ROLL CALL Councilmembers present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Campbell, Dalla, DiCerchio, Eiser, Kimble, Matienzo, McCabe, Morse, Myers, Post, Trees. APPROVAL OF MINUTES Motion by Zarate, seconded by Beauchamp, the Minutes of the Adjourned Regular Meeting of October 16, 2001, and the Regular Meeting of October 16, 2001, be approved. Carried by unanimous vote. MAYOR'S PRESENTATION (102-14-2) Letter from Sweetwater Union High School's MCJROTC Unit regarding color guards. ACTION: Robert E. Jackson, Colonel, U.S. Marine Corps (Ret), Senior Marine Instructor from Sweetwater High School, spoke in favor of the request. Motion by Beauchamp, seconded by Morrison, to designate the Sweetwater Union High School MCJROTC Color Guard and the official color guard of National City. Carried by unanimous vote. PRESENTATION PORT COMMISSION ADMIN (101-18-1) Port Commissioner Jess Van Deventer — Annual Port of San Diego Update. "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH STONE & YOUNGBERG TO PROVIDE FINANCIAL ADVISORY SERVICES IN THE ISSUANCE OF A 2002 GENERAL OBLIGATION LIBRARY BOND. Public Hearing — Specific Plan and subdivision for 42 single-family residential parcels on the south side of Paradise Valley Road east of the terminus of E. 8th Street (Applicant: Simon and Richard Construction Co., Inc.) (Case File Nos.: SP-2000-1, S-2000-3, 1S-2000-10). (Planning) Note: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff recommended approval of an amended Specific Plan and subdivision reflecting 38 single-family lots with a minimum 6,500 square foot lot size and typical 50 feet of street frontage. Mayor Waters read into the record a petition submitted to the Planning Commission in opposition to the proposal signed by "approximately" 70 people. The following individuals spoke in opposition to the proposal: Kathy Smith, 815 Ethel Place, National City. Ron Detzer, 1129 Mary Ct., National City. Anne Campbell, 1129 Mary Ct., National City. Fred Puhn, 425 Shell Ave., National City. Alan Rockefeller, 1135 Mary Lane, National City. Ted Godshalk, 2143 Cleveland Ave., National City. Edwardo Nieto, 809 Mary Court, National City. Rip Reopelle, 801 Ethel Pl., National City, was neutral on the proposal until he had time to review the recent changes. ACTION: Motion by Beauchamp, seconded by Inzunza, in favor of staff's recommendations for approval with appropriate Book 83/Page 283 1 1 /6/01 PUBLIC HEARING (cont.) SPECIFIC PLAN ADMIN (417-1-1) findings, and to modify condition No. 6 on the Tentative Subdivision Map of Approval to delete wording that begins "since the proposal includes mitigation measures...," and to delete condition No. 32(b) through (f). Motion by Zarate, seconded by Waters, to continue the item for two weeks so that the people in the area will have a better understanding of what the new proposal looks like. Vice Mayor Beauchamp accepted the amendment as part of his motion. Following a question about the propriety of the motion, Vice Mayor Beauchamp withdrew his motion and restated it to be, to continue the item but modify the environmental conditions of approval that will come back before us as proposed in his previous motion and to continue the public hearing. Carried by unanimous vote. A recess was called at 8:20 p.m. The meeting reconvened at 8:31 p.m. All members were present. PUBLIC HEARING NATIONAL CITY MUNICIPAL CODE 2001 (506-2-16) 3. Public Hearing — Proposed Ordinance establishing the Mile of Cars Business Improvement District pursuant to the parking and business improvement area law of 1989 and levying an assessment and charge therein for upgrading and improving the area. (Community Development Commission) Refer to Item No. 26 Note: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff recommended approval. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Beauchamp, to close the hearing. Carried by unanimous vote. SUBJECT: Notice of Decision — Conditional Use Permit for the sale of beer and wine (off -site consumption), and pre -packaged fish in a grocery store at 3446 Highland Avenue (Applicant: Canned Foods, Inc.)
