ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager, Tom G. McCabe followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Van Deventer, seconded by Dalla, the Minutes of the Regular Meeting of March 17. 1992. be approved. Carried by unanimous vote. Item No. 15 was heard at this time. AREA DEVELOPMENT 15. SUBJECT: Report on City's options with respect to lease of Port property. RECOMMENDATION: Staff request Council provide direction to Staff. TESTIMONY: City Attorney Eiser and Planning Department Director Post gave brief overviews of their reports. ACTION: Motion by Van Deventer, seconded by Zarate, to direct letters through the Mayor's Office to the Port Commission to urge the Port to conduct a full and complete Environmental Review of the proposal and to the Executive Director of the Coastal Commission in the San Francisco Bay Area to ask them to look into this situation. Carried by unanimous vote. PUBLIC HEARINGS ZONING 1992 1. SUBJECT: Public Hearing - Amendments regarding Design Standards and Procedural Requirements for New Industrial and Commercial Development and Nonconforming Uses. NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff recommends approval of the proposed amendment. Book 74/Page 72 03/24/92 PUBLIC HEARING (continued) TESTIMONY: Mary Johnson, 326 W. 11th Street, National City, requested an extension of provision to existing industrial buildings as well as to residential. Ron Morrison, 1233 Harbison Avenue, National City, spoke in support of the proposed amendments. Ed Borrak, 1420 McKinley Avenue, National City, made inquiry of the Planning Director. Mayor Waters declared the Public Hearing closed. NOTE: Councilman Dalla stated that he would be abstaining as his residence would stand to benefit from the amendment and stated, however, that if he were able to vote he would vote in favor of the amendment. ACTION: Motion by Van Deventer, seconded by Waters, in favor of the amendment. Carried by the following vote, to -wit; Ayes: Inzunza, Van Deventer, Zarate, Waters. Nays: None. Abstaining: Dalla. Motion by Zarate, seconded by Van Deventer, to refer item raised by Ms. Johnson back to staff for review. Carried by unanimous vote. Motion by Van Deventer, seconded by Inzunza, to request the City Attorney bring back a written report to Council on the legal ability to do physical inspection on buildings with absentee landlords to ensure they are brought up to code. Carried by unanimous vote. MUNICIPAL CODE 1992 2. SUBJECT: Public Hearing - Extension of Ordinance No. 91-2011, an urgency measure enacting a moratorium on the opening of adult businesses. NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff recommends approval of the attached report and extension of the moratorium for one year. TESTIMONY: None. Mayor Waters declared the Public Hearing closed. ACTION: Motion by Van Deventer, seconded by Inzunza, for approval of staffs recommendation. Carried by unanimous vote. Book 74/Page 73 03/24/92 CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 92-42 through 92- 45.) NOTE: A member of the public requested that Item No. 3, Resolution No. 92-42 be pulled. Motion by Van Deventer, seconded by Inzunza, for approval (except Item No. 3, Resolution No. 92-42). Carried by unanimous vote. STREET VACATION 4. Resolution No. 92-43. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING EXECUTION OF ORDER TO VACATE AND CLOSE THE UNIMPROVED PORTION OF "N" AVENUE NORTH OF 28TH STREET. CASE FILE NO. SC-1-90." Adopted. See above. DEEDS & EASEMENTS 5. Resolution No. 92-44. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED FOR THE TRANSFER OF REAL PROPERTY OWNED BY THE CITY TO AUSTIN JERALD AND MARGARET ANN OLIVER." Adopted. See above. DEEDS & EASEMENTS 6. Resolution No. 92-45. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING CONVEYANCE OF REAL PROPERTY FROM AUSTIN JERALD AND MARGARET ANN OLIVER." Adopted. See above. POLITICAL SUPPORT 3. Resolution No. 92-42. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY IN SUPPORT OF LEGISLATION TO CREATE A LOCAL GOVERNMENT TRAFFIC SAFETY ASSESSMENT. (SB 1645)" TESTIMONY: Ron Morrison, 1233 Harbison Avenue, National City, made inquiry of the Council and expressed his personal opinions on the proposed Senate Bill. ACTION: Motion by Van Deventer, seconded by Zarate, in favor of Resolution No. 92-42. Carried by unanimous vote. ORDINANCE FOR ADOPTION Motion by Van Deventer, seconded by Waters, the Ordinance be adopted by title only. Carried by unanimous vote. MUNICIPAL CODE 1992 7. Ordinance No. 92-2027. "AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTED PURSUANT TO GOVERNMENT CODE SECTION 65858 AS AN URGENCY MEASURE EXTENDING THE MORATORIUM ON THE OPENING OF ADULT BUSINESSES WITHIN THE CITY." RECOMMENDATION: Staff recommended adoption of the Ordinance. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Van Deventer, for approval. Carried by unanimous vote. Book 74/Page 74 03/24/92 WRITTEN COMMUNICATIONS BUDGET FY91-92 8. SUBJECT: Request for Donation from the Sweetwater High School Marching Band to go toward the purchase of uniforms. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Zarate in favor of the allocation of $125.00. Carried by unanimous vote. NEW BUSINESS WARRANT REGISTERS 1991 9. SUBJECT: Warrant Register No. 38. Ratification of Demands in the amount of $1,297,442.70 (Warrant Nos. 120702 through 120812 inclusive excepting none). RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Van Deventer, seconded by Inzunza, for approval. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. ZONE VARIANCE 10. SUBJECT: Notice of Decision - Planning Commission Resolution No. 6-92 approving a Zone Variance for access to a parcel via an easement and to allow a parcel with 24 feet of frontage in lieu of the 50 feet required at 1239 "0" Avenue. (Applicant: Mario and Maria Espinosa) (Case File No. Z-1991-6). RECOMMENDATION: Staff concurs with the Planning Commission decision and recommends that the Notice of Decision be filed. ACTION: Motion by Van Deventer, seconded by Zarate, in favor of Staff's recommendation to file. No objection as filed. SOLID WASTE/RECYCLING 11. SUBJECT: Recycling Program for City Buildings. RECOMMENDATION: Staff recommends that the report be filed. ACTION: Motion by Van Deventer, seconded by Zarate the report be filed. No objection as filed. TEMPORARY USE PERMIT 12. SUBJECT: Temporary Use Permit - Sweetwater Kiwanis Club request a TUP to conduct a fund raising carnival at the Plaza Bonita Shopping Center from April 5 through April 15, 1992, from 12:00 noon to 11:00 p.m. A waiver of fees is also requested. RECOMMENDATION: Staff recommended approval of the Temporary Use Permit and granting a waiver of only the $345.00 permit fee. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Inzunza, for approval. Carried by unanimous vote. Book 74/Page 75 03/24/92 TEMPORARY USE PERMIT 13. SUBJECT: Temporary Use Permit - Committee to Elect Relly Mondoza request a TUP to announce candidacy for the City Council to be held in the parking lot at 1420 E. Plaza Boulevard from 1:45 p.m. to 3:15 p.m. on April 4, 1992. A waiver of fees is also requested. RECOMMENDATION: Staff recommends approval of the Temporary Use Permit subject to compliance with all conditions of City departments and deny the request for waiver of fees. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Inzunza, to approve the Temporary Use Permit subject to compliance with all requirements of City departments and deny the request for waiver of fees. Carried by unanimous vote. LITIGATION/CORN V. COONS 14. SUBJECT: Consider Tender of Defense - Curtis J. Corn v. Bruce D. Coons. RECOMMENDATION: Staff requests Council provide direction to staff. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Dalla, for the City Attorney to call Mr. Carnes and provide legal guidance and file an answer to the complaint. with the understanding that the City is not committing at this time to indemnifying anyone. which would be paying damages. so the City's rights would be reserved in that respect. Carried by unanimous vote. Item No. 15 was heard earlier, after the Approval of Minutes. AREA DEVELOPMENT 15. SUBJECT: Report on City's options with respect to lease of Port property. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR - Mayor Waters referred a complaint of gangs hanging out in the ditch by the Boys and Girls Club to Police Chief Knee. Mayor Waters read a letter received from the Governor regarding Assembly Bill 2090. Copy on file in the Office of the City Clerk. CITY COUNCIL - Councilman Dalla referred to Planning Staff the property on North 16th Street and C Avenue which is zoned commercial for review. Councilman Dalla requested Public Works look into the large quantity of street lights which are out throughout the city. Book 74/Page 76 03/24/92 Vice Mayor Zarate made inquiry of Public Works regarding the guards placed on street lights. Councilman Inzunza spoke regarding the strict discipline Council has taken on traffic issues, and requested support for the family of the girl in a coma from a hit and run accident. PUBLIC ORAL COMMUNICATIONS - Ed Borrak, 1420 McKinley Avenue, National City, commented on the Kiwanis Carnival and made inquiry regarding security light installation. Al Alvarado, 2423 E. 20th Street, National City, made inquiry regarding the southeast corner of Euclid Avenue/Plaza Boulevard, heading east. There is a construction site making it unsafe for children walking to school. Alfonso Hernandez, 2132 Euclid Avenue, spoke regarding the vacant lot at Euclid Avenue and 24th Street, where a pond has been created after test grading by the owner of property, and the driveway drains are not working; and regarding the maintenance of a house for sale at 16th Street and Euclid Avenue. ADJOURNMENT Motion by Dalla, seconded by Van Deventer, the meeting be adjourned to the Next Regular City Council Meeting - April 7. 1992 - 4:00 D.M. - Council Chambers. Civic Center.
