/9/91 ABATEMENT WEED 1990 2. SUBJECT: Public Hearing - 1990 Weed Abatement. RECOMMENDATION: Staff recommends considering any written or oral protests or objections to the Report and Account. Approve the Report and Account. TESTIMONY: Gareth Walker, 448 Blackthorne St., El Cajon. part owner of Parcel No. 557-380-12, spoke in opposition to the assessment. Ron Osborne, City Contractor, answered Councils' questions. Wilfrido Naval. 427 Shell Avenue, National City, a representative of Pacific Islanders Partnership spoke regarding Parcel No. 557-220-11 and the financial problems of the partnership and requested a compromise on the bill to $1,000. Mrs. L. E. Morrison, 3220 Dolen Avenue, Bonita, Parcel No. 563-184-40 spoke regarding her property at 32nd and Shelby and in opposition to the assessment amount. ACTION: Mayor Waters declared the Public Hearing closed. Motion by Van Deventer, seconded by Dalla, for approval of the report and to overrule any oral protests in accordance with the report. Carried by the following vote, to -wit: Ayes: Dalla, Van Deventer, Zarate, Waters. Nays: Inzunza. NEW BUSINESS WARRANT REGISTERS 1990 3. SUBJECT: Warrant Register No. 40. Ratification of Demands in the amount of $159,314.33 (Warrant Nos. 115595 through 115674 inclusive excepting none) and Certification of Payroll in the amount of $442,806.00. RECOMMENDATION: Staff recommends the warrants be ratified and the payroll certified. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. WRITTEN COMMUNICATIONS TEMPORARY USE PERMIT 4. SUBJECT: Letter from the Department of the Army requesting temporary use of Port District Land as a temporary coordination point for vehicles, equipment, and materials being redeployed from "Operation Desert Storm." RECOMMENDATION: None. Book 73/Page 92 4/9/91 WRITTEN COMMUNICATIONS (Continued) TESTIMONY: LTC. Clark C. Hall. Commander, Military Traffic Management Command, Southern California Outpost for the Department of the Army, answered Councils' questions. ACTION: Motion by Van Deventer. seconded by Waters, for approval. Maker and second agreed to amend the motion to include assessing the Port District for the Public Streets usage for wear and tear and add control of the hours of usage. Carried by unanimous vote. OTHER BUSINESS CONDITIONAL USE PERMIT 5. SUBJECT: Notice of Decision - Planning Commission Resolution No. 12-91 denying a Conditional Use Permit for the sale of beer and wine within a convenience store at 101 N. Highland Avenue. Suite A. (Applicant: Glen Volmer, West Coast Cafes) (Case File No. CUP-1991-2). RECOMMENDATION: Staff concurs with the Planning Commission decision and recommends the Notice of Decision be filed. ACTION: Motion by Dalla, seconded by Van Deventer, the Notice of Decision be filed. No objection as filed. PLANNED DEVELOPMENT PERMIT 6. SUBJECT: Notice of Decision - Planning Commission Resolution No. 11-91 approving a Planned Development Permit for construction of six townhouse apartments at 3348 Cypress Avenue. (Applicant: Robert Thompson) (Case File No. PD-9-90). RECOMMENDATION: Staff concurs with the Planning Commission decision and recommends the Notice of Decision be filed. ACTION: Motion by Van Deventer. seconded by Dalla, this item be filed. No objection as filed. CITY MANAGER - No report. CITY ATTORNEY - City Attorney Eiser stated that the Mayor and Council had received a letter from the Lee Mather Realty Co. for the Delgado Terrace, inviting them to attend a meeting to discuss various problems and issues affecting the City. He suggested that in order to avoid a potential violation of the Brown Act, that 2 members of the Council be appointed to attend or request a representative of the Homeowners Association bring the concerns to a Council Meeting and handle it as an Agenda item. It was the consensus of the Council to have the City Attorney contact the representatives and have them bring their concerns to the Council. (Copy on file in the Office of the City Clerk). Book 73/Page 93 4/9/91 OTHER STAFF - No report. MAYOR - Mayor Waters stated that on Tuesday. April 16th at 10:00 a.m. the National City Police Department will have a demonstration of the new Photo Radar Program. Photo Radar will be operational in the City a minimum of 30 hours per week. Mayor Waters inquired into the "Trash Enclosure" citation increase and the decrease in calls concerning abandoned vehicles,. Planning Director Post explained the reasons behind these occurrences. CITY COUNCIL - No report. PUBLIC ORAL COMMUNICATIONS - Ron Morrison. 1233 Harbison. National City, inquired as to why a courtesy notice could not be sent via direct mail to the property owner in addition to the Certified notice. City Clerk Peoples noted that this is the current practice with Public Hearing Notices. Mr. Morrison addressed concerns with the Graffiti Program and was provided a copy of the latest progress report. Mayor Waters read into the record the statistics of the latest Graffiti report, (Copy on file in the Office of the City Clerk). ADJOURNMENT Motion by Van Deventer, seconded by Zarate. the meeting be adjourned to the Next Regular City Council Meeting - April 16, 1991 - 4:00 p.m. Council Chambers, Civic Center.
