MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
OCTOBER 24, 2000
The Regular Meeting of the City Council of the City of National City was
called to order at 6:01 p.m. by Mayor Waters.
ROLL CALL
Councilmembers present: Beauchamp, Inzunza, Morrison, Soto, Waters.
Administrative officials present: Dalla, Eiser, Kirkpatrick, Kimble, Morse,
Ray, Ruiz, Short, Trees.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag by Assistant City
Manager Park Morse, followed by the invocation by Vice Mayor Soto.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Beauchamp, the Minutes of the Regular
Meeting of October 17, 2000, be approved. Carried by unanimous vote.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Beauchamp, the Proclamation be read in
its entirety. Carried by unanimous vote.
The Proclamation proclaiming October 22-28, 2000, to be: "WORLD
POPULATION AWARENESS WEEK," was read in its entirety by
Mayor Waters.
PUBLIC HEARING
CONDITIONAL USE PERMITS 2000 (403-15-1)
1. Public Hearing — Conditional Use Permit to allow alcohol sales at the
relocated Wrigley's Supermarket at 34 N. Euclid Avenue (Applicant:
Sam Arabo). (Case File No.: CUP-2000-20) (Planning)

CONDITIONAL USE PERMITS 2000 (403-15-1)
Note: Notice of Public Hearing and Proof of Publication are on file
in the Office of the City Clerk.
RECOMMENDATION: Staff concurred with the decision of the
Planning Commission and recommended that the Conditional Use
Permit be approved with the inclusion of all conditions approved by
the Commission.
TESTIMONY: Attorney Freddy Garmo, 275 E. Douglas
Ave., #110, El Cajon, representing Wrigley's Market, spoke in
favor of waiving four of the conditions recommended by the
Planning Commission and turned in a petition in support of the
market.
ACTION: Motion by Morrison, seconded by Beauchamp, to
concur with the Planning Commission's recommendation with
one minor modification to Condition No. 7, to delete the
reference to cork vs. screw caps for wine. Carried by
unanimous vote.
PUBLIC HEARING
VARIANCE DENIALS 2000 (409-1-30)
2. Public Hearing — Tentative Parcel Map for the division of one lot into
two with a variance to allow a reduced front yard setback in the 1200
block of K Avenue (Applicant: Raul Thompson). (Case File Nos.:
LS-1999-2, Z-1999-3) (Planning)
Note: Notice of Public Hearing and Proof of Publication are on file
in the Office of the City Clerk.
RECOMMENDATION: Staff concurred with the decision of the
Planning Commission and recommended that the Tentative Parcel
Map and Variance be approved.
TESTIMONY: Raul Thompson, 3145 Lloyd St., San Diego,
spoke in favor of the Parcel Map and variance.
David Hargrave, 1557 Antoine Dr., San Diego, spoke in favor
of the Parcel Map and variance.

Robert Johnson, 1214 'K' Ave., spoke in opposition to the
variance.
Larry Tagle, 1204 'K' Ave., spoke in opposition to the variance.
ACTION: Motion by Morrison, seconded by Soto, to deny.,
without prejudice, the Tentative Parcel Map based on findings
that: a) the: proposed Map is not consistent with the General
Plan; and b) that the site is not physically suitable for the
proposed type of development or proposed density; and the
Request for a Variance be denied, without prejudice, based on
findings that: a) the request, if granted, would constitute a grant
of special privileges not enjoyed by others and; b) the variance.,
if granted, would authorize a use or activity which is not
otherwise granted or authorized by the zoning regulations
governing the property. Carried by unanimous vote.
CONSENT CALENDAR
ADOPTION OF CONSENT CALENDAR. Item Nos. 3 though 9
(Resolution Nos. 2000-132, 2000-133, 2000-134, 2000-135, 2000-136,
2000-137, 2000-138), and Item No. 10 (Warrant Register No. 16). Motion
by Beauchamp, seconded by Morrison, Item Nos. 3, 5, 8 and 9 be pulled,
the remainder of the Consent Calendar be approved, and the Claim for
Damages be denied. Carried by unanimous vote.
CONTRACT (C2000-5)
3. Resolution No. 2000-132. "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE AN AMENDMENT TO THE
AGREEMENT BETWEEN THE CITY OF NATIONAL CITY AND
PARTERRE LANDSCAPE ARCHI"LECTURE TO PROVIDE
SCHEMATIC, DESIGN AND DEVELOPMENT PLANS FOR THE
CIVIC CENTER LANDSCAPE IMPROVEMENT PLAN, AND
AUTHORIZING THE CITY MANAGER TO EXPEND
ADDITIONAL FUNDS TO IMPLEMENT SAID AMENDMENT."

RECOMMENDATION: Staff recommended approval.
TESTIMONY: Patrick O'Connor, Parterre Landscape
Architecture, 1221 Hays Avenue, San Diego, responded to
questions.
ACTION: Motion by Beauchamp, seconded by Morrison, to
approve staff's recommendation. Carried by unanimous vote.
GRANT / LAW ENFORCEMENT (302-1-2)
GRANT / DRUG SUPPRESSION IN SCHOOL (206-4-17)
4. Resolution No. 2000-133. "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING THE
UNITED STATES DEPARTMENT OF JUSTICE LOCAL LAW
ENFORCEMENT BLOCK GRANT." (Police)
TESTIMONY: City Attorney Eiser pointed out that there is a
typographical error in the Resolution and the proper Grant
Award amount should be $138,411.
ACTION: Approved. See above.
CONTRACT (C2000-44)
5. Resolution No. 2000-134. "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AWARDING A
CONTRACT TO T&M ELECTRIC, INC FOR THE TRAFFIC
SIGNAL INTERCONNECT PROJECT ON NATIONAL CITY
BOULEVARD / PLAZA BOULEVARD (ENGINEERING SPEC.
97-6)." (Public Works / Engineering)
RECOMMENDATION: Staff recommended approval.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, to
approve staff's recommendation. Carried by unanimous vote.

6. Resolution No. 2000-135. "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE CITY ENGINEER TO ESTABLISH A RED "NO PARKING"
ZONE BETWEEN THE DRIVEWAYS SERVING 2825 "J"
AVENUE AND 2837 "J" AVENUE (J. STRUIKSMA, TSC ITEM
NO. 2000-18)." (Engineering)
ACTION: Adopted. See above.

7. Resolution No. 2000-136. "RESOLUTION OF THE CITY

THE CITY ENGINEER TO ESTABLISH A "NO PARKING FIRE
LANE" IN THE 400 BLOCK OF LANTANA DRIVE (FIRE

CONTRACT (C2000-45)
8. Resolution No. 2000-137. "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE AN AGREEMENT WITH RANDALL
FUNDING & DEVELOPMENT, LLC TO RAISE A MINIMUM OF
$500,000 IN NEW GRANT FUNDS FOR THE CITY." (City
Manager)
RECOMMENDATION: Staff recommended approval.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, to
approve staff's recommendation. Carried by unanimous vote.

9. Resolution No. 2000-138. "RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE AN AGREEMENT WITH BI TRAN
SYSTEM, INC FOR THE DESIGN AND IMPLEMENTATION OF

RECOMMENDATION: Staff recommended approval.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, to
approve staff's recommendation with the understanding that it
is the Council's intent to look at collaborative efforts to secure
grant funding. Carried by unanimous vote.
WARRANT REGISTER (202-1-15)
10. Warrant Register # 16. Ratification of Demands in the amount of
$282,286.45. (Finance)
ACTION: Approved. See above.
NEW BUSINESS
VARIANCE DENIALS 2000 (409-1-30)
11. SUBJECT: A request of City Council to approve a waiver from
Council Policy, "Standards for Public Right -of -Way and Public
Improvements Installed Thereon," adopted by Ordinance No.
92-2033 on June 16, 1992." (Engineering) Refer to Item No. 2.
RECOMMENDATION: Staff recommended that City Council
uphold the current policy. However, in light of development
constraints, if the City Council approves a waiver from the City
standards, staff recommended that parking be prohibited in the
cul-de-sac.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Soto, to deny
without prejudice. Carried by unanimous vote.

POLITICAL SUPPORT ADMIN (102-4-1)
12. SUBJECT: Consider jointing Amicus curie briefs in Alameda
Books v. City of Los Angeles, Lim v. City of Long Beach, and
Cornette v. Department of Transportation. (City Attorney)
RECOMMENDATION: Staff recommended approval.
TESTIMONY: None.
ACTION: Motion by Waters, seconded by Soto, to approve
staffs recommendation. Carried by unanimous vote.
NATIONAL CITY COMMUNITY CENTER (1101-5-1)
13. SUBJECT: Use of the South Room of the Community Center for a
Ca1PERS workshop. (Public Works)
RECOMMENDATION: None.
TESTIMONY: None.
ACTION: Motion by Inzunza, seconded by Waters, to
approve staffs recommendation. Motion withdrawn. Motion
by Beauchamp, seconded by Morrison, to deny staff s
recommendation. Carried by unanimous vote.
TEMPORARY USE PERMITS 2000 (203-1-16)
14. SUBJECT: Temporary Use Permit — Full Gospel Business Men's
Fellowship International. (Building & Safety)
RECOMMENDATION: Staff recommended to deny the
Application for a Temporary Use Permit based on the Police and
Parks and Recreation Departments' recommendations.
TESTIMONY: Alfred Morales, 520 'E' Ave., spoke in favor.
ACTION: Motion by Beauchamp, seconded by Morrison, in
favor of staff s recommendation to deny the request. Carried
by unanimous vote.
CONDITIONAL USE PERMITS 2000 (403-15-1)
15. SUBJECT: Notice of Decision — Conditional Use Permit for martial
arts studio at 2505 E. Division Street, Suite C (Applicant: Marcelin
Deleon). (Case File No. CUP-2000-23)." (Planning)

RECOMMENDATION: Staff concurred with the decision of the
Planning Commission and recommended that the Notice of Decision
be filed.

CITY ATTORNEY. No Report.
OTHER STAFF
City Clerk Dalla reminded the Council, staff and public that the City Clerk
would be hosting National City's Election Central on Tuesday, November 7,
2000.
MAYOR
Mayor Waters said there will be a major new store coming to Plaza Bonita,
but he was not at liberty to disclose the name.
CITY COUNCIL
Councilman Morrison reported graffiti on vehicles at two locations and
asked the City Attorney to report back on what can be done.
PUBLIC ORAL COMMUNICATIONS
Betty Lang, 1314 '0' Avenue, read a letter complimenting Councilman
Morrison for his efforts on behalf of residents in her neighborhood. Mayor
Waters reviewed a complaint he received from the neighborhood and the
subsequent referral and actions taken by city staff.
ADJOURNMENT
Motion by Inzunza, seconded by Soto, the meeting be adjourned to the Next
Regular Council Meeting, November 14, 2000, at 6:00 p.m., Council
Chambers, Civic Center. Carried by unanimous vote.
