MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
MAY 22, 2001
The Regular Meeting of the City Council of the City of National City was
called to order at 6:01 p.m. by Mayor Waters.
ROLL CALL
Councilmembers present: Beauchamp, Inzunza, Morrison, Soto, Waters.
Administrative officials present: Dalla, Defratis, DiCerchio, Eiser,
Kirkpatrick, Kimble, McCabe, Post, Trees.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Beauchamp.
APPROVAL OF MINUTES
Motion by Morrison, seconded by Beauchamp, the Minutes of the Regular
Meeting of May 8, 2001, be approved. Carried by unanimous vote.
Approval of the Minutes of the Regular Meeting of May 15, 2001, was
deferred to next week.
PROCLAMATIONS (102-2-1)
Motion by Morrison, seconded by Soto, the Proclamation be read. Carried
by unanimous vote.
The Proclamation proclaiming June 3-10, 2001 as: "NATIONAL HOME-
OWNERSHIP WEEK," was read in its entirety by Mayor Waters, and
presented to Merna Pasqual, Representative for HUD.

Mayor Waters read a letter from the Port District complimenting City staff
and departments for their professional and timely efforts facilitating the
parking lot project on Tidelands Avenue.
Councilman Morrison left the Chamber at 6:08 p.m.
INTERVIEWS AND APPOINTMENTS
STREET TREE & PARKWAY COMMITTEE ADMIN (101-2-1)
Mayor Waters turned control of the meeting over to Vice Mayor
Beauchamp. Mr. Beauchamp announced that Mayor Waters had
recommended that William Morales be reappointed to serve on the Street
Tree & Parkway Committee, for a term ending April 30, 2005.
ACTION: Motion by Soto, seconded by Inzunza, in favor of
Mayor's recommendation. Carried by unanimous vote. Absent:
Morrison.
Vice Mayor Beauchamp returned control of the meeting to Mayor Waters.
Councilman Morrison returned at 6:11 p.m.
One of the Closed Session items was taken up next as an Open Session
item, at the request of the Appellant.
CLOSED SESSION
Appeal from Public Employee Discipline — Demotion. Government
Code Section 54957.
TESTIMONY: Thomas R. Gill, Attorney for Appellant, and
Tamara Smith, Attorney for Fire Department, presented oral
arguments in the Disciplinary Appeal of Mr. Richard Edwords.
City Attorney Eiser advised the Council that the next step in
the process would be for the City Council to retire into Closed
Session to deliberate and render a decision. That decision
would then be communicated to the parties in writing.

ACTION: Motion by Beauchamp, seconded by Soto, to go
into Closed Session. Carried by unanimous vote.
Members left the Chamber at 6:55 p.m.
The meeting was reconvened at 7:00 p.m. All members were present except
for Councilmember Inzunza.
CONSENT CALENDAR
ADOPTION OF CONSENT CALENDAR. Item Nos. 1 through 4
(Resolution Nos. 2001-76, 2001-77, 2001-78, 2001-79), and Item No. 5
(Warrant Register No. 46). Motion by Beauchamp, seconded by Soto, the
Consent Calendar be approved. Carried by unanimous vote. Absent:
Inzunza.

1. Resolution No. 2001-76. "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY
ENGINEER TO ESTABLISH A DISABLED PERSON'S PARKING
ZONE AT 2101 HOOVER AVENUE (CHRISTMAS IN JULY, TSC
ITEM NO. 2001-13)." (Engineering)

8. SUBJECT: Letter from Granger Junior High School requesting use
of the portable stage and 200 folding chairs for a promotion
ceremony on June 14, 2001.
RECOMMENDATION: None.

ACTION: Motion by Morrison, seconded by Inzunza, to
approve the request. Carried by unanimous vote.
CONDITIONAL USE PERMITS 2001 (403-16-1)
9. SUBJECT: Request from Vernon Myres to discuss the conditions of
his Conditional Use Permit that was approved on 5/15/01.
RECOMMENDATION: None.
TESTIMONY: Mr. Vernon Myres, 11961 Fuerte Dr., La
Mesa, requested that the Council extend the time limit they
imposed on the CUP they approved for his property.
ACTION: No action taken on this item.

ACTION: Due to scheduling conflicts, no action taken on this
item.

12. SUBJECT: Post -Budget City Council Recess. (City Manager)
RECOMMENDATION: Staff recommended that Council establish
the post -budget Council meeting recess as June 26, July 3, and July
10, 2001.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, to
approve staff's recommendation. Carried by the following
vote, to -wit: Ayes: Beauchamp, Inzunza, Morrison, Soto.

13. SUBJECT: Temporary Use Permit — La Mesa R.V. — Parking Lot
Sale and Show. (Building & Safety)
RECOMMENDATION: Staff recommended approval of the
Application for a TUP, subject to compliance with all conditions of
approval.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Beauchamp, to
approve staffs recommendation. Carried by unanimous vote.

14 SUBJECT: Temporary Use Permit — Barking Dogs Promotion —
Power Rangers Time Force Time Blaster Tour 2001. (Building &
Safety)
RECOMMENDATION: Staff recommended approval of the
Application for a TUP, subject to compliance with all conditions of
approval.
TESTIMONY: Jennifer Baloian, representing the applicant,
responded to questions and spoke in favor.
ACTION: Motion by Soto, seconded by Waters, to approve
staff's recommendation. Carried by unanimous vote.
TEMPORARY USE PERMITS 2001 (203-1-17)
15. SUBJECT: Temporary Use Permit — Lions Club — 4th of July
Celebration. (Building & Safety)
RECOMMENDATION: Staff recommended approval of the
Application for a TUP, subject to compliance with all conditions of
approval, and grant the request for a waiver of all fees, except the
$10,336 in Police overtime fees.
TESTIMONY: None.
ACTION: Motion by Beauchamp, seconded by Morrison, to
approve staff's recommendation. Carried by unanimous vote.
TEMPORARY USE PERMITS 2001 (203-1-17)
16. SUBJECT: Temporary Use Permit — Tommy & Mike Productions —
Used Vehicle Tent Sale. (Building & Safety)
RECOMMENDATION: Staff recommended approval of the
Application for a TUP, subject to compliance with all conditions of
approval.
TESTIMONY: Tommy Karathanas, 22134 Archwood St.,
Canoga Park, California., spoke in favor of the request.
Bob Shumake, 9305 Viento Fuerte Way, La Mesa, Executive
Director of the Mile of Cars Association, spoke in opposition
to the request.
ACTION: This item was continued. No action was taken.

CITY MANAGER. No Report.
CITY ATTORNEY. No Report.
OTHER STAFF
City Clerk Dalla reported that he distributed a letter to the Council from
Mr. Mark Baca, who requested that it be entered into the record. Mr. Baca
was advised that the information requested in the letter would be addressed
in a timely manner.
MAYOR. No Report.
CITY COUNCIL
Councilmember Beauchamp referenced a letter from the Chamber of
Commerce regarding the proposed identification sign along Interstate 5.
Mr. Beauchamp requested that the Mayor write a letter to San Diego and
Arizona Eastern Railroad emphasizing the importance of the sign to the
city.
PUBLIC ORAL COMMUNICATIONS
Terry Hanks, 1104 Palm Ave., #32 requested that the Council reconsider
their decision in changing the frequency of City Council meetings.
Mr. Hanks reiterated his objections to police practices when stopping
motorists.
Linda Hanks, 1104 Palm Ave. #32, spoke against reducing the number of
City Council meetings.
Mayor Waters called a recess at 7:56 p.m.
The meeting was reconvened at 7:58 p.m. All members were present.
Mark Baca, 105 Harbison Ave., reiterated his strong opposition to reducing
the number of City Council meetings.
Councilman Inzunza encouraged Mr. Baca to keep doing what he is doing
and to keep advocating for what he believes in but to please show some
public decency as he acts on his civil rights.

Conference with Legal Counsel — Anticipated Litigation
Initiation of litigation pursuant to Subdivision (c) of Government
Code Section 54956.9 (Two Potential Cases)
Appeal from Public Employee Discipline -Demotion. Government
Code Section 54957. (taken -up earlier in the meeting)
ACTION: Motion by Beauchamp, seconded by Morrison, to go into
Closed Session on the first item. Carried by unanimous vote.
Members left the Chamber at 8:05 p.m.
ADJOURNMENT
The meeting was adjourned to the Next Regular Meeting of the City
Council of the City of National City, Tuesday, June 5, 2001, at 3:00 p.m.,
Council Chambers, Civic Center.
The meeting closed at 8:35 p.m.
