MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
JULY 5, 1977
The regular meeting of the City Council of the City of National City was
called to order at 7:35 p.m. by Mayor Morgan,
ROLL CALL
Council members present: Camacho, Dalla, Pinson, Reid, Morgan. Absent:
None. Administrative officials present: Campbell, Gerschler, Gill,
Hoffland, McCabe, McLean.

PUBLIC ORAL COMMUNICATIONS
VICE MAYOR PINSON introduced Penny Hill, contestant, National City Rodeo
Queen contest, who was present in the audience. Miss Hill thanked
Council for support of the Rodeo and gave times and dates of planned
events.
ADOPTION OF RESOLUTIONS
Moved by Camacho, seconded by Reid, these Resolutions be presented by
title only. Carried by unanimous vote.
Resolution No, 12,396, "RESOLUTION ACCEPTING COVENANT AND AGREEMENT TO
HOLD PROPERTY AS ONE PARCEL (Wayne & Mary L. Lawyer)." Moved by Reid,
seconded by Camacho, Resolution No. 12,396 be adopted. Carried by
unanimous vote.
Resolution No. 12,397, "RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO THE
LAND USE CODE OF THE CITY OF NATIONAL CITY (Z-6-77)." Moved by Reid,
seconded by Morgan, Resolution No. 12,397 be adopted. Motion carried,
by the following vote, to -wit: Ayes: Pinson, Reid, Morgan. Nays:

Resolution No. 12,398, "RESOLUTION DESIGNATING ENFORCEMENT AGENCIES
FOR THE SOLID WASTE MANAGEMENT PROGRAM." Moved by Reid, seconded by
Camacho, Resolution No. 12,398 be adopted. Carried by unanimous vote.
Resolution No. 12,399, "RESOLUTION RETAINING CARROLL & PENDLETON,
ASSOCIATES AS AUDITORS FOR THE CITY OF NATIONAL CITY." Moved by Camacho,
seconded by Pinson, Resolution No. 12,399 be adopted. Carried by
unanimous vote.
Resolution No. 12,400, "RESOLUTION APPROVING MEMORANDUM OF UNDERSTANDING
WITH MUNICIPAL EMPLOYEES ASSOCIATION FOR A TWO-YEAR PERIOD JULY 1, 1977
THROUGH JUNE 30, 1979." Moved by Camacho, seconded by Pinson, Resolution

Item 12, CLAIM FOR DAMAGES from PHILIP PATTON MCMAHON alleging injury
May 11, 1977 and;
Item 13, CLAIM FOR DAMAGES from JOHN ANDREW TRENT alleging damage to
car June 28, 1977 were presented. Moved by Camacho, seconded by Pinson,
these claims (12 & 13) be denied and referred to the City Attorney.
Carried by unanimous vote.
SOUTH BAY B.M.X. CLUB'S request for a temporary use permit, bicycle
motorcross race, July 24, 1977, Las Palmas Park and the use of four
bleachers (fund raising event -- muscular dystrophy; between 700 and 800
riders are anticipated and twice that many spectators.) was presented.
Moved by Camacho, seconded by Morgan, in favor of the request. Vice
Mayor Pinson stated he would also like to see this group police their
own area and be responsible for the clean up. Mayor Morgan questioned
the use of moving the bleachers to the area; this might set a precedent„
Moved by Morgan, seconded by Reid, the motion be amended to leave the
bleachers out of this request, unless they want to haul them themselves.
Amendment carried by unanimous vote. Motion carried by unanimous vote.
The Director of Public Works' recommendation to DENY APPROVAL of a
DRIVEWAY at 1212 McKinley Avenue (Able Machine Tool) (The applicant
requested approval of an existing 34' wide driveway; approximately half
of the driveway is in front of a planter box, with inadequate length
for parking in the driveway; the driveway cannot be completely
reconstructed completely clear of poles and the planter box for its full
width of 34'.) was presented. TOM MCCUNE, 1212 McKinley Avenue, was
present and stated that he has been led to believe this is an illegal
driveway; upon purchasing the property two years ago and having a title
search, no illegal driveway showed up; the building was erected in 1973
and the City issued a permit for the driveway at that time and asked
why would it be illegal now. City Engineer Hoffland stated that it is
too narrow to park a car in and does not lead to a parking facility, he
recommended removal of 16 feet of drive and rebuilding the curb; and the
planters had been added and they are encroaching in the right-of-way
for the street. Moved by Pinson, seconded by Reid, this be referred to
staff. Carried by unanimous vote.
The Director of Building & Housing's recommendation to approve the
BUILDING USE AGREEMENT with SWEETWATER UNION HIGH SCHOOL DISTRICT [The
Sweetwater Union High School Governing Board has requested the annual
use Agreement for Kimball Community Center be renewed for 1977-78; the
school district conducts classes of instruction and related educational
programs throughout the year (approximately 325 hours); the conditions
contained in the Agreement are identical to previous agreements approved
by the Council.] was presented. Moved by Dalla, seconded by Camacho,
this be approved. Carried, by the following vote, to -wit: Ayes:

The appeals of MICHA .L LEE MITH and JODY EDWARDS and KURT KILLEENG
pursuant to Municipal Code 11.43 (abatement of public nuisance) and the
City Clerk's suggestion public hearings be set for July 12, 1977, were
presented. Moved by Pinson, seconded by Reid, this be set fox public
hearing July 12th. Carried by unanimous vote.
OTHER BUSINESS
PLANNING COMMISSION - NOTICES OF DECISION
Planning Commission Resolution No. 50-77 - APPROVING application for
ZONE VARIANCE to allow division of property (LOT SPLIT) that will
reduce the rear yard setback from 26' to 19' at 2507 "J" Avenue (Z-9-77)
was presented. Ordered filed by unanimous vote.
Planning Commission Resolution No. 51-77 - APPROVING application for
PLANNED DEVELOPMENT PERMIT to allow development of a 4-unit apartment
building at 2041 E. 5th Street (PD-90) was presented. City Clerk
Campbell stated an appeal of the Planning Commission action was received
and suggested the public hearing be set for July 26th at 7:45 p.m.
Moved by Pinson, seconded by Reid, this be set for hearing July 26th.
Carried by unanimous vote.
PUBLIC HEARING
The PUBLIC HEARING on PROPOSED AMENDMENTS (12) TO THE GENERAL PLAN (GP-
2-77) was held at this time, City Clerk Campbell stated the certificate
of Publication of Notice of Hearing was on file. Planning Director
Gerschler said the Planning Commission recommended approval of Items
1 through 12.
1. To show the RM-1 and RM-1--PD zoned properties located on the
north and south side of 24th Street, between Newell Avenue and Las
Palmas Park, for "Residential" use; specific density to be determined
by the City Council at the Public Hearing: Planning Director Gerschler
reported the Planning Commission recommended (a) to change the land
use designation from "Park" to "Residential 16-20 Dwelling Units/Acre"
on the properties located on the north and south side of 24th Street
between Newell Avenue and Las Palmas Park, but excluding the property
at the northwest corner of 24th and Newell, and the properties at 1839,
1923, and 1925 24th Street (Assessor's Parcels 563-061-18, 20, 31, 22,
23, 26, 36, 53, 57, 58, 63, and 71; 561-360-8, 16, 23, & 32); (b) to
change the land use designation from "Park" to "Residential 6-10
Dwelling Units/Acre" on the property located at the northwest corner
of 24th and Newell, and the properties at 1839, 1923, and 1925 24th
Street (Assessor's Parcels 561-360-25, 27, 29, and 31). Mr. Gerschler
displayed a schematic drawing of a single family condominium project on
all but four lots saying it would mean the consolidation of all but four
lots; it seems to meet all code requirements and to represent a good
design; if the Council agrees to removal of the park designation and to
a density sufficient to support a viable condominium project, the
project would be eligible for zone change to single family residence
with planned unit development1 (PUD) overlay; if the zone change is
adopted, they would then file for a planned development and a sub-
division for a condominium; ultimately the council would have absolute
control of the development and division of the property; staff recommend-
ed that the park designation be taken off, that the residential stay
on and that the density be increased to only 10. No one spoke in this
regard. Planning Director Gerschler stated the area encompassed
approximately 25 acres. Moved by Pinson, seconded by Reid, in favor
of the Planning Commission's recommendation. Carried by unanimous vote.
2. To change from "Commercial General" to "Light Industrial" the
land use designation on the properties within the half blocks facing
the east side of Roosevelt Avenue between 8th and 16th Streets and the
properties within the large block between 16th Street on the north,
Roosevelt and West Avenues on the east, 18th Street on the south, and
Hoover Avenue on the west: Planning Director Gerschler reported the
Planning Commission recommended to change the land use designation from

"Commercial General" to "Light Industrial" on the properties within the
half blocks facing the east side of Roosevelt Avenue between 8th and
16th Streets; and the properties within the large block between 16th
Street on the north, Roosevelt and West Avenues on the east, 18th
Street on the south, and Hoover Avenue on the west (Assessor's Parcels
560-143-2, 3, 10, 11, 12, 13, 22, 27, 28, 29, 30, 31, 32, 34, & 35) . No
one spoke in this regard. Moved by Morgan, seconded by Camacho, in favor
of the PlannincUommission's recommendation. Carried by unanimous vote.
3. To change from "Commercial Automotive" to "General Commercial"
the two blocks between 14th and 16th Streets, and National and "A"
Avenues: Planning Director Gershcler reported the Planning Commission
recommends in favor of Item 3. No one was present in this regard.
Moved by Pinson, seconded by Camacho, in favor of the Planniea Commission'
Commission's recommendation. Carried by unanimous vote.
4. To change from "Commercial Automotive" to "General Commercial"
the "CH" zoned properties between National and "B" Avenues and 16th and
20th Streets; and between National and Roosevelt Avenues and 16th and
18th Streets: Planning Director Gerschler reported the Planning
Commission recommends to change the land use designation from "Commercial
Automotive" to "Commercial General" on the properties within the blocks
bounded by National Avenue, 16th Street, "B" Avenue, and 18th Street;
and, on the south side of 18th Street between National Avenue and "B"
Avenue (Assessor's Parcels 560-210-1, 2, 3, 5, 6, 7, 8, 9, & 10) and,
within the area between National and "A" Avenues, and 18th and 20th
Streets, but excluding the Ball Oldsmobile auto dealership at 1935
National Avenue (Assessor's Parcels 560-210-4, 34, 35, 36, 37, 38, 41 &
42); and, the triangular city block bounded by National Avenue, West
Avenue, and 16th Street; and the Brown Volkswagen dealership at 5 West
18th Street (Assessor's Parcels 560-143-25 & 26). Mr. Gerschler stated
anything automotive related could then go into this area; the only thing
that wouldn't be allowed is a body and fender shop. In answer to a
question from Councilman Reid, Mr. Gerschler stated the people who own
the sanitarium within this area are aware of this change and spoke in
favor of it at the Planning Commission hearings. Moved by Morgan,
seconded by Dalla, in favor of the Planning Commission recommendations.

5. To change from "Light Industrial" to "Commercial Automotive" the
properties within the area bounded on the east by the westerly right-of-
way line of National Avenue; on the south by a line parallel to and
approximately 720 feet southerly of the southerly right-of-way line of
West 30th; on the west by a line parallel to and approximately 300 feet
westerly of the westerly right-of-way line of National Avenue; and on
the north by the current boundary line between "Light Industrial" and
"Automobile and Related Commercial" parallel to and approximately 300
feet southerly of the southerly right-of-way line of West 30th Street;
Planning Director Gerschler reported the Planning Commission recommends
to change the land use designation from IlLight Industrial" to "Commercial
Automotive" on the properties within the area bounded on the east by the
westerly right-of-way line of National Avenue; and, on the south by a
line parallel to and approximately 720 feet southerly of the southerly
right-of-way line of West 30th Street; and, on the west by a line
parallel to and approximately 300 feet westerly of the westerly right-
of-way line of National Avenue; and, on the north by the current
boundary line between "Light Industrial" and "Automobile and Related
Commercial" parallel to and approximately 300 feet southerly of the
southerly right-of-way line of West 30th Street. No one spoke in this
regard. Moved by Camacho, seconded by Pinson, in favor of the Planning
Commission's recommendation. Carried by unanimous vote.
6. To change from "Light Industrial" to "Neighborhood Commercial"
the land use designation on the property at 3103 "D" Avenue (Assessor's
Parcel 562-280-16): Planning Director Gerschler reported the Planning
Commission recommends in favor of the proposed General Plan change; this
land is adjacent to the National City Swap Meet land and is now being
used for commerical purposes and has a light industrial designation;

7. To change from "Residential 6-'0 Dwelling Units Per Acre" to
"Commercial Tourist" the properties within the Reiner Annexation located
on the northerly side of Sweetwater Road adjacent to the easterly city
limit (Assessor's Parcels 564-310-03, 04, and 05); Planning Director
Gerschler reported the Planning Commission recommends in favor of this
General Plan change; this change will accommodate the health spa which
Council has already approved for the area. No one spoke in this regard.
Moved by Camacho, seconded by Reid, infavo.of the Planning Commission's
recommendation. Carried by unanimous vote. Absent: Pinson.
8. To change from "General Commercial" and "Historical" to
"Residential," density to be determined by the Planning Commission at
the hearing, the properties within the area bounded by Plaza Boulevard
on the north, "D" Avenue on the east, 12th Street on the south, and
National Avenue on the west: Planning Director Gerschler reported the
Planning Commission recommends (a) to change the land use designation
from "General Commercial" to "Residential 21-30 Dwelling Units/Acre"
on the properties on the east and west side of "B" Avenue between Plaza
Boulevard and 12th Street (Assessor's Parcels 556-532-8, 9, 10, 11, &
12; 556-540-20, 21, & 22; 556-551-1, 2, 6, 12, 13, 14, 15, 16, 17, &
18); (b) to change the land use designation from "General Commercial"
to "Residential 6-10 Dwelling Units/Acre" on the properties within the
area bounded by Plaza Blvd., "C" Avenue, 12th Street and the centerline
of the alley and northerly prolongation thereof, located between "B"
and "C" Avenues; and within the area bounded by Plaza Blvd., "D"
Avenue, 12th Street, and "C" Avenue. Mr. Gerschler stated this had
been reviewed by the Community Development Commission staff because of
its relation to the Center City Redevelopment plan; also, staff
calculated the existing per acre density within these blocks; the
block between "A" & "B" north of llth showed a density of 12.6 units/
acre; the large block between 10th & 12th and "B" & "C", 16.8 units/
acre; the block between "C" & "D", 8.4 units/acre; within these blocks
there are properties with much higher densities. (Vice Mayor Pinson
returned to Council Chambers.) VERL MASON, 925 Nacion, Chula Vista,
was present and displayed a map of property he owns at 1107 "B" Avenue;
also showing the drainage from surrounding lots in the area onto his
lot; the proposed changes will not change any of the drainage excepting
the lot directly to the east of him. Mr. Mason stated in his proposed
development he has agreed to backfill the lot enough to avoid a ponding
area; given a density of 30, he would need 10,890 square feet; the lot
is 9,945 square feet and therefore short, Mr. Mason said he planned
parking under the units and asked if that space could be added to the
9,945 square feet to give the needed square footage for 8 units. Mr.
Mason stated that 80%0 of the property owners on "B" between Plaza & 12th
were in favor of his request for eight units (which would require the
density of 31-40 units/acre); the apartments he plans would be 2-bedroom
2 bath with approximately 920 square feet and would have a secured
entrance. Mr. Mason stated he would like Council's permission to put
the eight units in this area; he needs to put in the eight because of the
additional expense which will be incurred in backfilling part of the
area in order to work out the drainage problem. ROY THOMAS, 1045 "C"
Avenue, was present and inquired about the density on "D", which has
been referred to as 30; but there seems to be a split between "D" and
"C"; on the right side of "C" there are 10 and on the other side going
east Council wants 30; why such a drastic change in density. Planning
Director Gerschler stated all of "C" and the west side of "D" will
continue to be 30; the Planning Commission's feeling was because of the
existing single family residential pattern in there, that higher density
would be counterproductive. Mr. Thomas stated that if the density were
increased someone could develop and make a little profit out of the
area and contribute to the tax structure of the City. Moved by Pinson,
seconded by Camacho, we increase the density to the next higher unit for
this particulaF one and approve the project. Carried, by the following
vote, to -wit: Ayes: Camacho, Pinson, Reid. Nays: Morgan. Abstain:
Dalla. Planning Director Gerschler stated Mr. Peterson, Director of
Community Development, has recommended that the half block on both
sides of "A" from llth to 12th be designated as "Government" with
public parking to serve the Civic,Center and t one half block on both

sides of "A" Avenue from Plaza and llth be designated as "Residential";
staff agrees and it is recommended it be added to Councils motion.
Moved by Pinson, seconded by Camacho, to that effect. Motion carried,
by the following vote, to-wit:Ayes: Camacho, Pinson, Morgan. Nays:
None. Abstain: Dalia, Reid.
9. To change from "Neighborhood Commercial" to "General Commercial"
in the commercially designated land east of Harbison Avenue between
8th Street and Plaza Boulevard; and the Plaza Village Shopping Center
site on the south side of Plaza Boulevard east of Harbison Avenue;
Planning Director Gerschler reported the Planning Commission recommends
changing the land use designation from "Neighborhood Commercial" to
"General Commercial" on the commercial properties on the south side
of Plaza Boulevard and east side of Harbison Avenue (Assessor's Parcels
558-030-28 & 35); within the block bounded by 8th, Olive, Plaza, and
Harbison, but excluding the residential properties fronting on the
west side of Olive Street and the service station located at 3100 East
8th Street; on the commercial property at 3423 Plaza Boulevard (Assessor's
Parcels 669-101-3, 4, & 6). Mr. Gerschler stated the Council recently
adopted an interim zoning ordinance that rezoned these areas and
certain property east of Olive Avenue to CBD, except the southeast
corner of 8th and Harbison and those properties that front on 8th Street.
The proposal is to change the General Plan to show "General Business"
to be consistent with CBD zoning. No one spoke in this regard. Moved
by Camacho, seconded by Reid, in favor of the Planning Commission's
recommendation. Mr. Gerschler stated the zoning that will come from
this will have the PD overlay on it which will allow Council the
opportunity to review all plans for development and deny or accept them
as they relate to the surrounding neighborhood. Vice Mayor Pinson
stated he thought they would be able to make a mobile home park out
of the Fritz property; it's the last place left in the City for it;
if they change the area to "Commercial" they can't do it. Motion
failed, by the following vote, to -wit: Ayes: Camacho, Reid. Nays:
Dalla,'Pinson. Abstain: Morgan. Moved by Pinson, seconded by Dalia,
the Planning Commission's recommendation be approved except for the
Fritz property. Mr. Gerschler stated the Fritz property is that area
between the Alpha Beta and single family area. Motion carried, by the
following vote, to -wit: Ayes: Camacho, Dalla, Pinson, Reid. Nays:
None. Abstain: Morgan.
10. To change from "Residential 16-20 Dwelling Units Per Acre"
to "Residential", density to be determined by the Planning Commission
at the hearing, the residential designated area located between 6th
and 8th Streets, and between the northerly prolongation of the center-
line of "N" Avenue and Palm Avenue: Planning Director Gerschler
reported the Planning Commission recommends (a) to change the land use
designation from "Residential 16-20 Dwelling Units/Acre" to "Residential
6-10 Dwelling Units/Acre" on the properties fronting on the south side
of 6th Street between Palm Avenue and the northerly prolongation of
the centerline of "N" Avenue (Assessor's Parcels 557-101-4, 5, 6, 8,
9, 10, 22, 23, 24, and the northerly 115 feet of Parcels 1, 20, & 21);
(b) to change the land use designation from "Residential 11-15 Dwelling
Units/Acre" on the properties fronting on the north and south side
"of 7th Street between Palm Avenue and the northerly prolongation of
the Centerline of "N" Avenue (Assessor's Parcels 557-101-11, 12, 13,
14, 15, 16, 17, 18, 19, and the southerly 155 feet of Parcels 1, 20, &
21; 557-102-1, 2, 4, 17, 6, 9, 11, 12, 13 and the northerly 160 feet of
Parcel 10). Mr, Gerschler stated in order for the General Plan to be
consistent with the rezoning the Planning Commission recently recommend-
ed, the General Plan should be amended to show those properties facing
6th Street for residential with a density of 10 units per acre and
those properties facing 7th for residential with a density of 15 units
per acre; if the General Plan change is approved there will be a latet
zone change; staff is in possession of a petition from the neighbors
that asks for just what was recommended. No one was present in this
regard. Moved by Pinson, seconded by Cii*acho, in favor of the Planning

11. To change from "Neighborhood Commercial to "General Commercail"
the property at the northeast corner of Euclid Avenue and Division
Street (Assessor's Parcel No. 552-302-01): Planning Director Gerschler
reported the:Planning Commission recommends in favor of the General
Plan change. No one spoke in this regard. Moved by Camacho, seconded
by Reid, in favor of of the Planning Commission's recommendation.
Carried by unanimous vote.
12. To change from "Park" to "General Commercial" the property
at the northwest corner of 30th Street and Grove Street (Assessor's
Parcel No. 563-150-22): Planning Director Gerschler reported the
Planning Commission recommends in favor of the General Plan change.
No one spoke on this item. Moved by Camacho, seconded by Reid, in favor
of the Planning Commission's recommendation. MARCUS ACOSTA, (represent-
ing the Oliver family, 2805 "N" Avenue) was present and stated the
family was in favor of this General Plan change. Carried by unanimous
vote. Absent: Pinson.

MAYOR
MAYOR MORGAN asked the City Manager about the possibility of cutting
the property tax rate now that the budget is completed. City Manager
