ROLL CALL Councilmembers present: Inzunza, Soto, Waters. Councilmembers absent: Beauchamp, Morrison. Administrative officials present: DiCerchio, Dalla, Desrochers, Eiser, Hodges, Kimble, Matienzo, McCabe, Morse, Myers, Post, Ruiz, Trees. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag and invocation by City Manager Tom McCabe. APPROVAL OF MINUTES Motion by Beauchamp, seconded by Morrison, the Minutes of the Regular Meeting of January 23, 2001, be approved. Carried by unanimous vote. Absent: Beauchamp, Morrison. MAYOR'S PRESENTATION (102-14-2) Concerned Parents for Safe Skating in National City. Jarrod Pollard, 306 4th Street, and Dan Iono, representing the Skate National City Project, reviewed the written materials provided to the City Council and responded to questions. The consensus was to refer the proposal to staff for review and recommendation. There was no vote. Book 83/Page 28 2/6/01 CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. Item Nos. 1 through 4 (Resolution Nos. 2001-11, 2001-12, 2001-13, 2001-14), Item Nos. 5 and 6 (Warrant Register Nos. 30 and 31), Item No. 7 (Consolidated Cash and Investment Report), and Item Nos. 8 through 12 (Claims for Damages). Motion by Soto, seconded by Inzunza, the Consent Calendar be approved. Carried by unanimous vote. Absent: Beauchamp, Morrison. PERSONNEL ADMIN (604-6-1) 1. Resolution No. 2001-11. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AMENDED AND RESTATED FLEXIBLE BENEFITS PLAN." (Personnel) ACTION: Adopted. See above. CONTRACT (C2001-4) 2. Resolution No. 2001-12. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING NATIONAL CITY FORD THE LOWEST RESPONSIVE BIDDER AND AUTHORIZING THE PURCHASING AGENT TO ISSUE A PURCHASE ORDER FOR FIVE BLACK AND WHITE POLICE PATROL VEHICLES." (Purchasing) ACTION: Adopted. See above. CONTRACT (C2001-5) 3. Resolution No. 2001-13. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DECLARING WEST COAST SAFETY SUPPLY COMPANY THE LOWEST RESPONSIVE BIDDER AND AUTHORIZING THE PURCHASING AGENT TO ISSUE A PURCHASE ORDER FOR A SEWER RODDER." Resolution No. 2001-15. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY GIVING NOTICE OF INTENTION TO VACATE A PORTION OF 7TH STREET WEST OF ROOSEVELT AVENUE AND THE ADJACENT ALLEY. (CASE FILE NO. SC-2000-1) (Planning) RECOMMENDATION: Staff concurred with the decision of the Planning Commission and recommended that the Resolution scheduling a public hearing for the street vacation be adopted. TESTIMONY: None. ACTION: Motion by Soto, seconded by Inzunza, that the item be set for public hearing on February 27, 2001. Carried by unanimous vote. Absent: Beauchamp, Morrison. OLD BUSINESS LAND USE PLANNING / QUAY AND 28TH ST (405-10-3) 14. SUBJECT: Newport Petroleum — Use of tank farm located at Quay and 28th Street. (City Manager) RECOMMENDATION: None. TESTIMONY: Dave Diaz, representing Newport Petroleum, responded to questions. ACTION: Motion by Soto, seconded by Inzunza, to continue for two weeks. Carried by unanimous vote. Absent: Beauchamp, Morrison. Book 83/Page 31 2/6/01 NEW BUSINESS TEMPORARY USE PERMITS 2001 (203-1-17) 15. SUBJECT: Temporary Use Permit — Credit Union Buyer Direct (CUBD) — Used Vehicle Tent Sale. (Building & Safety) RECOMMENDATION: Staff recommended approval of the TUP subject to compliance with all conditions of approval. TESTIMONY: Ron Blomquist, President of CUBD, 3003 Highland Ave. #C, spoke in favor and responded to questions. Bill Cummings, representing the Mile of Cars Association, 2301 National City Blvd., spoke in opposition to the request. ACTION: Motion by Soto, seconded by Inzunza, to approve the request. Carried by the following vote, to -wit: Ayes: Inzunza, Soto. Nays: Waters. Absent: Beauchamp, Morrison. Abstain: None. TEMPORARY USE PERMITS 2001 (203-1-17) 16. SUBJECT: Temporary Use Permit — McCune -Chrysler -Plymouth - Jeep — Used Vehicle Tent Sale. (Building & Safety) RECOMMENDATION: Staff recommended approval of TUP subject to compliance with all conditions of approval. TESTIMONY: None. ACTION: Motion by Soto, seconded by Inzunza, to approve the request. Carried by unanimous vote. Absent: Beauchamp, Morrison. TEMPORARY USE PERMITS 2001 (203-1-17) 17. SUBJECT: Temporary Use Permit — St. Mary's Catholic Church — Easter Sunday Service. (Building & Safety) RECOMMENDATION: Staff recommended approval of TUP subject to compliance with all conditions of approval, and grant the waiver of fees. TESTIMONY: None. ACTION: Motion by Soto, seconded by Inzunza, to approve the request, including waiver of fees. Carried by unanimous vote. Absent: Beauchamp, Morrison. Book 83/Page 32 2/6/01 NEW BUSINESS (cont.) CONDITIONAL USE PERMITS 2001 (403-16-1) 18. SUBJECT: Notice of Decision — Approval of a Conditional Use Permit to allow a church at 1540 E. 18th Street. (Applicant: Jose C. Soriano, Sr.) (Case File No.: CUP-1999-6) (Planning) RECOMMENDATION: Staff concurred with the decision of the Planning Commission and recommended that the Notice of Decision be filed. TESTIMONY: None. ACTION: Motion by Soto, seconded by Waters, to set the item for public hearing on February 27, 2001. Carried by the following vote, to -wit: Ayes: Soto, Waters. Nays: None. Absent: Beauchamp, Morrison, Abstain: Inzunza. Note: Councilman Inzunza stated that he abstained because he lives within two blocks of the proposed use. CITY MANAGER. No Report. CITY ATTORNEY. No Report. OTHER STAFF. No Report. MAYOR Mayor Waters expressed his concern about street lights being on during daylight hours and asked the City Manager to look into it. CITY COUNCIL. No Report. PUBLIC ORAL COMMUNICATIONS. None. Mayor Waters called a recess at 3:46 p.m. until 6:30 p.m. Vice Mayor Morrison reconvened the meeting at 6:30 p.m. All members were present except Mayor Waters and Councilman Soto. ADJOURNMENT The meeting was adjourned to the Next Regular Council Meeting, February 13, 2001, at 6:00 p.m., Council Chambers, Civic Center.
