MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
JULY 21, 1992
The Regular Meeting of the City Council of the City of National City was called to order
at 4:00 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Van Deventer, Zarate, Waters.
Administrative officials present: Bolint, Eiser, McCabe, Berkuti, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager, Tom G.
McCabe followed by the invocation by Councilman Dalla.
APPROVAL OF MINUTES
Motion by Van Deventer, seconded by Inzunza, the Minutes of the Regular Meeting of
July 14. 1992 be approved. Carried by unanimous vote.
Item No. 7 was heard at this time.
ELECTION 11-03-1992
7. SUBJECT: Consider November 3, 1992 General Municipal Election: Citizen -
Sponsored Card Club Initiative and Alternative and adoption of appropriate
resolutions. Motion by Van Deventer, seconded by Inzunza, the item be heard by
title only. Carried by unanimous vote.
RECOMMENDATION: Staff requested Council direction.
TESTIMONY: Elias Rodriguez, 1440 I Avenue, National City,
representing the New Opportunity Voters Association, spoke in opposition
to the initiative and the placing of an alternate on the ballot.
Kile Morgan, 1223 J Avenue, National City, spoke in opposition to the
initiative.
Lourdes Hesson, 2936 E. Division Street, National City, spoke in support
of the initiative.
Alfonso Hernandez, 2132 Euclid Avenue, National City, spoke in
opposition to the initiative.
John Ambre, 510 E. 4th Street, National City, spoke in support of the
initiative.
Larry Bennett, 3009 E. 5th Street, National City, spoke in opposition to the
initiative.
Paul Rinks, 331 E. 29th Street, National City, spoke in support of the
initiative.
Alda West, 315 E. 3rd Street, National City, spoke in opposition to the
initiative.
Manuel Guaderrama, 3228 Menard Street, National City, spoke in support
of the initiative.

Louise Martin, 1527 E. 15th Street, National City, spoke in opposition to
the initiative, and the placing of an alternate on the ballot.
Autrey Neighbors, Pastor of the Highland Avenue Baptist Church, 2605
Highland Avenue, National City, spoke in opposition to the initiative.
Ray Sequaros, 1430 E. 5th Street, National City, spoke in support of the
initiative.
Denise Galvez, 311 E. 2nd Street, National City, spoke in opposition to the
initiative.
Ron Morrison, 1233 Harbison Avenue, National City, spoke in opposition
to the initiative, and the placement of an alternate initiative on the ballot
and requested assistance from the City Council in getting the information
out to the citizens in opposition to the initiative.
Troy Fulks, 2118 N Avenue, National City, spoke in opposition to the
initiative.
John Ambre, 510 E 4th Street, National City, made closing comments in
support of the initiative.
Cecilia Kirk, 311 E. 2nd Street, National City, spoke in opposition to the
initiative.
City Attorney Eiser explained Council's options as included in the Agenda.
ACTION: Motion by Inzunza, seconded by Van Deventer, to move to put
the initiative that was circulated on the ballot only (no alternative).
City Attorney Eiser read the title of Resolution No. 92-142 into the record (1 A).
Resolution No. 92-142. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY AMENDING RESOLUTION NO. 92-125 CALLING AND
GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO
BE HELD ON TUESDAY, NOVEMBER 3, 1992, AND AMENDING RESOLUTION
NO. 92-126 REQUESTING THE BOARD OF SUPERVISORS TO CONSOLIDATE
THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 3, 1992
WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THE SAME
DATE, TO INCLUDE THE SUBMISSION TO THE VOTERS OF AN INITIATIVE
ORDINANCE AUTHORIZING LICENSING AND REGULATION OF CARD CLUBS
WITHIN THE CITY."
TESTIMONY: Fred Pruitt, 2414 E. 19th Street, National City, made
inquiry of the City Attorney with regards to written arguments.
ACTION: Motion carried by unanimous vote.

City Attorney Eiser read the title of Resolution No. 92-143 into the record (1 B).
Resolution No. 92-143. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY, CALIFORNIA, PROVIDING FOR THE FILING OF REBUTTAL
ARGUMENTS FOR CITY MEASURES SUBMITTED AT MUNICIPAL
ELECTIONS."
ACTION: Motion by Van Deventer, seconded by Inzunza, in favor of
Resolution No. 92-143. General discussion ensued. Motion withdrawn.
Motion by Van Deventer, seconded by Inzunza this item be filed. No
objection as filed.
City Attorney Eiser read the title of Resolution No. 92-144 into the record (1 C).
Resolution No. 92-144. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY, CALIFORNIA, DETERMINING TO FILE A WRITTEN
ARGUMENT AND DIRECTING THE CITY ATTORNEY TO PREPARE AN
IMPARTIAL ANALYSIS, PERTAINING TO A MEASURE AUTHORIZING
LICENSING AND REGULATION OF CARD CLUBS."
ACTION: Motion by Van Deventer, seconded by Inzunza, in favor of
Resolution No. 92-144. Carried by unanimous vote.
Motion by Van Deventer, seconded by Inzunza, to approve a sub-
committee of Councilman Dalla and Mayor Waters to compose a draft
argument. Carried by unanimous vote.
Mayor Waters called a five-minute recess at 5:10 p.m.
Council reconvened at 5:25 p.m.

ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 92-136 through 92-
138.) Motion by Van Deventer, seconded by Dalla for approval. Carried by unanimous
vote. Absent: Inzunza.
CONTRACT
1. Resolution No. 92-136. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY DECLARING E & J WEED ABATEMENT CO. THE LOWEST
RESPONSIBLE BIDDER AND AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT WITH E & J WEED ABATEMENT CO." Adopted.

CONTRACT
2. Resolution No. 92-137. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY AUTHORIZING EXECUTION OF THE UNIFORM FARE
STRUCTURE AGREEMENT FOR FISCAL YEAR 1993." Adopted. See above.

3. Resolution No. 92-138. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY ADOPTING AN AMENDMENT TO THE COMBINED
GENERAL PLAN/ZONING MAP FROM CG TO IC -OS FOR PROPERTIES
NORTHWEST OF 16TH STREET AND "C" AVENUE. APPLICANT: CITY
INITIATED. (CASE FILE NOS. GP-1992-2/ZC-1992-1)." Adopted. See above.
NON CONSENT RESOLUTIONS
Motion by Van Deventer, seconded by Zarate, they be adopted by title only. Carried by
unanimous vote. Absent: Inzunza.
GRANT TDA/TRANSPORTATION DEVELOPMENT ACT FUNDS
4. Resolution No. 92-139. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY AUTHORIZING EXECUTION OF CLAIMS, AGREEMENTS
AND APPLICATIONS NECESSARY FOR RECEIPT OF TDA ARTICLE 4.5 AND
TRANSNET FUNDS FOR NATIONAL CITY WHEELS."
Councilman Inzunza returned to the Council Chambers at 5:28 p.m.
ACTION: Motion by Van Deventer, seconded by Zarate, in favor of
Resolution No. 92-139. Carried by unanimous vote.
LABOR RELATIONS FIREFIGHTERS MOU 1992
5. Resolution No. 92-140. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY APPROVING A MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF NATIONAL CITY AND NATIONAL CITY
FIREFIGHTERS' ASSOCIATION."
ACTION: Motion by Van Deventer, seconded by Zarate, in favor of
Resolution No. 92-140. Carried by unanimous vote.
SEWER CAPACITY/FEES
6. SUBJECT: Consider authorizing an increase in sewer rates within the City of
National City and adoption of appropriate resolution.
RECOMMENDATION: Staff recommended approval of the resolution for the
budgeted rate, or approval of the resolution for the alternate rate.
TESTIMONY: City Attorney Eiser advised as to the response he had
received from the Fair Political Practices Commission, which he had
distributed to Council (copy on file in the Office of the City Clerk), and
recommended that before the Council consider the substance of this item,
the decision be made whether or not the Council wishes to participate in
the decision, or if Council wishes further input from the Fair Political
Practices Commission in the form of a written advice letter.
Ron Morrison, 1233 Harbison Avenue, National City, expressed his
opinions on the sewer rate system.
Alfonso Hernandez, 2132 Euclid Avenue, National City, made inquiry of
the Council and expressed his opinions on the original sewer ordinances.

ACTION: Motion by Van Deventer, seconded by Inzunza, in favor of
Alternate C. single-family rate of $14.58. (Resolution No. 92-141. A
"RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY
AUTHORIZING AN INCREASE IN SEWER RATES WITHIN THE CITY OF
NATIONAL CITY.") Carried by the following vote, to -wit: Ayes: Dalla,
Inzunza, Van Deventer, Waters. Nays: None. Abstaining: Zarate.
Item No. 7 was heard earlier, after the Approval of Minutes.

"C" AVENUE. APPLICANT: CITY INITIATED. (CASE FILE NOS. GP-1992-2
AND ZC-1992-1)."
OLD BUSINESS
BUILDING PERMIT/HISTORIC
9. SUBJECT: Citizens Petition Regarding Construction of a Garage at 425 Shell
Avenue. (J.M. Perdue).
RECOMMENDATION: Staff recommended the report be received and filed.
NOTE: Councilman Dalla clarified for the record that there was no basis for
denial.
TESTIMONY: Fred Puhn, 425 Shell Avenue, National City, answered
Council's questions.
ACTION: Motion by Van Deventer, seconded by Inzunza, the report be
received and filed. No objection as filed.
WRITTEN COMMUNICATIONS
BUDGET FY92-93
10. SUBJECT: Request from Su -Hi Alumni Association for a City ad in its memory
book.
ACTION: Motion by Inzunza, seconded by Waters in favor of $150.00
ad. Carried by unanimous vote.

NEW BUSINESS
WARRANT REGISTERS 1992
11. SUBJECT: Warrant Register No. 02. Ratification of Demands in the amount of
$358,392.68 (Warrant Nos. 122197 through 122291 inclusive excepting none)
and Certification of Payroll in the amount of $317,060.00.
NOTE: Councilman Van Deventer stated that he would be abstaining on
Warrant No. 122241, as he owns the building.
RECOMMENDATION: Staff recommended ratification of these warrants.
ACTION: Motion by Van Deventer, seconded by Inzunza, in favor.
Warrants (except No. 122241) carried by the following vote, to -wit: Ayes:
Dalla, Inzunza, Van Deventer, Zarate, Waters. Nays: None. Warrant No.
122241 carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Zarate,

CABLE TV ULTRONICS (NATIONAL CITY CABLE)
12. SUBJECT: Semi -Annual Status Report Submitted by Ultronics Inc.
RECOMMENDATION: Staff recommended that the report be accepted and
filed.
ACTION: Motion by Van Deventer, seconded by Inzunza, the report be
accepted and filed. No objection as filed.
TEMPORARY USE PERMIT
13. SUBJECT: Temporary Use Permit - Mexican Independence Day Celebration
(Radio Latina).
RECOMMENDATION: Staff recommended approval of the TUP application
subject to compliance with conditions of city departments including
reimbursement to city departments for all costs incurred in conjunction with the
event, grant a waiver of only the $356.00 TUP processing fee, and deny the
request to serve/sell alcoholic beverages.
TESTIMONY: Peter Moore, 4540 Paseo de la Vista, Bonita, made
inquiry of Council.
Nate Mendez, Wetherwood Terrace, San Diego, made inquiry of Council.
Greg Beatie, Director of the Boys and Girls Club of National City, 1430 D
Avenue, National City, answered Council's questions.
ACTION: Motion by Van Deventer to carry this item over for one week.
Motion died for lack of second. Motion by Van Deventer, seconded by
Inzunza, to carry this item over for two weeks to look into the budget.
Carried by unanimous vote.
Alfonso Hernandez, 2132 Euclid Avenue, National City, spoke regarding
the 4th of July carnival and food booths.
COMMUNITY PROMOTION
14. SUBJECT: City Entry in the National City Automobile Heritage Days.
RECOMMENDATION: Staff recommended approval of the request to display
the antique fire engine in this year's event on August 2, 1992 in Kimball Park.
ACTION: Motion by Van Deventer, seconded by Dalla, in favor. Carried
by unanimous vote.

MAYOR
Mayor Waters read into the record a letter from Robert Griner resigning his position with
the Civil Service Commission (copy on file in the Office of the City Clerk).
Mayor Waters reported that he had received a telephone call from Robert McCutcheon,
representing the regional Pacific Theaters, regarding the increase in cost for a
subscription to the City Council Agendas.
Mayor Waters read from an ad placed in the Star News by the Lions Club thanking the
Mayor and Council for the support and cooperation they provided for the 4th of July
carnival and fireworks display in Kimball Park.
CITY COUNCIL - No report.
PUBLIC ORAL COMMUNICATIONS
Alfonso Hernandez, 2132 Euclid Avenue, inquired as to when the Lions Club would be
submitting their operations report and costs for expenses.
Lori Peoples, 1504 E. 22nd Street, National City, member of the "Christmas in July"
Committee, reminded everyone that this weekend is "Christmas in July" weekend.
Rita Heiss, 2121 E. 4th Street, National City, spoke regarding relocation of a building for
private use on public land in El Toyon Park.
Troy Fulks, 2118 N Avenue, National City, made inquiry as to the money set aside to
help fund items that bring in positive publicity to the city.
Mike Soliz, 1135 Garnet, San Diego, General Chairman, San Diego Swimming,
explained the swimming program and the prohibition of alcohol and tobacco.
Alfonso Hernandez, 2132 Euclid Avenue, National City, spoke regarding the parking
situation in Las Palmas Park during swim meets.
Louise Martin, 1527 E. 15th Street, National City, commended Council for their stand in
opposition to the Card Club Initiative.

Motion by Van Deventer, seconded by Zarate, the meeting be adjourned to the next
Regular City Council Meeting - July 28. 1992 - 7:00 p.m. - Council Chambers. Civic
Center. Carried by unanimous vote.
