ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. Administrative officials present: Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager, Tom G. McCabe followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Zarate, seconded by Van Deventer, the Minutes of the Regular Meeting of November 12. 1991. be approved. Carried by unanimous vote. The following item was trailed to after Item No. 6 PRESENTATION Expression of thanks to the City by the San Diego Regional Fire and Emergency Services Foundation for donated equipment. APPOINTMENT/VICE MAYOR Mayor Waters recommended that Councilwoman Rosalie Zarate be appointed as the new Vice -Mayor for the term ending November 10, 1992. ACTION: Motion by Van Deventer, seconded by Dalla, in favor of the Mayor's recommendation. Carried by unanimous vote. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS Resolution Nos. 91-230 through 91-234 and Item No. 5 - TUP). NOTE: Mayor Waters requested Item Nos. 3 and 5 be pulled (Resolution No. 91-232 and TUP). Councilman Dalla stated he would be voting against Item No. 1, Resolution No. 91-230. Motion by Van Deventer, seconded by Dalla, for approval (except Item Nos. 1, 3 and 5). Carried by unanimous vote. CONDITIONAL USE PERMIT 1. Resolution No. 91-230. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING A CONDITIONAL USE PERMIT FOR THE EXPANSION OF A SHOPPING CENTER AT 3007 HIGHLAND AVENUE." (APPLICANT: SILLMAN/WYMAN, INC.) (CASE FILE NO. CUP-1991-6). Carried by the following vote, to -wit: Ayes: Inzunza, Van Deventer, Zarate, Waters. Nays: Dalla. Book 73/Page 287 11/19/91 CONTRACT 2. Resolution No. 91-231. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE FOURTH AMENDED UNIFIED SAN DIEGO COUNTY EMERGENCY SERVICES AGREEMENT." Adopted. See above. STREET DIVISION WIDENING 4. Resolution No. 91-233. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A PROGRAM SUPPLEMENT AGREEMENT AND STATE -LOCAL ENTITY MASTER AGREEMENT WITH CALTRANS FOR THEIR PARTICIPATION IN THE CONSTRUCTION COST OF THE DIVISION STREET IMPROVEMENTS." Adopted. See above. CONTRACT 3. Resolution No. 91-232. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A LICENSE AGREEMENT WITH THE DEPARTMENT OF THE NAVY FOR THE INSTALLATION OF LANDSCAPING AND A BUS STOP ON THE NORTH SIDE OF 8TH STREET, EAST OF HARBOR DRIVE." ACTION: Motion by Waters, seconded by Van Deventer, in favor of Resolution No. 91-232. Carried by unanimous vote. TEMPORARY USE PERMIT 5. SUBJECT: Temporary Use Permit - Request from National Association for Hispanic Elderly (Project Ayuda) to use Kimball Community Building and waiver of fees. RECOMMENDATION: Staff recommended approval of the Temporary Use Permit and waiver of fees. TESTIMONY: None. ACTION: Motion by Waters, seconded by Inzunza, in favor of the use inclusive of the waiver of fees. Carried by unanimous vote. NON CONSENT RESOLUTIONS Motion by Van Deventer, seconded by Dalla, it be adopted by title only. Carried by unanimous vote. TRAFFIC SIGN/SIGNAL ADMIN 1991 6. Resolution No. 91-234. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE REMOVAL OF THE SINGLE STOP SIGNS ON 22ND STREET AT "J" AVENUE AND AT "K" AVENUE, AND AUTHORIZING THE INSTALLATION OF YIELD SIGNS AT SAID LOCATIONS." TESTIMONY: Ron Morrison, 1233 Harbison Avenue, National City, spoke regarding the issue. ACTION: Motion by Van Deventer, seconded by Zarate, in favor of Resolution No. 91-234. Carried by unanimous vote. Book 73/Page 288 11/19/91 Presentation was heard at this time. PRESENTATION Expression of thanks to the City of National City by the San Diego Regional Fire and Emergency Services Foundation for donated equipment. Mr. Frank Ault, Vice Chairman of the San Diego Regional Fire and Emergency Services Foundation stated that National City was the 1st City in the County of San Diego to donate obsolete equipment/supplies for redistribution to fire departments most in need and thanked them for their generosity. Mr. Ault then introduced Randy Sandoval, Campo Reservation Fire Department, recipient of the surplus equipment who also thanked the Council for their generosity. ORDINANCE FOR INTRODUCTION Motion by Van Deventer, seconded by Inzunza, the Ordinance be introduced by title only. Carried by unanimous vote. CONTRACT 7. An "ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF NATIONAL CITY AND THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM TO INCLUDE THE "SINGLE HIGHEST YEAR" PROVISION." WRITTEN COMMUNICATION CITY OF NATIONAL CITY FEE SCHEDULE 8. SUBJECT: Letter from Mr. Jake Benjamin, President of the Filipino -American Senior Citizens Association of National City regarding the rental cost and use of the Kimball Recreational Hall. TESTIMONY: None. ACTION: Motion by Van Deventer, this item be filed. Motion died for lack of a second. Motion by Waters, seconded by Inzunza, to send this back to the City Attorney to change the Resolution to where the Council's policy is in there. if the Council wants to waive or make an adjustment for the senior citizen population or anyone. they can do that. Motion clarified to senior citizens only at this time. Amended motion by Van Deventer, seconded by Dalla, to provide for all valid National City based senior citizen organizations who use the facility, a blanket 10% discount. City Attorney Eiser asked for clarification of the motion that the National City based senior organizations must have a majority of the membership be over age 62 and National City residents. Carried by unanimous vote. Book 73/Page 289 11/19/91 NEW BUSINESS WARRANT REGISTERS 1991 9. SUBJECT: Warrant Register No. 20. Ratification of Demands in the amount of $345,191.09. (Warrant Nos. 118906 through 119030 inclusive, excepting none). NOTE: Councilman Van Deventer stated he would be abstaining on Warrant Nos. 118965 as he owns the building and 118924 as he has a contract with the business. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Van Deventer, seconded by Dalla, in favor. Warrants (except Nos. 118965 and 118924) carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. Warrant Nos. 118965 and 118924 carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Zarate, Waters. Nays: None. Abstaining: Van Deventer. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR - No report. CITY COUNCIL Councilman Van Deventer noted for the record, that although the subject falls under the Community Development Commission, the permit policy procedure has been changed as requested by the Commissioners whereby each set of papers for redevelopment loan applications states "funds to be dispersed only after a copy of proper National City Building Permit has been provided to the Community Development Commissions Office." Vice Mayor Zarate made inquiry of the Planning Director as to the status of the Westside Moratorium and was informed that the Planning Commission had held one hearing and had another scheduled in December after which the report will come before the City Council for action. Councilman Inzunza congratulated Councilman Dalla on his success in having the graffiti removed from the building located at Interstate 5 and 24th Street (MTDB purchased and demolished the building on the site). PUBLIC ORAL COMMUNICATIONS Gary Mujica, 1438 "Q" Avenue, Apt. #1, National City, informed the Council of an incident he had been involved in with the Police Department. Book 73/Page 290 11/19/91 ADJOURNMENT Motion by Van Deventer, seconded by Inzunza, the meeting be adjourned to the Next Regular City Council Meeting - November 26. 1991 - 7:00 p.m. - Council Chambers. Civic Center. Carried by unanimous vote.
