Council members present: echo, Colburn, Hogue, Reid, Morgan. Absent: None. MINISTRATIVE OFFICIALS present: Foster, McLean, Minogue, Osburn, Stockman. T e meeting was opened with salute to the Flag led by City Manager Osburn, f.11owed with invocation by Councilman Colburn. Moved by Reid, seconded by Camacho, the minutes of the regular meeting of A gust 27, 1968 be approved. Carried by unanimous vote. M•ved by Hogue, seconded by Colburn, the following two resolutions be read b1 title. Carried by unanimous vote. R OLUTION NO. 9656, "RESOLUTION ADOPTING THE BEAUTIFICATION PROGRAM FOR T CITY OF NATIONAL CITY, CALIFORNIA." Moved by Colburn, seconded by C-nacho, the Resolution be adopted. Carried by unanimous vote. R A M u OLUTION NO. 9657, "RESOLUTION OF THE CITY OF NATIONAL CITY, CALIFORNIA, HORIZING THE FILING OF APPLICATION FOR URBAN BEAUTIFICATION GRANT." ved by Colburn, seconded by Reid, the Resolution be adopted. Carried by animous vote. R OLUTION NO. 9658, "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATION - CITY, CALIFORNIA REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF S DIEGO TO CONSOLIDATE THE BOND ELECTION OF SAID CITY TO BE HELD NOVEMBER 5, 1968 WITH STATE WIDE ELECTION TO BE HELD ON THE SAME DATE," was presented M.ved by Hogue, seconded by Camacho, it be read by title. Carried by unan- i ous vote. The title was read. Moved by Colburn, seconded by Hogue, the Resolution be adopted. Carried by unanimous vote. CaUNCILMAN COLBURN stated the last resolution sets in motion the possibility including on the November ballot a bond measure submitted for the proval of National City residents; the passage of the measure would pprove the purchase of the water company; there have been numerous dis- cussions in years past regarding public ownership of the water company; a oint Powers Agreement was prepared and they refused to go along with it for several reasons; he asked if the Council would consider the Joint owers Agreement as opposed to individual public ownership by the City of ational City; he did not feel that National City by itself could operate nd run the water company efficiently with a savings to the citizens; how- ever, it could certainly be run efficiently under joint powers. Council - an Colburn requested the City Manager bring a report, before the ordinance is presented, to bring them up to date as to the feeling of the South Bay Irrigation District regarding the Joint Powers. Mayor Morgan stated there as litigation regarding this and perhaps the City Attorney would like to ave an Executive Session at the end of the meeting. City Attorney McLean said there were certain aspects of the law suit which should be discussed in Executive Session; some of the questions raised by Councilman Colburn ould be better answered there. Councilman Colburn said he would withdraw is comments until after the Executive Session. • RDINANCE NO. 1205, "AN ORDINANCE PROHIBITING OPERATION OF MOTORIZED HICLES IN CITY PARKS," was presented for the second reading. Moved by olburn, seconded by Reid, it be read by title. Carried by unanimous vote. he title was read. Moved by Reid, seconded by Hogue, the Ordinance be dopted. Carried by unanimous vote. •ITY ATTORNEY McLEAN thanked the Council for sending him on the trip he took last week (3i-annual Convention of the Phi Alpha Delta Law Fraternity), 9/3/68 rt 116 BILLS audited by the FINANCE COMMITTEE were presented as follows: General Fund $15,980.85 Traffic Safety 3,137.18 Capital Outlay 1,860.00 Park 1,229.28 Gas Tax 2106 5,387.69 Trust & Agency 50.00 Sewer 1,907.03 Civic Center 569.77 N.oved by Hogue, seconded by Colburn, the bills be approved and warrants ordered drawn for same. Carried by the following vote, to -wit: Ayes: Camacho, Colburn, Hogue, Reid, Morgan. Nays: None. The report of A. F. MALEY, DIRECTOR OF PARKS & RECREATION, on the free use of the Municipal Swimming Pool, was presented. Moved by Hogue, seconded by Colburn, the report be accepted and filed. Mayor Morgan said he would like to see a trial of free time; the children can go with their parents and swim for $1.00; the time has come when they should set 1-2 hours aside for anyone who doesn't have money to swim in the Municipal Pool. Councilman Colburn said he would agree with that if they could limit that to National City residents; the residents are paying the taxes to meet the deficit under which the Pool operates; they could honor their student body cards to prove their residency. Mayor Morgan said it was suggested in conference the City Manager could work out the time and try it for 2-3 months; if they did not like it they could do away with it or amend it. Motion to accept and file the report carried by unanimous vote. Moved by Colburn, seconded by Reid, the City Manager be authorized to work out the proposed plan to offer a free swim period for the citizens of National City to present some time be- fore the next swim season. Carried by the following vote, to -wit: Ayes: Camacho, Colburn, Reid, Morgan. Nays: Hogue. The Council considered review of the application for premises to premises transfer of license by THOMAS E. GROESCHEL, DBA MUSTANG, 816-20 National Avenue. City Clerk Minogue stated a letter from Thomas E. Groeschel was attached to the Agenda. Moved by Colburn, seconded by Camacho, this item be referred to the City Manager and City Attorney to negotiate with Mr. Groeschel, the intention of this motion to show Mr. Groeschel the Council would be interested in removing their protest on the transfer of his license based on his coming forth with the remodeling plan for the new address. Carried by the following vote, to -wit: Ayes: Camacho, Colburn, Hogue, Reid. Nays: Morgan. An application for premises to premises transfer of on sale beer license by ELMER S. & LOUISE F. SLUSSER, DBA GALLOPIN INN, 2329 Highland Avenue (relocate across the street - larger, more modern facilities), was pre- sented. Moved by Colburn, seconded by Reid, the application be referred to the City Manager and City Attorney to be brought back to the Council next week with their recommendation regarding stipulations that could be attach- ed if they did not protest the transfer of the license and that the old address would not be leased by these people to be used for a bar. Council- man Reid said he did not quite understand Councilman Colburns Mayor Morgan said the motion asked for a report next week. Carried by the following vote, to -wit: Ayes: Camacho, Colburn, Reid. Nays: Hogue. Abstaining: Morgan. Application for person to person transfer (adding partner) of on sale gen- eral (bona fide public eating place) by WESLEY M. HITE, KATY E. & JAMES W. THOMPSON, ABA CAFE LA MAZE, 1441 Highland Avenue, was presented. Moved by Hogue, seconded by Camacho, the application be filed. Nays: None. communication from ALBERT WILSKE, DIRECTOR OF OPERATIONS, CONTINANA CONVA- ESCENT HOSPITAL, requesting a six-month extension of option to accomplish: 1) Further the development of obviously needed out -patient clinic; (2) mmediately commence market and feasibility studies to determine the highest nd best use of the additional land, was presented. Moved by Hogue, second- d by Camacho, the request be denied. Albert Wilske was present and said study showed there was a need for housing by people who were not in need f medical care but who needed custodial care; there is a need because of a remendous residential development immediately adjacent to this property or out -patient clinic which they are pursuing; it will take a lot of co- peration by the local medical community; the survey showed there was a ritical need for interim dwellings, apartment houses, for the middle and pper middle income people being transferred here because of the booming ndustrial development; the vacancy ratio in National City is less than 1% n apartments. Mr. Wilske stated he would go ahead under the authority of heir president to make an economic and feasibility study to develop the and into better apartment houses which would rent from $175.00 - $275.00 er month. IRECTOR OF PLANNING STOCKMAN presented the Planning Commission recommenda- ion in regard to Residential Planned Development Permit No. 12 (property nown as 2803-05 Lincoln Court) which would be a Single Family Residence oning within the Residential Planned Development Zone; the Planning omission recommended it be approved subject to conditions relative to time f construction and requiring landscaping and aesthetic appearance of the tructure. Moved by Colburn, seconded by Reid, this item be approved and he stipulations set forth by the Planning Commission be adhered to. Carr- ed by unanimous vote. Moved by Colburn, seconded by eid, the recommendation be approved. he HEARING ON THE APPEAL OF THE AMERICAN OIL COMPANY OF THE DENIAL OF SSUANCE OF A BUILDING PERMIT FOR CONSTRUCTION WITHIN THE REDEVELOPMENT EA (SW CORNER 24TH STREET, NATIONAL AVENUE) was held at this time. City lerk Minogue stated the Planning Commission recommendation of July 22nd as attached to the Agenda. Director of Planning.Stockman stated the pro- 9/3/68 118 F-� •osed building would be comparable to the American Oil building under con- struction on Plaza and Palm Avenue; being a metal building, it would be subject to the Planning Commissions consideration as to aesthetic appear- nce; since this property is located within the Redevelopment Area and ntil the planning consultant and engineer have had a chance to investigate the property as to what they feel is best for that area. Mrs. Stockman tated the Planning Commission recommended the appeal of the denial of the ssuance of a building permit by the Department of Building & Housing (for the construction of an American Oil Service Station at the SW corner of 4th Street and National Avenue within the proposed Redevelopment Area) be enied. Keith Atherton, 5762 Pray Street, Bonita, was present. Mayor organ told Mr. Atherton they were starting five minutes early on the hear- 'ng and asked if they had any objections to it. Mr. Atherton said he had one; his group was present. Mr. Atherton said the"ordinance"adopted in ugust 1967 states, "Be it further resolved that an applicant for a build- 'ng permit within the described area may appeal the refusal of the issuance f a permit to the City Planning Commission and then to the City Council if proposed improvement is, in the judgment of the City Council, consistent ith the projected redevelopment project, or outside the boundaries of the .roposal project area the City Council, upon recommendation of the City lanning Commission may authorize the issuance of a building permit;" the •roblem arises over the fact that the Council sits as the Redevelopment gency and recommends through its City Manager who is the Clerk of the gency; this makes them feel they are losing to start with; however, due o certain material presented to the Planning Commission and the section •uoted from the ordinance, the Council does have a right to see if this ould be consistent with the development plan for the area; all they heard o date was: "We don't know; we don't have a plan for it yet." Mayor Mor- an said they would have a director for the project. Mr. Atherton said as ndicated in the material before the Planning Commission, City Engineer oster could see nothing wrong with this plan for the service station on he corner as to grade elevation; the street improvements are in and there s nothing wrong with the plan of the building. Mr. Atherton inquired if t was the intention of the City Council to continue to turn down permits n this area until this redevelopment plan has been completed; he knew what- ver came up on that corner after the plan was completed would be a service tation; just before the other hearing (August 20, 1968) the Sunday paper arried an ad showing the "Mile of Cars" in National City; they knew what as going to be in the area.; it was going to be automobile dealerships, ervice stations, etc.; it just makes sense - it has to be there; all they ere asking was the privilege and right for American Oil and Mr. Pearson to pend his money to develop his own property; they started negotiating the ease last October and have been held up; they were paying taxes on proper- y on which they may be held up another year or two waiting for the plan to e developed; he did not believe there was any objection to the style of the tation or at least it did not come up at the Planning Commission meeting. ouncilman Colburn said he did not have any objections to the service sta- ion and would doubt that the grade level would be changed at that location; he thing they have been confronted with was whether or not, after they ubmitted the total acreage encompassed in the Redevelopment Program, any hange would have a bearing on the redevelopment program as a whole. ouncilman Colburn asked Mr. Osburn as Acting Executive Director if he had ver heard from the Federal Government whether or not they could go ahead o long as the land was at the proper grade with the development that would itimately be in this project without hindering the original proposal. Mr. sburn said not to his knowledge; they have received nothing relating to his; the key thing is what will the final plan be. Councilman Colburn nquired if they have asked this question of the Federal Government. Mr. sburn said to his knowledge they had not done so; in the Federal legisla- ion they have given the right to withhold permits in this area; one or two ave been withheld to this time; this would be the third one. (City ttorney McLean was called from the meeting.) Councilman Colburn said he nderstood that; the ones being withheld were because basically, they were n the center of the project and in a location where a grade change would probably take place. Councilman Colburn inquired how long it would take to • • 1 4 1 11 9/3/68 119 ge an answer regarding the issuance of a building permit on a location that co dntt change grade and could not therefore do anything to the project. Vi e Mayor Hogue said he felt if the Federal Government gave them permission to refuse permits, then it was understood they could issue permits if they wa ted to. Mayor Morgan said he thought this commission had the authority to issue or deny permits; he remembered when land was for sale between 22nd an• 24th Street; there was always a standing offer for a service station (t atts where Lamb Chevrolet went in); they might have missed the whole unit th-re if they had sold a corner to some oil company or someone and would not ha e had the development there that Lamb Chevrolet put in and which is a cr-dit to the City of National City; he felt this was the feeling of some of th- members of the commission. Mr. Atherton said they should know that Mr. Person owns the adjoining land both to the south and to the west of the si e for the service station; it would not take all of his land. Mayor Mo gan said he realized that but it could limit something else coming in th-re; he did not know what was going to be planned but it may be they would wa t the whole thing planned at the same time; this Council may do that. Mr. Atherton said at one time Mr. Pearson planned to move his car agency to th's location and even then he did not plan to use the corner except for a se vice station; they were talking about $80,000.00 when they talked about th- service station; he was only projecting what the owner planned for his o property; whoever plans this property should do what a private indivi- dual would do. Mr. Atherton said they passed the ordinance to allow issu- an e of permits in the area; they are going to be held up another year so; maybe they should have gone to the Board of Supervisors to have them reduce their taxes since they could not use the land. Mr. Atherton said he could not tell them what their Redevelopment Planning Director was going to come up with but the Council could give them a permit if they saw fit to put this ni e station on the corner; Mr. Pearson feels this is the best development f.r his property and they only ask that the permit be given so they could be•in construction. Councilman Reid said back of that property there was a di ch that needed drainage and inquired where the Engineer got the informa- ti.n that the grade would not need to be changed; could there be some infor- mation that he missed on it. City Manager Osburn said they were referring only to the corner for the service station, just roughly the 200 x 200 cor- ner where the old Ranch House building and parking lot now exists; the rest o it would have a grade change. Mayor Morgan said most anything could make a hange there; the engineer may make a recommendation the corner be changed t ere; he doubted it but it was a possibility; he was not sure that every- t ing was settled. Mr. Atherton read a statement from the Planning Commiss- i.n meeting: "The report received from Mr. Harold C. Foster, City Engineer, City of National City, advises the plans as submitted have been reviewed and it apPears that the proposed construction as shown on Drawing No. 11285 s ould be compatible with the ultimate development in the Redevelopment Area. National Avenue and 24th Street have both been approved as suitable to p anning to redevelopment and the drainage from the proposed improved area i directed to exist in drainage structures which are not contemplated to b- removed by the redevelopment project. It is recommended the plan that h-s been submitted be approved." Councilman Reid inquired if the City's E gineering Department gave them that. Mr. Atherton said it did. James Pearson, Bonita, was present. Councilman Colburn asked Mr. Pearson if as o er of the property it was his intention to be a participating owner. Mr. P=arson said so far as this one parcel is now; other than this he could not s-y. Councilman Colburn inquired if Mr. Pearson meant he did not know if h intended to move his agency down there. Mr. Pearson said he could not s-y at this time. Councilman Camacho inquired if they were going to hire a engineer and men to settle this area. Mayor Morgan said the Agency would h're an engineer and a planner to plan the whole area and then we've got the d'rector; he will recommend to the Redevelopment Agency the planner that he w-nts and the engineer that he wants to do the job; all of it will be p anned at one time. Councilman Reid said that Was his understanding and h still didn't get this "engineer" that went on. Mayor Morgan said he c.uldn't say too much about the Engineer; maybe he feels that this is pretty n-ar the grade but he isn't going to be the engineer on this redevelopment; t ere will be a new engineer to come in and make recommendations. George C egan, 3635 Vista de la Bahia, San Diego, was present and said he was real 9/3/68 120 estate representative for the American Oil Company; he had with him the area engineer with plans if they had any questions in engineering; the station they propose to build is of a ranch style with planter boxes attached to and around the building; the plans show they have included an area planting of low shrubs so as to not obstruct visibility; they would appreciate the Council's consideration of issuance of the permit; if they had any question4 he, Mr. Atherton who was counsel for Mr. Pearson, or their engineer, Mr. Walters, would be happy to answer them. Mayor Morgan said he did not think any of them had any kicks on the beauty of the service station; it has been discussed limiting service stations; nothing has ever been done about it; he did not believe there could be any question on the beauty of the proposed service station; they were concerned only with developing 132 acres rather than just 125' x 125'. Moved by Colburn, the hearing be closed and the re- quest of the American Oil Company to get a building permit at 24th and National to erect a service station be approved. Motion died for lack of second. Moved by Hogue, seconded by Camacho, the hearing be closed and the request be denied. Carried by the following vote, to -wit: Ayes: Camacho, Hogue, Reid, Morgan. Nays: Colburn. MAYOR MORGAN stated they would not be able to call an Executive Session (due to the absence of the City Attorney at this time). Moved by Hogue, seconded by Reid, the meeting be closed.
