ROLL CALL Council / Commission members present: Morrison, Natividad, Parra, Ungab, Zarate. Administrative Officials present: Dalla, Deese, Eiser, Garcia, Gonzales, Juniel, Kirkpatrick, Limfueco, Lopez, Post, Raulston, Smith, Soriano, Zapata. Others present: City Treasurer George Hood and Student Representative Roseanita Hernandez. Maria Roble, National City, spoke on behalf of the residents of Keystone Trailer Park seeking assistance from the City if the park is sold. SUBJECT: Temporary Use Permit — San Diego Tijuana Border Initiative's Cinco de Mayo con Orgullo Para la Familia - May 5, 2007 from 10:00 a.m. to 5:00 p.m. at Kimball Park. (Building & Safety) TESTIMONY: None. ACTION: Motion by Zarate, seconded by Ungab, to approve the Temporary Use Permit. Carried by unanimous vote. The City Council expressed interest in the need for a maintenance agreement for stage. There was no vote. TEMPORARY USE PERMITS 2007 (203-1-23) 15. SUBJECT: Temporary Use Permit — Philippine Fair & Parade at Kimball Park - June 9, 2007 from 8:00 a.m. to 6:00 p.m. (Building & Safety) TESTIMONY: Rita Andrews, representing COPAO, the applicant, requested a continuance to allow time to explore ways to lower the costs charged by the City. ACTION: Motion by Parra, seconded by Ungab, to continue to the April 17, 2007 Meeting. Carried by unanimous vote. TEMPORARY USE PERMITS 2007 (203-1-23) 16. SUBJECT: Temporary Use Permit — Lions Club Annual Independence Day Carnival/Intemational Parade and Fair at Kimball Park from June 29, 2007 to July 4, 2007. (Building & Safety) TESTIMONY: None. ACTION: Motion by Morrison, seconded by Zarate, to continue to the April 17, 2007 Meeting and direct staff to look at existing regulations for co -sponsored events; specifically the possibility of applying the $1500 City subsitity on a per -day basis rather than per -event and to look at police costs. Carried by unanimous vote. PUBLIC HEARING SUBDIVISIONS / VARIANCES 2007 (415-1-3) 17. Public Hearing — Tentative Subdivision Map to divide three properties into twelve individual Tots (each containing four existing apartment units) and a zone variance for reduced side -yard setbacks with an exception for reduced street frontage at 1904-1934 K. Avenue and 1905-1935 J Avenue (Van Linn Apts.) (Applicant: Westone Management Consultants) (Case File No. S-2006-13/Z-2006-7) (Planning) RECOMMENDATION: Staff concurs with the recommendation of the Planning Commission to approve the Tentative Subdivision Map and Zone Variance. ACTION: Motion by Zarate, seconded by Parra, to close the Hearing. Carried by unanimous vote. Motion by Parra, seconded by Natividad, to deny the Tentative Subdivision Map based on findings. Carried by the following vote, to -wit: Ayes: Morrison, Natividad, Parra, Ungab. Nays: Zarate. Absent: None. Abstain: None. ORDINANCE FOR INTRODUCTION MUNICIPAL CODE 2007 (506-2-22) 18. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING TITLE 11 OF THE NATIONAL CITY MUNICIPAL CODE BY ADDING CHAPTER 11.34 PERTAINING TO TRUCK IDLING AND PARKING MANEUVERS NEAR A SCHOOL OR RESIDENCE. (City Attorney) TESTIMONY: Stephanie Buttell-Maxin and Margaret Godshalk, teachers at Kimball School, spoke in support of the Ordinance. Francisca Arellana, representing the Environmental Health Coalition, spoke in support of the Ordinance and submitted signed forms of support from the community. ACTION: It was the consensus of the Council to add, under Section 11.34.050 A, Paragraph 7, a new sub -section (c) prohibiting refrigerator units from operating within 100 feet of a school or residence. The Ordinance was introduced for first reading as modified. ORDINANCE FOR ADOPTION MUNICIPAL CODE 2007 (506-2-22) 19. AN ORDINANCE OF THE CITY OF NATIONAL CITY AMENDING TITLE 15 OF THE NATIONAL CITY MUNICIPAL CODE BY AMENDING CHAPTER 15.16 PERTAINING TO HOUSING INSPECTIONS AND PERMITS. (Building & Safety) RECOMMENDATION: Adopt the Ordinance. TESTIMONY: None. ACTION: Motion by Natividad, seconded by Parra, to adopt the Ordinance. Carried by unanimous vote. RESOLUTION OF THE CITY OF NATIONAL CITY TO AWARD A CONTRACT IN THE AMOUNT OF $694,151 TO KOCH ARMSTRONG GENERAL ENGINEERING, INC. FOR THE NATIONAL CITY STREET RESURFACING PROJECT, FY 06-07, SPECIFICATION NO. 06-03. Funded by Proposition "A" (TransNet) and Traffic Congestion Relief Funds (Engineering) RECOMMENDATION: Adopt the Resolution. TESTIMONY: None. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE PURCHASE FROM DELL OF FOUR DELL SERVERS AND A STORAGE AREA NETWORK IN THE AMOUNT OF $60,748.31. Notice of Decision — Planning Commission approval of a Conditional Use Permit for a proposed 5-unit apartment complex at the southwest corner of Highland Avenue and Division Street with exceptions for Tess than required side and rear yard setbacks. (Applicant: Ricardo Perez) (Case File CUP -2006-12) (Planning) RECOMMENDATION: Staff concurs with the decision of the Planning Commission and recommends that the Notice of Decision be filed. TESTIMONY: Janice Martinelli, representing the applicant, spoke in support of the CUP and against the need for a Public Hearing. (Copy on file in the Office of the City Clerk) COMMUNITY DEVELOPMENT COMMISSION WARRANT REGISTER JULY 2006 — JUNE 2007 (202-1-21) 25. Ratifications of Expenditures of the Community Development Commission: Expenditures for the Period of 03/07/07 through 03/16/07 of $242,963. (Community Development Commission/Finance) RECOMMENDATION: Ratify the expenditures. ACTION: Motion by Zarate, seconded by Ungab, to ratify the expenditures. Carried by unanimous vote. (APN #559-063-04). National City, Califomia. (Community Development Commission) TESTIMONY: Ted Godshalk, Old Town Neighborhood Council, asked a question about the appraisal. ACTION: Accepted and filed. STAFF REPORTS HUMAN RESOURCES DEPT ADMIN (1104-1-2) 30. SUBJECT: Report: Status of the Human Resources Department's efforts in administering the City's Critical Staffing Plan. (Human Resources) MAYOR AND CITY COUNCIL Vice Mayor Parra; stated that the planter boxes along Highland Avenue need to be re-evaluated; expressed interest in Ordinances to control cel towers; reported that at 16th and Rachael there is a large plant hindering site distance and suggested that a co-ordinated approach to after school programs could be beneficial. Council Member Ungab said it would be beneficial to have a map showing existing cel tower locations in the City and that the Aquatic Center design should include plans for a possible cel tower. Mr. Ungab stated that the City should name something in honor of Cesar Chavez. Council Member Zarate requested a report on the number of cel towers in the City including a comparison with other jurisdictions; suggested a moratorium might be in order and advised of an up -coming grant writing workshop in Oceanside. Book 89 / Page 76 04-03-2007 MAYOR AND CITY COUNCIL (cont.) Mayor Morrison presented the City Manager a check from the Regional Solid Waste Authority in the amount of $18,901. Mayor Morrison said it is time to do a community clean-up project in and around City Hall.
