HomeMy WebLinkAbout2000 04-11 CC MINBook 82/Page 91 4/11/00 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA APRIL 11, 2000 The Regular Meeting of the City Council of the City of National City was called to order at 6:00 p.m. by Mayor Waters. ROLL CALL Councilmembers present: Beauchamp, Inzunza, Morrison, Soto, Waters. Administrative officials present: Dalla, DiCerchio, Eiser, McCabe, Morse, Myers, Post, Trees, Yeo. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag led by City Manager Tom G. McCabe, followed by the invocation by Vice Mayor Soto. APPROVAL OF MINUTES Motion by Inzunza, seconded by Morrison, the Minutes of the Adjourned Regular Meeting of March 8, 2000, the Minutes of the Adjourned Regular Joint Meeting of March 29, 2000, and the Minutes of the Regular Meeting of April 4, 2000, be approved. Carried by unanimous vote. PRESENTATION (102-14-2) Port Commissioner Jess Van Deventer — Biannual Port of San Diego Update. Port Commissioner Van Deventer provided a written and verbal report and update on: a) SDG&E fuel storage tanks in National City; b) MOU between the CDC and the Port; c) Rail Car Art Plaza; d) National Distribution Center property; e) Marina project and scheduling; f) Wharf extension project; g) Derelict vessel removals; h) National City Marine Terminal automobile operations; I) Major real estate projects; j) Airport; k) Baseball stadium; and 1) Miscellaneous Port and property issues. Book 82/Page 92 4/11/00 PUBLIC HEARINGS UNDERGROUND UTILITY DISTRICT 21 ADM1N (904-1-7) 1. Public Hearing to determine whether the Public Health, Safety or Welfare require the formation of Underground Utility District No. 21 (Phase III) on Highland Avenue from 16th Street to 24th Street. (Engineering) Note: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: None. TESTIMONY: None. ACTION: There were no speakers. The hearing was closed. UNDERGROUND UTILITY DISTRICT 22 ADMIN (904-1-8) 2. Public Hearing to determine whether the Public Health, Safety or Welfare require the formation of Underground Utility District No. 22 on National City Boulevard from 35th Street to "C" Avenue. (Engineering) Note: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: None. TESTIMONY: None. ACTION: There were no speakers. The hearing was closed. CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. Item Nos. 3 through 6 (Resolution No. 2000-36, 2000-37, 2000-38, 2000-39), Item No. 7 (Warrant Register No. 40), and Item Nos. 8 and 9 (Claims for Damages). Motion by Inzunza, seconded by Morrison, Item No. 5 be pulled, the remainder of the Consent Calendar be approved, and the Claims for Damages be denied. Carried by unanimous vote. STREET / DIVISION WIDENING (903-16-2) 3. Resolution No. 2000-36. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING CHANGE ORDER NO. 1 FOR THE DIVISION STREET WIDENING FROM Book 82/Page 93 4/11/00 STREET/ DIVISION WIDENING (cont.) DREXEL AVENUE TO THE EAST CITY LMITS PROJECT. (ENGINEERING SPEC. NO. 96-5) (Public Works/ Engineering) ACTION: Adopted. See above. STREET / DIVISION WIDENING (903-16-2) 4. Resolution No. 2000-37. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING CHANGE ORDER NO. 2 FOR THE DIVISION STREET WIDENING FROM DREXEL AVENUE TO THE EAST CITY LIMITS PROJECT. (ENGINEERING SPEC. NO. 96-5) (Public Works/Engineering) ACTION: Adopted. See above. N.C. TRANSIT PARATRANSIT PLAN (TDA FUNDS) (805-1-4) GRANT TDA/TRANSPORTATION DEV ACT FUNDS (206-4-9) 5. Resolution No. 2000-38. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING EXECUTION OF CLAIMS, AGREEMENTS AND APPLICATIONS NECESSARY FOR THE RECEIPT OF TRANSPORTATION DEVELOPMENT ACT FUNDS FOR FISCAL YEAR 2001." (National City Transit) RECOMMENDATION: Staff recommended approval. TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by Morrison, to adopt Resolution No. 2000-38. Carried by unanimous vote. CONTRACT (C2000-15) COMPUTER DATA NETWORK SYSTEM (1200-01-02) 6. Resolution No. 2000-39. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING THE BID FROM GTC SYSTEMS, INC. AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT FOR THE PURCHASE OF COMPUTER NETWORK HARDWARE. (CMO/MIS) ACTION: Adopted. See above. Book 82/Page 94 4/11/00 WARRANT REGISTER (202-1-14) 7. Warrant Register #40. Ratification of Demands in the amount of $200,825.83. (Finance) ACTION: Approved. See above. CLAIMS (501-1-144) 8. SUBJECT: Claim for Damages: Arturo A. Gonzalez and Maria D. Gonzalez. (City Clerk) ACTION: Denied. See above. CLAIMS (501-1-144) 9. SUBJECT: Claim for Damages: Tomas Garcia Diaz. (City Clerk) ACTION: Denied. See above. ORDINANCES FOR ADOPTION Motion by Morrison, seconded by Inzunza, the Ordinances be adopted by title only. Carried by unanimous vote. MUNICIPAL CODE 2000 (506-2-15) 10. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING TITLE 18 (ZONING) OF THE NATIONAL CITY MUNICIPAL CODE REGARDING THE REGULATION OF MARKETS SELLING SEAFOOD. APPLICANT: CITY INITIATED. CASE FILE NO. A-2000-1." (Planning) ACTION: Motion by Morrison, seconded by Inzunza, to adopt Ordinance No. 2000-2173. Carried by unanimous vote. MUNICIPAL CODE 2000 (506-2-15) 11. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY REZONING CERTAIN PARCELS OF REAL PROPERTY PURSUANT TO THE LAND USE CODE. CASE FILE NOS. GP-2000-1, GP-2000-2, ZC-2000-1, ZC-2000-2. (Planning) Book 82/Page 95 4/11/00 MUNICIPAL CODE 2000 (cont.) ACTION: Motion by Morrison, seconded by Inzunza, to adopt Ordinance No. 2000-2174. Carried by the following vote to -wit: Ayes: Inzunza, Morrison, Soto, Waters. Nays: None. Absent: None. Abstain: Beauchamp. Councilman Beauchamp stated that his abstention was due to the fact that he owns property near the site being rezoned. NEW BUSINESS CONDITIONAL USE PERMITS 2000 (403-15-1) 12. SUBJECT: Notice of Decision — Conditional Use Permit to allow a wireless communications facility at 700 National City Boulevard (Applicant: Metricom, Inc.) (Case File No. CUP-2000-4). (Planning) RECOMMENDATION: Staff concurred with the decision of the Planning Commission and recommended that the Notice of Decision be filed. TESTIMONY: None. ACTION: Accepted and filed. CONDITIONAL USE PERMITS 2000 (403-15-1) 13. SUBJECT: Notice of Decision — Conditional Use Permit to allow the sale of distilled spirits in addition to the currently permitted sale of beer and wine in a market at 1220 E. Plaza Boulevard (Applicant: Smart and Final) (Case File No.: CUP-2000-3). (Planning) RECOMMENDATION: Staff concurred with the decision of the Planning Commission and recommended that the Notice of Decision be filed. TESTIMONY: None. ACTION: Accepted and filed. NATIONAL CITY COMMUNITY CENTER (1101-5-1) 14. SUBJECT: Use of the Community Building by the InterAmerican College, and Waiver of Fees. (Public Works) RECOMMENDATION: Staff requested Council decision on use and waiver of fees. Book 82/Page 96 4/11/00 NATIONAL CITY COMMUNITY CENTER (cont.) TESTIMONY: None. ACTION: Motion by Inzunza, seconded by Beauchamp, to approve the request, including waiver of fees. Carried by unanimous vote. TEMPORARY USE PERMITS 2000 (203-1-16) 15. SUBJECT: Temporary Use Permit — California Conservation Corps. (Building & Safety) RECOMMENDATION: Staff recommended approval subject to compliance with all conditions of approval, and grant the waiver of fees. TESTIMONY: None. ACTION: Motion by Waters, seconded by Beauchamp, to approve the request, including waiver of fees. Carried by unanimous vote. CITY MANAGER. No Report. CITY ATTORNEY. No Report. OTHER STAFF. No Report. MAYOR Mayor Waters expressed concern about work in progress and the condition of the streets for the Maytime Band Review. Staff advised that construction would be halted prior to the parade. Mayor Waters reported that David Manriquez, a lifetime resident who was very active in the Boys & Girls Club and with National City youth, had died and that a Memorial Service would be held on Saturday, April 15th at the Boys & Girls Club. Book 82/Page 97 4/11/00 CITY COUNCIL Councilman Morrison read newspaper excerpts dealing with a) the Steve Peace Bill, and b) comments about the importance of Downtown San Diego in relation to the rest of the region. Councilman Beauchamp reported that LAFCO has approved the dissolution of the Lower Sweetwater Fire Protection District and suggested that it is a good time to revisit the annexation issue. PUBLIC ORAL COMMUNICATIONS. None. CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION. Initiation of Litigation pursuant to Government Code Section 54956.9(c). (One potential case) ACTION: Motion by Beauchamp, seconded by Morrison, to go into closed session. Carried by unanimous vote. Councilmembers left the Council Chambers at 7:05 p.m. ADJOURNMENT The meeting was adjourned in honor of David Manriquez to the Next Regular City Council Meeting, April 18, 2000, at 3:00 p.m., Council Chambers, Civic Center.
