MINUTES OF THE ADJOURNED REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA
August 23, 2005
The Adjourned Regular Meeting of the City Council of the City of National City,
meeting in Joint Session with the Community Development Commission, was
called to order at 6:46 p.m. by Mayor Nick Inzunza.
ROLL CALL
Councilmembers present: Inzunza, Morrison, Natividad, Zarate.
Councilmembers absent: Parra.
Administrative officials present: Condon, Dalla, Deese, Eiser, Kirkpatrick, Post,
Saucedo, Trees, Wurbs, Zapata.
APPROVAL OF MINUTES
None.
PUBLIC ORAL COMMUNICATIONS
None.
PUBLIC HEARING
COMMUNITY DEVELOPMENT ADMIN (406-2-9)
1. JOINT PUBLIC HEARING of the City Council and the Community
Development Commission on the proposed Disposition and Development
Agreement by and between the Community Development Commission
and Mossy Nissan, Incorporated for the development of a new car
dealership located at 2626 through 2700 National City Boulevard.
RECOMMENDATION: Conduct the Public Hearing.
TESTIMONY: CDC Consulting Attorney Art Deddich, provided
information and responded to questions regarding `Notice' of the
proceedings.
Stan Rich, a Bonita Realtor, spoke in support of the Daily family.
Larry Daily, Bonita, spoke in support of the Daily Family Trust and
against the proposed actions.
Steve Kahlil, Attorney representing the Daily Family Partnership,
reviewed the history of actions and process that have taken place
relative to the property and spoke in opposition to the proposed
actions.
Anna Roppo, representing the Daily Family Partnership, requested
more time, stated that improper notice was given to the Daily family
and requested that all issues be continued.

TESTIMONY: Tim Daily, San Diego, spoke in opposition to the
proposed actions.
Peter Mossy, President of Mossy Nissan, explained the importance
of acquiring the property, provided a history of events and
negotiations, stated that no deal had been reached with the Daily
family and spoke in support of the proposed actions.
Ed Wittier, Attorney representing Mossy, clarified various issues
raised during the hearing and spoke in support of the proposed
actions.
Alex Zerpolo, a consultant retained by Mossy Nissan, gave a slide
presentation on conditions and deficiencies of the existing
dealership facilities leased by Mossy.
ACTION: Motion by Natividad, seconded by Inzunza, to continue
this item and all related items for two weeks, encourage both sides
to continue to work for an agreement and the Council be provided
with copies of all notices that went out. Carried by the following
vote; to -wit: Ayes: Inzunza, Morrison, Natividad, Zarate. Nays:
None. Abstaining: None. Absent: Parra.
Note: Agenda Items Numbered 2 through 7, related to Community Development
Commission business and are not included in these minutes.

8. Resolution No. 2005-184: APPROVING THE HEALTH AND SAFETY
CODE SECTION 33433 REPORT; APPROVING THE DISPOSITION
AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE
COMMUNITY DEVELOPMENT COMMISSION AND MOSSY NISSAN,
INCORPORATED FOR DEVELOPMENT OF A NEW CAR DEALERSHIP
AT 2626 THROUGH 2700 NATIONAL CITY BLVD; AND MAKING
CERTAIN FINDINGS IN CONNECTION HEREWITH. (Community
Development Commission)
RECOMMENDATION: Adopt the Resolution.
TESTIMONY: None.
ACTION: Continued for two weeks. See above.
PROPERLTY TAX RATE BONDED INDEBTEDNESS (205-2-2)
9. Resolution No. 2005-185: ESTABLISHING THE PROPERTY TAX RATE
FOR BONDED INDEBTEDNESS FOR FISCAL YEAR 2005-2006.

RECOMMENDATION: Adopt the Resolution.

CLOSED SESSION
1. Conference with Legal Counsel — Anticipated Litigation — Significant
Exposure to Litigation Pursuant to Government Code Section 54956.9(b).

ACTION: Motion by Zarate, seconded by Morrison, to ao into closed session.
Carried by unanimous vote. Absent: Parra.
Members retired into Closed Session at 7:40 p.m.
ADJOURNMENT
The meeting was adjourned to an Adjourned Regular Meeting of the City Council
to be held on August 30, 2005, at 6:00 p.m., in the Council Chambers, Civic
Center, 1243 National City Boulevard, National City.
