HomeMy WebLinkAbout1991 11-12 CC MINBook 73/Page 280 11/12/91 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA NOVEMBER 12, 1991 The Regular Meeting of the City Council of the City of National City was called to order at 7:02 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. Administrative officials present: Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager, Tom G. McCabe followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Van Deventer, seconded by Dalla, the Minutes of the Regular Meeting of November 5. 1991. be approved. Carried by unanimous vote. MAYOR'S PRESENTATION Mr. Gary Butterfield, Manager Sweetwater Authority --Presentation of Operation. The Mayor stated that due to prior commitments, Mr. Butterfield requested his presentation be rescheduled (packet to be submitted in advance) to the City Council meeting of November 26, 1991 at 7:00 p.m. The Mayor deviated from the Agenda to state that the Council had made good on its word and provided personal checks towards the payment of the TUP fees for the Thanksgiving Dinner for the homeless to be held at the Kimball Community Center. The event is being sponsored by the New Convenant Tabernacle of National City. PROCLAMATIONS Motion by Dalla, seconded by Van Deventer, the Proclamation be read in its entirety. Carried by unanimous vote. The Proclamation proclaiming November 19, 1991 as: "SAN DIEGO READS BEST DAY," was read aloud in full by Mayor Waters who then requested that the City Manager forward it to the appropriate people. PUBLIC HEARINGS STREET VACATION 1. SUBJECT: Public Hearing - Vacation of an alley located on the east side of Roosevelt Avenue between 12th Street and Civic Center Drive, and on the north side of Civic Center Drive between National City Boulevard and Roosevelt Avenue. (Case File No. SC-1991-1) (Applicant: City of National City). RECOMMENDATION: Staff concurs with the recommendation of the Planning Commission and recommends that vacation of the alley be approved. NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. Book 73/Page 281 11/12/91 PUBLIC HEARING (continued) TESTIMONY: None. ACTION: Mayor Waters declared the Public Hearing closed. Motion by Van Deventer, seconded by Dalla for approval. with all conditions of staff. Carried by unanimous vote. CONDITIONAL USE PERMIT 2. Public Hearing - Continued Public Hearing -Appeal of Planning Commission denial of Conditional Use Permit for the expansion of a shopping center at 3007 Highland Avenue. (Applicant: Sillman/Wyman, Inc.) (Case File No. CUP-1991-6). RECOMMENDATION: Staff concurs with the action of the Planning Commission and recommends that the appeal be denied. NOTE: Planning Director Post stated a correction for the record in that the required parking spaces were 636. The applicant's revised plans reflect 641. TESTIMONY: Larry Sillman of Sillman/Wyman Inc., Architect/Engineer, 9609 Waples, Ste. 200, San Diego, spoke in favor of the appeal and requested a change in Condition 29, which stipulates stucco; in that they would prefer an anti -graffiti paint. Harold Katersky, 22020 Claridon St., Woodland Hills, CA., spoke in favor of the project, and answered Council's questions. ACTION: Mayor Waters declared the Public Hearing closed. Motion by Van Deventer, seconded by Inzunza, for approval with all conditions. adding conditions that the Planning Director add a list of non -approved uses for the 6.000 sq. ft. site and amend condition #29. instead of having a plaster wall on the back. as long as it's sealed with anti graffiti paint. Carried by the following vote, to -wit: Ayes: Inzunza, Van Deventer, Zarate, Waters. Nays: Dalla. NON CONSENT RESOLUTIONS Motion by Van Deventer, seconded by Dalla, that the Resolutions be approved by title only. Carried by unanimous vote. CIVIL SERVICE RULES -AMENDMENTS 3. Resolution No. 91-227. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AMENDMENTS TO CIVIL SERVICE RULES III, IV, & XI." RECOMMENDATION: Staff recommended approval. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Van Deventer, in favor of Resolution No. 91-227. Carried by unanimous vote. COUNCIL POLICY ADMIN 4. Resolution No. 91-228. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING UPDATES TO THE CITY COUNCIL POLICY MANUAL." RECOMMENDATION: Staff recommended the adoption of the policies for inclusion in the Policy Manual. Book 73/Page 282 11/12/91 COUNCIL POLICY ADMIN (continued) NOTE: City Attorney Eiser stated that the Resolution would be corrected prior to processing to reflect as indicated on the A-200 to include the "Use of mobile stage and equipment." TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Dalla, in favor of Resolution No. 91-228. Carried by unanimous vote. PARKING ADMIN 1991/BUDGET TRANSFERS 1991 5. Resolution No. 91-229. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DESIGNATING LIMITED PARKING FOR STREET SWEEPING ZONES AND POSTING OF SIGNS, FOR THE AREA BOUNDED BY "A" AVENUE, 1ST STREET, "C" AVENUE, AND 7TH STREET AND AUTHORIZING A TRANSFER OF FUNDS." RECOMMENDATION: Staff recommended Council approval. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor of holding over Resolution No. 91-229 until the December 3. 1991 meeting. Carried by unanimous vote. ORDINANCE FOR INTRODUCTION Motion by Van Deventer, seconded by Dalla, the Ordinance be introduced by title only. Carried by unanimous vote. MUNICIPAL CODE 1991 6. An "ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING CERTAIN PORTIONS OF ORDINANCE NOS. 1076, 1440 & 1943, AMENDING ORDINANCE NO. 1281, AND AMENDING CHAPTER 3.12 OF THE NATIONAL CITY MUNICIPAL CODE." WRITTEN COMMUNICATION STREET EUCLID AVENUE EXTENSION 7. SUBJECT: Letter from Bernard Carillo and Rich Riel regarding property at 2031 S. Euclid Avenue, National City, CA. TESTIMONY: Rich Riel, 2498 La Marque St., San Diego, representing Mr. Carillo, provided a video presentation depicting Mr. Carillo's property. Mike Long, 8527 Hamlet Rd., Santee, General Contractor on the project, spoke to the issue. Alex McLintock, 2038 Euclid Avenue, National City area property owner, expressed his opinions on the issue. ACTION: Motion by Van Deventer that a staff report be brought back to Council in three weeks. Motion died for lack of second. Motion by Van Deventer, seconded by Inzunza, that a staff report be brought back to Council at the meeting on December 17, 1991 at 4 p.m. Carried by unanimous vote. Book 73/Page 283 11/12/91 NEW BUSINESS WARRANT REGISTERS 1991 8. SUBJECT: Warrant Register No. 19. Ratification of Demands in the amount of $422,479.79. (Warrant Nos. 118827 through 118904 inclusive, excepting none) and Certification of Payroll in the amount of $478,652.72. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Van Deventer, seconded by Inzunza, the Warrants be ratified and the Payroll certified. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. PLANNED DEVELOPMENT PERMIT ADMIN 1991 9. SUBJECT: Notice of Decision - Planning Commission Resolution No. 37-91 approving a Planned Development Permit for construction of a single-family dwelling on a lot with an existing residence in the RM-1-PD Zone at 1341 E. 17th Street. (Applicant: Mr. Contreras) (Case File No. PD-1991-5). RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. ACTION: Motion by Van Deventer, seconded by Inzunza, this item be filed. No objection as filed. CONDITIONAL USE PERMIT 10. SUBJECT: Notice of Decision - Planning Commission Resolution No. 36-91 approving a Conditional Use Permit for live entertainment within an existing movie theater at 330 National City Boulevard. (Applicant: Juan and Dignora Torres) (Case File No. CUP-1991-13). RECOMMENDATION: Staff concurs with the Planning Commission decision and recommends that the Notice of Decision be filed. ACTION: Motion by Waters, seconded by Van Deventer, a Public Hearing be set for December 10. 1991 at 7:00 pm. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR - No report. CITY COUNCIL - Councilwoman Zarate requested, if possible, that a general idea of what will be on the Agenda be provided to the Council in advance of the official Agenda release. Councilman Van Deventer made inquiry as to a letter received from Judge Sterling pertaining to the use of a computerized warrant issue device. The City Manager stated that he had requested the Police Chief review and respond if necessary. Book 73/Page 284 11/12/91 CITY COUNCIL (continued) Councilman Van Deventer also provided a letter from Governor Wilson advising of the availability of flexible fuel vehicles for use in municipalities and requested the City Manager have the appropriate departments review it. The Mayor stated that he had received a letter from the Philipino American Citizens Senior group with regards to the increased fees for the use of the Community Center and stated he would put it on next week's Agenda for discussion. Vice Mayor Inzunza reported that he had attended the Grand Opening of the new Toys-R-Us store on Saturday. Councilwoman Zarate made inquiry as to the status of Student Commissioner program. PUBLIC ORAL COMMUNICATIONS - Richard Sherman, 1236 16th St., National City, made inquiry as to whether the City had an ordinance on loud noise. Ron Morrison, 1233 Harbison Ave., National City, made inquiry as to the parking lot arrangement at new Toys-R-Us store. Alfonzo Hernandez, 2132 Euclid Ave., National City, expressed his opinions on City entrances, etc. CLOSED SESSION City Attorney Eiser stated that he had come from a late conference with all parties, their attorneys and the Judge with regards to the Bay National litigation which resulted in several developments requiring Council guidance. ACTION: Motion by Van Deventer, seconded by Inzunza, to bring this item onto the floor as the need to take action arose after the Agenda was posted. Carried by unanimous vote. ACTION: Motion by Zarate, seconded by Van Deventer, in favor of holding the Closed Session under Government Code Section 54956.9 (A). Carried by unanimous vote. Council members left the Council Chambers at 9:15 p.m. Council members returned to the Council Chambers at 9:26 p.m. ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. Book 73/Page 285 11/12/91 ADJOURNMENT Motion by Zarate, seconded by Van Deventer, the meeting be adjourned to the Next Regular City Council Meeting - November 19. 1991 - 4:00 p.m. - Council Chambers.
