223 MINUTES OF THE REGULAR MEETING OF THE CITE' COUNCIL OP THE CITY OF NATIONAL CITY, CALIFORNIA December 1, 1970 The regular meeting of the City Council of the City of, National City was called to order at 7:30 p.m. by Mayor Morgans ROLL. CALL Council members present: Camacho, Hogue, Reid, Waters, Morgan. Absent: None, Administrative officials present: Bourcier, Foster, McLean, Minogue, Osburn, Stockman. SALUTE TO FLAG AND INVOCATION The meeting was opened with salute to the Flag led by City Manager Osburn followed with invocation by a representative of the Ba.ha t i Faith. APPROVAL OF MINUTES Moved by Waters, seconded by Camacho, the minutes of the regular meeting of November 24 1970 be approved. Carried by unanimous vote. COUNCIL COMMUNICATIONS VICE MAYOR CAMACHO reported he just received a note of thanks from the students of Sweetwater High School for permitting them to have the two rallies for their CIF playoffs signed by Joseph Turrentine. COUNCILMAN WATERS inquired about the proposed amendment to the ordinance on the upgrading of the size of apartment complexes; he would like this on the agenda as soon as possible. Director of Planning Stockman said a proposed ordinance will go to the Planning Commission for setting a public hearing at the next regular meeting; it will then come to the Council and at that time they could ask to make it an interim ordinance. Councilman Waters ask- ed the Director of x lanning how she was coming along on the moratorium that was set a few weeks ago, Mrs. Stockman replied she was working on that also; she has a committee of two members of the Planning Commission helping her; they should be coming well within the 60 days. COUNCILMAN HOGUE said a year or so ago he brought to the attenti'n of the Council the fact that oil companies were buying up prime corner lots in the City for installation of service stations; they were unable to do much about it; two stations in his area have closed down because they were not profit- able; he thought the reality of this had finally reached the Council and it was time they did something about it; the prime corners could be used for something more productive to the citizens than vacant service stations; he would like someone (he didn't care who) to give him a report on the number of service stations closed down at this time in the City. COUNCILMAN HOGUE said he had always championed sports for young people in the community; there are two outstanding football teams in the area; Sweet- water High School football team which went into the CIF playoffs should be brought before the Council to be recognized; and the Pop Warner Tecolotes who were undefeated until last week should be brought here and given recog- nition from the Council. Mayor Morgan asked the City Manager to see that these teams are invited to appear at different Council meetings. ORAL COMMUNICATIONS E. H. ALSDORF, 2105 J Avenue, was present and said about 7:00 this evening he was disturbed by a car climbing the curb across the street at 21st and J; there was another one with the front wheel off in the middle of the road; he would request once again that stop signs be placed at this corner. ADOPTION OF RESOLUTION; Moved by Camacho, seconded by Waters, the resolutions be read b title. Carried by unanimous vote. 12/1/70 224 RESOLUTION NO. 10,223, "RESOLUTI0N AUTUORIZING CAPITAL OUTLAY FUND EXPENDI- TURE (El Toyon, Phase II)." Moved by Camacho, seconded by seaters, Resolution No. 10,223 be adopted. Carried by unanimous vote. RESOLUTION NO. 10,224, "RESOLUTION AUTHORIZING EXECUTION OF GRANT DEEDS TO REDEVELOPMENT AGENCY OF CITY OF NATIONAL CITY (Parcels 14-3, 20-1 & 20-6) . " Moved by Hogue, seconded by Reid, Resolution No. 10 24 be ado ted. Carried by unanimous vote. REPORT OF CITY ATTORNEY - no report. Carried by the following vote, to -wit: Ayes: Camacho, Hogue, Reid, t ers , Morgan. Nays: None. Absent: None. REFERRALS The request of MRS. BILL R. HART to address the Council was listed on the agenda. Mrs. Hart, 3409 Menard Street, was present and said in regard to Phil Milligan, after they met with Mr. Osburn last Monday, they realized it would be impossible to reinstate Mr. Milligan as Juvenile Officer but they felt now was the tiiie for them to set up a Narcotics Division in the Police Department; they couldn't wait; the biggest problem with juveniles is nar- cotics and it will have to be stopped; Phil Milligan is a man who is well qualified and is one of the best persons she ever had the privilege to meet; he helped her with many problems with her children and in instructing her and her husband to understand them better; this man has been to school and has worked with it on his own time and in the department. Gene Berry, 1226 Roselawn Street, was present and said the people present tonight believe there is a major narcotics problem and it was a shame the Council Chamber was not large enough for all the people to get inside, there were many in the lobby; they were present to request the City set up a Narcotics Division to work with young people before they get into trouble; it is a fact that on our Junior High School and Senior High School campuses they can buy heroin, drugs are being sold in the restrooms, in the hallways and in the classrooms. Mr. Berry urged National City to create a Narcotics Bureau composed of two officers; narcotic prevention among juveniles is more important than any other police work in our City; as narcotic addiction arises, so does all crime; they need someone with proven ability and experience in the field of narcotics (not just someone who has passed a written or oral examination); the Mayor stated last Tuesday evening he was in favor of a narcotics officer and would see that the money was put in the next budget - but could they wait until next year. Bill Hart, 3409 Menard Street, was present and spoke on behalf of a Narcotics Division and Phil Milligan. Mayor Morgan said he would go along with anything that can be done to create a Narcotics Division if they have the money. Councilman Waters asked the City Manager to check to see if they could afford two men for a Narcotics Division. HEARINGS The USE DISTRICT HEARING ON THE PROPOSED AMENDMENT TO ORDINANCES 962 AND 1236 TO PERMIT ALL USES OF TRANSPORTATION CENTER PLANNED DEVELOPMENT ZONE AND TRANSPORTATION CENTER SUPPORT PLANK DEVELOPMENT ZONE ON ALL OF PARCELS NO. 1 AND NO. 2, MAP NO. GNI, E. J. CHRISTMAN INDUSTRIAL PARK was held at this time. City Clerk Minogue stated the Certificate of Publication was on file and the recommendation of the Planning Commission to approve was attached to the agenda. Director of Planning Stockman said the public 12/1/70 225 hearing was on the zoning of property located between 18th Street and 22nd Street at National. Avenue and the proposed alignment of Transportation Avenue known as Roosevelt Avenue; it has come to the attention of the Executive Director of Redevelopment and the Planning Director that there are buildings there that could be used that are outside of the Redevelopment Area and they felt the zoning was too restrictive; they recommend the zoning be changed so that both uses could be conducted within that area to utilize the buildings that are on the property; the Planning Commission unanimously voted the zoning be established as outlined. Wyman Hack, Security Pacific National Bank, Real Estate Department, was present and said they have a par- cel of property a city block long which falls within Phase II of the Re- development Program; it is roughly in the 2100 block on the west side of National Avenue* Mr. Emde would like to locate in this area and has an application in for a use permit for what would be termed motorcycles; this is not a new car agency but it is a transportation situation; until Phase II goes into effect, they would upgrade their property and it would be an asset rather than a liability. Director of Planning Stockman said this would put transportation support as a permissible use in this area; she talked to Mr. Emde and he was merely waiting for the passing of the ordinance and she thought he would proceed. REFERRALS (Continued) The report of the CITY MANAGER in regard to the appointment of William F. Devaney to the Detective Division was presented. Ordered filed by unanimous vote. UNFINISHED BUSINESS A communication from the CITY MANAGER in regard to policy for handling overwidth driveways was presented. Moved by Hogue, seconded by Camacho, Iunicaiscomir)frolutttSily...E. Carried by unanimous vote. Council considered an overwidth driveway for the MAPLE COTTAGE FURNITURE STORE, 2704 Highland Avenue: (a) Request for driveway by Les Hansen and (b) Recommendation of the Director of Planning and City Engineer to approve the request subject to three conditions and (c) plot plan. Moved by Waters, seconded by Camacho, the request for overwidth driveway by the Maple Cottage Furniture Store, 2704 Highland Avenue be a roved as recommended b the Director of Planning and City Engineer sub'ect to the four conditions of staff. 4th condition: it be restricted to right-hand turn only enterin Highland Avenue off of the property). NEW BUSINESS A communication from the DIRECTOR, COUNTY DEPARTMENT OF SANITATION & FLOOD CONTROL, requesting payment of 30.7% of interest payments to the Division of Highways as per contract (Sweetwater River Channel) was presented. City Manager Osburn said he would like permission to pay this in the amount of $7,126.02. Moved by Hogue, seconded by Camacho, the payment to the County Remrtment_2f Sanitation & Floop,LControl of 30.7% of interest be made. Carried by unanimous vote. A communication from the SAN DIEGO COUNTY WATER AUTHORITY in regard to the intention to pay whole or stated percentages of taxes to be derived from the area of San Diego County Water Authority lying within City boundaries was presented. Ordered filed by unanimous vote. The request of JOSEPH N. FOX, INDUSTRIAL SALES CO., 1604 McKinley Avenue, for the closing of a portion of 16th Street between McKinley Avenue and alley ($100.00 fee paid) was presented. Moved by Hogue, seconded by 4hters, the request of Joseph N. Fox, Industrial Sales Co., pertaining to the closing of a portion of 16th St. between McKinley Avenue and thealleyjm referred to the Planning Commission. Carried by unanimous vote. 12/1/70 226 A communication from the CITY MAAGER recommending the easement granted in Resolution 6831 be cancelled for non-use and the request of the L. BRUCE STALLARD CO. to void said easement and clear the title were presented. The request of the BOARD OF DIRECTORS, NATIONAL CITY CHAMBER OF COMMERCE, for support of their action in regard to maintaining Camp Pendleton and the Otay Ranch area as green belts was presented. Moved by Hogue, seconded by Reid, this item from the Board of Directors of the National Cit Chamber of Commerce ertainin to Cam Pendleton and 4ta Ranch be filed. Edith Sherman, Manager, Chamber of Commerce, was present and said this was the recommenda- tion of their Pollution Control Committee; they were only asking that the County Planning Commission and the San Diego Chamber of Commerce be request- ed to study this and try to maintain some areas as green belts; they didn't designate any number of acres or specific areas; these two areas were suggested. Carried by the following vote, to -wit: Ayes: Camacho, Hogue, Reid. Nays: Waters, Morgan. A communication from the CITY MANAGER stating National City stood No. 6 in Group 3 of the League of California Cities Annual Safety Contest was pre- sented. Moved by Hogue, seconded by Camacho, Item 7 pertaining to the stand- ing of National Cit so far as the Annual Safet Contest be filed. City Manager Osburn said this is a contest among the cities of California that are divided into groups; Group 3 covers cities having from 51 to 300 employees; we had an accident frequency of 16.55 out of 483,312 man hours of exposure; the winner in this class had 7.63 out of 393,433 man hours of exposure; this is the first time we have come near the top; the employees should be commend- ed for their safety habits. Moved by Waters, seconded by Camacho, the motion be amended that the gay Manager send a communication from the Council thankin the Cit em to ees for their outstandin 'ob in the annual safet contest for the City. The amendment to the motion carried by unanimous vote. The original motion carried by unanimous vote. A communication from the LICENSE COLLECTOR **commending the dog license grace period be extended to January 31, 1971 in order for National City to hold a rabies clinic January 15 was presented. Moved by Waters, seconded by Camacbo, the communication from the License Collector recommending the dog license grace period be extended to January 311 1971 in order for National Cit to hold a rabies clinic January 15. Carried by unanimous vote. The request of the PARADISE VALLEY SEVENTH DAY ADVENTIST CHURCH to conduct an annual Ingathering, report of the Business License Clerk and the License Collector 's recommendation the request be granted were presented. Carried by unanimous vote. 12/1/70 227 The minutes of the meeting of the BOARD OF TRUSTEES, NATIONAL CITY PUBLIC LIBRARY, November 4, were presented. Ordered filed by unanimous vote. A communication from the CITY CLERK,, CITY OF OCEANSIDE, reporting Oceanside adopted a resolution urging the Local Agency Formation Commission to adopt a policy of requiring annexation to municipalities for any area which required urban services was presented. Moved by Hogue, seconded by Camacho, National City make a resolution on the order of the one Oceanside prepared and bring to Council for adoption to be sent to the Board of Supervisors. There was discussion. Motion failed by the following vote, to -wit: Ayes: Camacho, Hogue. Nays: Reid, Waters, Morgan. A lady in the audience inquired if they were going to be able to express their opinions regarding a Narcotics Division. Mayor Morgan suggested they finish the agenda and then if she had something to say, they would talk some. REPORTS CITY MANAGER OSBURN reported receipt of a request at 4:45 p.m. from Mrs. Alma Russell addressed to the Council for a permit to hold a rummage sale December 4 and 5 at St. Matthews Episcopal Church, 521 E. 8th Street from 9:00 to 5:00 p.m.; they are a non-profit organization; money from the sale will helpfeed homeless cats. Moved by Waters, seconded by Morgan, Mrs. Alma Russell be allowed to hold a rummage sale December 4 and 5 at St. Matthews Church, 521 E. 8th Street so the sale will help to feed the cats. Carried by the following vote, to -wit: Ayes: Camacho, Reid, Waters, Morgan. Nays: Hogue. CITY MANAGER OSBURN reported receipt of a communication from Albert Alvarado, President, National City -Lincoln Acres Community Action Council, urging the City to set up a Narcotics Bureau and agsuring their support for a Narcotics Bureau in the City of National City. Moved by Hogue, seconded by Morgan, this item from Mr. Alvarado be referred to the Finance Committee. Albert Alvarado was present and said he hoped this letter wouldn't get filed like the letter they sent in for the narcotics agency they tried to form in National City. Carried by unanimous vote. CITY MANAGER OSBURN said he had a communication signed by the City Manager, City Attorney and the City Engineer and its subject was the Plaza Boulevard Interceptor Sewer; they recommended that in Specification No. 761, Plaza Boulevard Interceptor Sewer, Project HUD WS-Calif 422, the City Council re- ject all bids based on the use of reinforced plastic mortar pipe (all bids concerning the use of reinforced plastic mortar pipe be rejected for the following reasons: A. The reinforced plastic pipe, up until this time has not been approved by the American Society of Testing Materials; B. The Bureau of Standards of the City of Los Angeles has not approved reinforced plastic pipe) and the bid of Harper & Henson, a Joint Venture, in the amount of $782,930.00 be accepted and the contract for the Plaza Boulevard Inter- ceptor Sewer, Specification No. 761, be awarded to said Joint Venture, using vitrified clay pipe; the award of a contract to Harper & Henson, a Joint denture, will be subject to the approval of the Department of Housing & Urban Development, and further subject to the concurrence of the City of San Diego, who will participate in the project with the City of National City; the foregoing recommendations are made following an exhaustive and detailed analysis of all the bids, together with the suitability of the alternate pipe materials. Moved by Camacho, seconded by Waters, the City Manager's, City Attorney is and City Engineer's recommendation be approved on the inter- ceptor sewer. There was discussion. Gerald Dorfman, General Manager for .... a contractor, was present and said they submitted the low bid on the rein- forced plastic mortar pipe; when they placed the bid with the City of National City they thoroughly investigated National City's specifications and plans; there was no indication, written or oral, that the reinforced plastic mortar pipe was inferior but they were apparently now so indicating; they placed a bid that was approximately $50,000.-$60,004. less than they wanted to award now to a material that was used in many other areas; if that 12/1/70 228 was what their conscience tells them or if that was what they thought was best for the City, that was what they would probably vote for, but it just doesn't seem to balance what was in the specifications and plans when they submitted their bid. Larry Olsen, District Sales Manager, Techite Depart- ment of United Technology Center, a Division of the United Aircraft Corpora- tion, 3100 Jefferson Street, ;riverside, was present and said they do guaran- tee their product exactly the same way as all the others guarantee theirs; in most specifications there is a one year guarantee covering workmanship and materials; it's in their quotations and in their contract. There was further discussion. Glen Van ;tie Veere, 1314 K Avenue, was present and said he had experience with both kinds of plastic pipe and was unbiased; the reason he was low was because plastic was easier to lay and plastic would be much faster to repair and much cheaper; you don't have to take out a whole section to repair it. Joe Preston, employed by Interpace Corporation of Los Angeles, was present and said he represented the clay pipe industry this evening; clay pipe has been in use for over 2,O00 years; it was depend- able, easy to lay, and it was guaranteed against corrosion, erosion, includ- ing the joints, labor and materials for 50 years; to repair the pipe it is very simple. John W. Stewart, 3118 Biggs Court, was present and said all of this time they were talking about sewers; they asked for their children and yet they get cut off. Moved by Hogue, the Council contact the Federal Gov- ernment to see if the Federal Government has any resentment against the use of plastic pipes for the installation of this sewer since they are paying the majority of the cost. Died for lack of second. Motion carried by the following vote, to -wit: Ayes: Camacho, Reid, 4hters, Morgan. Nays: Hogue. DIRECTOR OF PLANNING STOCKMAN said the Planning Commission passed by unani- mous vote that a conditional use permit be granted to the Southland Indus- trial Park Subdivision, Unit No. 2, which lies south of the flood control channel subject to 6 conditions; this would still place the requirement that the engineering plans be prepared and approved by the City Engineer and would not include any of the existing water right of way, the proposed flood channel or any of the Route 54 freeway; it also would permit the developers to install two railroad spur tracks to serve the area as operated and approved by the railroad company and the State Division of Highways. Moved by Waters, seconded by Hogue, the recommendation that request for Conditional Use Permit covering all remainin lots after settlement with the Division of Hi hwa s State of California in Southland Industrial ?ark Unit No. 2, be granted s b;'ej cLto the 6 conditions of staff. Carried by unanimous vote. REFERRALS (continued) John W. Stewart, 3118 Biggs Court, was present and spoke on behalf of Phil Milligan; told of personal problems he had which Officer Milligan helped him with and said they needed a Narcotic Division; he was not saying Officer Milligan was the right man but he was outstanding with the children and the parents and very considerate of all people, young and old; he will explain how the parents can look out for the daughters and sons and what to look for; he has done this personally in his house; he has done this for quite a few people in National City. Mrs. Lewis Dames, 2044 F Avenue, was present and said they have a man qualified and couldn't understand why he wasn't working at the job that he knows. Ruth Hitt, 3408 Menard Street, was pres- ent and spoke on behalf of Officer Milligan and said they should not under- estimate the power of the people as the Council could be removed from office. Francis F. Mournian, 2721 B Avenue, was present and said National City had a problem similar to Chula Vista with narcotics; they were close to the border and would live with this problem a long time; he heard the Mayor say he wanted to save money; when the Mayor wanted to he obtained a nice new Library when a lot of people said it couldn't be done; they need a Narcotics Division and apparently they had a trained man; Phil Milligan does not work a straight 8-hour shift; how many times does he go out in the middle of the night and how many extra things were there involved; some cities have given their officers a recorder and use of a stenographer to transcribe his re- ports. Barbara Hubbard, 2535 Melrose Street, was present and said Mr. Milligan might have been a little late for work; she didn't know how many nights she had seen him at meetings, at people's homes telling them about 12/1/70 229 narcotics and inquired if the Council paid him for all the time he puts in. Mayor Morgan said if this problem was so much in school rooms and lockers they should do something about the schools. Margaret Hirschy, 2314 B. 13th Street, was present and said she worked with the community every day; she found that not only the children in the schools but the children out of schools, drop outs, are using drugs every day; she recommended someone on the Council look into the California Criminal Justice Department; there are funds there still available and they should look under the Safe Street Act to get funds for the narcotics problem; there are funds available if you will make the application. Lewis Daves, 2044 F Avenue, was present andsaid a week ago last Monday they had a meeting with the City Manager and the Chief of Police; he said he was operating 3 men short; they said 2 men could operate this Narcotics Bureau and since money was evidently appropriated for those three men before this year started why couldn't they form this Bureau by adding three men to the unit and start it now when they need it; if no one knows where you can buy narcotics, ask some school kid. Kirk Johannes, 34O9 Menard Street, was present and said he knew Mr. Milligan and, he could talk to them and they to him; they couldn't talk to just anybody; Mt. Milligan was the kind of guy who understood them and there were not many other people who did; he thought Mr. Milligan was the best guy for the Narcotics Division. Diana Frost, Science Teacher at National City Junior High School, was present and said this week they were having a drug abuse program at school and the Police Chief said he doesn't have anyone qua.lifiod now to talk and they have too much paper work to talk to them; there are groups like DARE but these groups have problems because the kids who came last year to talk, well, one of theca came high on marijuana. Joe Camacho, 1937 A Avenue, was present and said regarding raising money, if they could tax people 21 years old and older a quarter every three months it would be a dollar a year which would probably give them $27,O00.00 a year or more; this would be enough money to staff two people and buy all of their equip- ment every year. Steve Ord, 34 Street, was present and said he was there on behalf of Mr. Milligan; this was his last year of high school and he was one of the stupid kids who tried dope; he couldn't talk to his parents so he just kept on doing it; he didn # t know how to handle it; he finally got caught by his parents who called Mr. Milligan; no one else could get through to him like Mr. Milligan could and tell him why he really took it. Vice Mayor Camacho inquired if he was still taking it. Mr. Ord replied no, he quit it. Vice Mayor Camacho asked what induces a fine young man to take something like this knowing that you're going to have problems. Officer Milligan came to the microphone and said he could answer for Steve; it is hard for kids of this age to converse with the older generation, the estab- lishment; we have neglected the kids and we don't give them the credit which they deserve; these are intelligent children; they can read newspapers, books, and they know what is going on in the world; they are our future gen- eration; they will be running this world and we had better start listening to them. Officer Milligan said he was proud of the National City Police Department but there is no way he would accept a position in the Juvenile Division of the National City Police Department unless he was so ordered and if he was ordered back into that position, he would attempt to get out of it some way or other; this City needs a Narcotics Division and it needs it badly; it doesn't need it tomorrow, it needs it now. Mrs. Doris McKinney, 120 Valva Avenue, was present and said she came here because she was on the Civil Service Commission and was interested in seeing what was going on and knowing what it was all about; she talked to Mr. Milligan on the evening of November 24 and he told her at that time that he had no intention of appeal- ing the action of Chief Cagle in this matter; she came down because she was interested in what this was all about. Mrs. McKinney said she has 2 sons, one 25 years old, a professor at California -Western University and a gradu- ate of Sweetwater High School and San Diego State College; he said California Western was the only place he felt he could teach because the narcotics problem was a very minor one at Cal Western; he says you can walk into San Diego State's cafeteria and get high just on the odor; her younger son, 20 years of age and a student at Southwestern College, says the same thing about Southwestern. Mrs. McKinney said she went to see one of Sweetwater's 12/1/70 230 football games recently and she was astounded at the amount of marijuana being passed around at that game in plain sight; she felt they most definitely have to have a Narcotics Division and was certain the council could find a way to finance it; the question came to her mind where they talking about hiring new officers or using officers already on the force. Kim Rutledge, 35 White Willow Road, Bonita, was present and said Mr. Milligan was trying to help the youth; they didn't seem to care that he would stick up for the kids and try to help them with their problems. Glen Van De Veer, 1314 Avenue, was present and said he took dope from the time he was almost 13 until almost 18, LSD and anything; he couldn't live at home; he had to go see Milligan (and he would tell them now he is his cousin which didn't have anything to do with it); what caused him to start taking it were the inad- equacies he felt around him, especially from the Police Department. Carol Trumbower, Social Worker, Chula Vista, was present and said she was present as a professional social worker; she knew Mr. Milligan through her job but she was not here as a representative of her job; she has seen him work and could see a man who was very sensitive to the needs of children and youth; these children for some reason listen to him and can talk to him; they really feel that he is sincere; you say there are other men in your department that are taking his place and other men who can receive training in narcotics, etc.; however, not every policeman has the kind of ability that this man has to communicate. Josephine Shepherd, 2035 E. 8th St., was present and said she was a mother of 4 boys, ages 12, 16, 17 and 18; she thought a lot of people present were surprised at a lot of the comments; it goes to show what we mean when we say we have a generation gap between not only the children but the Police Department and the parents; you put this man back in uniform and she didn't think the youth would relate to him as they did before; she wished they had more people like him; she thought they had a fine Police De- partment but wouldn't say it was 1005; she thought some of the younger officers antagonize the youth; she taught her boys respect for law and order and property. Gene Berry inquired if the Mayor would like them to come back next week with more people or could they be assured of this. Mayor Morgan replied they would like to see people out any time; they are here to serve the people and they want to serve the people. Councilman Waters asked questions relating to a Narcotics Division of Officer Milligan. Moved by Camacho, seconded by Reid, the meeting be closed. Carried by unan- imous vote.
