MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
September 13, 1977
The regular meeting of the City Council of the City of National City
was called to order at 7:30 p.m. by Mayor Morgan.
ROLL CALL
Council members present: Camacho, Daila, Pinson, Reid, Morgan. Absent:
None. Administrative officials present: Gill, Boffland, Kulikowski,
McCabe, McLean.
SALUTE TO THE FLAG AND INVOCATION
The meeting was opened with salute to the flag led by City Manager Gill
followed with invocation by the Rev. Alan Sackett, Paradise Valley
Hospital.
PRESENTATIONS AND PROCLAMATIONS
Deputy City Clerk Kulikowski read the Mayor's proposed proclamation
"CONSTITUTION OBSERVANCE MONTH," September 1977. Moved by Camacho,
seconded by Reid, thesproclamation be adopted. Carried by unanimous
vote. Mayor Morgan presented the proclamation to Bob Chalfa.
MAYOR'S APPOINTMENTS - None.
PUBLIC ORAL COMMUNICATIONS
FRANK W. CHENELLE, President, Sweetwater High School P,T.A, was present
distributed to Council an example of the pornographic material that is
being sold in close proximity to the Schools within the City.. Mr.
Chenelle also distributed a letter from Principal Zoe Elder, National
City Junior High School, wishing to go on record as formally endorsing
a campaign against pornography. Mr. Chanelle requested the City
Attorney investigate the possibility of drafting an Ordinance that
would eliminate the placement of pornographic material within short
distances of school grounds. Moved by Morgan, seconded by Camacho,
the City Attorney look over the.Cit and various locations and come
back with a recommendation as to what can be done to eliminate this
from National City streets. City Attorney McLean reiterated his state-
ment thatthe matter of child pornography has been preempted by state
law; he will look into this and report back to council. Motion carried
by unanimous vote.
ADOPTION OF RESOLUTIONS
Moved by Camacho, seconded by Reid, these Resolutions be resented to
Council by title only,. -Carried by unanimous vote.
Resolution No. 12,472, "RESOLUTION GRANTING A PLANNED DEVELOPMENT PERMIT
PURSUANT TO ORDINANCE 1077 (to allow conversion of an existing Thirfty
Oil Company Service Station to a self-service gasoline station with
controlled exit on property located at 1139 Harbison Avenue - Permit
No. 89)." Moved by Reid, seconded by Camacho, Resolution No. 12,472
be adopted. Carried by unanimous vote.

Ordinance No. 1595 (9/6/77-1) , "AN ORDINANCE PURSUANT TO LAND USE CODE
OF THE CITY OF NATIONAL CITY, CALIFORNIA (ZC-10-77, to rezone certain
properties on the south side of 6th Street and west side of Pawn Avenue
from RM-1 [Multiple Family Residential] and RT-PD [Two Family Residen-
tial - Planned Development] to RS-2- [Single Family Residence])."

Ordinance No. 1596 (9/6/77-2), "AN ORDINANCE PURSUANT TO LAND USE CODE
OF THE CITY OF NATIONAL CITY, CALIFORNIA (ZC-14-77, to rezone certain
properties west of Palm Avenue between 6th and 8th Streets from RM-1
[Residential Multiple Family] and CL [Commercial Limited] to RT-PD
[Residential Two Family -Planned Development]).-" Moved by Reid, seconded
by Camacho, Ordinance No. 1596-,.(9/6/; 2) tie,,,, -adopted, Carried by
unanimous vote.
Ordinance No. 1597 (9/6/77-3), "AN ORDINANCE PURSUANT TO LAND USE CODE
OF THE CITY OF NATIONAL CITY, CALIFORNIA (ZC-16-77, to rezone certain
properties located between Newell Avenue and Las Palmas Park and on the
north and south of 24th Street from RM-1-PD-DS [Multiple Residential
Planned Development - Density 5] and RM-1-D5 to RS-2-PUD-D20 [Single
Family Residential Planned Development - Density 20])." Moved by
Camacho, seconded by Reid, Ordinance No. I597 (9/€/ be adopted,.
Carried by unanimous vote.
Ordinance No. 1598 (9/6/77-4), "ORDINANCE AMENDING MUNICIPAL CODE
SUBSECTIONS 18...16.300 AND 18.56.030, SUBPARAGRAPH E, REGARDING REDUCTION
OF REQUIRED FRONTAGE (A-6-77)." Moved by Camacho, seconded by Reid,
Ordinance No. 1598 (9/6/ 1 be adopted. Carried by unanimous vote.
NEW BUSINESS
The City Treasurer/Finance Director's request for RATIFICATION OF
WARRANT REGISTER NO. 8 dated September 13, 1977 in the amount of
$26,314.04 (Warrant Nos. 59352 through 59396) and PAYROLL dated 8/16-
31/77 in the amount of $178,323,89 were presented. Moved by Camacho,
seconded by Reid, this be approved. Carried by the following vote,
to -wit: Ayes: Camacho, Dalla, Pinson, Reid, Morgan. Nays: None.
A CLAIM FOR DAMAGES from Barbara Janet Patten alleging injury July 26,
1977 was presented. Moved by Reid, seconded by Camacho, this claim be
denied and referred to -the City Attorney. Carried by unanimous vote.
The City Clerk's report on BID OPENING for Specification No. 869,
Mbdif ication of 7th Street channel bridge to provide bicycle passage
was presented. No bids were received regarding this project. Moved
by Camacho, seconded by Pinson, tJ.L.s belaid overfoor resubmitting to
bid. Carried by unanimous vote.
OTHER BUSINESS
CITY MANAGER - No report.
CITY ATTORNEY
City Attorney McLean stated he has been informed by legal newspaper
that a bill regarding regulation of pornography and display of such has
come out of committee in both House and Senate and a compromise will
now be worked out between them,
OTHER STAFF - No report.

CITY COUNCIL
COUNCILMAN PINSON requested a sundown law written to eliminate Ordinances
that have been on the books and out of date for a long time; perhaps
a time period of two -years of so, unless they are required and necessary
and have been reviewed by the City Attorney; this would help bring the
code up-to-date. Moved by Pinson, seconded by Dalia, this be referred
to the Planning Commission for study. There was discussion. Motion
failed, by the following vote, to -wit: Ayes: Dalia, Pinson. Nays:
Camacho, Reid, Morgan.
PUBLIC HEARINGS
The HEARING on Resolution Intention No. 12,420 (Granger Avenue between
24th Street to Leonard Street, Assessment District No. 189) was held at
this time. Deputy City Clerk Kulikowski stated the Affidavit of Posting
and Certificate of Mailing were on file. ROBERT ONLEY, Engineering
Department, called Council's attention to a map placed on the bulletin
board which gave the area to be improved and outlined in green the
protest area which amounted to 100%. Moved by Camacho, seconded by
Reid, the City drop the project. Carried by unanimous vote. Moved
by Morgan, seconded by Reid, the City Manager and Engineer work with
the eo le in the area on the drains a roblems. Carried by unanimous
vote.
Moved by Camacho, seconded by Reid, the meeting be closed. Carried
by unanimous vote. The meeting closed at 7:55 P.M.
