ROLL CALL Councilmembers present: Inzunza, Morrison, Natividad, Parra, Ungab. Administrative officials present: Condon, Dalla, Diaz, Eiser, Matienzo, Morse, Myers, Ray, Short, Trees. Pledge of Allegiance to the flag and Invocation by Mayor Nick Inzunza. APPROVAL OF MINUTES Motion by Morrison, seconded by Ungab, the Minutes of the Regular Meeting of June 17, 2003, be approved. Carried by unanimous vote. PUBLIC ORAL COMMUNICATIONS Refugio Gonzalez, National City, expressed concerns about unlicensed venders and pushcarts. Toni Romo, Lincoln Acres, and Luz Vicario, Chula Vista, and Alfonso Dinegre, San Diego, expressed appreciation to the Council for approving Stop signs at Lincoln Acres School. Toni Romo, speaking as incoming President of the Las Palmas Little League, inquired about how to go about getting improvements to the ball fields. PRESENTATIONS LAW ENFORCEMENT ADM (302-2-1) Presentation to the Police Department by the Tobacco -Free Communities Coalition and BREATH for achieving outstanding compliance with California's Smoke -Free Workplace Law. Presentation to the City Council by the Renacy Corporation to discuss vandalism in National City, viable solutions, and funding opportunities. PROCLAMATION Mayor Inzunza informed the Council Troy Rawls, Tae-Kwon-Do instructor, picnic. Book 85/Page 157 7/01/03 that he would be presenting Master with a proclamation at an upcoming CONSENT CALENDAR ADOPTION OF CONSENT CALENDAR. Item No. 1 (NCMC), Item Nos. 2 through 10 (Resolution Nos. 2003-89 through 2003-97), Item Nos. 11 and 12 (Warrant Registers), and Item No. 13 (Claims). Motion by Natividad, seconded by Parra, Item Nos. 2 and 13 be bulled the remainder of the Consent Calendar be a roved. Carried by unanimous vote. NATIONAL CITY MUNICIPAL CODE (506-2-18) 1. SUBJECT: Approval of a motion to waive reading of the text of all Ordinances considered at this meeting and provides that such Ordinances shall be introduced and/or adopted after a reading of only the title. (City Clerk) ACTION: Adopted. See above. CONTRACT (C2003-22) 2. Resolution No. 2003-89. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH THE NATIONAL SCHOOL DISTRICT FOR THE NATIONAL PUBLIC LIBRARY TO PROVIDE AN AFTER -SCHOOL EDUCATION PROGRAM." A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ESTABLISHING A MID -YEAR CAPITAL IMPROVEMENT PROJECT TO REPAIR THE UNDERGROUND FUEL TANKS AT THE PUBLIC WORKS' YARD, AND TO CLOSE THE UNDERGROUND DIESEL TANK AT THE POLICE STATION." (Public Works/Engineering) ACTION: Adopted. See above. SPECIFIC PLAN AMENDMENT (417-1-8) 10. Resolution No. 2003-97. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING A SPECIFIC PLAN AMENDMENT AND APPROVING A TENTATIVE SUBDIVISION MAP FOR 120 DETACHED CONDOMINIUM UNITS ON THE SOUTH SIDE OF SWEETWATER ROAD EAST OF PLAZA BONITA (APPLICANT: CONCORDIA COMMUNITIES, LLC) (CASE FILE NO. (City Clerk) RECOMMENDATION: Deny the claim and refer to the City Attorney. ACTION: Motion by Natividad, to pay for the damages. Motion died for lack of a second. Motion by Natividad, second by Inzunza, to consider the item at a closed session in two weeks. City Attorney Eiser was asked to clarify the effect of the motion on the claim. Mr. Eiser suggested the procedure that should be followed is to go ahead and deny the claim now and the Council can always decide in two weeks or at any other time to have a closed session. The motion was withdrawn. Motion by Morrison, seconded by Parra, in favor of staff s recommendation to deny the claim. Carried by unanimous vote NON CONSENT RESOLUTIONS CONTRACT (C91-21) 14. Resolution No. 2003-98. A "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE AN EXTENSION OF THE AGREEMENT FOR ADMINISTRATION OF TAXICAB AND OTHER FOR -HIRE REGULATIONS." (Police) RECOMMENDATION: Staff recommended that Council authorize the City Manager to approve the contract for 90 days, July 1, 2003 through September 30, 2003. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Natividad, to approve staff recommendation. Carried by unanimous vote. NATIONAL CITY MUNICIPAL CODE (506-2-18) 15. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ESTABLISHING SEWER SERVICE CHARGES FOR FISCAL YEAR 2003-04, 2004-05, AND 2005-06." (City Attorney) TESTIMONY: Scott Avery, SBC representative, thanked the staff for their work on the Ordinance and spoke in favor. Ed Lopez, Cox Cable, thanked the staff for their work on the Ordinance and spoke in favor. Note: Councilman Ungab excused himself from the dais during consideration of the item due to his employment by SBC. ORDINANCES FOR ADOPTION NATIONAL CITY MUNICIPAL CODE (506-2-18) 17. "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ELECTING TO HAVE SEWER SERVICE CHARGES COLLEC I'ED ON THE TAX ROLL, AND ADDING SECTION 14.04.075 TO THE NATIONAL CITY MUNICIPAL CODE." (City Attorney) RECOMMENDATION: Staff recommended to approval. TESTIMONY: None. ACTION: Motion by Morrison, seconded by Parra, to adopt Ordinance No. 2003-2225. Carried by unanimous vote. Book 85/Page 162 7/01/03 NEW BUSINESS NATIONAL CITY COMMUNITY CENTER (1101-5-1) 18. SUBJECT: Request for use of the Community Center by the National City Community Concert Band and waiver of fees. (Public Works/Engineering) RECOMMENDATION: None. TESTIMONY: None. ACTION: Motion by Parra, seconded by Morrison, to approve, and authorize Mr. Reid to select the music. Carried by unanimous vote. CONDITIONAL USE PERMITS (403-18-1) 19. SUBJECT: Notice of Decision — Planning Commission denial of a Conditional Use Permit for a wireless communications facility at the Seventh Day Adventist Church at 3737 Sweetwater Road (Applicant: Cingular Wireless) (Case File No. CUP-2002-4). (Planning) RECOMMENDATION: Staff concurred with the decision of the Planning Commission and recommended that the Notice of Decision be filed. TESTIMONY: None. ACTION: Motion by Parra, seconded by Morrison, to accept and file. Carried by the following vote, to -wit: Ayes: Inzunza, Morrison, Natividad, Parra. Nays: None. Absent: None. Abstain: Ungab. Councilmember Ungab abstained due to his employment with the phone company. VARIANCES 2003 (409-1-35) 20. SUBJECT: Notice of Decision — Planning Commission approval of a zone variance to allow the Roark's Carpet and Linoleum building at 2100 Highland Avenue to be rebuilt with reduced setback and parking requirements (Applicant: Michael Roark) (Case File No. Z-2003-1). (Planning) RECOMMENDATION: Staff concurred with the decision of the Planning Commission and recommended that the Notice of Decision be filed. TESTIMONY: Michael Roark responded to questions. ACTION: Accepted and filed. Book 85/Page 163 7/01/03 NEW BUSINESS (cont.) CONDITIONAL USE PERMITS 2003 (403-18-1) 21. SUBJECT: Notice of Decision — Planning Commission approval of a Conditional Use Permit for a private school (K-12) at 2432 E. 18th Street (Applicant: Filipino and American Bible Baptist Academy) (Case File No. CUP-2003-9). (Planning) RECOMMENDATION: Staff concurred with the decision of the Planning Commission and recommended that the Notice of Decision be filed. TESTIMONY: A request was made and withdrawn by representatives of the church for a modification of one of the conditions of approval. ACTION: Accepted and filed. STAFF City Engineer Burt Myers publicly announced that he was attending his last Regular Council Meeting prior to retiring after 40 years of public service. Mr. Myers recapped his career and accomplishments, and expressed appreciation to Council, staff, employees, residents and the media. Councilmembers expressed their appreciation to Mr. Myers for his years of service. MAYOR AND CITY COUNCIL Councilman Morrison announced that he has been elected to serve another year as Chairman of SANDAG. Vice Mayor Parra inquired about the status of the specific plan for the West Side. Councilman Natividad expressed concerns about the conditions of the trash dumpster and fence at the Laundromat at 18th and Euclid. ADJOURNMENT The meeting was adjourned to the Adjourned Regular Meeting of the City Council to be held on July 8, 2003, at 9:00 a.m., Council Chambers, Civic Center.
