ROLL CALL Councilmembers present: Beauchamp, Inzunza, Morrison, Zarate, Waters. Administrative officials present: Dalla, DiCerchio, Eiser, McCabe, Morse, Myers, Post. Pledge of Allegiance to the flag led by City Manager Tom G. McCabe, followed by the Invocation by Councilmember Beauchamp. APPROVAL OF MINUTES Motion by Morrison, seconded by Beauchamp, the Minutes of the Regular Meeting of October 15, 2002 be approved. Carried by unanimous vote. MAYOR'S PRESENTATION (102-14-2) Presentation to Lynn Robinson. Mayor Waters presented a key to the City to Lynn Robinson, National City Adult School Principal, for her many years of service to the community. NEW EMPLOYEE INTRODUCTION PROGRAM (604-2-2) Mayor Waters turned control of the meeting over to Vice Mayor Inzunza. Mr. Inzunza requested that Police Chief DeCerchio introduce his new employees, Andrea Gonzalez / Police Recruit, and Yolanda Felix / Police Records Clerk. Ms. Gonzalez, and Ms. Felix stood and were recognized by those present. PROCLAMATIONS (102-2-1) Motion by Morrison, seconded by Zarate, the Proclamations be read in their entirety. Carried by unanimous vote. Book 84/Page 246 11/19/02 PROCLAMATIONS (cont.) The Proclamation proclaiming the remaining holiday months of 2002 and all of 2003 to be: "BUCKLE UP FOR LIFE CHALLENGE," was read in its entirety by Mayor Waters. Vice Mayor Inzunza returned control of the meeting to Mayor Waters. PUBLIC HEARING MAYOR ADMIN (102-14-2) 1. Public Hearing — Appeal of Planning Commission action regarding new construction at 2244 E. 4th Street (Applicant: Charles I. Cheneweth Foundation) (Case File No.: Appeal-2002-1). (Planning) Note: Notice of Public Hearing and Proof of Publication are on file in the Office of the City Clerk. RECOMMENDATION: Staff concurred with the recommendation of the Planning Commission and recommended that the appeal be granted with the condition requiring only one door facing the street. TESTIMONY: Jorge Engle, Project Architect, appeared on behalf of the applicant and responded to questions. Florence Bland, National City, spoke in favor of the appeal. Pam Bronson, Del Mar, spoke in favor of the appeal. Lane Barrack, La Mesa, spoke in favor of the appeal. Alfred Barrack, La Mesa, spoke in favor of the appeal. Lane Cheneweth, Chula Vista, the applicant, spoke in favor of the appeal. Shannon Noyes, San Diego, read a poem and spoke in favor of the appeal. Martha Ojeda, National City, spoke in favor of the appeal. Martha Jakobson, San Diego, spoke in favor of the appeal. Georgia Guarano, National City, spoke against the appeal. Everett Dickson, National City, did not speak for or against the appeal but suggested a model of structure would be helpful. Mike Crossley, National City, spoke in favor of the appeal. Patrick McDaniels, National City, spoke in favor of the appeal. Rita Heuss, National City, did not speak for or against the appeal. Book 84/Page 247 11/19/02 PUBLIC HEARING (cont.) MAYOR ADMIN (102-14-2) Ron Bibb, National City, did not speak for or against the appeal but expressed disappointment about the way neighbors' concerns were portrayed in the media. ACTION: Motion by Beauchamp, seconded by Inzunza, to grant applicant's appeal and staff recommendations. Carried by the following vote, to -wit: Ayes: Beauchamp, Inzunza, Zarate. Nays: Morrison, Waters. Absent: None. Abstain: None. CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. Item Nos. 2 through 7 (Resolution Nos. 2002-162 through 2002-167), Item Nos. 8 and 12 (Warrant Registers), Item No. 13 (Street Tree and Parkway Committee Minutes). Motion by Waters, seconded by Beauchamp, the Consent Calendar be approved. Carried by unanimous vote. PARKING ADMIN 2002 (801-2-2) 2. Resolution No. 2002-162. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY ENGINEER TO ESTABLISH TWO THREE-FOOT RED NO PARKING ZONES ADJACENT TO THE DRIVEWAY AT 1045 EAST 3an STREET (R. PETERE, TSC. ITEM NO .2002-27)." (Public Works / Engineering) ACTION: Adopted. See above. DEEDS AND EASEMENTS (D2002-4) 3. Resolution No. 2002-163. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY TO APPROVE AND ACCEPT A STORM DRAIN EASEMENT LOCATED AT THE SOUTHWEST CORNER OF NATIONAL CITY BOULEVARD AND 33RD STREET, AND AUTHORIZING THE RECORDATION OF SAME DOCUMENT (A.P.N. 562-330-43)." A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AMENDMENT TO THE COMMERCIAL RENTAL AGREEMENT BETWEEN THE CITY OF NATIONAL CITY AND THE NATIONAL CITY HISTORICAL SOCIETY (FORMERLY THE SOUTH BAY HISTORICAL SOCIETY) FROM THE LEASE OF THE GRANGER MUSIC HALL PROPERTY." A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A LEASE BETWEEN THE CITY OF NATIONAL CITY AND THE NATIONAL CITY ADULT SCHOOL." (Engineering) ACTION: Adopted. See above. CONTRACT (C2002-51) 6. Resolution No. 2002-166. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CHIEF OF POLICE TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE NATIONAL CITY DISTRICT FOR JOINT FUNDING OF A D.A.R.E./J.O.G./SCHOOL RESOURCE OFFICER FOR FOUR YEARS, AS REQUIRED BY THE COPS IN SCHOOLS FEDERAL GRANT." "AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE STANDARD URBAN STORMWATER MITIGATION PLAN." (Public Works / Engineering) RECOMMENDATION: Staff recommended approval. TESTIMONY: None. ACTION: Motion by Beauchamp, seconded by Zarate, to adopt Urgency Ordinance No. 2002-2213. Carried by unanimous vote. OLD BUSINESS PUBLIC REQUEST / COMPLAINT ADMIN (102-1-1) 16. SUBJECT: Continued discussion regarding the Trophy Lounge on National City Boulevard. (City Manager) RECOMMENDATION: None. TESTIMONY: The following individuals spoke about problems associated with the Trophy Lounge and encouraged the City Council to take corrective action: Janice Martinelli; Isabel Brown; Mark Brown; Elizabeth Penagos; Nancy Estolano; Judith de los Santos; Armando Abundis; Dave Gravagno; Ed Schumah; Debora Allen; Louise Branch; Betty McCoy; Jeannette Salazar; representing the Historical Society; Elizabeth Salas; Marie Kreider. PUBLIC REQUEST / COMPLAINT ADMIN (102-1-1) The following individuals spoke in support of the Trophy Lounge; explained the steps they have taken to correct problems and outlined future facility improvements: John Ford, General Manager of Red Lion and Holiday Inn, and President of the National City Downtown Business Owners Association; John Smaha, Attorney for the Trophy Lounge; John Tynes, Trophy Lounge employee. ACTION: Motion by Waters, seconded by Morrison, to refer to staff for recommendation and come back in 30 days. Carried by unanimous vote. CONTRACT (C99-39) WIRELESS COMM ADMIN (908-1-3) EL TOYON PARK ADMIN (702-6-1) 17. SUBJECT: Consider approval of proposed modification of AT&T wireless facility at El Toyon Park. (City Attorney) RECOMMENDATION: Staff recommended approval. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Beauchamp, to approve the modification. Carried by unanimous vote. SUBDIVISION ADMIN (415-1-1) 18. SUBJECT: Time Extension Request — Tentative Subdivision Map for division of a vacant, 61,420 square foot lot into nine single-family parcels at the northwest corner of E. 16th Street and M Avenue (Applicant: Frank and Linnea Arrington) (Case File No.: S-2000-2). (Planning) RECOMMENDATION: Staff recommended that the expiration date for Tentative Map S-2000-2 be extended for one year to December 12, 2003. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Zarate, to approve the time extension. Carried by the following vote, to - wit: Ayes: Beauchamp, Morrison, Zarate, Waters. Nays: None. Absent: None. SUBDIVISION ADMIN (415-1-1) Note: Vice Mayor Inzunza abstained due to the fact that he owns property in the immediate area of the proposed subdivision. N.C. COMMUNITY CENTER (1101-5-1) 19. SUBJECT: Request to use the Community Center by the Sweetwater Union High School Marine Corps JROTC and waiver of fees. (Public Works) RECOMMENDATION: None. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Beauchamp, to approve the request including waiver of fees. Carried by unanimous vote. N.C. COMMUNITY CENTER (1101-5-1) 20. SUBJECT: Request to use the Community Center by the National School District and waiver of fees. (Public Works) RECOMMENDATION: None. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Beauchamp, to approve the request including waiver of fees. Carried by unanimous vote. Two off -agenda items (Claim for Damages) were requested to be brought on to the Agenda. ACTION: Motion by Beauchamp, seconded by Zarate, to bring the items onto the Agenda. Carried by unanimous vote. CLAIMS (501-1-146) 21. SUBJECT: Claim for Damages: Monica Williams. (City Clerk) RECOMMENDATION: Staff recommended denial. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Zarate, to deny the claim and refer to the City Attorney. Carried by unanimous vote. Book 84/Page 253 11/19/02 CLAIMS (501-1-146) 22. SUBJECT: Claim for Damages: California Auto Leasing. (City Clerk) RECOMMENDATION: Staff recommended denial. TESTIMONY: None. MAYOR. No Report. CITY COUNCIL Councilman Beauchamp reported on pending activities of the Sweetwater Authority including a new water well near El Toyon Park. PUBLIC ORAL COMMUNICATIONS Mr. Joe Amaro, Director of the Fairest of the Fair Pageant, appeared along with Miss National City, to present a plaque of Appreciation to Mayor Waters from the 22nd Agricultural District for his many years of support for the Fairest of the Fair Pagent. Mr. Tom Carnes, National City, representing the National City Historical Society, read a letter regarding the Coronado Belt Line and urged the Council to include it on the local list of historic sites. Ed Kravitz, Imperial Beach, spoke about the events that have transpired regarding the Coronado Belt line and expressed appreciation to the City Council for their support. Book 84/Page 254 11/19/02 PUBLIC ORAL COMMUNICATIONS (cont.) Bruce Coons, Coronado, representing Save our Heritage Organization (SOHO), explained the reasons for the vote by the State Historical Site Board and urged the City Council to include the rail line on the local historic site list. Bernard Levi, Encinitas, encouraged the City Council to direct the City Attorney to intercede with the Judge on behalf of Mr. Terry Hanks for violating his probation. Rita Heuss, National City, thanked the City Council for allowing her to serve on the Civil Service Commission and said she hoped to continue serving long into the future. CLOSED SESSION Conference with Legal Counsel — Existing Litigation — Government Code Section 54956.9 (a) — Coronado Branch Line ACTION: Motion by Zarate, seconded by Morrison, to go into Closed Session. Carried by unanimous vote. Councilmembers left the Council Chamber at 10:00 p.m. Councilmembers reconvened at 10:07 p.m. Mayor Waters and Vice Mayor Inzunza were absent. ACTION: City Attorney Eiser reported that in Closed Session the City Council took action to direct staff to bring the Coronado Branch Line issue back at the December 3rd City Council meeting with a Resolution to designate the Coronado Branch Line and Right-of-way an historic site and to include input on the issue from the CDC Executive Director. Book 84/Page 255 11/19/02 ADJOURNMENT Motion by Beauchamp, seconded by Zarate, the meeting be adjourned to the Next Regular Meeting of the City Council, to be held December 3, 2002, at 6:00 p.m., Council Chambers, Civic Center. Carried by the following vote; to -wit: Ayes: Beauchamp, Morrison, Zarate. Nays: None. Absent: Waters, Inzunza. Abstain: None.
