HomeMy WebLinkAbout1992 04-14 CC MINBook 74/Page 84 04/14/92 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA APRIL 14, 1992 The Regular Meeting of the City Council of the City of National City was called to order at 7:00 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager, Tom G. McCabe followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Van Deventer, seconded by Zarate, the Minutes of the Regular Meeting of April 7, 1992, be approved. Carried by unanimous vote. PROCLAMATIONS Motion by Van Deventer, seconded by Dalla, the proclamations be presented by title onlv. Carried by unanimous vote. The Proclamation proclaiming the month of April, 1992 to be "THE MAGIC OF HEAD START MONTH" was read in full by Mayor Waters who requested that the City Manager forward it to the appropriate people. Councilman Dalla left the Council Chambers at 7:03 p.m. Councilman Dalla returned to the Council Chambers at 7:05 p.m. The Proclamation proclaiming April 14, 1992 as "THE SECOND BATTALION, 185TH ARMOR OF THE CALIFORNIA ARMY NATIONAL GUARD DAY' was read in full by Mayor Waters who then presented it to Lt. Col. Harold Scott, who thanked the City for the recognition. Mayor Waters stated that the National City Lion's Club would be presenting a $1500.00 check to the Senior Center for a camcorder and new copier. Mayor Waters will personally present the check to Ms. Dibley at the Senior Center. Book 74/Page 85 04/14/92 BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS BUILDING ADVISORY & APPEALS BOARD Mayor Waters turned the meeting over to Vice Mayor Zarate who stated that Mr. George Dunn and Mr. Leonard Greaser expressed a desire to be reappointed to the Building Advisory & Appeals Board. ACTION: Motion by Inzunza, seconded by Van Deventer, in favor of the reappointment. Carried by unanimous vote. VARIOUS BOARDS & COMMISSIONS Vice Mayor Zarate introduced the following people for Council interview for various Commissions: Maria Lourdes Adrid, Alfred Hlawatsch and Myrtle Rudesill. The following people were not present to be interviewed but asked to be considered: Diane Davis and Alma Graham. PLANNING COMMISSION Vice Mayor Zarate stated that there were two incumbents, George Hood and Pat Large and nine other individuals wishing to serve on the Planning Commission. The following individuals were interviewed: John A. Aguilera, Pete Flores, George Hood, Charles Howrey, Richard Knutson, and Relly Mendoza. The following applicants were not able to be present but asked to be considered: Ted Hamilton, Pat Large, Joseph Allen Martin, Paul Rinks, and Elizabeth Toy. Al Alvarado, 2423 E. 20th Street, National City, made inquiry of the Council as to the status of his application. Vice Mayor Zarate closed the interviews for Planning Commission, and distributed ballots to the Mayor and Council. Vice Mayor Zarate handed out Ballots to the City Council and instructed them to vote for the first 4-year term vacancy. The City Clerk read the results of the Ballots, to -wit: Pat Large - 4 votes, Pete Flores - 1 vote. Vice Mayor Zarate handed out the second set of Ballots for the second 4-year term. The City Clerk read the results of the Ballots, to - wit: Pete Flores - 3 votes, George Hood - 2 votes. Vice Mayor Zarate then handed out the Ballots for the final vacancy, a partial 2-year term. The City Clerk read the results of the Ballots, to -wit: Richard Knutson - 3 votes, George Hood -2 votes. Vice Mayor Zarate turned the meeting back over to Mayor Waters. Item No. 15 was heard at this time. PUBLIC REQUEST/COMPLAINT 15. SUBJECT: Further consideration of letter from National City Historical Society, Inc. regarding the historic farm property located at 1808 "F" - "E" Street. TESTIMONY: Planning Director Post read into the record his Memo of April 14, 1992, covering the issues of ownership, sale of property, and City involvement. (Copy on file in the Office of the City Clerk.) Elias Rodriquez, 1440 I Avenue, National City, spoke in support of the farm. Book 74/Page 86 04/14/92 PUBLIC REQUEST/COMPLAINT (continued) Donald Freeman, Attorney for Mr. & Mrs. Head, suggested a contribution and donation of the buildings and equipment currently on the property as a possible solution verses acquisition. Ron Maze, 3401 Eleanor Place, National City, gave a verbal report and presented a handout to the Council in support of the farm. (Copy on file in the Office of the City Clerk.) Harold Payne, 1818 E Avenue, National City, spoke in support of the farm. Elvira Castillo, 1926 E Avenue, National City, spoke in support of the farm. ACTION: Motion by Van Deventer, to refer to Staff for additional information. Motion died for lack of second. Motion by Van Deventer, seconded by Zarate, to refer to Staff for more information, cost analysis, etc.. and report back to Council on May 5, 1992. Carried by unanimous vote. Mayor Waters declared a recess at 8:35 p.m. Council reconvened at 8:48 p.m. ROLL CALL Councilmembers present: Dalla, lnzunza, Van Deventer, Zarate, Waters. PUBLIC HEARINGS HOUSING ELEMENT/GENERAL PLAN 1992 1. SUBJECT: Public Hearing - Updated Housing Element of the General Plan. Case File No. GP-1991-4. RECOMMENDATION: Staff concurs with the Planning Commission recommendations that Council adopt the updated Housing Element after considering the attached responses to comments from the State. TESTIMONY: None. Mayor Waters declared the Public Hearing closed. ACTION: Motion by Van Deventer, seconded by Zarate, in favor of Planning Commission recommendation to adopt the Updated Housing Element. Carried by unanimous vote. ZONING 2. SUBJECT: Public Hearing - Appeal of Notice of Violation directed to S.T. Trust, property owner, regarding an automotive related business operating on property that has less than 7,500 sq. ft. and which has lost any nonconforming use rights at 1900 Wilson Avenue, Suite B. RECOMMENDATION: Staff concurs with the Planning Commission decision to deny the appeal. Book 74/Page 87 04/14/92 ZONING (continued) NOTE: A request was received from the applicant on April 13, 1992 to continue the Public Hearing. ACTION: Motion by Dalla, seconded by Inzunza, to continue the Public Hearing until the April 28, 1992 meeting. Carried by unanimous vote. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTION (Resolution Nos. 92-49 through 92- 52). Motion by Van Deventer, seconded by Zarate, for approval. Carried by unanimous vote. CONTRACT 3. Resolution No. 92-49. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION FOR THE PUMP STATION IMPROVEMENTS. (Engineering Specs. 1045)" Adopted. See above. CONTRACT 4. Resolution No. 92-50. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A PROGRAM SUPPLEMENT AGREEMENT WITH CALTRANS FOR CALTRANS' PARTICIPATION IN THE PALETA CREEK BRIDGES ON HARBOR DRIVE." Adopted. See above. CONTRACT 5. Resolution No. 92-51. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE LAW FIRM OF LIEBERT, CASSIDY AND FRIERSON TO PROVIDE CONSULTING, REPRESENTATIONAL, AND LEGAL SERVICES PERTAINING TO EMPLOYEE RELATIONS MATTERS." Adopted. See above. HOUSING ELEMENT/GENERAL PLAN 1992 6. Resolution No. 92-52. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING AN UPDATED HOUSING ELEMENT OF THE CITY'S GENERAL PLAN. Case File No. GP-1991-4)" Adopted. See above. ORDINANCE FOR INTRODUCTION Motion by Van Deventer, seconded by Dalla, the Ordinance be introduced by title only. Carried by unanimous vote. MUNICIPAL CODE 1992 7. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING SECTION 1 OF ORDINANCE NO. 1939, A PORTION OF ORDINANCE NO. 1812, AND SECTION 7.10.010 OF CHAPTER 7.10 OF THE NATIONAL CITY MUNICIPAL CODE, AND ADDING SECTIONS 7.10.190 THROUGH 7.10.220 TO CHAPTER 7.10 OF THE MUNICIPAL CODE, TO ESTABLISH A MANDATORY RECYCLING PROGRAM WITHIN THE CITY." Book 74/Page 88 04/14/92 MUNICIPAL CODE 1992 (continued) TESTIMONY: Planning Director Post commented on the Ordinance and requested a continuance. ACTION: Motion by Dalla, seconded by Inzunza, to continue this item to the April 28, 1992 meeting. Amended motion by maker and second to continue this item for one week. Carried by unanimous vote. ORDINANCE FOR ADOPTION Motion by Van Deventer, seconded by Dalla, the Ordinance be adopted by title only. Carried by unanimous vote. ZONING 1992 8. Ordinance No. 92-2028. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING TITLE 18 (ZONING) OF THE NATIONAL CITY MUNICIPAL CODE REGARDING EXPANSION AND RECONSTRUCTION OF NONCONFORMING, SINGLE-FAMILY DWELLINGS." (Case File No. A- 1991-3). RECOMMENDATION: Staff recommended adoption of the Ordinance. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor. Carried by the following vote, to -wit: Ayes: Inzunza, Van Deventer, Zarate, Waters. Nays: None. Abstaining: Dalla. WRITTEN COMMUNICATIONS BUDGET FY91-92 9. SUBJECT: Request for donation from National City Girls Softball League. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Zarate, in favor. Carried by unanimous vote. BUDGET FY91-92 10. SUBJECT: Request for donation from Granger Jr. High School's MUSIC IN MOTION to compete in the America's Music Showcase Festival. TESTIMONY: None. ACTION: Motion by Van Deventer, seconded by Zarate, in favor of the $250.00 request. Carried by unanimous vote. TEMPORARY USE PERMIT 11. SUBJECT: Letter from the Federation of Filipino -American Senior Citizens Organizations, Inc. requesting use of Kimball Hall. TESTIMONY: None. ACTION: Council requested the Public Works Director bring a report back to Council. Book 74/Page 89 04/14/92 NEW BUSINESS WARRANT REGISTERS 1991 12. SUBJECT: Warrant Register No. 41. Ratification of Demands in the amount of $315,657.14 (Warrant Nos. 120989 through 121057 inclusive excepting none), and Certification of Payroll in the amount of $445,124.36. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Van Deventer, seconded by Zarate, in favor. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. CITY -OWNED LAND/ADMIN 13. SUBJECT: Report on the surplus property at the northwest corner of Euclid Avenue and 16th Street. RECOMMENDATION: 1. Direct Staff to proceed with the project and negotiate the sale of the remaining portion of the parcel; or, 2. Delete the project and negotiate the sale of the entire remaining parcel to the adjacent property owner. TESTIMONY: None. ACTION: Council requested the City Engineer bring a report back in two weeks from the bus company stating their interest and intent, and explore further information. PUBLIC REQUEST/COMPLAINT 14. SUBJECT: Report from City Attorney regarding Directional Sign for Plaza Bonita Road. TESTIMONY: Edith Hughes, Executive Director, Chamber of Commerce, answered Council's questions. ACTION: Motion by Van Deventer, seconded by Waters, to refer this item to the next CDC budget, to have it amended for this other part added to the sign and the expense of that to be out of the funds that we allocated for the sign in the CDC budget. Amended motion by maker and second to allow the Chamber of Commerce to collect funds from Plaza Bonita for utilities. Carried by unanimous vote. Councilman Van Deventer requested that the sign on Highway 54 be referred to the CDC budget for May. City Engineer Myers gave an update of negotiations with Cal Trans on directional signage on Highway 805 for Plaza Bonita Road and on the Reo Drive right of way acquisition status. CITY MANAGER - Item No. 15 was heard earlier, after the Interviews/Appointments. PUBLIC REQUEST/COMPLAINT 15. SUBJECT: Further consideration of letter from National City Historical Society, Inc. regarding the historic farm property located at 1808 "F" - "E" Street. Book 74/Page 90 04/14/92 CITY ATTORNEY - CONTRACT 16. SUBJECT: Proposed operating agreement between the City of National City and the Filipino -American Community of National City. TESTIMONY: None. Councilman Van Deventer requested that Page 8, Item B, under consumption of alcohol be amended. City Attorney Eiser recommended the wording state: "no consumtion of alcholic beverages unless prior approval of the City Council and ABC is obtained."; also require City Council approval of the design on the sign. Planning Director Post stated that Condition #11 on page 6 pertaining to a requirement for a Conditional Use Permit and parking variance should be stricken from the agreement. Ron Morrison, 1233 Harbision, National City, made inquiry of the Council. City Attorney Eiser requested direction in paragraph 2 (duration; provides for a term of the agreement). Consensus was to have it the same as the Boys and Girls Club. City Attorney Eiser clarified the termination clause and requested the addition of a stronger clause. ACTION: Motion by Van Deventer, seconded by Dalia, for approval with conditions noted. Carried by unanimous vote. OTHER STAFF - No report. MAYOR - No report. CITY COUNCIL - Councilman Dalla requested that the Boards and Commissions application form be revised and a list created (a running record) of who applied, when their term expires, and to notify applicants by letter to ask if they're still interested. PUBLIC ORAL COMMUNICATIONS - Lori Peoples, 1504 E. 22nd Street, National City, Board member of National City Boys and Girls Club, thanked Council for their attendance and support at the Boys and Girls Club groundbreaking. Alfonso Hernandez, 2132 Euclid Avenue, National City, made inquiry regarding weeds at corner of 16th and Euclid and expressed concerns regarding newspaper bin at Rachael and vacant lot usage. ADJOURNMENT Motion by Van Deventer, seconded by Zarate, the meeting be adjourned to the Next Regular City Council Meeting - April 21. 1992 - 4:00 D.M. - Council Chambers, Civic Center.
