ROLL CALL Council members present: Dalla, Van Deventer, Zarate, Waters. Absent: Inzunza. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager, Tom G. McCabe, followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Van Deventer, seconded by Zarate, the Minutes of the Regular Meeting of September 3. 1991. be approved. Carried by unanimous vote. Absent: Inzunza. PROCLAMATIONS Motion by Van Deventer, seconded by DaIla, the Proclamations be accepted by title only. Carried by unanimous vote. Absent: Inzunza. The Proclamation proclaiming the week of September 16-20, 1991 as "BUSINESS & INDUSTRY WEEK," was read aloud in full by Mayor Waters who stated he would be personally presenting it. The Proclamation proclaiming the week of September 17-23, 1991 as "CONSTITUTION WEEK," was read aloud in full by Mayor Waters who then requested it be delivered to the Daughters of the American Revolution. Item Nos. 1, 2, 6 and 8 were trailed to the end of the Agenda pending the arrival of Vice Mayor Inzunza. PUBLIC HEARINGS ZONING 1. SUBJECT: Public Hearing - Proposed amendment to the combined general plan/zoning map from CL and CG to RM-1-PD for properties north and south of E. 9th Street between "M" and "N" Avenues. ACTION: Trailed. CITY FEE SCHEDULE 2. SUBJECT: Continued Public Hearing Adoption of City Fee Schedule. Continued from August 27, 1991. ACTION: Trailed. Book 73/Page 233 9/10/91 PROP A 3. SUBJECT: Public Hearing to modify the 1991-92 seven-year Regional Transportation Improvement Program (RTIP). NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff recommended approval of the recommended changes. TESTIMONY: None. ACTION: Mayor Waters declared the Public Hearing closed. Motion by Van Deventer, seconded by Zarate, in favor of Staffs recommendation to go along with the proposed changes where funds will be re -allocated and a $2 million bond will be earmarked against the Prop A money to fulfill the need. Carried by unanimous vote. Absent: Inzunza. NON -CONSENT RESOLUTIONS Motion by Van Deventer, seconded by Della, for approval by title only. NOTE: Item No. 6 was trailed. Carried by unanimous vote. Absent: Inzunza. PROP A 4. Resolution No. 91-181. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY REQUESTING SANDAG TO PROVIDE ADVANCE FUNDING THROUGH DEBT FINANCING FOR IMPROVEMENTS ON REO DRIVE FROM STATE ROUTE 54 TO SWEETWATER ROAD." RECOMMENDATION: Staff recommended adoption of the Resolution, requesting advanced funding from SANDAG. ACTION: Motion by Van Deventer, seconded by Della, for approval of Resolution No. 91-181. Carried by unanimous vote. Absent: Inzunza. PROP A 5. Resolution No. 91-182. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING THE SEVEN-YEAR TRANSNET LOCAL STREET AND ROADS PROGRAM OF PROJECTS FOR FISCAL YEARS 1992 THROUGH 1999." RECOMMENDATION: Staff recommended adoption of the Resolution. NOTE: City Engineer Myers requested a revision to page 1 of the report under Fiscal Year 92-93, Prop "A" Funding (307), Item 1 from Division - Euclid to Drexel to Division - 1-5 to East City Limits, and Item 2 from $100,000. to decrease the project amount to $25,000. ACTION: Motion by Van Deventer, seconded by Della, in favor of Resolution No. 91-182 with the changes recommended by the City Engineer. Carried by unanimous vote. Absent: Inzunza. CITY FEE SCHEDULE 6. Resolution No. 91-183. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE "CITY OF NATIONAL CITY FEE SCHEDULE" FOR USER FEES WITHIN THE CITY." ACTION: Trailed. Book 73/Page 234 9/10/91 BUDGET TRANSFER 1991 7. Resolution No. 91-184. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE APPROPRIATION AND TRANSFER OF FUNDS FOR A TRAFFIC SIGN INVENTORY STUDY." RECOMMENDATION: Staff recommended adoption of the Resolution. ACTION: Motion by Van Deventer, seconded by Zarate, in favor of Resolution No. 91-184. Carried by unanimous vote. Absent: Inzunza. ORDINANCE FOR INTRODUCTION MUNICIPAL CODE 1991 8. An "ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING AMENDING VARIOUS SECTIONS OF THE NATIONAL CITY MUNICIPAL CODE PERTAINING TO FEES." ACTION: Trailed. ORDINANCES FOR ADOPTION Motion by Van Deventer, seconded by Dalla, the Ordinance be adopted by title only. Carried by unanimous vote. Absent: Inzunza. MUNICIPAL CODE 1991 9. Ordinance No. 91-2017. An "ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING SECTION 4.32.040 OF THE NATIONAL CITY MUNICIPAL CODE, AND SECTION 4 OF ORDINANCE NO. 1100." RECOMMENDATION: Staff recommended the Ordinance be adopted. ACTION: Motion by Van Deventer, seconded by Zarate in favor. Carried by unanimous vote. Absent: Inzunza. NEW BUSINESS WARRANT REGISTERS 1991 10. SUBJECT: Warrant Register No. 10. Ratification of Demands in the amount of $225,052.16 (Warrant Nos. 117881 through 117964 inclusive, excepting none). RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Dalla, seconded by Van Deventer, the demands be ratified. Warrants carried by the following vote, to -wit: Ayes: Dalla, Van Deventer, Zarate, Waters. Nays: None. Absent: Inzunza. WRITTEN COMMUNICATION BUDGET FY91-92 11. SUBJECT: Request for a donation for the National City Senior Citizens Softball Team. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Dalla, in favor. Carried by unanimous vote. Absent: Inzunza. Book 73/Page 235 9/10/91 BUDGET FY91-92 12. SUBJECT: Request for a donation for the National City Pony Baseball League. NOTE: Assistant City Manager, Gerry Bolint, distributed a memorandum stating that the team manager had contacted him and requested the item be pulled from the Agenda. Copy on file in the Office of the City Clerk. ACTION: No action taken as request was withdrawn. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR PARKING ADMIN 1991 13. SUBJECT: Request for Handicapped Parking Space near the corner of "B" Avenue and 18th Street at the north/east corner. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Zarate, in favor of the request. Motion withdrawn. Motion by Van Deventer, seconded by Dalla, to refer this item to next weeks Agenda to allow for Staff review and recommendation. Carried by unanimous vote. Absent: Inzunza. The Mayor read into the record an article on the Radisson Hotel success. Copy on file in the Office of the City Clerk. CITY COUNCIL BUDGET FY91-92 14. SUBJECT: Discussion of letter from National City Middle School. TESTIMONY: None. ACTION: Motion by Van Deventer, to request the allocation of $250. towards this item. Motion died for lack of a second. Vice Mayor Inzunza arrived at 7:23 p.m. ACTION: Motion by Van Deventer, to request the allocation of $225. towards this item. Motion died for lack of a second. Motion by Van Deventer, seconded by Zarate in favor of the allocation of $225. Carried by the following vote, to -wit: Ayes: Inzunza, Van Deventer, Zarate. Nays: Dalla, Waters. Councilwoman Zarate made inquiry as to when the update on the Westside Moratorium would be back before the Council. Planning Director Post answered that the report to the City Council would be on the Agenda of September 17, 1991. Book 73/Page 236 9/10/91 Item Nos. 1, 2, 6 and 8 were heard at this time. PUBLIC HEARINGS ZONING 1. SUBJECT: Public Hearing - Proposed amendment to the combined general plan/zoning map from CL and CG to RM-1-PD for properties north and south of E. 9th Street between "M" and "N" Avenues. NOTE: The Notice of Public Hearing, Affidavit of Mailing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff concurred with the Planning Commission's recommendation. Planning Commission recommended the amendment be approved based on their findings for approval. TESTIMONY: None. ACTION: Mayor Waters declared the Public Hearing closed. Motion by Van Deventer, seconded by lnzunza, in favor of the Planning Commissions recommendation based on their findings. Carried by unanimous vote. CITY FEE SCHEDULE 2. SUBJECT: Continued Public Hearing - Adoption of City Fee Schedule. Continued from August 27, 1991. RECOMMENDATION: Staff recommended the required Public Hearing be held and the Resolution establishing a City Fee Schedule be adopted at the conclusion of the Public Hearing. TESTIMONY: The following people made inquiry and/or expressed their opinions on the subject: Alex Gonzalez, 3628 Stockman St., National City. Norine Ball, 417 W. 14th St., National City. Paul Rinks, 331 E. 29th St., National City. Ron Morrison, 1233 Harbison Ave., National City. Alfonzo Hernandez, 2132 Euclid Ave., National City. ACTION: Mayor Waters declared the Public Hearing closed and requested the following Fee Nos. be pulled for individual consideration: 04-06 Garage Sale Permit; 04-12, 04-13, 04-14 Dog License; 12-15 Malicious False Alarm Response; 12-16 False Alarm Response; 13-11 Inspections Outside Normal Hours and 41-13 Basketball Leagues. City Manager McCabe requested Fee No. 11-02 Abandoned Vehicle Towing be pulled, to be brought back after further study. Motion by Van Deventer, seconded by Dalla, in favor of the adoption of the fees (except those pulled). Motion withdrawn by maker. FINANCE - FEE NOS. 04-12, 04-13 and 04-14 Dog License Motion by Van Deventer, seconded by Dalla, to approve the increase to the average of the cities surveyed in the report. rounded to the nearest dollar. Book 73/Page 237 9/10/91 CITY FEE SCHEDULE (continued) FIRE - FEE NOS. 12-15 and 12-16 Malicious False Alarm Response and False Alarm Response Motion by Van Deventer, seconded by Inzunza, in favor of Fee Nos. 12- 15 and 12-16 with an administrative policy exemption for single family residences. Carried by unanimous vote. BUILDING & SAFETY - FEE NO. 13-11 Inspections Outside of Normal Hours Motion by Van Deventer, seconded by Inzunza, in favor of Fee No. 13- 11 being increased to time and one half. Carried by unanimous vote. PARKS & RECREATION - FEE NO. 41-13 Basketball Leagues Motion by Van Deventer, seconded by Zarate, in favor of the proposed 41-13 fees. Carried by unanimous vote. FINANCE - FEE NO. 04-06 Garage Sale Permit Motion by Van Deventer, seconded by Inzunza, in favor of no increase at all. Carried by unanimous vote. Motion by Inzunza, seconded by Waters, to hold the Fee Schedule over for another week. Motion failed by the following vote, to -wit: Ayes: Inzunza, Waters. Nays: Dalla, Van Deventer, Zarate. Motion by Van Deventer, seconded by Dalla, for adoption of the City Fee Schedule. Carried by the following vote, to -wit: Ayes: Dalla, Van Deventer, Zarate. Nays: Inzunza, Waters. NON -CONSENT RESOLUTIONS Motion by Van Deventer, seconded by Dalla, they be presented by title only. Carried by unanimous vote. CITY FEE SCHEDULE 6. Resolution No. 91-183. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE "CITY OF NATIONAL CITY FEE SCHEDULE" FOR USER FEES WITHIN THE CITY." RECOMMENDATION: Staff recommended adoption of the Resolution. ACTION: Motion by Van Deventer, seconded by Dalla, in favor of Resolution No. 91-183 with the voted changes. Carried by the following vote, to -wit: Ayes: Dalla, Van Deventer, Zarate. Nays: Inzunza, Waters. An "ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING AMENDING VARIOUS SECTIONS OF THE NATIONAL CITY MUNICIPAL CODE PERTAINING TO FEES." Alex Gonzalez, 3628 Stockman St., National City, answered Councils questions and expressed his opinions on city fees. PUBLIC ORAL COMMUNICATIONS Richard Sherman, 1236 E. 16th St., National City, made inquiry and expressed his opinions on graffiti abatement. Mrs. Robert Richards, 1411 E. 16th St., National City, spoke regarding area sidewalk installations and problems she had discovered and reported for correction. Alex Gonzalez, 3628 Stockman St., National City, made inquiry regarding the closing of Cagle Street. Ron Morrison, 1233 Harbison St., National City made inquiry of the Council and expressed his opinions. Alfonzo Hernandez, 1232 Euclid Ave., National City made inquiry of the Council and expressed his opinions. ADJOURNMENT Motion by Van Deventer, seconded by Inzunza, the meeting be adjourned to the Next Regular City Council Meeting - September 17. 1991 - 4:00 p.m. - Council Chambers, Civic Center.
