HomeMy WebLinkAbout1992 02-04 CC MINBook 74/Page 28 02/04/92 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA FEBRUARY 4, 1992 The Regular Meeting of the City Council of the City of National City was called to order at 4:01 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Ray. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager, Tom G. McCabe followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Van Deventer, seconded by Dalla, the Minutes of the Regular Meeting of January 28, 1992, be approved. Carried by unanimous vote. MAYOR'S PROCLAMATIONS Motion by Van Deventer, seconded by Dalla, the proclamations be accepted by title only. Carried by unanimous vote. The Proclamation proclaiming February 9-15, 1992 as "I LOVE A COP WEEK" was read aloud in full by Mayor Waters who then presented it to Police Chief Knee. Mayor Waters also read a letter from H. V. Otterholt, Ph.D., 3301 Fairlomas Road, National City, expressing his appreciation for the continued responsiveness and professionalism demonstrated by the Police Department. Copy on file in the Office of the City Clerk. After receiving the proclamation, Chief Knee informed the Council that Detective L. Brent Roark has been named National City's "Officer of the Year" and will receive his award at a dinner sponsored by the Police Officer's Association, in San Diego on February 14, 1992. The Proclamation proclaiming the month of February, 1992 as "TURN ON YOUR IMAGINATION MONTH" was read aloud in full by Mayor Waters who then presented it to Christopher Ewing, Children's Librarian, N.C. Public Library; Ms. Ewing then presented "I Love to Read" T-shirts, buttons and TV -knob tags to members of the Council. Book 74/Page 29 02/04/92 CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 92-22 through 92-23 and Consolidated Cash & Investment Report as of December 31, 1991). NOTE: Alfonzo Hernandez, 2132 Euclid Avenue, National City, requested that Item No. 3 be pulled. Motion by Van Deventer, seconded by Zarate for approval, (except Item No. 3). Carried by unanimous vote. CONTRACT 1. Resolution No. 92-22. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION FOR THE INSTALLATION OF TRAFFIC CONTROL EQUIPMENT AT LOCATIONS ON HIGHLAND AVENUE AND ON PALM AVENUE." (Engineering Specs. No. 91-15). Adopted.. See above. CONTRACT 2. Resolution No. 92-23. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH MAYTIME BAND REVIEW CORPORATION FOR ADVERTISING." Adopted. See above. FINANCIAL MANAGEMENT 3. SUBJECT: Consolidated Cash & Investment Report as of December 31, 1991 TESTIMONY: Alfonzo Hernandez, 2132 Euclid Avenue, National City, made inquiry of the Council regarding the 91-92 Investment Earnings. ACTION: Motion by Van Deventer, seconded by Dalla, the report be accepted and filed. No objection as filed. WRITTEN COMMUNICATIONS BUDGET FY 1991-92 4. SUBJECT: Request for Donation from Nat -Par Colt Baseball League. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1991 5. SUBJECT: Warrant Register No. 31. Ratification of Demands in the amount of $143,573.41 (Warrant Nos. 120005 through 120119 inclusive excepting 120046) and Certification of Payroll in the amount of $490,318.09. NOTE: Councilman Van Deventer stated he would be abstaining on Warrant No. 120027 as he owns the building. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Van Deventer, seconded by Zarate, in favor. Warrants (except 120027) carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. Warrant No. 120027 carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Zarate, Waters. Nays: None. Abstaining: Van Deventer. Book 74/Page 30 02/04/92 NEW BUSINESS (continued) STREET TREE REMOVAL 6. SUBJECT: Street tree removals and replacements. RECOMMENDATION: Staff recommended approval of the following: Pedro Castillo, 1036 E. 4th Street, request for removal of eight trees due to raised sidewalk, with eight replacements required. ACTION: Motion by Van Deventer, seconded by Della, in favor. Motion withdrawn. Motion by Van Deventer, seconded by Zarate, #Q hold this item over for two weeks so that Director of Parks and Recreation can notify the residents in the immediate area of the potential tree removals and bring back a report to Council of any responses received. Carried by unanimous vote. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR - No report. CITY COUNCIL Councilman Van Deventer stated that he has received calls from small business people regarding the new California State law requiring proof of Workman's Compensation Insurance before a Business License is issued. He requested the City Attorney to review the situation and perhaps survey other cities in the county to see how they are handling the process. He feels the new law creates a hardship for the small business owner. Councilman Van Deventer also stated that there is a need to streamline the process for issuing Business Licenses, and requested that the City Manager work with the Finance Director in establishing possible new procedures such as a tiered/catagorical cost structure and bring a report back to Council in 45 days. Councilman Inzunza inquired as to whether the new graffiti contractor had begun their work, and stated that the graffiti on the utility box at Sweetwater Road and Stockman Street is still there. PUBLIC ORAL COMMUNICATIONS Paul Rinks, 331 E. 29th Street, National City, spoke in agreement with Councilman Van Deventer regarding new State Workman's Compensation Insurance law. CLOSED SESSION FOR PENDING LITIGATION UNDER GOVERNMENT CODE SECTION 54956.9(A) (CLAIM OF BERNARD H. CARRILLO AND ISABEL M. CARRILLO) ACTION: Motion by Van Deventer, seconded by Della, in favor of holding the Closed Session under Government Code Section 54956.9(A). Carried by unanimous vote. Book 74/Page 31 02/04/92 CLOSED SESSION (continued) Council members left the Council Chambers at 4:48 p.m. Council members returned to the Council Chambers at 5:03 p.m. ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. ADJOURNMENT Motion by Van Deventer, seconded by Zarate, the meeting be adjourned to the Next Regular City Council Meeting - February 11. 1992 - 7:00 p.m. - Council Chambers. Civic Center.
