HomeMy WebLinkAbout2002 09-17 CC MINBook 84/Page 210 9/17/02 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA September 17, 2002 The Regular Meeting of the City Council of the City of National City was called to order at 6:00 p.m. by Mayor Waters. ROLL CALL Councilmembers present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Dalla, DiCerchio, Eiser, Kimble, Kirkpatrick, Morse, Post, Trees. Pledge of Allegiance to the flag led by Assistant City Manager Park Morse, followed by the Invocation by Councilmember Beauchamp. APPROVAL OF MINUTES Approval of the Minutes of the Regular Meeting of September 3, 2002, was deferred to the next meeting. MAYOR'S PRESENTATION NEW EMPLOYEE INTRODUCTION PROGRAM (604-2-2) Mayor Waters requested that Fire Chief Randy Kimble introduce his new employee, Paul Kane/Firefighter. Mr. Kane stood and was recognized by those present. PROCLAMATIONS (102-2-1) Motion by Morrison, seconded by Zarate, the Proclamation be read in its entirety. Carried by unanimous vote. The Proclamation proclaiming the week of September 30 — October 5, 2002 to be: "LAWSUIT ABUSE AWARENESS WEEK," was read in its entirety by Mayor Waters. Book 84/Page 211 9/17/02 The Proclamation proclaiming the month of October 2002 to be: "THE COLUMBIAN FOUNDATION FOR PEOPLE WITH MENTAL RETARDATION MONTH," was read in its entirety by Mayor Waters. INTERVIEWS AND APPOINTMENTS LOCAL LAW ENFORCEMENT ADVISORY BD-APPTS (101-35-1) Mayor Waters turned control of the meeting over to Vice Mayor Inzunza who announced that the Mayor had recommended a slate of appointments to the Local Law Enforcement Advisory Board: Mr. Victor Nunez, Assistant Division Chief, Prosecutors Office, South Bay Office representing the District Attorney's Office; Ms. Michelle Longtin, Assistant Executive Office, San Diego County Superior Court, South County Division, Court Representative; and Ms. Alma Graham, National city Chamber of Commerce Public Safety Committee Member, representing Community Volunteer Group. ACTION: Motion by Morrison, seconded by Beauchamp, in favor of the Mayor's recommendation. Motion carried by unanimous vote. City Clerk Dalla administered the oath of office to the newly appointed members. CITY BOARDS AND COMMISSIONS —INTERVIEWS (101-1-1) Gustavo Tony Rios, 3414 Eleanor Place, expressed an interest in serving on the Street Tree & Parkway Committee and the Park and Recreation Advisory Board. Carlos Carrillo, 3421 Eleanor Place, who had indicated an interest in serving on the Planning Commission, was not present Roberta Settergren, 1317 "D" Avenue #802, expressed an interest in serving on the Housing & Community Development Committee. Alethea Pruitt, 1321 Manchester Street, expressed an interest in serving on the Sweetwater Authority. Gloria Pangelinan, 2021 "N" Avenue, expressed an interest in serving on the Street Tree & Parkway Committee and the Traffic Safety Committee. Book 84/Page 212 9/17/02 SENIOR CITIZEN ADVISORY COMM ADMIN-APPTS (101-11-1) Vice Mayor Inzunza announced that Mayor Waters had recommended that Helen Murphy be re -appointed to the Building Advisory & Appeals Board. ACTION: Action was deferred until Ms. Murphy could be present. Vice Mayor Inzunza returned control of the -meeting to Mayor Waters. CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. Item Nos. 1 through 5 (Resolution Nos. 2002-141 through 2002-145, Item No. 6 and 7 (Warrant Registers), and Item No. 8 (Claims). Motion by Morrison, seconded by Zarate, Item No. 1 be pulled, the remainder of the Consent Calendar be approved, and the Claim for Damages be denied. Carried by unanimous vote. CONTRACT (C97-6) 1. Resolution No. 2002-141. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A FIRST AMENDMENT TO THE FIVE-YEAR LICENSE AGREEMENT BETWEEN SAN DIEGO GAS & ELECTRIC AND THE CITY OF NATIONAL CITY FOR THE BAYSHORE BIKEWAY. (Public Works / Engineering) TESTIMONY: Councilman Beauchamp indicated that he has a conflict due to prior contractual agreements with San Diego Gas & Electric and would not be voting on the item. Speaking as a private citizen, Mr. Beauchamp urged the Council to delay action on the Resolution for 60 days until there are discussions underway with the bike path proponents. ACTION: Motion by Inzunza, seconded by Morrison, to table for 60 days. Carried by unanimous vote. Abstaining: Beauchamp. CONTRACT (C2002-45) 2. Resolution No. 2002-142. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH SCHATZ CONSULTING GROUP, INC. TO PERFORM CONSULTING Book 84/Page 213 9/17/02 CONSENT CALENDAR (cont.) CONTRACT (C2002-45) SERVICES FOR DESIGN AND CONSTRUCTION SUPPORT SERVICES FOR THE MARTIN LUTHER KING, JR. COMMUNITY CENTER." A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE POLICE CHIEF TO EXECU1'h MEMORANDUMS OF UNDERSTANDING WITH THE SWEETWATER UNION HIGH SCHOOL DISTRICT AND THE NATIONAL SCHOOL DISTRICT FOR JOINT FUNDING OF THE D.A.R.E./J.O.G./SCHOOL RESOURCE OFFICER PROGRAM." ACTION: Motion by Morrison, seconded by Zarate, to approve the request. Carried by unanimous vote. TEMPORARY USE PERMITS 2002 (203-1-18) 17. SUBJECT: Temporary Use Permit — First United Methodist Church Street fair. (Building & Safety) RECOMMENDATION: Approve the application subject to compliance with all conditions of approval. TESTIMONY: Mr. Ben Richardson, representing the First Methodist Church, spoke in favor, responded to questions and requested that the date be changed to September 27, 28 and 29. ACTION: Motion by Beauchamp, seconded by Waters, to approve with the requested change in date. Carried by unanimous vote. Book 84/Page 217 9/17/02 NEW BUSINESS (cont.) TEMPORARY USE PERMITS 2002 (203-1-18) 18. SUBJECT: Temporary Use Permit — Annual review of the temporary office trailer for Paradise Creek. (Building & Safety) RECOMMENDATION: Approve the TUP for one additional year. TESTIMONY: Ted Godshalk, 2143 Cleveland Ave., spoke in favor. ACTION: Motion by Waters, seconded by Zarate, to approve the request. Carried by unanimous vote. CITY MANAGER. No Report. CITY ATTORNEY. No Report. OTHER STAFF. No Report. MAYOR. No Report. CITY COUNCIL Councilman Morrison reported that the funding for the Plaza Boulevard Widening Project has been re -allocated. Five million dollars has been relinquished to other cities for their current projects and two million remains in National City for Plaza Boulevard engineering work. At a later date, the five million dollars should again be made available to the City. PUBLIC ORAL COMMUNICATIONS. None. CLOSED SESSIONS CONFERENCE WITH LEGAL COUNSEL -ANTICIPATED LITIGATION — Initiation of Litigation Pursuant to Government Code Section 54956.9 (c) (One potential case) ACTION: Motion by Zarate, seconded by Morrison, to go into closed session. Carried by unanimous vote.
