HomeMy WebLinkAbout2000 01-25 CC MINBook 82/Page 13 1/25/2000 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA JANUARY 25, 2000 The Regular Meeting of the City Council of the City of National City was called to order at 6:05 p.m. by Mayor Waters. ROLL CALL Councilmembers present: Beauchamp, Inzunza, Morrison, Soto, Waters. Administrative officials present: Campbell, Dalla, Desrochers, DiCerchio, Eiser, McCabe, Myers, Post, Trees. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Soto. APPROVAL OF MINUTES Motion by Inzunza, seconded by Waters, the Minutes of the Regular Meeting of January 18, 2000, be approved. Carried by unanimous vote. PUBLIC HEARING MUNICIPAL CODE 2000 (506-2-15) 1. Public Hearing — Amendment to Title 18 (Zoning) of the National City Municipal Code regarding transitional housing for the homeless. (Applicant: South Bay Community Services) (Case File No.: A-1999-4) (Planning) Note: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff concurred with the decision of the Planning Commission to deny the request. TESTIMONY: Kathryn Lembo, Director, South Bay Community Services, 315 4th Ave., explained the nature of the proposed use and project, and spoke in favor. Ms. Lembo Book 82/Page 14 1/25/2000 PUBLIC HEARING (cont.) emphasized that the facility was not intended for the homeless but rather would house National City residents currently spread throughout the community. Time is critical to retain the funding and the facility in National City. Georgia Guarano, 410 Harbison Ave., Chairperson for the CDC Advisory Board, stated that the Board voted against the proposed project. Aileane Roberts, 845 E. 13t Street, spoke against the proposed project. ACTION: Motion by Beauchamp, seconded by Inzunza, to determine that the item before us has been based on a misinterpretation of the classification of the application upon which the item is based, and that it is not subject to Title 18. Motion amended to continue the Public Hearing on the amendment to the Title 18 and bring the previous motion on the agenda as a separate item specific to the project proposed by South Bay Community Services. Carried by unanimous vote. CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. Item Nos. 2 through 3 (Resolution Nos. 2000-5, 2000-6), Item No. 4 (Warrant Register No. 29), and Item No. 5 (Consolidated Cash and Investment Report as of August 31, 1999). Motion by Inzunza, seconded by Soto, the Consent Calendar be approved. Carried by unanimous vote. PARKING ADMIN 2000 (801-2-20) 2. Resolution No. 2000-5. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY ENGINEER TO ESTABLISH A ONE -HOUR LIMITED TIME PARKING ZONE ON THE SOUTH SIDE OF 171" STREET BETWEEN NATIONAL CITY BOULEVARD AND THE Book 82/Page 15 1/25/2000 PARKING ADMIN 2000 (cont.) ALLEY ADJACENT TO THE PROPERTY AT 1705 NATIONAL CITY BOULEVARD. (A. FILSON, TSC ITEM NO. 2000-2)." (Engineering) ACTION: Adopted. See above. EMERGENCY DECLARATION ADMIN (301-1-2) 3. Resolution No. 2000-6. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY COUNCIL TO DECLARE AN EMERGENCY FOR THE REPAIR AND RESTORATION OF THREE STRUCTURES DAMAGED BY A SEWAGE OVERFLOW." (Public Works) ACTION: Adopted. See above. WARRANT REGISTER (202-1-14) 4. Warrant Register #29. Ratification of Demands in the amount of $941,805.21. (Finance) ACTION: Approved. See above. FINANCIAL MANAGEMENT 2000 (204-1-14) 5. SUBJECT: Consolidated Cash and Investment Report as of August 31, 1999. (Finance) ACTION: Approved. See above. NON CONSENT RESOLUTIONS CIVIL SERVICE COMMISSION APPEALS (603-2-5) 6. Resolution No. 2000-7. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AFFIRMING THE DECISION OF THE CIVIL SERVICE COMMISSION IN THE MATTER OF THE APPEAL OF VIVIANE ELIG." (City Attorney) RECOMMENDATION: Staff recommended approval. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Beauchamp, to adopt Resolution No. 2000-7. Carried by unanimous vote. Book 82/Page 16 1/25/2000 NEW BUSINESS CITY MANAGER. No Report. CITY ATTORNEY. No Report. OTHER STAFF. No Report. MAYOR Mayor Waters reminded everyone about the ribbon cutting for the Harrison Avenue extension and Rail Car Roundhouse project to be held on Thursday, January 27`1'. Mayor Waters read a letter of commendation that was sent on behalf of Fire Battalion Chief Don Condon and a letter the Mayor sent to Assemblywoman Ducheny regarding parking for the proposed Educational Village project. POLITICAL SUPPORT ADMIN (102-4-1) 7. SUBJECT: Memorandum and sample resolution of support for Proposition 14, California Reading and Literacy Improvement and Public Library Construction and Renovation Bond Act of 2000 from the City Librarian. (Library) TESTIMONY: Anne Campbell, City Librarian, spoke in favor of the resolution and answered questions. ACTION: Motion by Inzunza, seconded by Beauchamp, to bring back a Resolution next week. Carried by unanimous vote. CITY COUNCIL POLITICAL SUPPORT ADMIN (102-4-1) 8. SUBJECT: Discussion of a Model Resolution opposing SB329 (Peace). (Councilman Morrison) TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by Soto, to bring back a Resolution next week. Carried by unanimous vote. Book 82/Page 17 1/25/2000 STREET DEDICATING / NAMING 2000 (903-11-15) 9. SUBJECT: Discussion of Harrison Avenue Extension Name Change. (Councilman Inzunza) TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by lnzunza, to change the name to Marina Way. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Soto. Nays: Morrison, Waters. Absent: None. Abstain: None. Councilman Soto expressed his belief that the City Council should hear from both sides prior to taking a position on a ballot Proposition and that it was his intention to refrain from voting on anything unless he hears both sides. PUBLIC ORAL COMMUNICATIONS Joaquin Castro, CMF Environmental, 477 Marina Pkwy, Chula Vista, passed out materials, including a petition, and requested that the City Council consider changing the rule that prohibits the relocation of houses into the City. Mr. Castro was referred to the Planning Department. Bertha Vasquez, 1422 "Q" Avenue #9, outlined her experiences and complained about the treatment she received from SoCal Development Corporation. Desiree Brisento, 1400 "Q" Avenue 141, complained about the practices and treatment she received from SoCal Development and the fact that the residents have not been apprised of their rights. Socorro Pompa, no current address, formerly from 1440 "Q" Avenue, complained about SoCaI Development. Hector Aguilar, 1436 "Q" Avenue #10, told of his experiences and the experiences of others in dealing with SoCal Development . Mr. Aguilar Book 82/Page 18 1/25/2000 PUBLIC ORAL COMMUNICATIONS (cont.) provided statistics on the number of families that have been evicted and the number that have been relocated by SoCal Development and referenced some applicable law dealing with such actions. Francisco Chavez, 1537 "Q" Avenue #6, said he spoke with the Deputy Director of the CDC about SoCal Development. Margarita Martinez, 1436 "Q" Avenue, #8, complained about SoCal Development's treatment of the people on "Q" Avenue. CDC staff indicated that they would follow up on the issues raised, contact the Fair Housing Council to act as mediators if necessary, and report back to the Commission. Terry Hanks, 1430 "L" Avenue, voiced some complaints he has with the practices of the Police Department and distributed signed statements from three businesses on the West side. ADJOURNMENT Motion by Morrison, seconded by Beauchamp, the meeting be adjourned to the Next Regular City Council Meeting, February 1, 2000, at 3:00 p.m., Council Chambers, Civic Center.
