MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
JUNE 19, 2001
The Regular Meeting of the City Council of the City of National City was
called to order at 3:09 p.m. by Mayor Waters.
ROLL CALL
Councilmembers present: Beauchamp, Inzunza, Morrison, Soto (arrived at
4:36 p.m.), Waters.
Administrative officials present: Dalla, Desrochers, DiCerchio, Eiser,
Kimble, Matienzo, McCabe, Morse, Myers, Post, Ruiz, Trees.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with the salute to the flag by City Manager
Tom G. McCabe, followed by the invocation by Vice Mayor Beauchamp.
APPROVAL OF MINUTES
Motion by Beauchamp, seconded by Inzunza, the Minutes of the Regular
Meeting of June 5, 2001, be approved. Carried by unanimous vote. Absent:
Soto.
The Minutes of the Regular Meeting of June 12, 2001, was deferred.
MAYOR'S PRESENTATION
NEW EMPLOYEE INTRODUCTION PROGRAM (604-2-2)
Mayor Waters requested that Finance Director Marylou Matienzo introduce
her new employee, Rosario Palazo / Accountant. Ms. Palazo stood and was
recognized by those present.
Mayor Waters also requested that Police Chief Skip DiCerchio introduce his
new employee, Vanessa Castro / Police Services Officer. Ms. Castro stood
and was recognized by those present.

INTERVIEWS AND APPOINTMENTS
BOARDS AND COMMISSIONS (101-1-1)
Carlos Carrillo, 3421 Eleanor Place, appeared for an interview and
expressed an interest in serving on several Boards and Commissions.
CIVIL SERVICE COMMISSION ADMIN (101-9-1)
Vice Mayor Beauchamp announced that Mayor Waters had recommended
that Richard Hubbard be appointed to the Civil Service Commission, for a
term ending September 30, 2006.
ACTION: Motion by Morrison, seconded by Inzunza, in favor of
Mayor's recommendation. Carried by unanimous vote. Absent: Soto.
CONSENT CALENDAR
ADOPTION OF CONSENT CALENDAR. Item Nos. 1 through 7
(Resolution Nos. 2001-89, 2001-90, 2001-91, 2001-92, 2001-93, 2001-94,
2001-95), Item No. 8 (Warrant Register Nos. 48 and 49). Motion by
Beauchamp, seconded by Morrison, Item Nos. 1 through 4 be pulled, and
the remainder of the Consent Calendar be approved. Carried by unanimous
vote. Absent: Soto.
BUDGET 2001-2002 (206-1-17)
1. Resolution No. 2001-89. "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY APPROVING THE
PRELIMINARY BUDGET FOR FISCAL YEAR 2001-02." (City
Manager)
RECOMMENDATION: Staff distributed an attachment to the
Resolution (See Exhibit A, attached) and recommended approval.
TESTIMONY: None.
ACTION: Motion by Waters, seconded by Beauchamp, to
adopt the Resolution, with a correction of $5,000 for the
Filipino Independence Day. Carried by unanimous vote.
Absent: Soto.
CONTRACT (C2001-27)
2. Resolution No. 2001-90. "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY DISPENSING WITH THE
BIDDING PROCESS AND AUTHORIZING ACCEPTANCE OF A

PROPOSAL FROM OMNI-PACIFIC FOR ERGONOMICALLY

RECOMMENDATION: Staff recommended approval.

ACTION: Motion by Waters, seconded by Beauchamp, to
adopt the Resolution.. Carried by unanimous vote. Absent:
Soto.
CONTRACT (C2001-28)
3. Resolution No. 2001-91. "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE
MAYOR TO EXECUTE A CONTRACT WITH THE NATIONAL
CITY CONCERT BAND FOR A MUSICAL PROGRAM TO BE
HELD AT PEPPER PARK." (Parks & Recreation)
RECOMMENDATION: Staff recommended approval.
TESTIMONY: Ed Reed, Band Director, was present to
answer questions.
ACTION: Following discussion, the Resolution was tabled
until a full Council was present.
POLITICAL SUPPORT ADMIN (102-4-1)
4. Resolution No. 2001-92. "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY OPPOSING THE BOARD OF
TRUSTEES OF THE SAN DIEGO COUNTY LAW LIBRARY'S
RECOMMENDATION TO CLOSE THE SOUTH COUNTY LAW
LIBRARY." (City Attorney)
RECOMMENDATION: None.
TESTIMONY: Charles R. Dyer, Director of the San Diego
Public Law Library and Secretary to the Board of Trustees,
provided information on the financial status and future plans of
the Library to deal with the current financial crisis.
Michael Inzunza, representing Supervisor Greg Cox, spoke in
favor of the Resolution.
ACTION: Motion by Inzunza, seconded by Soto, to adopt the
Resolution. Carried by unanimous vote.

CONTRACT (C2001-28)
3. Resolution No. 2001-91. "RESOLUTION OF THE CITY COUNCIL

MAYOR TO EXECUTE A CONTRACT WITH THE NATIONAL
CITY CONCERT BAND FOR A MUSICAL PROGRAM TO BE

RECOMMENDATION: Staff recommended approval.

5. Resolution No. 2001-93. "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY APPROVING CHANGE
ORDER NO. 1, ACCEPTING THE WORK AND AUTHORIZING
THE FILING OF A NOTICE OF COMPLETION FOR THE JJ
AUTO REPAIR SEWER PROJECT (ENGINEERING SPEC. NO.
00-7)." (Engineering)
ACTION: Adopted. See above.
CONTRACT (C2001-29)
6. Resolution No. 2001-94. "RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY
MANAGER TO EXECUTE A HOLD HARMLESS AND
INDEMNIFICATION AGREEMENT BETWEEN THE CITY OF
NATIONAL CITY AND SOUTHWEST DRILLING,
INCORPORATED." (Police)
ACTION: Adopted. See above.

APPLICATION, ASSURANCES AND MITIGATION PROGRAM
FOR GRANT FUNDS UNDER THE COASTAL CONSERVANCY

IMPROVEMENT PROGRAM (CIP) BY INCLUDING A CAPITAL
IMPROVEMENT PROJECT TO REPLACE APPROXIMA I'ELY
HALF OF THE FIXED WINDOWS AT THE CIVIC CENTER
BUILDING WITH WINDOWS THAT CAN BE OPENED." (Public

RECOMMENDATION: Staff recommended approval.

NATIONAL CITY MUNICIPAL CODE 2001 (506-2-16)
11. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AMENDING TITLE 10 OF THE NATIONAL
CITY MUNICIPAL CODE BY AMENDING CHAPTER 10.30
REGULATING ALCOHOLIC BEVERAGES AND REPEALING
CHAPTER 10.31 REGULATING THE CONSUMPTION OF
ALCOHOLIC BEVERAGES." (City Attorney)

RECOMMENDATION: Staff recommended approval.
TESTIMONY: Dan Tomsky, Institute for Public Strategies,
148 E. 30th St., spoke in favor of the Ordinance.
Terry Hanks, 1104 Palm Ave., spoke against the Ordinance.
ACTION: Motion by Beauchamp, seconded by Morrison, to
adopt Ordinance No. 2001-2186. Carried by unanimous vote.
NATIONAL CITY MUNICIPAL CODE 2001 (506-2-16)
12. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY AMENDING THE REDEVELOPMENT PLAN
FOR THE NATIONAL CITY REDEVELOPMENT PROJECT
THROUGH THE ADOPTION OF THE 2001 AMENDMENT TO
THE REDEVELOPMENT PLAN." (Community Development
Commission)
Note: Notice of Public Hearing and Proof of Publication are on file
in the Office of the Community Development Commission.
RECOMMENDATION: Staff recommended approval.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Soto, to adopt
Ordinance No. 2001-2187. Carried by the following vote, to -
wit: Ayes: Morrison, Soto, Waters. Nays: None. Absent:
None. Abstain: Beauchamp, Inzunza. Note: Council members
Beauchamp and Inzunza abstained due to the fact that they own
property within the redevelopment area.

NEW BUSINESS
N.C. COMMUNITY CENTER (1101-5-1)
13. SUBJECT: Request to use the Community Center by the Mental
Health Systems, Inc. (Public Works)
RECOMMENDATION: None.
TESTIMONY: None.
ACTION: Motion by Waters, seconded by Morrison, to deny
the request. Carried by unanimous vote.
LAS PALMAS POOL ADMIN (702-3-3)
14. SUBJECT: City Pool Master Plan. (Parks & Recreation/
Engineering)
RECOMMENDATION: Staff recommended approval.
TESTIMONY: Mr. Nachi Madhaven of Jones & Madhaven,
Project Consultant, 2550 Hawthorne Blvd., Torrance,
California, responded to questions.
ACTION: Motion by Morrison, seconded by Soto, to approve.
Carried by unanimous vote.
It was reported that a Temporary Use Permit application came up after
preparation of the Agenda that requires immediate action because of the
scheduled three-week City Council recess.
Motion by Morrison, seconded by Soto, to bring the item on to the Agenda.
Carried by unanimous vote.
TEMPORARY USE PERMITS 2001 (203-1-17)
SUBJECT: Temporary Use Permit — McCune -Chrysler -Plymouth -
Jeep Used Vehicle Tent Sale. (Building & Safety)
RECOMMENDATION: Approve the application subject to
compliance with all conditions of approval.
TESTIMONY: None.
ACTION: Motion by Soto, seconded by Inzunza, to approve
staff's recommendation. Carried by unanimous vote.

CITY MANAGER. No Report.
CITY ATTORNEY
City Attorney Eiser reported that the Union -Tribune Newspaper has
submitted a Public Records Act Request for the appointment book calendars
for the Mayor and Councilmembers. Mr. Eiser requested that the
Councilmembers contact him so that an appropriate response could be
prepared.
OTHER STAFF. No Report.
MAYOR
Mayor Waters reported that there was a unanimous vote by the Board of
Port Commission to fund the full cost of the National City Marina in
addition to approving $29 million for a new cargo pier.
CITY COUNCIL
Councilman Morrison discussed the City -sponsored COPAO Filipino
Independence Festival that took place in National City, and the newspaper
article that referenced it as a county event funded by county money.
Councilman Soto acknowledged there was a mistake in the newspaper
article, but said it was a good community event that helped bring the
community closer, and offered an opportunity for others to learn about the
Filipino culture.
Vice Mayor Beauchamp said he was impressed that the San Diego Police
Chief rode in the Filipino Parade. Mr. Beauchamp reminded everyone
about the next Chamber of Commerce Breakfast that would honor Fire
Department personnel.
PUBLIC ORAL COMMUNICATIONS. None.
Mayor Waters called a recess at 4:30 p.m.
The meeting was reconvened at 5:01. All members with the exception of
Councilmember Soto were present.

Agency Negotiators: Roger DeFratis, Don Condon (Replaced by
Brian Cooper), Randy Kimble
Employee Organization: National City Firefighters' Association
ACTION: Motion by Morrison, seconded by Waters, to go into
Closed Session. Carried by unanimous vote.
Members left the chamber at 5:02 p.m.
ADJOURNMENT
The meeting was adjourned to the Next Regular Meeting of the City
Council of the City of National City to be held on Tuesday, July 17, 2001,
at 6:00 p.m., Council Chambers, Civic Center.
The foregoing minutes were approved at the Regular Meeting of July 17,
2001.
