MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA
NOVEMBER 20, 2001
The Regular Meeting of the City Council of the City of National City was
called to order at 6:03 p.m. by Mayor Waters.
ROLL CALL
Councilmembers present: Beauchamp, Inzunza, Morrison, Zarate, Waters.
Administrative officials present: Campbell, Dalla, DiCerchio, Eiser,
Kimble, Morse, Myers, Post.
Pledge of Allegiance to the flag led by Assistant City Manager Park Morse
followed by the Invocation by Vice Mayor Beauchamp.
APPROVAL OF MINUTES
Motion by Zarate, seconded by Beauchamp, the Minutes of the Regular
Meeting of November 6, 2001, and the Special Meeting of November 6,
2001, be approved. Carried by unanimous vote.
MAYOR'S PRESENTATION
NEW EMPLOYEE INTRODUCTION PROGRAM (604-2-2)
Vice Mayor Beauchamp requested that Police Chief DiCerchio introduce
his new employee, Jacqueline Esterly / Crime Scene Specialist. Ms. Esterly
stood and was recognized by those present.
Vice Mayor Beauchamp also requested that Fire Chief Kimble introduce his
two newest firefighters, Thomas Butts and Scott Robinson. Mr. Butts and
Mr. Robinson stood and were recognized by those present.

INTERVIEWS AND APPOINTMENTS
Appointment — Vice Mayor.
Mayor Waters recommended that Councilmember Nick Inzunza be
appointed to serve as the Vice Mayor from November 20, 2001 to
November 10, 2002.
ACTION: Motion by Beauchamp, seconded by Zarate, to approve
the Mayor's recommendation. Carried by unanimous vote.
PUBLIC HEARING
NATIONAL CITY MUNICIPAL CODE 2001 (506-2-16)
1. Continued Public Hearing — Amendment to National City Municipal
Code Chapters 9.32 (Advertising Displays Bordering Freeways),
18.04 (Definitions), 18.16 (Commercial Zones), 18.62 (Signs and
Outdoor Advertising displays), and 18.92 (Outdoor Display or Sale of
Merchandise) (Case File No. A-2001-3). (Planning) Refer to Item
No. 10 (Continued from Council Meeting of November 6, 2001)
Note: Notice of Public Hearing and Proof of Publication are on file
in the Office of the City Clerk.
RECOMMENDATION: Staff recommended approval. City
Attorney Eiser stated that there was a revision to the proposed
Ordinance contained in a new Section 10.
TESTIMONY: None.
ACTION: Motion by Morrison, seconded by Beauchamp, to
close the hearing. Carried by unanimous vote.
PUBLIC HEARING
SPECIFIC PLAN ADMIN (417-1-1)
2. Continued Public Hearing — Specific Plan and subdivision for 42
single-family residential parcels on the south side of Paradise Valley
Road east of the terminus of E. 8th Street (Applicant: Simon and
Richard Construction Co., Inc.) (Case File Nos.: SP-2000-1,
S-2000-3, IS-2000-10). (Planning) (Continued from Council
Meeting of November 6, 2001.

PUBLIC HEARING
SPECIFIC PLAN ADMIN (417-1-1)
RECOMMENDATION: Staff recommended approval of an
amended Specific Plan and subdivision reflecting 38 single-family
lots with a minimum 6,500 square foot lot size and typical 50 feet of
street frontage.
TESTIMONY: The following individuals spoke in favor of the
specific plan:
Peter Moncrieff, 3600 E. 8`h St., National City.
Alan Rockefeller, 1135 Mary Lane, National City.
Roberto Ito, 8799 Balboa Ave #100, San Diego.
Edith Hughes, 1104 Manchester St., National City.

consultant.

Cathy Schoonover, no address given, read letter.
Ed Cabradilla, 3637 Forest Glen Rd., San Diego, submitted
petition with 43 names, supporting the proposal.
The following individuals spoke in opposition to the proposal:
Ron Detzer, 1129 Mary Ct., National City.
Fred Puhn, 425 Shell Ave., National City.
Gary Smith, 815 Ethel Place, National City.
Edwardo Nieto, 809 Mary Court, National City.
Kathy Smith, 815 Ethel Place, National City.
ACTION: Motion by Morrison, seconded by Inzunza, to
approve the amended Specific Plan and Tentative Map as
recommended with the required findings and modification to
two conditions of approval. (Delete Item 32(e) and insert in
Item 32 (d) after the word "the mitigation area" the following:
"in excess of that native grass land in open space classification
on the project site shall be purchased"). Carried by unanimous
vote.

THE FILING OF AN IMPARTIAL ANALYSIS AND WRITTEN
ARGUMENTS RELATING TO LIBRARY BOND ELECTION,
REQUESTING COUNTY SERVICES, AND ADDING
STATEMENT TO BOND MEASURE. (City Clerk)
RECOMMENDATION: Staff recommended approval.
TESTIMONY: None.
ACTION: Motion by Zarate, seconded by Morrison, to
approve the Resolution. Carried by unanimous vote.

PROPOSITION OF INCURRING BONDED DEBT FOR THE
PURPOSE OF THE ACQUISITION, CONSTRUCTION AND
COMPLETION OF NEW CITY LIBRARY TO THE QUALIFIED
VOTERS OF THE CITY OF NATIONAL CITY AT THE SPECIAL
MUNICIPAL ELECTION TO BE HELD ON MARCH 5, 2002."

14. SUBJECT: General Obligation Bond for construction of new City
Library; determination of term of bond issue; request of City
Treasurer to sign Tax Rate Statement. (Library)
RECOMMENDATION: Staff recommended approval of the terms
for bond issue and the request of City Treasurer to sign tax rate
statement.
TESTIMONY: Bill Huck of Stone and Youngberg, City Bond
Counsel, responded to questions.
ACTION: Motion by Morrison, seconded by Beauchamp, to
approve a 25-year term. Carried by unanimous vote. Motion
by Morrison, seconded by Beauchamp, to request that the City
Treasurer sign the tax rate statement. Carried by unanimous
vote.
PUBLIC HEARING
SEWER CAPACITIES FEES ADMIN (906-1-4)
3. Public Hearing — Proposed Sewer Rate Increases for Fiscal Years
2002 and 2003. (Public Works / Engineering)
RECOMMENDATION: Staff recommended that the item be
continued and brought back to Council at a later date.
TESTIMONY: None.
ACTION: Motion by Waters, seconded by Inzunza, to close
the hearing. Carried by unanimous vote.
CONSENT CALENDAR
ADOPTION OF CONSENT CALENDAR. Item Nos. 4 through 8
(Resolution Nos. 2001-175 through 2001-177), and Item Nos. 7 and 8
(Warrant Registers). Motion by Morrison, seconded by Zarate, the Consent
Calendar be approved. Carried by unanimous vote.

13. SUBJECT: Report on clarification of the relationship between
Transient Occupancy Taxes and the definition of "Transient." (City
Attorney) Continued from Council Meeting of October 16, 2001.
RECOMMENDATION: None.
TESTIMONY: Todd Olson, 1785 Hancock St., San Diego,
requested the item be continued to a workshop at a later date.
ACTION: The consensus was to have a workshop at a date to
be determined. There was no vote.

property at the southwest corner of National City Boulevard and West

RECOMMENDATION: Staff concurred with the decision of the

CITY COUNCIL
Councilman Morrison reported on the regional planning efforts being
individually pursued by Senator Steve Peace and the cities. Councilman
Morrison also reported on his visit to Father and Son Auto Sales and
suggested that future Temporary Use Permit applications be looked at
closely.
Councilman Beauchamp provided an update on recent personnel changes at
the Metropolitan Transit Development Board.
PUBLIC ORAL COMMUNICATIONS
Terry Hanks, 1104 Palm Ave., inquired about his request for a California
Attorney General investigation of a police shooting. Mr. Hanks discussed
his impressions and opinions about the practices and conduct of the police
department.
Adrian Lopez, 2321 `G' Ave., related his experiences with harassment by
the National City Police Department.
