HomeMy WebLinkAbout1992 04-28 CC MINBook 74/Page 99 04/28/92 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA APRIL 28, 1992 The Regular Meeting of the City Council of the City of National City was called to order at 7:00 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Zarate, Waters. Absent: Van Deventer. Administrative officials present: Berkuti, Bolint, Eiser, McCabe, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with salute to the flag led by City Manager, Tom G. McCabe followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Zarate, seconded by Inzunza, the Minutes of the Regular Meeting of April 21. 1992, be approved. Carried by unanimous vote. Absent: Van Deventer. Proclamations were heard at this time. PROCLAMATIONS Motion by Dalla, seconded by Inzunza, the proclamations be presented by title only. Carried by unanimous vote. Absent: Van Deventer. The Proclamation proclaiming Tuesday, April 28, 1992 to be "NATIONAL YOUTH SERVICE DAY" was read in full by Mayor Waters who requested that the City Manager forward it to the appropriate people. Councilman Inzunza left the Council Chambers at 7:05 p.m. The Proclamation proclaiming the week of May 3-9, 1992 as "HIRE A VETRAN WEEK" was read in full by Mayor Waters who will present it personally. The Proclamation proclaiming the week of May 3-9, 1992 as "VICTIMS OF PORNOGRAPHY WEEK" was read in full by Mayor Waters who requested that the City Manager forward it to the appropriate people. The Proclamation proclaiming the month of May, 1992 to be "AMATEUR RADIO OPERATORS WEEK" was read in full by Mayor Waters who presented it to Walt Popelar and Ronald L. Coulter. Councilman Inzunza returned to the Council Chambers at 7:10 p.m. Book 74/Page 100 04/28/92 Mayor Waters deviated from the Agenda at this time to state that the American Legion Post #255 donated $500.00 to the D.A.R.E. program, which he presented to Police Chief Knee. The American Legion also provided a check for $1,000.00 for the "Christmas in July " program, which the Mayor will deliver personally. The American Legion also donated $1,000.00 to the National City Boys and Girls Club Building Fund. Boards and Commissions, Interviews/Appointments were heard at this time. BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS STREET TREE & PARKWAY COMMITTEE Mayor Waters recommended the reappointment of Mr. James Ledbetter to the Street Tree & Parkway Committee for a full term ending April 30, 1996. ACTION: Motion by Inzunza, seconded by Zarate, in favor of the Mayor's recommendation. Carried by unanimous vote. Absent: Van Deventer. SENIOR CITIZENS ADVISORY BOARD Mayor Waters recommended that Mr. Alfred J. Hlawatsch be appointed to the Senior Citizens Advisory Board . ACTION: Motion by Inzunza, seconded by Zarate, in favor of the Mayor's recommendation. Carried by unanimous vote. Absent: Van Deventer. PRESENTATIONS Presentation pertaining to the analysis of the Community Development Commission's Amendment III cash flow position. The City Manager gave a brief overview and introduced Mr. Mark Stockwell, Principal of Katz Hollis, Sacramento, California, who gave a brief verbal presentation of the analysis and their findings as presented in the Agenda attachment, and answered Council's questions. Arnold Peterson, Executive Director, Community Development Commission for the City of National City, commented on the report and the conservativeness reflected therein. ACTION: Motion by Inzunza, seconded by Zarate, to accept the report. Carried by unanimous vote. Absent: Van Deventer. Proclamations were heard earlier, after the Approval of Minutes. BOARDS AND COMMISSIONS INTERVIEWS/APPOINTMENTS STREET TREE & PARKWAY COMMITTEE Mayor Waters appointed Mr. James Ledbetter to the Street Tree & Parkway Committee for a full term ending April 30, 1996. SENIOR CITIZENS ADVISORY BOARD Mayor Waters appointed Mr. Alfred J. Hlawatsch to the Senior Citizens Advisory Board. PUBLIC HEARINGS ZONING 1. SUBJECT: Continued Public Hearing - Appeal of Notice of Violation directed to S.T. Trust, property owner, regarding an automotive related business operating on property that has Tess than 7,500 sq. ft. and which has lost any nonconforming use rights at 1900 Wilson Avenue, Suite "B". Continued from Council Meeting of 4/14/92. NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff concurs with the Planning Commission decision to deny the appeal. TESTIMONY: Dick Plumleigh, S.T. Trust, 525 W. 20th Street, National City, spoke in favor of the request for appeal and answered Council's questions. Mayor Waters declared the Public Hearing closed. ACTION: Motion by Dalla, seconded by Inzunza, to concur with Planning Commission recommendation. Carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Zarate. Nays: Waters. Absent: Van Deventer. ABATEMENT WEED 1991 2. SUBJECT: Public Hearing - 1991 Weed Abatement Hearing. NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff recommended that any written or oral protests or objections to the Report and Account be considered, and that the Report and Account be approved. Book 74/Page 102 04/28/92 ABATEMENT WEED 1991 (continued) TESTIMONY: Fire Chief Kimble briefly explained the procedure and introduced Fire Marshall Patricia Pittman and Ken Osborne, Weed Abatement Contractor for the City, who answered Council's questions. Nick Debbas, 6323 Nancy Ridge Dr., San Diego, son of owner of property on Sweetwater Road (A.P.N. 570-320-09/10) protested the billing. Gloria Debbas, 5875 Friars Road, #4417, San Diego, owner of above property, spoke in protest to the billing and answered Council's questions. ACTION: Motion by Waters, seconded by Dalla, the property owners be required to pay the bill. Carried by unanimous vote. Absent: Van Deventer. TESTIMONY: Bill Turpin, partner of Robert Walton, 972 Songbird Lane, Bonita, regarding 226-228 E. 6th Street, (A.P.N. 556-333-11), protested the billing amount and made inquiry of the Council/Staff. ACTION: Motion by Waters, the individual should receive a 40% reduction of the bill, the maximum to be paid to be $381.00. Motion died for lack of a second. Motion by Dalla, seconded by Inzunza, to reaffirm the assessment on this particular parcel. Carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Zarate. Nays: Waters. Absent: Van Deventer. Motion by Inzunza, seconded by Dalla, to approve the overall assessment of the Fire Department. Carried by unanimous vote. Absent: Van Deventer. Mayor Waters called a recess at 9:55 p.m. Council Members returned to Council Chambers at 10:05 p.m. ROLL CALL Council Members present: Dalla, Inzunza, Zarate, Waters. CONSENT CALENDAR ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 92-62 through 92- 65 and Item No. 7-Consolidated Cash and Investment Report as of March 31, 1992). Motion by Inzunza, seconded by Dalla, for approval. Carried by unanimous vote. Absent: Van Deventer. CITY ACQUISITION/PROPERTY 3. Resolution No. 92-62. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY ENGINEER TO ACCEPT AN OFFER FOR SALE AND OPEN AN ACQUISITION ESCROW FOR THE PURCHASE OF THE PROPERTY AT 3402 VALLEY ROAD." Adopted. See above. Book 74/Page 103 04/28/92 DEEDS & EASEMENTS 4. Resolution No. 92-63. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED FOR THE TRANSFER OF REAL PROPERTY OWNED BY THE CITY TO WILLIAM S. AND FETUAO DESMOND (Portion of A.P.N. 558-240-09)." Adopted. See above. STREET DIVISION WIDENING 5. Resolution No. 92-64. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION FOR THE IMPROVEMENTS OF DIVISION STREET FROM PALM AVENUE TO "U" AVENUE. (Engineering Spec. No. 1042)." Adopted. See above. BUDGET TRANSFERS 1992 6. Resolution No. 92-65. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE APPROPRIATION AND TRANSFER OF FUNDS FOR THE IMPROVEMENTS OF DIVISION STREET FROM PALM AVENUE TO "U" AVENUE. (Engineering Spec. 1042)." Adopted. See above. FINANCIAL MANAGEMENT 1992 7. SUBJECT: Consolidated Cash and Investment Report as of March 31, 1992. RECOMMENDATION: Staff recommended that these reports be accepted and filed. TESTIMONY: None. ACTION: Adopted. See above. ORDINANCE FOR ADOPTION Motion by Dalla, seconded by Inzunza, the Ordinance be adopted by title only. Carried by unanimous vote. Absent: Van Deventer. MUNICIPAL CODE 1992 8. Ordinance No. 92-2029. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 9.52 TO THE NATIONAL CITY MUNICIPAL CODE, TO ESTABLISH A MANDATORY RECYCLING PROGRAM WITHIN THE CITY." RECOMMENDATION: Staff recommends adoption of the Ordinance. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Zarate, in favor of adoption of the ordinance. Carried by unanimous vote. Absent: Van Deventer. OLD BUSINESS CITY -OWNED LAND/ADMIN 9. SUBJECT: Report on the surplus property at the northwest corner of Euclid Avenue and 16th Street. Continued from Council Meeting of 4/14/92. RECOMMENDATION: Staff requests City Council's direction on the need for a project. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Inzunza, to take steps to schedule this as a project with funds available from Euclid Avenue, 20th to 22nd Streets. Carried by unanimous vote. Absent: Van Deventer. Book 74/Page 104 04/28/92 WRITTEN COMMUNICATIONS TEMPORARY USE PERMIT 10. SUBJECT: Letter from The Rotary Club of National City requesting diminishing or waiving the usual fees for rental of the Community Center for a fund raising spaghetti dinner benefiting the Thousand Smiles Foundation. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by DaIla, to donate $250.00 to the National City Rotary Club. Motion withdrawn. Motion by Inzunza, seconded by Zarate, to deny the request. Carried by unanimous vote. Absent: Van Deventer. Motion by Inzunza, seconded by Waters, to direct staff to notify the National City Rotary Club to submit a request for $250.00. Amended motion by Dalla, to honor the existing letter as a request for $250.00. Amended motion died for lack of second. Prior motion carried unanimously. Absent: Van Deventer. NEW BUSINESS WARRANT REGISTERS 1991 11. SUBJECT: Warrant Register No. 43. Ratification of Demands in the amount of $130,162.25 (Warrant Nos. 121163 through 121254 inclusive excepting none) and Certification of Payroll in the amount of $459,882.50. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Waters, seconded by Zarate, for approval. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Zarate, Waters. Nays: None. Absent: Van Deventer. ZONING 12. SUBJECT: Report on Zoning for Property Northwest of 16th Street and "C" Avenue. RECOMMENDATION: Staff agrees with the Planning Commission recommendation that the City Council initiate an amendment from CG to IC -OS for the area and direct the Planning Commission to hold a public hearing on the matter. TESTIMONY: None. ACTION: Motion by Dalla, seconded by Zarate, in favor of Staff's recommendation. Carried by unanimous vote. Absent: Van Deventer. COUNCIL WORKSHOP NOTICES 13. SUBJECT: Recommendation for Council Workshop for 3:00 p.m., Wednesday, May 6, 1992 to review Clean Water Program costs and their impact on Sewer Service Fees. TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Dalla, in favor of Council Workshop to be held at 4:00 D.M. , Wednesday, May 6. 1992. Carried by unanimous vote. Absent: Van Deventer. CITY MANAGER - No report. MAYOR - Mayor Waters read into the record a letter from the National City Rotary Club regarding Preserve Planet Earth Day. Copy on file in the Office of the City Clerk. Mayor Waters read into the record a letter from the City of Del Mar regarding support for establishment of a Low-level Hazardous Waste Disposal site within the State of California. Copy on file in the Office of the City Clerk. Mayor Waters read into the record a letter from "Save Our Forest & Ranchlands" requesting Council's endorsement of the Forest Conservation Initiative. Copy on file in the Office of the City Clerk. Mayor Waters referred to a letter from Councilman Dalla regarding a request for a green curb (copy on file in the Office of the City Clerk), and referred the request to the City Engineer. Mayor Waters reported that the Sweetwater Authority Governing Board gave unanimous support to the City's request for financial participation in historical restoration project. CITY COUNCIL - Councilman Dalla asked that the request for a green curb at 24 E. 24th Street be placed on the Agenda for next week. Vice Mayor Zarate stated that she attended the League of Cities Seminar on Community Services on April 22 & 24 and will provide information to Council. She stated that the Lambs Players had a program there on "What is a Hero", and that they were very well received and a positive reflection on National City. PUBLIC ORAL COMMUNICATIONS - Mrs. Robert Richards, 1411 E. 16th Street, National City, spoke regarding weeds/dead trees/trash on sidewalks/gutter at 1506 E. 16th Street and requested City assistance. A dog that had been reported running loose is now tied in the yard and now barks continually. Councilman Inzunza made inquiry regarding unsightly abandoned shopping carts throughout the City. Councilman Dalla also commented on the shopping cart issue, as did Mrs. Robert Richards.
