CALIFORNIA APRIL 16. 1991 The regular meeting of the City Council of the City of National City was called to order at 4:00 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers. Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager. Tom G. McCabe, followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Van Deventer. seconded by Zarate, the minutes of the regular meeting of April 9. 1991 be approved. Carried by unanimous vote. Mayor Waters requested a deviation from the Agenda and presented Councilwoman Zarate with her Official Badge. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 91-61 through 91- 64). Motion by Van Deventer. seconded by Inzunza, for approval. Carried by unanimous vote. BUDGET TRANSFER 1990 1. Resolution No. 91-61. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE APPROPRIATION ANDi TRANSFER OF FUNDS FOR THE FACILITIES MAINTENANCE DIVISION." Adopted. See above. Book 73/Page 95 4/16/91 TRAFFIC STREET MARKINGS 2. Resolution No. 91-62. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE ESTABLISHMENT OF ONE-WAY TRAFFIC FLOW WESTBOUND ON A SECTION OF 9TH STREET, EAST OF PARADISE DRIVE." Adopted. See above. GRANT/LAW ENFORCEMENT 3. Resolution No. 91-63. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CHIEF OF POLICE TO SUBMIT AN APPLICATION FOR GRANT FUNDS TO THE OFFICE OF CRIMINAL JUSTICE PLANNING AND TO UTILIZE THE GRANT AWARD FOR LAW ENFORCEMENT PURPOSES." Adopted. See above. CONTRACT 4. Resolution No. 91-64. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING DALEY CORPORATION TO BE THE LOWEST RESPONSIVE BIDDER AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH DALEY CORPORATION FOR THE WIDENING OF EUCLID AVENUE FROM 20TH TO 22ND STREETS." (Engineering Spec. No. 1033). Adopted. See above. NON -CONSENT RESOLUTIONS Motion by Van Deventer. seconded by Dalla, it be accepted by title only. Carried by unanimous vote. CONTRACT 5. Resolution No. 91-65. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A JOINT POWERS AGREEMENT BY AND BETWEEN THE CITY OF NATIONAL CITY AND THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF NATIONAL CITY." RECOMMENDATION: Staff recommends adopting the Resolution. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor of Resolution No. 91-65. Carried by unanimous vote. ORDINANCES FOR ADOPTION ZONING 1991 Motion by Van Deventer, seconded by Inzunza, they be accepted by title only. Carried by unanimous vote. 6. "AN ORDINANCE REZONING CERTAIN PROPERTY PURSUANT TO THE LAND USE CODE FROM CL TO RS-2 AT THE SOUTHWEST CORNER OF MORNING BREEZE LANE AND LANOITAN AVENUE." (Applicant: SRT Engineering) (Case File Nos. GP-1991-2, ZC-1991-1). RECOMMENDATION: Staff recommends adopting the Ordinance. NOTE: Councilman Dalla stated he would be abstaining as his sister owns the property. ACTION: Motion by Van Deventer, seconded by Inzunza. for approval of Ordinance No. 91-2005. Carried by the following vote. to -wit: Ayes: Inzunza, Van Deventer. Zarate, Waters. Nays: None. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING THE LCP AND REZONING CERTAIN REAL PROPERTY FROM 0S-CZ TO ML-PD-CZ AT THE NORTHWEST CORNER OF NATIONAL CITY BOULEVARD AND 33RD STREET." (Applicant: Thomas Moynahan. Jr.) (Case File Nos. GP-3-90, ZC-12-90, LCP-1991-1). RECOMMENDATION: Staff recommends adopting the Ordinance. NOTE: Councilman Van Deventer stated he would be abstaining as this property is in close proximity to Item No. 8 and one of his employees is a partner in the project. ACTION: Motion by Inzunza, seconded by Zarate, for approval of Ordinance No. 91-2006. Carried by the following vote. to -wit: Ayes: Dalla, Inzunza, Zarate, Waters. Nays: None. Abstaining: Van Deventer. ZONING 1991 8. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING THE LCP AND REZONING CERTAIN REAL PROPERTY FROM OS -CZ TO CA-PD-CZ AT THE SOUTHWEST CORNER OF NATIONAL CITY BOULEVARD AND 33RD STREET." (Applicant: Kada II Partnership) (Case File Nos. GP-2-90, ZC-11-90, LCP-1991-1) RECOMMENDATION: Staff recommends adopting the Ordinance. NOTE: Councilman Van Deventer stated he would be abstaining on this item as one of his employees is a partner in this project. ACTION: Motion by Dalla. seconded by Inzunza. for approval of Ordinance No. 91-2007. Carried by the following vote. to -wit: Ayes: Dalla, Inzunza, Zarate. Waters. Nays: None. Abstaining: Van Deventer. OLD BUSINESS POLICE FACILITY PROPOSED 9. SUBJECT: National City Police Facility Progress Report. RECOMMENDATION: Staff recommends receiving Council direction. TESTIMONY: Ron Morrison. 1233 Harbison Avenue. National City, expressed concerns with what might be underground on the proposed site. ACTION: Motion by Van Deventer, seconded by Inzunza, the City Manager and Staff to move forward on the movement of the Police Facility across the street. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1990 10. SUBJECT: Warrant Register No. 41. Ratification of Demands in the amount of $162.255.67 (Warrant Nos. 115676 through 115763 inclusive excepting none). Book 73/Page 97 4/16/91 NEW BUSINESS (Continued) RECOMMENDATION: Staff recommends the warrants be ratified. ACTION: Motion by Inzunza. seconded by Van Deventer, in favor. Warrants carried by the following vote. to -wit: Ayes: Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. CLAIM(S) FOR DAMAGES AGAINST THE CITY CLAIM GALEANO DELFIA 11. SUBJECT: Claim for Damages: Delfia Galeano. RECOMMENDATION: Staff recommends denying and referring to the City Attorney. ACTION Motion by Van Deventer. seconded by Inzunza, to deny and refer to the City Attorney. Carried by unanimous vote. CLAIM AGUILLARD JOSEPH 12. SUBJECT: Claim for -Damages:- Joseph Aguillard, RECOMMENDATION: Staff recommends denying and referring to the City Attorney ACTION: Motion by Van Deventer, seconded by Inzunza, to deny and refer to the City Attorney. Carried by unanimous vote. CLAIM WHEELER. WIMER. BLACKMAN & ASSOCIATES 13. SUBJECT: Claim for Damages: Wheeler, Wimer. Blackman & Associates. RECOMMENDATION: Staff recommends denying and referring to the City Attorney. ACTION: Motion by Van Deventer,• -seconded by Inzunza, to deny and refer to the City Attorney. Carried by unanimous vote. WRITTEN COMMUNICATIONS TRAFFIC SPEED CONTROL 14. SUBJECT: Letter from Will T. Hill concerning "Speed Humps" on Palm and Stockman Streets. TESTIMONY: The City Engineer provided Council with an update on the implementation of "Speed Humps" on Stockman. They are to be bid in May, awarded in June and construction in August or September. Will T. Hill. 3306 Stockman requested "Speed Humps" at the stop sign of Stockman by the Shopping Center and also at Alston and Newberry. Book 73/Page 98 4/16/91 WRITTEN COMMUNICATION (Continued) Edgar Monroy, Traffic Engineer answered Councils' questions and explained where the "Speed Humps" will be located. Ron Morrison. 1233 Harbison, National City spoke regarding the closure of Cagle Street. ACTION: Motion by Van Deventer. seconded by Inzunza, to approve the installation of 4 "Speed Humps", additional potential locations to be reviewed by Staff, the results to be brought back to Council. Carried by unanimous vote. POLITICAL SUPPORT 15. SUBJECT: Letter from Alan G. Herridge concerning a Sovereignty Advisory Petition to Congress. TESTIMONY: Alan G. Herridge, 5369 Balboa Avenue, San Diego. requested the Councils' support on the "Sovereignty Advisory Petition to Congress" and provided handouts to the Council explaining same. (Copy on file in the Office of the City Clerk). OTHER BUSINESS COMMUNITY PROMOTION 16. SUBJECT: Maytime Band Review. City Entry. RECOMMENDATION: Staff recommends approving as submitted. ACTION: Motion by Van Deventer, seconded by Dalla, in favor. Carried by unanimous vote. TRAFFIC SAFETY COMMITTEE 17. SUBJECT: Report of the Traffic Safety Committee Meeting of December 12, 1991. RECOMMENDATION: Staff recommends receiving and filing the unapproved minutes (due to lack of quorum). NOTE: The City Clerk noted the date should read December 12, 1990. ACTION: Motion by Van Deventer, seconded by Dalla, to receive and file. No objection as filed. TRAFFIC SAFETY COMMITTEE 18. SUBJECT: Report of the Traffic Safety Committee Meeting of February 13, 1991. RECOMMENDATION: Staff recommends receiving and filing the approved minutes. ACTION: Motion by Van Deventer. seconded by Inzunza, to receive and file. No objection as filed. Book 73/Page 99 4/16/91 CITY MANAGER - City Manager McCabe noted that he and the Public Works Director were ready to discuss the sewage impact problems with the City Council. An item will be put on next weeks' Agenda in accordance with policy, setting a Workshop for Wednesday, May 1st at 3:30 p.m. CITY ATTORNEY - No report. OTHER STAFF - Police Chief Knee stated that "good vibrations" were received in support of the new Photo Radar Program that was put into effect today. MAYOR - Mayor Waters read into the record a letter from Russ Hamm, Project Director of Project Read, thanking the City Council and the Community Development Commission for their support of the adult literacy program and block grant funds. (Copy on file in the Office of the City Clerk). Mayor Waters read into the record a letter from the National City Lions Club thanking the Mayor and Council for money to be used for the fireworks display on July 4th in Kimball Park. (Copy on file in the Office of the City Clerk). Mayor Waters read into the record a letter he had prepared on the usage of water for National City from the Loveland and Sweetwater Reservoirs and the wells. The right of the public to use the wells is controlled by an agreement National City made before Sweetwater Authority took control. The City has the right to control the usage at the two spickets. (Copy on file in the Office of the City Clerk). CITY COUNCIL - 19. SUBJECT: Further discussion of Delgado Terrace. Councilwoman Zarate requested that two Council members attend the meeting for the Delgado Terrace to discuss various problems and issues affecting the City. Councilman Dalla agreed to attend with Councilwoman Zarate. PUBLIC ORAL COMMUNICATIONS - None. CLOSED SESSION CLOSED SESSION WITH CITY'S DESIGNATED REPRESENTATIVES UNDER GOVERNMENT CODE SECTION 54957.6. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor. Carried by unanimous vote. ADJOURNMENT Motion by Van Deventer, seconded by Zarate, the meeting be adjourned to the Joint City Council/Planning Commission Meeting - April 17, 1991 - 6:30 2.m. Council Chambers, Civic Center. Carried by unanimous vote. Next Regular City Council Meeting - Tuesday, April 23, 1991 - 7:00 p.m. - Council Chambers. Civic Center.
