HomeMy WebLinkAbout1992 10-06 CC MINBook 74/Page 225 10/06/92 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA OCTOBER 6, 1992 The Regular Meeting of the City Council of the City of National City was called to order at 4:00 p.m. by Mayor Waters. ROLL CALL Council members present: Dalla, Inzunza, Van Deventer, Waters. Absent: Zarate. Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager, Tom G. McCabe followed by the invocation by Councilman Dalla. APPROVAL OF MINUTES Motion by Inzunza, seconded by Van Deventer, the Minutes of the Regular Meeting of September 22. 1992 be approved. Carried by unanimous vote. Absent: Zarate. PROCLAMATIONS Motion by Van Deventer, seconded by Waters, the Proclamations be adopted by title only. Carried by unanimous vote. Absent: Zarate. The Proclamation proclaiming October 15, 1992 to be "WHITE CANE SAFETY DAY" was read aloud by Mayor Waters. The Mayor then requested that the City Manager forward it to the appropriate people. Mayor Waters then deviated from the Agenda and presented a check to Joint Powers Financing Authority Secretary Tom McCabe in the amount of $747,726. which was received from the Community Development Commission for payment towards the new Police Facility. BOARDS AND COMMISSIONS ADMIN INTERVIEWS/APPOINTMENTS Mayor Waters introduced applicant Jeffrey P. Scott, 1250 5th Avenue, #813, National City, who explained his interest in serving on various Commissions and answered Council's questions. PUBLIC HEARINGS ZONING 1. SUBJECT: Public Hearing - Amendment to the combined General Plan/Zoning Map to rezone certain properties from RS-2 (Single -Family Residential --small lot) to RS-1 (Single -Family Residential --large lot). Applicant: City of National City. Case File Nos.: GP-1992-5/ZC-1992-4. Book 74/Page 226 10/06/92 PUBLIC HEARINGS (continued) NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff agreed with the Planning Commission recommendation that the City Council approve the amendment, based on the following findings: 1. That the project will not have a significant effect on the environment and adopt the proposed negative declaration. 2. That the proposed amendment is in the public interest and not in conflict with the Housing Element of the General Plan, since rezoning the area from RS-2 to RS-1 will have a minor impact on housing development potential and there is adequate area for residential development in accordance with National City's regional share of new housing. 3. That the proposed rezoning from RS-2 to RS-1 is consistent with the General Plan policy which protects single-family residential neighborhoods from inappropriate, higher density residential development. TESTIMONY: None. Mayor Waters declared the Public Hearing closed. ACTION: Motion by Van Deventer, seconded by Dalla, in favor of Staff's recommendation to rezone this area from RS-2 to RS-1. Carried by unanimous vote. Absent: Zarate. ZONING STREET REO DRIVE EXTENSION 2. SUBJECT: Public Hearing - Amendment to the combined General Plan/Zoning Map to prezone one acre at 3402 Valley Rd. as RS-2-PUD and rezone adjacent CALTRANS Right -of -Way from RS-1 to RS-2-PUD at the Route 54/Reo Drive Interchange. Applicant: City. Case File No. GP-1992-4/ZC-1992- 2. NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff agreed with the Planning Commission recommendation that the City Council approve the amendment, based on the following findings: 1. That the project will not have a significant effect on the environment and adopt the proposed negative declaration. 2. That the proposed amendment is in the public interest and is consistent with General Plan policies for construction of Reo Drive between Sweetwater Road and Route 54, provision of a broad range of housing types, promotion of a higher rate of homeownership, and development of higher quality housing; since the residential prezoning for annexation of area will increase opportunities for new, higher quality housing development in the City and facilitate extension of Reo Drive. That the rezoning is consistent with and necessary to implement the General Plan, since proposed zoning is identical with the land use designation of the General Plan, and the proposed PUD overlay zone will provide discretionary review to ensure higher quality housing and compatibility with adjacent single-family residential neighborhoods. TESTIMONY: Pasquel Oliveri, 3344 Bonita Heights Lane, Bonita, spoke in opposition to the change, and requested his easement be reopened for mail delivery and better access. Planning Director Post explained that the easement and property that Mr. Oliveri was discussing belongs to CALTRANS, not the City. Santo Oliveri, 3344 Bonita Heights Lane, Bonita, expressed his concerns and frustrations with mail delivery. Mayor Waters declared the Public Hearing closed. ACTION: Motion by Van Deventer, seconded by Dalla in favor of Staff's recommendation and Planning Commission recommendation. Carried by unanimous vote. Absent: Zarate. HOUSING ELEMENT/GENERAL PLAN 1992 3. SUBJECT: Public Hearing - Amendment to the Housing Element of the General Plan. Applicant: City. Case File No. GP-1992-6. NOTE: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff agreed with the Planning Commission recommendation that the City Council approve the amendment, based on the following findings: 1. That the project will not have a significant effect on the environment and adopt the proposed negative declaration. 2. That the proposed amendment is in the public interest; incorporates responses to the State Department of Housing and Community Development on the Housing Element adopted April 14, 1992; and complies with the provisions of the California Government Code for adoption of housing elements; since it provides available information and further analysis of housing needs in the City and clarifies and expands programs for development and conservation of housing for all income groups. TESTIMONY: None. Mayor Waters declared the Public Hearing closed. ACTION: Motion by Waters, seconded by Van Deventer, in favor of the amendment to the Housing Element of the General Plan. NOTE: Mayor Waters requested that Item No. 4, Resolution No. 92-177, be pulled. Motion by Van Deventer, seconded by Inzunza, for approval (except Item No. 41 Carried by unanimous vote. Absent: Zarate CONTRACT 5. Resolution No. 92-178. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION FOR THE RE -ROOFING FIRST LEVEL OF THE CIVIC CENTER PROJECT. (C.I.F. PROJECT NO. 1553-92)." Adopted. See above. CONTRACT 6. Resolution No. 92-179. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH UNITED STATES TESTING CO. INC. TO PROVIDE SOILS AND MATERIALS TESTING SERVICES." Adopted. See above. GRANT/LAW ENFORCEMENT 7. Resolution No. 92-180. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE ACTING CHIEF OF POLICE OF THE NATIONAL CITY POLICE DEPARTMENT TO APPLY FOR AN OFFICE OF CRIMINAL JUSTICE PLANNING GRANT, TO RECEIVE AND ADMINISTER THE GRANT PROCEEDS, AND AUTHORIZING THE TEAM I COMMANDER OF THE NATIONAL CITY POLICE DEPARTMENT TO SIGN ANY AND ALL DOCUMENTS IN CONNECTION WITH SAID GRANT." A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY INITIATING PROCEDURES FOR A REORGANIZATION TO BE KNOWN AS THE REO DRIVE REORGANIZATION. AN-1992-1." Adopted. See above. CONTRACT 4. Resolution No. 92-177 A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING CEMENT CUTTING, INC. TO BE THE LOWEST RESPONSIVE BIDDER AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH CEMENT CUTTING, INC. FOR THE DEMOLITION OF TWO RESIDENTIAL STRUCTURES ON VALLEY ROAD AND SITE CLEARANCE." TESTIMONY: City Engineer Myers recommended that the Resolution be pulled, all bids be rejected and that Council authorize the City Engineer to readvertise the project on a fast track. ACTION: Motion by Inzunza, seconded by Van Deventer, in favor of the City Engineer's recommendation. Carried by unanimous vote. Absent: Zarate. SUBJECT: Request for donation to help support Sweetwater High School's Basketball Program. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor. Carried by unanimous vote. Absent: Zarate. NEW BUSINESS WARRANT REGISTERS 1992 16. SUBJECT: Warrant Register No. 12. Ratification of Demands in the amount of $295,535.01 (Warrant Nos. 123068 through 123168 inclusive excepting Warrant No. 123076) and Certification of Payroll in the amount of $454,133.65. RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Inzunza, seconded by Van Deventer, in favor. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Van Deventer, Waters. Nays: None. Absent: Zarate. WARRANT REGISTERS 1992 17. SUBJECT: Warrant Register No. 13. Ratification of Demands in the amount of $198,034.06 (Warrant Nos. 123170 through 123304 inclusive excepting none). RECOMMENDATION: Staff recommended ratification of these warrants. ACTION: Motion by Inzunza, seconded by Van Deventer, in favor. Warrants carried by the following vote, to -wit: Ayes: Dalla, Inzunza, Van Deventer, Waters. Nays: None. Absent: Zarate. TRAFFIC SAFETY COMMITTEE 1992 18. SUBJECT: Report of the Traffic Safety Committee meeting of August 12, 1992. TESTIMONY: Councilman Van Deventer requested that Item No. 1, 92-12, be referred back to the Traffic Safety Committee. ACTION: Motion by Van Deventer, seconded by Dalla, the report bQ received and filed. No objection as filed. Absent: Zarate. CITY MANAGER - No report. CITY ATTORNEY - No report. OTHER STAFF - No report. MAYOR Mayor Waters read into the record from the Port Commission Agenda Sheet No. 33, dated September 29, 1992 (copy on file in the Office of the City Clerk) regarding the bid for landscaping miscellaneous parkways in National City. The bids were opened on September 24, 1992, and in the very near future major improvements will be seen. Book 74/Page 231 10/06/92 MAYOR (continued) The Mayor also stated that the Port Commission had an item on their Agenda to consider purchasing Mr. Barkett's property for $8,250,000. and making it into a Marina/Seaport Village -type complex. The Port Director's recommendation was to direct staff to continue discussing the acquisition of the 22.5 acres and to develop and return to the Board for its consideration a program for acquisition of the parcel. CITY COUNCIL - No report. PUBLIC ORAL COMMUNICATIONS Everett Dickson, 2745 E. 14th Street, spoke regarding a request to remove the stop sign at 18th and Prospect Streets. City Engineer Myers stated that it would be placed on the next Traffic Safety Committee Agenda. Councilman Dalla requested that Public Works look into the stop sign on C Avenue going south. Kathy Smith, 3028 E. 11th Street, National City, spoke regarding neighborhood clean up attempts and problems that are still unresolved. Ms. Smith submitted a petition (copy on file in the Office of the City Clerk) for division of traffic flow between 10th and 11th Streets. Staff was requested to review the concerns and bring back a report in three weeks. Alfonso Hernandez, 2132 Euclid Avenue, National City, spoke regarding need for clean up on McKinley Avenue. Councilman Van Deventer addressed the issue and explained that the area is one of the next target areas that the Community Development Commission will be addressing. CLOSED SESSION CLOSED SESSION FOR PENDING LITIGATION UNDER GOVERNMENT CODE 54956.9(A) CARRILLO v. THE CITY OF NATIONAL CITY. ACTION: Motion by Van Deventer, seconded by Inzunza, in favor of holding the Closed Session under Government Code Section 54956.9(A). Carried by unanimous vote. Absent: Zarate.
