ROLL CALL Councilmembers present: Beauchamp, Inzunza, Morrison, Waters. Councilmembers absent: Soto (excused). Administrative officials present: Dalla, Eiser, Matienzo, McCabe, Morse, Myers, Post. SALUTE TO THE FLAG AND INVOCATION The meeting was opened with the salute to the flag by Assistant City Manager Park Morse, followed by the invocation by Vice Mayor Beauchamp. APPROVAL OF MINUTES Motion by Morrison, seconded by Waters, the Minutes of the Regular Meeting of March 6, 2001, be approved. Carried by unanimous vote. Absent: Soto. CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. Item Nos. 1 and 2 (Resolution Nos. 2001-31, 2001-32), and Item No.3 (Warrant Register No. 36). Motion by Morrison, seconded by Inzunza, the Consent Calendar be approved. Carried by unanimous vote. Absent: Soto. Book 83/Page 67 3/13/01 CONSENT CALENDAR (cont.) BUDGET FY 2000-2001 (206-1-16) 1. Resolution No. 2001-31. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AND ADOPTING A FINAL BUDGET FOR FISCAL YEAR 2000-01." (City Manager) ACTION: Adopted. See above. GRANT / LAW ENFORCEMENT (302-1-2) POLICE COMPUTER DISPATCH SYSTEM ADMIN (302-3-2) 2. Resolution No. 2001-32. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING APPROPRIATION OF $153,790 IN FY 2000/2001 LOCAL LAW ENFORCEMENT BLOCK GRANT FUNDS FOR PHASE THREE OF THE MOBILE DATA COMPUTING PROJECT." (Police) ACTION: Adopted. See above. WARRANT REGISTER (202-1-15) 3. Warrant Register #36. Ratification of Demands in the amount of $246,596.61. (Finance) ACTION: Approved. See above. NON CONSENT RESOLUTIONS CONTRACT (C2001-10) LAND USE PLANNING / MITIGATION (405-10-4) 4. Resolution No. 2001-33. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN OPTION AGREEMENT WITH THE SAN DIEGO AIRCRAFT CARRIER MUSEUM." (City Attorney) RECOMMENDATION: Staff recommended approval. TESTIMONY: Chuck Nichols, 2633 Ocean Front Walk, San Diego, spoke in favor of the Resolution. ACTION: Motion by Beauchamp, seconded by Inzunza, to approve the Resolution with the understanding that the Carrier Group would annually sponsor a National City Week rather Book 83/Page 68 3/13/01 NON CONSENT RESOLUTIONS (cont.) CONTRACT (C2001-10) LAND USE PLANNING / MITIGATION (405-10-4) than a National City Day on the Carrier. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Waters. Nays: Morrison. Absent: Soto. Abstain: None. PLANNED DEVELOPMENT PERMIT ADMIN 2001 (414-1-16) 5. Resolution No. 2001-34. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DENYING A PLANNED DEVELOPMENT PERMIT APPLICATION FOR A 93-UNIT EXPENDED STAY HOTEL AT THE NORTHWEST CORNER OF PLAZA BOULEVARD AND INTERSTATE 805 (APPLICANT: EXTENDED STAY AMERICA) (CASE FILE NO. PD-2000-9)." (Planning) RECOMMENDATION: Staff recommended action be taken on one of the following alternatives: (1) Adopt the Resolution of Denial, (2) Adopt the Resolution stating that the project was denied without prejudice, (3) Rescind the action taken at the hearing and set a new public hearing. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Waters, to approve the Resolution and deny without prejudice. Motion failed by the following vote, to -wit: Ayes: Morrison, Waters. Nays: Beauchamp, Inzunza. Absent: Soto. Motion by Beauchamp, to rescind the previous action and set the item for hearing on April 10. Motion died for lack of a second. OLD BUSINESS LABOR RELATIONS / CITY CLERK (605-9-1) 6. SUBJECT: City Clerk's Office — Position Classification and Compensation Adjustments. (City Manager) RECOMMENDATION: Staff recommended adoption of new classifications for City Clerk (Elective), Records Management Officer, and salary band. Book 83/Page 69 3/13/01 OLD BUSINESS (cont.) LABOR RELATIONS / CITY CLERK (605-9-1) TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by Inzunza, to accept staff' s recommendation with one minor change under `Duties' to add `accepts applications'. Motion clarified that there was no retroactivity and the effective date would be the closest payroll period to today or tomorrow. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Waters. Nays: Morrison. Absent: Soto. Abstain: None. WRITTEN COMMUNICATION COMMUNITY PROMOTION (102-1-3) 7. SUBJECT: Letter / Presentation from Southwest Center for Asian Pacific American Law to thank the council for past support and give an update on their progress. RECOMMENDATION: None. TESTIMONY: J.R. Chantengco and Sally Lorang reviewed the accomplishments of the Asian Pacific American Law office in National City and thanked the City Council for their support. ACTION: Filed. NEW BUSINESS CITY MANAGER. No Report. CITY ATTORNEY. No Report. OTHER STAFF. No Report. MAYOR. No Report. Book 83/Page 70 3/13/01 CITY COUNCIL Councilman Morrison asked staff to look into the status of the one-way street next to the adult school that was supposed to be converted to two-way by the School District. PUBLIC ORAL COMMUNICATIONS Steve Engen, 4096 Coleman Ave., San Diego, representing the Veterans of Foreign Wars (VFW), requested that the City Council amend the Municipal Code to permit the relocation of the VFW to the former Weiser's Sporting Goods Store location. The following individuals spoke in support of the VFW and expressed displeasure with comments made by Vice Mayor Beauchamp: Steve Engen, 4096 Coleman Ave., San Diego Janice Rushing, 2040 Osborn St., San Diego Albert Spooler, 696 `I' Street, Apt A, Chula Vista Sherry Smith, 6134 Bullock Dr., San Diego Sheila Nelson, 1440 Napa Ct., Chula Vista Traci Kennedy, 6434 Bullock Dr., San Diego CLOSED SESSION 1. Conference with Legal Counsel — Existing Litigation Government Code Section 54956.9(a) Shawn Lee, et al. v. City of National City United States District Court Case No. 98 CV 1292 BTM LSP 2. Conference with Legal Counsel — Initiation of Litigation Pursuant to Subdivision(c) of Government Code Section 54956.9. One potential case. Book 83/Page 71 3/13/01 CLOSED SESSION (cont.) 3. Conference with Legal Counsel — Existing Litigation — Government Code Section 54956.9 (a) National City Police Officers' Association v. City of National City, Court of Appeal, Fourth Appellate District Case No. D035158. ACTION: Item No. 3 was pulled. Motion by Morrison, seconded by Waters, to go into Closed Session. Carried by unanimous vote. Absent: Soto. Councilmembers left the Chambers at 7:05 p.m. ADJOURNMENT The meeting was adjourned to the Next Regular Council Meeting, March 20, 2001, at 3:00 p.m., Council Chambers, Civic Center.
