MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
MAY 19, 1992
The Regular Meeting of the City Council of the City of National City was called to order
at 4:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager, Tom G. McCabe
followed by the invocation by Councilman Dalla.
Mayor Waters announced that Millie Valdez, prior City employee, passed away over
the weekend in Arizona where she had relocated.
APPROVAL OF MINUTES
Motion by Van Deventer, seconded by Inzunza, the Minutes of the Regular Meeting of
May 12. 1992. and the Minutes of the Adjourned City Council Finance Committee
Meeting of May 15. 1992 be approved. Carried by unanimous vote.
CONSENT CALENDAR
ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 92-81 through 92-
87). Motion by Van Deventer, seconded by Inzunza, for approval. Carried by
unanimous vote.
CONTRACT
1. Resolution No. 92-81. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF
THE NOTICE OF COMPLETION FOR THE IMPROVEMENTS OF THELMA WAY
SOUTH OF 4TH STREET. (ENGINEERING SPEC. NO. 91-2)." Adopted. See
above.
CONTRACT
2. Resolution No. 92-82. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY DECLARING MIRAMONTES CONSTRUCTION CO. TO BE
THE LOWEST RESPONSIVE BIDDER AND AUTHORIZING THE MAYOR TO
EXECUTE AN AGREEMENT WITH MIRAMONTES CONSTRUCTION CO. FOR
SEWER REPAIR AND REHABILITATION. (ENGINEERING SPEC. NO. 92-3)."

DRIVEWAY CONSTRUCTION PERMITS
4. Resolution No. 92-84. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY APPROVING THE ISSUANCE OF A SECOND DRIVEWAY
PERMIT FOR THE PROPERTY LOCATED AT 2336 E. 18TH STREET."

CITY OWNED LAND /SALE
5. Resolution No. 92-85. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY ACCEPTING THE OFFER OF THE COMMUNITY
DEVELOPMENT COMMISSION OF THE CITY OF NATIONAL CITY (CDC) TO
BUY CITY OWNED SURPLUS LAND FOR $652,400." Adopted. See above.
POLITICAL SUPPORT
6. Resolution No. 92-86. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY, URGING THE GOVERNOR TO IDENTIFY A DISPOSAL
SITE FOR LOW-LEVEL HAZARDOUS WASTE WITHIN THE STATE OF
CALIFORNIA." Adopted. See above.
BUDGET FY92-93
7. Resolution No. 92-87. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY APPROVING AND ADOPTING PRELIMINARY BUDGET
FOR FISCAL YEAR 1992-93." Adopted. See above.
Mayor Waters requested a recess at 4:07 p.m.

8. Resolution No. 92-88. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY APPROVING THE ISSUANCE AND SALE OF NOT TO
EXCEED $29,000,000 AGGREGATE PRINCIPAL AMOUNT OF COMMUNITY
DEVELOPMENT COMMISSION OF THE CITY OF NATIONAL CITY NATIONAL
CITY DOWNTOWN REDEVELOPMENT PROJECT TAX ALLOCATION BONDS,
SERIES 1992."
ACTION: Motion by Van Deventer, seconded by Dalla, in favor.
Carried by unanimous vote.

Motion by Van Deventer, seconded by Dalla the Ordinance be introduced by title only.
Carried by unanimous vote.
ZONING 1992
9. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
AMENDING TITLE 18 (ZONING) OF THE NATIONAL CITY MUNICIPAL CODE
TO ALLOW A COMMERCIAL LAUNDRY PLANT IN THE PRIVATE
INSTITUTIONAL (IP) ZONE WITH ISSUANCE OF A CONDITIONAL USE
PERMIT."
ORDINANCE FOR ADOPTION
Motion by Dalla, seconded by Van Deventer, the Ordinance be adopted by title only.
Carried by unanimous vote.
MUNICIPAL CODE 1992
10. Ordinance No. 92-2030. "AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY AMENDING PORTIONS OF ORDINANCE NO. 1069,
AND SECTIONS 14.04.030(A) AND 14.04.040(B) OF THE NATIONAL CITY
MUN ICIPAL CODE."
ACTION: Motion by Van Deventer, seconded by Inzunza in favor.
Carried by the following vote, to -wit: Ayes: Inzunza, Van Deventer,
Zarate, Waters. Nays: Dalla.
NEW BUSINESS
WARRANT REGISTERS 1991
11. SUBJECT: Warrant Register No. 46. Ratification of Demands in the amount
of $178,385.79 (Warrant Nos. 121420 through 121516 inclusive excepting
none).
NOTE: Councilman Van Deventer stated he would be abstaining on Warrant
No. 121455 as he owns the building.
RECOMMENDATION: Staff recommended ratification of these warrants.
ACTION: Motion by Inzunza, seconded by Van Deventer for approval.
Warrants (except 121455) carried by the following vote, to -wit: Ayes:
Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. Warrant No.
121455 carried by the following vote, to -wit: Ayes: Dalla, Inzunza,
Zarate, Waters. Nays: None. Abstaining: Van Deventer.

TEMPORARY USE PERMIT
12. SUBJECT: Request for Temporary Use Permit - National City Lions Club
Fourth of July Independence Day Celebration.
RECOMMENDATION: Staff recommended approval of the Temporary Use
Permit subject to all conditions including reimbursement to City departments for
costs incurred in conjunction with the event and grant a waiver of only the
Temporary Use Permit processing fee.
TESTIMONY: Walter Wisniewski, Chairman of the National City Lions
Club, 2932 Ridgeway Drive, National City, answered Council's
questions.
George Sothras, 931 E. 16th Street, National City, answered Council's
questions regarding booth rentals.
Milt Miguel, Treasurer, National City Lion's Club, 332 Patricia Avenue,
Chula Vista, answered Council's questions.
Pinky Green, 1244 K Avenue, National City, expressed his perspective
on the request.
Bing Bersamina, 2312 F Avenue, National City, spoke regarding beer
sales at the event.
Ron Morrison, 1233 Harbison Avenue, National City, spoke regarding the
proposed fee to enter the carnival.
ACTION: Motion by Van Deventer, seconded by Waters, to waive the
fees relating to Parks and Public Works costs but not for police protection.
Amended motion by Dalla to require that the Lions Club supply a
financial report at the end of the event to provide a clear picture of the
amount of revenue generated by the event. Maker and second agreed to
include the amendment. Carried by the following vote, to -wit: Ayes:
Dalla, lnzunza, Van Deventer, Waters. Nays: Zarate.
NOTE: Vice Mayor Zarate stated for the Record that her objection to the
motion was only to the waiving of Parks and Recreation fees.
ACTION: Motion by Dalla, seconded by Inzunza, to support Staff's
recommendation regarding the sale of beer. Carried by unanimous vote.
Motion by Van Deventer, seconded by Zarate, fir approval of the
Temporary Use Permit with the changes made by the City Council.
Carried by unanimous vote.
Mayor Waters requested a recess at 5:23 p.m.
Council reconvened at 5:38 p.m.

ACTION: Motion by Van Deventer, seconded by Zarate, in favor of holding the
Closed Sessions under Government Code Sections 54957.6 and 545956.9(A)
Carried by unanimous vote.
Council members left the Council Chambers at 6:38 p.m.
Council members returned to the Council Chambers at 7:20 p.m.

BUSINESS LICENSES ADMIN
13. SUBJECT: Report on Business Licenses.
RECOMMENDATION: Staff recommended approval by separate vote of the
proposals numbered 1 to 7 on page 3 of the report.
TESTIMONY: National City Finance Director Alex Caloza gave a
Posterboard presentation and provided a Business License Handbook
for review. Copies on file in the Office of the City Clerk.
Councilman Inzunza left the Council Chambers at 7:03 p.m.
Councilman Inzunza returned to the Council Chambers at 7:08.
Ron Morrison, 1233 Harbison Avenue, National City, made inquiry of the
Finance Director and expressed his opinions on the proposed Business
License processing alternatives.
ACTION: Motion by Van Deventer, seconded by Waters, to adjust out of
town fixed rates (Attachment 6. Recommendation 5) Councilman Dalla
proposed an amended motion for Council to consider what was
presented and bring the item back in a week or two. Motion by Van
Deventer, seconded by Waters, to withdraw the original motion and hold
this item over for three weeks. Carried by unanimous vote.
CITY MANAGER
City Manage McCabe stated that Council had raised questions during the budget
hearings regarding National City Transit's request to add three new busses. Bob
Arthur then explained the request and answered Council's questions.
CITY ATTORNEY - No report.

OTHER STAFF
Assistant City Manager Bolint stated that he had spoken to the City Engineer regarding
the petition received requesting sidewalks on Earle Drive. The estimated cost is
between $12,000. and $14,000. The Engineering Department has a bid opening
scheduled for June 3rd and will know at that time if the requested work can be
accomplished. A report will be brought back to Council at that time.
MAYOR
Mayor Waters stated that Julie Martinez, who wanted to run for Miss Teen San Diego
was sponsored by his company.
CITY COUNCIL - No report.
PUBLIC ORAL COMMUNICATIONS
Frank Chenelle, 3025 Plaza Blvd., National City, representative for National City on
the San Diego County Water Board, gave a brief update on the progress of his board,
and provided a handout to the Council of their Capital Improvement Program. Copy
on file in the Office of the City Clerk.
The Closed Sessions were heard earlier, after Item 12.

Motion by Inzunza, seconded by Van Deventer to bring Item 12 back onto the Agenda.
Carried by unanimous vote.
TEMPORARY USE PERMIT
12. SUBJECT: Request for Temporary Use Permit National City Lions Club
Fourth of July Independence Day Celebration.
TESTIMONY: David Snyder, 5155 Cedarwood Road, Bonita, National
City Noontimer's Club, spoke in protest to the TUP and answered
Council's questions.
ACTION: Motion by Van Deventer, seconded by Inzunza, Mayor
Waters to advise the National City Lion's Club to permit National City
Noontimer's Club to have a booth or the Temporary Use Permit will be
reconsidered. Motion withdrawn.
TESTIMONY: Marion Cooper, 1313 N Avenue, National City,
expressed his concerns regarding this item and answered Council's
questions.
ACTION: Motion by Dalla, seconded by Zarate, to reconsider action on
prior Temporary Use Permit. Carried by unanimous vote. Motion by
Dalla, seconded by Inzunza to approve the Temporary Use Permit with
all the conditions previously considered (waive the fees relating to

Parks and Public Works costs but not police protection. the Lions Club

that National City service organizations be given priority before outside
organizations are permitted to participate: the National City Lions
Noontimer's Club to be located where the beer garden had been
previously located. Carried by unanimous vote.
ADJOURNMENT
Motion by Inzunza, seconded by Dalla the meeting be adjourned to the next Regular
City Council Meeting - May 26. 1992 - 7:00 p.m. - Council Chambers. Civic Center.
Carried by unanimous vote.
The meeting closed at 7:59 p.m.
