HomeMy WebLinkAbout1976 06-16 CC MIN114 ADJOURNED MEETING OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA June 14, 1976 ROLL CALL Council members present: Camacho, Pinson, Reid, Morgan. Absent: Dalla. Administrative officials present: Bourcier, Campbell, Gerschler, McCabe, McLean. City Attorney McLean stated he reviewed the material submitted to the Council concerning the AIR QUALITY PLANS for the region; he had reviewed again the three alternatives that have been proposed to the cities for their response: Strategy A, B, and C. Mr. McLean said he agreed with staff report that the City should recommend Strategy B with four modifications; Strategy B is important to the City of National City because it should meet the Federal air quality goals and leave air quality management with the local government, not with the EPA; secondly, Strategy B reserves all land use decisions to the local agencies where the City now has land use controls; so you will not under Strategy B have CPO or the Board of Supervisors or some other agency making land use decisions for National City. The City Attorney recommended modifications to Strategy B: (1) the cities in the South Bay must be given partici- pation in the air program management committee (as it was proposed the air management committee is to be nominated by the City of San Diego, County of San Diego, CPO and that is unacceptable for running a regional program); (2) the Strategy proposals enforcement will be in the hands of the air program management committee and that proposal is dangerous and inconsistent with the City's desire to maintain local land use control and therefore the enforcement by the air management committee should be advisory only; (3) we also think under Strategy B any reference to CPO authority to control land use decisions must be eliminated; with those conditions, Strategy B as modified is recommended; it is certain the City must do something or controls will be imposed by a Federal agency. Moved by Camacho, seconded by Pinson, the Resolution be presented by title only. There was discussion. Mayor Morgan suggested that the adopted Resolution be sent to the other cities within the county. MIKE AULICK, CPO and Air Quality Planning Team member, was present and stated yesterday the Port Dis- trict went for B as well as Vista; at present eleven cities have gone for B or a modified version of B. Carried by unanimous vote. Resolution No. 12,073, "RESOLUTION OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING THE PROPOSED REGIONAL AIR QUALITY STRATEGY AND AIR MANAGEMENT PROCESS." Moved by Camacho, seconded by Reid, Resolu- tion No. 12,073 be adopted. Carried by unanimous vote. Councilman Camacho discussed allocation of Section 5 funds based on three alternatives: (1) revenue miles only; (2) revenue passengers only; and (3) 40% revenue miles/60% revenue passengers and said Vice -Mayor. Reid needed Council direction as to the formula the City would prefer. Councilman Camacho said under the 60/40v formula (which CPO recommended) National City would receive $231,000.00; under revenue miles only, the City would receive $258,000.00; the City of Chula Vista would receive $3,000.00 less; the City of San Diego under the 100% revenue miles would have $6,800,000.00 and under 60/40% would have $6,400,000.00. Councilman Camacho stated Formula 1 appears to favor National City most. Moved by Morgan, seconded by Reid, we authorize our delegate to vote for Formula 1 (that UMTA Section 5 Subsidies for San Diego Transit Corporation be based on annual billings of cost per revenue mile served). Carried by unanimous vote. City Attorney McLean stated that Planning Dir. Gerschler has prepared a memo that he wants Council to have the opportunity to review prior to next Council meeting in regard to a proposed rule change for the Air Pollution Control District which, if adopted, would invest APCB with land use control, we think it's extremely important 6/16/76 115 that it is understood. Planning Director Gerschler stated he thinks this is the vital issue Council had been looking for in adopting the air strAtegy; throughout California all of the Regional Air agencies such as APCD are going to be asked to adopt new rules that would say just this -- if the APCD feels a new project is going to exceed national standards, they can deny the permit to construct. The San Diego Chamber of Commerce has lead a fight against this and have urged all cities to get involved at the Board hearing, and they are telling us that so far six of the regional agencies in California have strongly opposed this and they suspect that the business community will be very strongly opposed to it here. MAYOR MORGAN called an executive session on personnel matters at 5:16 p.m. The City Council reconvened at 5:28 p.m. ROLL CALL Council members present: Camacho, Dalla, Pinson, Reid, Morgan. Moved by Reid, seconded by Pinson, the meeting be closed. Carried by unanimous vote.
