MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
DECEMBER 22, 1992
The Regular Meeting of the City Council of the City of National City was called to order
at 7:03 p.m. by Mayor Waters.
ROLL CALL
Council members present: Dalla, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Bolint, Eiser, McCabe, Myers, Peoples, Post.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag led by City Manager, Tom G.
McCabe followed by the invocation by Vice Mayor Dalia.
APPROVAL OF MINUTES
Motion by Dalia, seconded by Morrison, the Minutes of the Regular Meeting of
December 15. 1992 be approved. Carried by unanimous vote.
MAYOR'S PRESENTATIONS
PERSONNEL RECOGNITION/APPRECIATION
Mayor Waters read a letter from City Manager McCabe to retiring City Librarian Shula
Monroe into the record (copy on file in the Office of the City Clerk), and then presented
her with a retirement gift and a Gold Key to the City.
Ms. Monroe then presented the Mayor and the City Council with coffee cups with
dinosaurs on them which said "Read --Avoid Extinction!", and thanked everyone for
their support.
BOARDS AND COMMISSIONS
INTERVIEWS/APPOINTMENTS
Mayor Waters turned the meeting over to Vice Mayor Dalla.
TRAFFIC SAFETY COMMITTEE
RECOMMENDATION: Mayor Waters recommended Mr. Vince Reynolds for
re -appointment to the Traffic Safety Committee for a full term.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of the
Mayor's recommendation to re -appoint Vince Reynolds to a full term on
the Traffic Safety Committee. Carried by unanimous vote.

HOUSING AND COMMUNITY DEVELOPMENT COMMISSION
TESTIMONY: Cecilia Mary Kirk, 311 E. 2nd Street, National City, expressed
her interest in serving on the Housing. and Community Development
Commission and answered questions of the Council.
Alda May West, 315 E. 3rd Street, National City, expressed her interest in
serving on the Housing and Community Development Commission and
answered Council's questions.
ACTION: Motion by Inzunza, seconded by Zarate, in favor of the
appointment of Cecilia Mary Kirk and Alda May West to the Housing and
Community Development Commission. Carried by unanimous vote.
CIVIL SERVICE COMMISSION
NOTE: Vice Mayor Dalla stated that one applicant had called and stated that
he was no longer interested in serving on the Civil Service Commission; also
that applicant Del Redding had been interviewed by the Council at the
December 15, 1992 Council meeting.
TESTIMONY: John Aguilera, 921 Hoover Avenue, National City, explained
his interest in serving on the Civil Service Commission and answered Council's
questions.
ACTION: Motion by Inzunza, seconded by Morrison, in favor of the
appointment of John Aguilera and Del Redding to the Civil Service
Commission. Carried by unanimous vote.
Vice Mayor Dalla turned the meeting back to Mayor Waters.
PUBLIC HEARINGS
PLANNED DEVELOPMENT PERMIT 1992
1. SUBJECT: Continued Public Hearing - Appeal of Planning Commission
denial of a Planned Development Permit for the construction of an 18 unit
apartment complex at the northeast corner of Harbison Avenue and 16th Street.
(Applicant: John Siuta, Silvergate Builders, Inc.) (Case File No. PD-1992-4).
Continued from the Council Meeting of December 8, 1992.
NOTE: Notice of Public Hearing and Proof of Publication are on file in the
Office of the City Clerk.
RECOMMENDATION: Staff recommended that Council provide policy
direction regarding land use alternatives.
NOTE: Council members were provided copies of a letter received by
the Mayor from the Law Offices of Wolf, Rifkin & Shapiro, who represent
property owner Leah Isaac (copy on file in the Office of the City Clerk).
TESTIMONY: Planning Director Post gave a brief verbal report on the
Neighborhood Meeting held on December 16, 1992, at 5 p.m. in the
Council Chambers.
John Kampe, 1315 Earl Drive, National City, expressed the concerns of
neighbors in opposition to the proposed apartment complex.
George Kolerick, 5504 Alleghany Street, San Diego, spoke in opposition
to the proposed apartment complex and in support of a gas station.

TESTIMONY: Ray Dracoules, representative of property owner Mrs.
Leah Isaac, expressed his client's position on the issue.
Mayor Waters declared the Public Hearing closed, and requested that Planning
Director Post explain the procedure the appeal would have to follow should they
desire to pursue the development of a gas station.
TESTIMONY: Mr. Dracoules answered questions of the Council
regarding the installation of a fully automated gas station.
City Attorney Eiser noted that unless the applicant states that they are
withdrawing the permit application and pursuing a permit application for
a gas station that: 1) a decision should be made to approve or deny the
application for an apartment complex; or 2) the Public Hearing could be
continued until the applicant could apply for processing of a gas station
application (90 days).
Mr. Dracoules confirmed agreement for a 90-day continuance.
ACTION: Motion by Morrison, seconded by lnzunza, in favor of
continuing the Public Hearing to allow the applicant to pursue a gas
station permit (90 days). Carried by the following vote, to -wit: Ayes:
lnzunza, Morrison, Zarate, Waters. Nays: Dalla.
CONDITIONAL USE PERMIT
2. SUBJECT: Public Hearing - Appeal of Planning Commission's action to
revoke Conditional Use Permit 1990-18 for the sale of beer and wine within a
restaurant at 1430 E. Plaza Boulevard, Suite E-1. (Appellant: Patricio B.
Villanueva). (Case File No. CUP-1992-10).
NOTE: Notice of Public Hearing and Proof of Publication are on file in the
Office of the City Clerk.
RECOMMENDATION: Staff concurred with the Planning Commission
decision to revoke Conditional Use Permit No. 1990-18 based on the finding
set forth in Planning Commission Resolution No. 26-92, and recommended that
the appeal be denied.
NOTE: Planning Director Post gave a brief overview of the occurrences at the
property and noted the receipt of a letter in support of the revocation of the
Permit by PNS Stores Inc. (copy on file in the Office of the City Clerk).
TESTIMONY: Pat Villanueva, 82221 Waterman Court, Spring Valley,
owner of Jollibee Family Restaurant, spoke in support of his appeal.
Mayor Waters declared the Public Hearing closed.
ACTION: Motion by Dalla, seconded by Morrison, to concur with the
Planning Commission decision and recommendation that the appeal be
denied and the Conditional Use Permit be revoked. This action is based
on the findings contained in the Planning Commission Resolution No.
26-92. Carried by unanimous vote.

COMMUNITY DEVELOPMENT HOME INVESTMENT PLAN
3. SUBJECT: Public Hearing - Approving and authorizing the submittal of the
Federal Fiscal Year 1993 Home Investment Partnership Annual Plan.
NOTE: Notice of Public Hearing and Proof of Publication are on file in the
Office of the Community Development Commission.
RECOMMENDATION: Staff recommended approval.
TESTIMONY: Assistant Director of the Community Development
Commission David Sheldon gave a brief verbal overview of the Plan.
Alfonso Hernandez, 2132 Euclid Avenue, National City, made inquiry of
the Council.
Mayor Waters declared the Public Hearing closed.
ACTION: Motion by Inzunza, seconded by Morrison, in favor of the
1993 Home Investment Partnership Annual Plan. Carried by unanimous
vote.
SOLID WASTE/ADMIN
GRANT/AB939
4. SUBJECT: Public Hearing - Adoption of the Preliminary Source Reduction
and Recycling Element and the Household Hazardous Waste Element of the
City's Solid Waste Management Plan.
NOTE: Notice of Public Hearing and Proof of Publication are on file in the
Office of the City Clerk.
RECOMMENDATION: Staff recommended accepting public input.
TESTIMONY: None.
Mayor Waters declared the Public Hearing closed.
Item No. 8, Resolution No. 92-233 was heard at this time.

8. Resolution No. 92-233. A "RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY ADOPTING THE PRELIMINARY SOURCE
REDUCTION AND RECYCLING ELEMENT AND THE HOUSEHOLD
HAZARDOUS WASTE ELEMENT OF THE CITY'S WASTE MANAGEMENT
PLAN."
ACTION: Motion by Morrison, seconded by Inzunza, for approval of
Resolution No. 92-233. Carried by unanimous vote.
CONSENT CALENDAR
ADOPTION OF CONSENT RESOLUTIONS (Resolution Nos. 92-230 through 92-
234). NOTE: Mayor Waters pulled Item No. 7 (Resolution No. 92-232), Item No. 8
(Resolution No. 92-233) was acted upon under Item No. 4, and a member of the public
requested Item No. 6 be pulled (Resolution No. 92-231). Motion by Zarate, seconded
by Morrison, for approval. Carried by unanimous vote.

CONTRACT
5. Resolution No. 92-230. "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY ACCEPTING WORK AND AUTHORIZING THE
FILING OF THE NOTICE OF COMPLETION FOR THE COMBINED PROJECTS:
CIVIC CENTER STORM DRAIN I AND II AND HOOVER AVENUE STORM
DRAIN. (ENGINEERING SPECS. NO. 92-1)."
ACTION: Adopted. See above.
COMMUNITY DEVELOPMENT HOME INVESTMENT PLAN 1993
9. Resolution No. 92-234. A "RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY APPROVING AND AUTHORIZING THE SUBMITTAL
OF THE FISCAL YEAR 1993 HOME INVESTMENT PARTNERSHIPS ANNUAL
PLAN."
ACTION: Adopted. See above.
TRAFFIC SIGNAL/SIGN
6. Resolution No. 92-231. "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY AUTHORIZING THE INSTALLATION OF STOP SIGN
ON 20TH STREET AT VAN NESS AVENUE."
RECOMMENDATION: The Staff recommends that the stop signs not be
installed because the Stop Sign Warrants have not been met.
TESTIMONY: Alfonso Hernandez, 2132 Euclid Avenue, National City,
spoke in support of Staff's recommendation not to approve the proposed
stop sign installation.
ACTION: Motion by Inzunza, seconded by Zarate to authorize the
installation of stop signs at 20th Street and Van Ness Avenue based on
the videos provided by concerned neighbors indicating their need. and
the fact that the intersection is at the crest of a hill which restricts the
visibility of west -bound traffic on 20th Street. Carried by unanimous vote.
CONTRACT
7. Resolution No. 92-232. A "RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT WITH THE CITY OF CHULA VISTA FOR FIRE DEPARTMENT
DISPATCHING SERVICES."
TESTIMONY; City Attorney Eiser stated that an issue had arisen after
placement of this item on the Agenda, and recommended that this item
be filed at this time.
ACTION: Motion by Inzunza, seconded by Morrison, to file this item.
No objection as filed.

LAW ENFORCEMENT ADMIN
10. SUBJECT: Update to City Council concerning neighborhood problems
surrounding Plaza Manor Apartments.
RECOMMENDATION: Staff recommended that the report be filed.
TESTIMONY: Acting Police Chief Tom Deese gave a brief verbal
update on actions taken to date.
Kathy Smith, 3028 E. 11th Street, National City, commended actions by
the Police Department, the improvements made, and expressed
concerns on the remaining traffic in the area, that gates remain closed,
and requested that Arcadia be red curbed, and tunnel grates be
installed, especially by Harbison and the separation between the two
streets.
WRITTEN COMMUNICATIONS
REVENUE & TAXATION
11. SUBJECT: Letter from Yair Eldar, General Manager, Radisson Inn & Suites of
National City concerning Ordinance #92-2038 - Occupancy Tax for Federal or
State Employees who are Paying with a Government Check.
TESTIMONY: Yair Eldar, Manager of the Radisson Inn and Suites,
National City, spoke in support of his request. Mr. Eldar confirmed that
his request was for the ordinance to be amended to provide for collection
of transient occupancy tax if the government employee pays for a room
and is reimbursed by the government.
ACTION: Motion by Zarate, seconded by Morrison, to hold this
item over for Staff to provide a more in-depth study and status of
other cities' actions on this topic in 30 days (January 26. 1993).
Carried by unanimous vote.
NEW BUSINESS
WARRANT REGISTERS 1992
12. SUBJECT: Warrant Register No. 24. Ratification of Demands in the amount
of $122,301.44 (Warrant Nos. 124316 through 124397 inclusive excepting
none) and Certification of Payroll in the amount of $535,121.21.
RECOMMENDATION: Staff recommended ratification of these warrants.
ACTION: Motion by Morrison, seconded by Waters, in favor. Warrants
carried by the following vote, to -wit: Ayes: Dalia, Inzunza, Morrison,
Zarate, Waters. Nays: None.

COMMUNITY POLICING PROGRAM
13. SUBJECT: Report to the City Council on the 1992 National City Police
Department Attitude and Public Opinion Survey.
RECOMMENDATION: Staff recommended that the report be approved.
ACTION: Motion by Inzunza, seconded by Morrison, the report be
filed. No objection as filed.
CITY MANAGER - No report.
City Manager McCabe wished all a Happy Holiday.
CITY ATTORNEY - No report.
City Attorney Eiser wished all a Happy Holiday.
OTHER STAFF - No report.
MAYOR - No report.
Mayor Waters wished a "Merry Christmas to all."
CITY COUNCIL
COUNCIL POLICY
14. SUBJECT: Rescheduling release of weekly agenda to Thursdays at 4:00
p.m.
ACTION: Motion by Morrison, seconded by Inzunza, to refer to City
Staff to provide comments (pros & cons) of such rescheduling. Carried
by unanimous vote.
Councilman Inzunza wished all a Merry Christmas and a Happy New Year.
PUBLIC ORAL COMMUNICATIONS
Alfonso Hernandez, 2132 Euclid Avenue, National City, expressed his opinions on the
inconsistency of Council's actions, the unauthorized dumping on the area of Grove
and Sweetwater, Newell Street and 24th Street, and weeds in public right-of-way.
Everett Dickson, 2745 E. 14th Street, National City, stated that he was the one who
instigated the removal of the stop sign by 18th Street and Prospect, but supports it
being left there as the neighborhood requested.
Al Alvarado, 2423 E. 20th Street, National City, stated he is working on a plan for the
Sister -City Committee, which he will bring back to Council. He commented on Arcadia
area parking and suggested permit parking for the residents.
Tom Deese, Acting Chief of Police, spoke regarding a local family whose home was
destroyed by a fire last Sunday and requested support.
Alda West, 315 E. 3rd Street, National City, thanked the City Council and the whole
City Government for a job well done!
Cecilia Kirk, 311 E. 2nd Street, National City, made inquiry as to whether the
Committee Against Card Casino could donate remaining funds of $42 to the family
that Acting Police Chief Deese referred to.

Al Alvarado, 2423 E. 20th Street, National City, expressed his opinion on the hotel tax
issue.

Motion by Zarate, seconded by Dalla, to adjourn to the next Regular City Council
Meeting of January 12. 1993 at 7 P.M. - Council Chambers. Civic Center. Carried by
unanimous vote.
