ROLL CALL Council members present: Camacho, Hogue, Reid, Waters, Morgan. Absent: None. Administrative officials present: Gerschler, McLean, Minague, Civil Engineer Associate Onley, Osburn, Stenberg. SALUTE TO FLAG AND INVOCATION The meeting was opened with salute to the Flag led by City Manager Osburn followed with invocation by the Reverend Reginald Berry, First Congrega- tional Church, APPROVAL OF MINUTES Moved by Waters, seconded by Camacho, the minutes of the regular meeting of June 1, 1971 be approved. Carried by unanimous vote. COUNCIL COMMUNICATIONS VICE MAYOR WATERS spoke in regard to the Weed Abatement program and sugges- ted the City clean its own lots and the parkways. COUNCILMAN HOGUE spoke in regard to federal assistance for Lockheed. Moved by Hogue, seconded by Waters, a resolution be re red and be sent to our senators and to our re resentatives that we as a Council believe that the Federal Government should underwrite future bank laws to kee Lockheed Co. in working order. Carried by unanimous vote. MOVED BY MORGAN, seconded by Reid, theyyauthorize, the City Manager to make the :minutes of the, just the items pe rtaina.ng to and the outcome of the vote on the minutes that the Council sees. , Carried by unanimous vote. Councilman Hogue said this means that... Mayor Morgan said the subject and the outcome. MAYOR MORGAN presented a 25-year pin to Ed Crossley of the Fire Department and said the City appreciated the excellent job he had done. The PROCLAMATION of "NURSING HOME WEEK" (June 20-26, 1971) was read. Moved by Reid, seconded by Camacho, the proclamation be adopted, Carried by unanimous vote. ORAL COMMUNICATIONS THE REV. JIM RUNYON, 142 E. 16th Street, was present and requested pern:is - . sion to have a parade June 19 between l8th and 16th Street and B and High- land between 10:00 and 11:00. Moved by Hogue, seconded by Reid, this item be referred to the Cit Mana er and Police Chief for a recommendation to the Council. Carried by unanimous vote. ADOPTION OF RESOLUTIONS Moved by Hogue, seconded by Waters, the resolutions be_ presented by title. Carried by unanimous vote. RESOLUTION NO. 10,360, "RESOLUTION AUTHORIZING, CAPITAL OUTLAY FUND EXPENDI- TURE (El Toyon Park)," Moved by Waters, seconded by Hogue, Resolution No., 104360 be adopted, Carried by unanimous vote. RESOLUTION NO. 10,361, "RESOLUTION OPPOSING SENATE BILL 427." Moved by Hogue, seconded by Reid, Resolution No 101361 be adopted. Carried by unanimous vote. Carried by unanimous vote, 6/8/71 131 ORDINANCE NO. 1272, "AN ORDINANCE AMENDING ORDINANCE NO, 962 AND ORDINANCE NO. 1213 TO ALLOW LIQUID PETROLEUM GAS DISPENSING FACILITIES IN ALL ZONES WHEREIN AUTOMOBILE SERVICE STATIONS AND GARAGES ARS PERMITTED." Carried by unanimous vote, REPORT OF CITY ATTORNEY CITY ATTORNEY McLBAN spoke in regard to a memorandum prepared by the Director of Planning which further elaborates the Planning memorandum of May 27 concerning possible zoning provisions to permit a Conditional Use Permit for Scrap Disposal and to restrict such Conditional Use Permits to that particular property so as not to encourage the expansion of the scrap industry in the Industrial Zone. Nays: Hogue. Abstaining: Reid, HEARINGS The HEARING ON REASSESSMENT ROLL NO. 153-SD covering the 1911 ACT IMPROVE- MENT CIF I, J, L, 20TH, 22ND, 24TH STREETS, was held at this time. City Clerk Minogue stated the Certificate of Publication and Affidavits of Mailing and Posting Notice of the Hearing of Reassessment were on file; written protests were received from Leslie J. and Blanche E. Landers, Mrs. Arthur J. Vigneault, Hazel and Herman Lentz, Lester J. Cramer, Mr. & Mrs. Roman Banashak and Leola C. Seabock. Robert Onley (Assessment Engineer for Assessment District 153.-SD) stated the reassessment was the result of a Court hearing and a Court Order; the Judge directed they seek and find a method of assessmcv �f would show.disparity between frontage property and non -frontage, , f; �,ey displayed a mapshowingthe improvements and construction within the district on which the properties for which protests were received were colored in green. Mr, Onley described the improvements and the method of reassessment (the San Diego 70/30) which was accomplished 4Y computer, Mr. Onley described certain abnormally high assessments which occurred in the computerized reassessment because the computer is not capable of judging benefit received. Mr. Coley recommended the 153-SD reassessments for parcels Nos. 4„ 6, 15, 22, 38, 101, 102, 103, 133, 154, rd 155 which were abnormally high be decreased and that the City's contri- tion be increased a total of $1 643.37 (total of the individual de- heases.) C rht Ix) ..0,akING ON THE PROPOSED AMENDMENT TO NATIONAL CITY ZONING ORDINANCE TO ALLOW INDUSTRIAL MEAT PACING INCLUDING SLAUGHTERING AS A OR CONDITIONAL USE IN THE M-4 ZONE SUBJECT TO LIMITATIONS AND 14044%1 STANDARDS TO BE ATTACKED was held at this time. City Clerk Gfie state the Certificate of Publication of Notice of the Hearing was ae and a communication from the Planning Department stating the Plan- N t`lion voted to amend the City's Zoning Code to allow existing 6/8/71 132 non -conforming meat packing and slaughter houses to be extended or enlarged, provided they conform with all other provisions of the Code and subject to the issuance of a Conditional Use Permit was attached to the Agenda. Planning Director Gerschler said the Council had the Planning Commission's recommendation in favor of this matter with the report of staff attached; the effect of this if approved by the City Council would be for the single purpose of allowing the existing meat packing houses to expand after they first obtain a Conditional Use Permit which would have to be approved by the City Council. The Planning Director said no protests were received at the Planning Commission hearing. There was no one present in this regard. Moved by Waters, seconded by Camacho, the public hearing be closed and Ordinance 962 be amended to allow industrial meat acking including Blau h- tering as ., a permitted or conditional use in the M-4 Zonin and all staff's sti ulations be adhered to. Carried by unanimous vote. The HEARING ON THE PROPOSED ZONE CHANGE ZCw-77-71 TO RECLASSIFY FROM ZONE R-2, TWO FAMILY RESIDENCE ZONE, TO ZONE R-4-PD, MULTIPLE FAMILY PLANNED DEVELOP- MENT ZONE, ON CERTAIN PROPERTY BETWEEN HELEN CIRCLE AND EUCLID AVENUE NORTH OF PLAZA BOULEVARD was held at this time. City Clerk Minogue stated the Certificate of Publication of the notice of the hearing was on file and a communication from the Planning Department stating the Planning Commission voted that the public hearing be closed and the application for Zone Change No. C-77 from R-2 to R-4-?D as recommended by staff be approved was attached to the Agenda. Planning Director Gerschler said the Council has the Plan- ning Commission's recommendation in favor of this proposal; transmitted are 12 documents which were presented to the Planning Commission hearing and the staff's report. Donald R. Jones, 2406 E. 19th Street, was present and said he lives in this neighborhood; apartments and duplexes are being built and there is getting to be a density of population in that area; the schools aren't big enough as they are right now; he would like to see the brakes put on apartment houses going up in the city; they will become the world's largest apartment complex shortly. Leonard,, R. Willett, 2226 E. llth Street, asked if they were supposed to have received a notice of this meeting under discussion tonight. Mr. Willett said there are over 721 apartments in this area between Palm and Harbison and Plaza and 8th Street; a considerable section of this area was knocked off for the 805 Freeway; they could get a saturation of apartments if they keep this up; he believed there could be .a better use for this particular land. Mr. Willett said they have asked if the Council approves the building of these apartments if they could have llth Street closed off because they find that the Fire Department does not need it for access; the main access to the area would be from another direction off Euclid Avenue; if there was any guarantee that they could get this closed off, possibly they would like to have a drop-off to cut the area down so that the area level would be lower than the llth Street level by 6' or 8' or 10'. Jim Patton, 580 3rd Avenue, Chula Vista, was present and displayed a map. Mr. Patton explained the boundaries of the 4-3/4 acres proposed for rezoning; and the tentative grading plans. Mr. Patton said below the elevation of the lot grades there will be a block wall, a concrete block wall. Mr. Patton said they have traded 30' the entire length of this property plus an angle in order to obtain a 60' right of way to Euclid Avenue, a 60' street which will be improved and maintained by them; this will facilitate the development along this property; if they will remember this property was too shallow at the present time to properly develop and get parking because of the banks; with 30' they can now grade the property. Mr. Patton pointed out the zoning in the area. Andrew Sadowitz, 1005 Helen Circle was present and said Mr. Patton said from the highest point of the lot he said he was going to take 10' and he would like to know where that comes down to llth Street. Planning Director Gerschler said he hadn't seen a grading plan for the property; he could only confirm that the elevation from llth Street to the site will be less than the difference in elevation from the lots on Helen Circle because Helen Circle is higher than llth St. Mrs. Donna Culp, 1017 Helen Circle, was present and said the people on llth Street have been opposed to rezoning from an R-2 to an R-4-PD because they feel that more apartments could do nothing to en- hance National City; on the contrary, they have pointed out already many of their areas have become an eyesore because of such complexes; they have talked with the developer and he said that he would lower the land; they feel a 10' drop on llth Street would not as directly affect them; however, they do feel that more apartments in this area, which are already saturated, could do nothing towards that area or the city as a whole; she would, 133 therefore, oppose the rezoning from R-2 to R-4PD. Mrs. Phyllis Saisavich, 2220 E. llth Street, was present and said she protested the zone change. Leonard W. Lightner, 2126 E. 12th Street, was present and said he lives on 12th Street and has access to Plaza Boulevard; Saturday he waited approxi- mately 10 minutes to get on Plaza Boulevard because of the traffic situa- tion; he felt that they don't have the streets to accommodate this many more people. City Clerk Minogue said she had not received any written protests; the hearing notice was by publication in the newspaper only. Vice Mayor Waters asked if they had any idea on the percentages of objections to this particular development at the hearing held by the Planning Commission. Planning Director Gerschler replied that information was contained in the Planning Commission minutes; it would only take a moment to work out the percentage. Mayor Morgan declared a recess of the public hearing and that the regular order of business on the agenda be brought to the floor. APPROVAL OF BILLS AND PAYROLL BILLS AUDITED BY THE FINANCE COMMITTEE were presented: General Fund $6,662.88 Traffic Safety 448.25 Capital Outlay 216.36 Park 509.15 Sewer 121.19 Total $71957.83 Moved by :eaters, seconded by Hogue, these bills be_paid and warrants drawn. Carried by the following vote, to -wit: Ayes: Camacho, Hogue,Reid, Waters, Morgan. Nays: None. PAYROLL AUDITED BY THE FINANCE COMMITTEE in the amount of $108,211.92 was presented. Moved by Camacho, seconded by Reid, this payroll be approved. Carried by the following vote, to -wit: Ayes: Camacho, Hogue, Reid, Waters, Morgan. Nays: None. UNFINISHED BUSINESS A report from the DIRECTOR CF COMMUNITY DEVELOPMENT in regard to the res- toration of Granger Hall was presented. Moved by Hogue, seconded by Reid, this item be tabled. Carried by unanimous vote. Tom Ruiz, Co -Chairman Granger Hail Committee, South Bay Historical Society, was present and said Mr • Foster, the City Engineer, has agreed to work on the structure with him; he also has an architect who was willing to help him; before they can really come up with anything they have to have an analysis by a structural engineer. Mayor Morgan said when he has the analysis he can come back and make a report. NEW BUSINESS A communication from the CITY MANAGER stating the Unified Port District requested authorization to meet in the National City Council Chambers at 7:30 p.m., Thursday, July 8, was presented. Moved by Camacho, seconded by Hogue, this re uest be ranted. Carried by unanimous vote. A communication from the DIRECTOR, URBAN HOUSING DIVISION, LEVITT-UNITED MULTIROUSING CORPORATION, in regard to the proposed high rise building for the elderly was presented. Moved by Hogue, seconded by Camacho, this item be referred to the City Manager for further study. Carried by unanimous vote. A communication from the PRESIDENT, SAN DIEGO GAS & ELECTRIC CO., in regard to future energy needs and inviting City representatives to a meeting of city and county officials June 25 was presented. Carried 6/8/71 134 The request of the WOMEN's AMERICAN ORGANIZATION FOR REHABILITATION THROUGH TRAINING for a no -.fee permit for a rummage sale at 35 E. 18th Street June 9 and 10, proceeds to go toward their health project, the report of the Busi- ness License Clerk and the License Collector's recommendation the request be granted were presented. Moved by Camacho, seconded by Hogue, this request be granted. Carried by unanimous vote. REPORTS CITY MANAGER OSBURN said last Friday they received a signed contract from HUD in relation to the sewer grant which grants a 50% grant up to $400,000. for the construction of the Plaza Boulevard Sewer; it says "We will in the near future advise you of the next steps to be taken relative to this project." The City Manager said as yet they have heard nothing. CITY MANAGER OSBURN reported receipt of a request from Mr. James E. Hanson, Associate Student Body Advisor, National City Junior High School, requesting the use of the Bowl, the Memorial Bowl, June 15, 8:30 a.m. to 11:30 a.m. Moved by Camacho, seconded by Reid, this request be granted. Carried by unanimous vote. CITY CLERK MINOGUE reported receipt of (a) Supplemental Opinion and Order, Decision No, 78719, Case No. 8249, before the California Public Utilities Commission, in regard to the County of Monterey application to reconstruct grade crossings and petitions for various modifications, and (b) Communica- tion from Congressman Don H. Clausen acknowledging receipt of a resolution regarding revenue sharing which were on file. Ordered filed by unanimous vote. The HEARING ON THE PROPOSE) ZONE CHANGE ZC-77»71 TO RECLASSIFY FROM ZONE R-2, TWO FAMILY RESIDENCE ZONE, TO ZONE R-4-PD, MULTIPLE FAMILY PLANNED DEVELOPMENT ZONE, ON CERTAIN PROPERTY BETWEEN HELEN CIRCLE AND EUCLID AVENUE NORTH OF PLAZA BOULEVARD was resumed. Planning Director Gerschler said the Planning Commission notified all of the owners of property shown on the assessment roll having property within 3001 surrounding the subject property; 44 notices were sent; 6 people spoke in opposition orally at the Planning Commission meeting as shown in their minutes; 2 letters of opposi...: tion were submitted for a total of 8 protests which would be approximately 18% of the total number of people who were notified. Lawrence Willett, 2226 E. llth Street, was present and said he was speaking for his parents; in regard to the statements made concerning the number of people that protested at the Planning Commission meeting he would like to state that the residents involved have many discussions on their own between the various Planning Commission meetings involving this and the people who were speaking at those meetings were speaking for a group; if they would like the number of the citizens who protested this, then they should notify the individual citizens they have to protest on an individual basis; this would give them a more accurate picture; he knew personally that last night a meeting was held at a neighborhood residence and the vast majority of the residents he personally heard to voice opposition; this isn't showing up in the statements of the number of people that have protested; he thought the Council should be aware that they are protesting for a group and not just one person protesting by himself. Moved by Hogue, seconded by Reid, this proposed zone change ZC-77-71 to reclassify from Zane R-2, Two Family Residence Zone to Zone R-4PD Multiple Fam Planned Develo ent Zone be approved and referred to the staff for proper processing.
